WHAT'S HAPPENING
**1 was appointed Clerk-Treasurer for 6 months. The 6 months
is up December 6, 1986. As you know, Shirley does the treas-
urer and financial aspects of the Clerk-Treasurer job and
Vicki has been doing the special assessments, elections and
other Clerk duties, and I have been signing my name to the
vartous documents and agreements.
The cities of Apple Valley and Champlin have split the Clerk-
Treasurer's duties. An example Resolution and Ordinance are
attached.
**The newsletter deadline is November 18, 1986. Valerie has
done a great job but she needs articles. (This is a record,
I believe we have published 4 bi-monthly newsletters in a
row) .
**The 4 houses on the end of Lily Street will have an Andover
zip code and get their mail through the Anoka post office.

**The land transaction with Laptuta has been completed. We
have purchased 40 acres and have a 40 acres option.
**School District 11 is looking at 20 acres of the newly
purchased Laptuta property for the school site.

MOTION by Vistad, seconded by Jovanovich that the Andover Planning
and zoning Commission recommend to the City Council approval of a
lot split requested by Donna Green for the property located at 2733
Bunker Lake Boulevard N.W., for the following reasons:
1) The proposed use will not be detrimental to the health, safety,
or general welfare of the community;
2) It will not cause serious traffic congestion;
3) It will not serioudly depreciate surrounding property values;
4) The lot split is in harmony with the general purpose and intent
of the zoning ordinance and the Comprehensive Plan.
It should be noted that the lot remnants are to be attached to
PIN 33 32 24 13 0038. A park dedication fee is required.

A RESOLUTION APPROVING A LOT SPLIT AS REQUESTED BY DONNA GREEN FOR
THE PROPERTY KNOWN AS 2733 BUNKER LAKE BOULEVARD.
WHEREAS, the Planning and Zoning Commission has reviewed
the lot split request of Donna Green; and
WHEREAS, after such review, the Planning and zoning Commission
recommended approval of the request citing the following reasons 1) the
proposed use will not be detrimental to the health, safety or general
welfare of the community; 2) it will not cause serious traffic congestion;
3) it will not seriously depreciate surrounding property values; 4) The lot
split is in harmony with the general purpose and intent of the zoning
ordinance and the Comprehensive Plan; and
WHEREAS, the City Council is in agreement with the recommend-
ation of the Planning and Zoning Commission.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Andover to hereby approve the lot split request of Donna Green to
split the rpoperty known as 2733 Bunker Lake Boulevard.
BE IT FURTHER RESOLVED that approval is contingent upon the
payment of park dedication fees.
BE IT STILL FURTHER RESOLVED that the lot remnants are to be
attached to PIN 33 32 24 13 0038.

zoning Commission recommend to the City Council adoption of an
amendment to Ordinance 8, Section 6.02 regarding the interior lot
lines in the Limited Buiness, Neighborhood Business, Shopping
Center, General Business, Limited Industrial and General Industrial
districts with an asterisk to refer to Section 4.14 of Ordinance 8.
Also, that the rear yard setback be 40 feet in the Limited Business,
Limited Industrial and General Industrial Districts with an asterisk
to refer to Section 4.14.

The City of Andover Planning and zoning Commission will hold
a public hearing at 7:30 P.M., Tuesday, October 28, 1986 at
the Andover City Hall, 1685 Crosstown Boulevard N.W., Andover,
MN to consider an amenpment to Ordinance No.8, Section 6.02.
Said amendment would refer to Section 4.14 of Ordinance 8 when
dealing with Industrial and Business district setbacks.

ORDINANCE NO.
AN INTERIM ORDINANCE REGULATING THE USE AND DEVELOPMENT OF LAND
WITHIN THE CITY OF ANDOVER FOR THE PURPOSE OF PROTECTING THE
PLANNING PROCESS AND THE HEALTH, SAFETY AND WELARE OF THE CITY.
The City Council of the City of Andover does hereby ordain:
Section 1. Legislative Findings of Fact
The City of Andover, Minnesota, a predominantly residential and
agricultural community has sustained considerable urban residential
development in the areas of the city which are not serviced by
sanitary sewer. Because of the lack of urban services capable of
accommodating such occurrence, the City commenced the process of
preparing and adopting a Community Development Plan pursuant to
Minnesota Statutes, Section 462.355, in January of 1973. Because
of, and following, plan adoption, the will prepare and recommend
for hearing and adoption new and amended ordinances and regulations
and additional amendments to the Community Development Plan governing
land use and development in the City which are reasonable .and necessary
measures for effectuating the adopted plan. The City finds that unless
reasonable measures are taken for a reasonable interim period to protect
the public interest by preserving the integrity of said plan until the
appropriate amendments to the existing plan and to the ordinances and
the areas where the Community Development Plan recommends changes in
the existing zoning ordinance and other land use regulations will
destroy the integrity of the Community Development Plan and its basci
purposes, need and effect.
Section 2. Legislative Intent
It is the intention of the City Council to protect the Community
Development Plan, proposed amendments thereto, and their implementation
by hereby adopting, pursuant to authority vested in the Council by
Chapter of Laws, 1976 of the State of Minnesota an interim zoning
ordinance for a reasonable time during the consideration of the afore-
mentioned Community Development Plan, proposed amendments and ordinances
and regulations for the City, to protect the public health, safety
and welfare and prevent a race of diligence between property owners
and City during said consideration, which would, in many instances
result in the continuation of a pattern of land use and development
which would be inconsistent with the plan, proposed amendments thereto,
and ordinances and violate their basic intent and fail to protect the
health, safety and welfare of the community.
Section 3. Affected Area; Supercedes
o
This ordinance shall apply to and govern all districts located within
the Metropolitan Urban Service search area boundary as shown on the
attached map for the purpose of protecting the planning process and
the health, safety and welfare of the city for a period of
from the date of adoption. This ordinance, during its effective

period,shall replace and supercede provisions in all other ordinances
and regulations applicable to the City of Andover which are in conflict
or inconsistent with the provisions herein. All ordinances and pro-
visions therein which are not in conflict with the terms and conditions
of this ordinance shall continue in full force and effect.
Section 4. Scope of Control
Except as hereinafter provided in this ordinance, during the period

a subdivision plat, site plan, rezoning, or other develop-
ment map or application, unless initiated by the Planning
and Zoning Commissio or the City Council, or unless such

The aforementioned restriction shall apply to any property
within the area as shown on the attached map.
Section 5. Appeal Provisions
The City Council shall have the power to vary or modify the application
of any provisions in this ordinance upon its determination in its
absolute legislative discretion that such variance or modification is
consistent with the letter and intent of the comprehensive plan or
proposed amendment, upon which this local ordinance is based, and with
the health, safety, and general welfare of the City of Andover. Upon
receiving any application for such variance or modification, the City
Clerk shall refer such application to the Planning Commission of the
City for report of said Planning Commission with respect to the effect
of the variance or modification upon said Community Development Plan or
proposed amendment. Such report shall be returned by the Planning
Commisison to the City Council within 60 days following the initial
application and shall be placed on the next agenda for the City Council.
Section 6. Penalty
Any person, firm, entity, or corporation who violates any provision of
this ordinance shall be subject to the penalties and enforcement pro-
visions set forth in Section 18, Ordinance 10 of the City of Andover.
Section 7. Validity
The validity of any word, sentence, section, clause, paragraph, part or
provision of this ordinance shall not affect the validity of any other
part of this ordinance which can be given effect without such invalid
part or parts.
Section 8. Effective Date

This ordinance shall take effect upon adoption and publication as re-
quired by law.

The City Council is requested to recommend the pond to be
pumped at an elevation of 884.5. Keep in mind the owner's
east side yard is a natural drainage area. This area prior
to the house being built on the property had water. This is
a natural feature which should be preserved and any storm water
that has drained into the east side yard should be able to
pond as it has in the past. The present owner, Mr. Terry
Hausam, has agreed to use ths elevation established by the
En~ineering Department of 884.5. If the water ponds in the
side yard for a period of two (2) weeks, the City of Andover
at that time would need to pump the pond to elevation where
no water is ponding on side yard and in the swale area at the
request of the owner.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Andover to hereby accept the above bids as shown to indicate Lake
Area Utility Contracting as being the apparent low bidder.
BE IT FURTHER RESOLVED TO HEREBY direct the Mayor and Clerk to
enter into a Contract with Lake Area Utility Contracting in the amount
of $54,607.50 for construction of Improvement Project No. 86-19 for
Storm Drainage Construction in the area of Dehn's Pond; and direct the
City Clerk to return to all bidders the deposits made with their bids,
except that the deposit of the successful bidder and the next lowest
bidder shall be retained until the Contract has been executed and
insurance and bond requirements met.

The City Council is requested to consider awarding the
Computer bids.
We received three bids on November 13, 1986.
Rodin & Asso. of Anoka bid on only part of the system.
It appears he has a software financial program to offer.
Computoservice, Inc. bid but did not use our proposal form
so comparing has been difficult but their bid is about
$110,000 with a couple of items open.
AmeriData Systems bid followed our proposal form, it is
easier to analysis. They appear to have bid everything with
a couple of unknowns. Their bid was $116,000.
At the meeting on the 13th, I gave the bids to Ted and Jerry
to review, as I received two bids packets from AmeriData
and from Computoservice, Inc.
I was disappointed we did not receive more bids. We sent
out eighteen bid spec's from a list Larry P. Johnson had
prepared, plus it was in the Anoka Union.
We are very anxsious to get a computer for Utility billing
as our accounts are really increasing along with needs in
Budget/funding, special assessments, and word processing.

Preliminar Plat
The City Council is requested to review the comments made
from the EngineeringDepartment for the Hills of Bunker Lake
per ordinance #10. (Review check list)
8.01 c) Written consent from the estate of Walter Vosika.
8.02 i) Copy of restrictive covenants.
8.02 j) The Engineering Department is recommending to approve
the Hills of Bunker Lake Preliminary Plat subject to
the City of Andover receiving a completed soil
report. The City of Andover has received fnterim
report in soils and water table testing. The
Engineering Department is calling to your attention
the apparent peat buried below mineral soils in test
holes 1,2,10 and Piezometer 5. Currently, Suburban
Engineer, Bill Jensen, has not yet been able to defin
the area affected. The City of Andover is waiting fo
the kind of action that the developers and suburban
Engineering will take concerning the buried peat.
8.03 d) Need to indicate the minimum basement floor elevation
for Block 22 Lot 5.
8.04 f) FLOOD PLAN MANAGEMENT - The Engineering Department is
recommending the developer to obtain a conditional
use permit due to the proposed filling shaded on
the grading plan between Block 22 Lot 26 and Block
25 Lot 1 which is in the floodway district. In
Ordinance 50, an ordinance for the management of
flood plains in the City of Andover under section
4.0 (Floodway District) conditional uses, the
developer shall obtain the conditional use permit
and process this permit with the Zoning Administra
tor due to the filling that is proposed in a
floodway district.

*NOTE - The developers must submit a letter and other requited
data to the Federal Emergency Management Agency and DNR
that a change of the floodway district boundary may be
necessary and ask for their approval concerning change.
9.02 b) Must provide access to Leonard S. Cochran. The
ordinance reads "The arrangement of streets in new
subdivisions shall make provision for the continuation
of existing and future streets in adjoining areas".
*NOTE: If this ordinance holds true, developers must
provide access to property on east of side plat
for landowner Richard J. & Penny R. Fuller.
c) No pre-plat shall be approved wherein lots front on
the Right of Way of state, county or community
arterial or collector roads. Such lots may front
on a service road with entrances to the above or at
intervals of 660 ft. for arterials and 330 ft. for
collectors. (This applies to Prairie Road)
9.05 BLOCKS
c) Recommend the removal of butt lots.
These lots included are:
Block 4 Lot 23
Block 15 Lot 11
Block 14 Lot 7
Block 14 Lot 14
Block 16 Lot 16
Width. The ordinance reads "All blocks shall be so
designed to provide for two tiers of lots
unless conditions exist to render this
requirement undesitable".
9.07 Parks, playgrounds, open space.
Developers must meet the park board requirements.
