WHAT'S HAPPENING
* The TIF and agreement with Boisclair requires the City
to select a CPA firm.
* WDE meeting set for Tuesday, October 7, 1986 at 3:00 PM.
Jim Elling thinks that is too soon for everyone to read
the document.
* Jane Risner will be Mrs. Peterson as of Friday afternoon.
"We let her leave early just this once!."
* The Newsletter is in the packet.
* Dale will be coming back on light duty. We have worked out
a deal with the insurance. We will pay him $5.00jhr. while
on light duty and EBA will make up the difference to his
regular pay.
The doctor and EBA have agreed what light duty is. Dale
will be able to install meters, etc. This will allow two
people to get back into sewer cleaning.

Pursuant to City Ordinance No. 32 and Ordinance No. 55, the following
charges on attached Exhibit A are hereby certified to the County
Auditor to be placed on the tax rolls and collected"'with the 1986

MOTION by Apel, seconded by Rogers that the Andover Planning and
zoning Commrnission recommend to the City Council approval of a lot
split requested by the Blaine Congregation of Jehovah's Witnesses
on the property known as PIN 13 32 24 42 0001 for the following

reasons:
1) It is part of an orderly planning process;
2) It would not adversely affect the health, safety or general
welfare of the community;
3) There was no opposition.
Approval is contingent upon the receipt of the Certificate of Title
for the West 33 feet as shown in the diagram and the payment of park
dedication fees in the amount of $100 per lot.
Motion carried unanimously.
NOTE: This was applied for on a Variance Request form rather
than a lot split form.

A RESOLUTION APPROVING A LOT SPLIT REQUESTED BY THE BLAINE CONGREGATION
OF JEHOVAH'S WITNESSES FOR THE PROPERTY DESCRIBED AS PIN 13 32 24 42
0001.
WHEREAS, the Planning and Zoning Commission has conducted a
public hearing and reviewed the lot split request of the Blaine
Congregation of Jehovah's witnesses; and
WHEREAS, after such review, the Planning and zoning
Commission recommended approval of the request citing 1) it is part
of an orderly planning process; 2) it would not adversely affect the
health, safety or general welfare of the community; and
WHEREAS, the City Council is in agreement with those
reasons given by the Planning and Zoning Commission.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Andover to hereby approve the lot split request of the Blaine
Congregation of Jehovah's Witnesses to split the property known as
PIN 13 32 24 42 0001 into two separate parcels.
BE IT FURTHER RESOLVED that approval is contingent upon
the following: 1) the Certificate of Title for the West 33 feet as
shown on the diagram will be provided for recording purposes; 2) payment
of park dedication fees in the amount of $100 per lot.

MOTION by Apel, seconded by Vistad that the Andover Planning
and Zoning Commission recommend to the City Council approval
of the lot split requested by Raphiel Stifter for the property
known as PIN 12 32 24 14 0003 to split an 87 foot strip of
property from said lot and attach it to Lot 1, Block 1, Birch-
wood Pond, owned by Dan Christensen. This lot split varies
from Ordiftftfl€e 40B in that it does not create two standard
lots. It creates a substandard lot.
Approval is contingent upon the 87' strip being attached to
Lot 1, Block 1, Birchwood pondJ making a standard lot of record.
APP1val is also contingent upon the payment of park dedication
fees.
It hould also be noted that the county is acquiring right of way
for county Road 18 and the legal description should reflect that
right of way.
Motion carried unanimously.

MOTION by Apel, seconded by Vistad that the Andover Planning
and zoning Commission recommend to the City Council approval of the
rezoning requested by Good Value Homes for the property described
as the east 60 acres of the South one-half of the Southwest one-
quarter of Section 34, Township 32, Range 24, from General Industrial
to Residential for the following reasons:
1) The land, although it is presently indicated as industrial,
is better suited for this type of development at this time;
2) It would not increase traffic in a significant manner to create
additional hazards;
3) It would not seriously depreciate surrounding property values;
4) It is in harmony with the intent and purpose of the Comprehen-
sive Plan and the zoning Ordinance for orderly planning.
It should be noted that a public hearing was held and there was
only one person against the rezoning. The only other person who
spoke was in favor.
Motion carried on a 2 yes, 0 no vote.

MOTION by Apel, seconded by Jovanovich that the Andover Planning
and Zoning commission recommend to the City Council approval of
the Preliminary Plat of Hidden Creek East being developed by
Good Value Homes, described as 'The S~ of the SW\ of Section
34, Township 32, Range 24, Anoka county, Minnesota containing
79.82 acres more or less', for the following reasons:
1) It is in conformance with the Comprehensive Plan if the
rezoning of the east 60 acres is approved;
2) It will not seriously affect property values;
3) It will not increase traffic significantlY in a fashion
that would cause harm to the area;
4) The recommendation is contingent upon the housekeepiQg items
as follows:
a) Changing of future park as provided by Council minutes
of September 16, 1986;
b) Elevation on Lots 1, 2, 3, 4 and 5 of Block 8 should be
changed to reflect the 886 elevation in the ARC memo
by Todd Haas;
c) The two smaller parks should be omitted and take Lot 12
,or 19, Block 7 to get the n~eded area so we have one large
'park;
d) Some sort of confirmation from the DNR that they will
accept drainage into Outlot A;
e) Some agreement with the engineering firm regarding drain~ge
in the park.

Hidden Creek East
Preliminary Plat

REQUEST: The City Council is requested to approve the preliminary
plat for Hidden Creek East upon reviewal of the comments made by
the Andover Review Committee (ARC).
Their comments are the following:
1. Solve drainage problems which is currently
under study with TKDA.
2. Recommend to remove 134th Lane NW cul-de-sac on
the East side of plat if Watts Garden Acres does
not plan to rezone to residential.
*Note: The stormwater ponding located on the North side
of the plat ultimately would drain to the North
to other ponding areas located near Bunker Lake
Boulevard.

I. Catch basin location behind Lot 1 of Block 8 is recommended
to be accepted if:

II. Fire Department would like to see an entrance from North near

A RESOLUTION APPROVING THE PRELIMINARY PLAT OF HIDDEN CREEK EAST
AS BEING DEVELOPED BY GOOD VALUE HOMES IN SECTION 34-32-24.
WHEREAS, pursuant to published notice thereof, the Planning
and Zoning Commission has conducted a public hearing on the Preliminary
Plat of Hidden Creek East; and
WHEREAS, as a result of such hearing and review, the Planning
and Zoning Commission is recommending approval of such plat, citing
as reasons for such recommendation as being 1) it is in conformance
with the Comprehensive Plan if the rezoning of the east 60 acres is
approved; 2) it will not seriously affect property values; 3) it will
not increase traffic significantly in a fashion that would cause harm
to the area; and
WHEREAS, the City Council acknowledges that a recommendation
has been received from the Park Board; and
WHEREAS, the City Council further acknowledges that the plat
has been reviewed by the Andover Review Committee and the Anoka County
Highway Department.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Andover to hereby approve the Preliminary Plat of Hidden Creek East
noting the following:

Department of Natural Resources stating that they will
accept drainage into Outlot A.

MOTION by Vistad, seconded by Apel that the Andover Planning and
Zoning Commission recommend to the City Council approval of the
replat of the Andover community Shopping Center for the following
reasons:
1) It will not adversely affect the existing or potential use of
adjac<snt land;
2) It is in conformance with the Comprehensive Plan;
3) The Commission feels it will not adversely affect any Tax
Increment Financing plans for the existing property;
4) The drainage will not be adversely affected;
5) It is necessary to the reasonable use of the land.
A public hearing was held and there was no opposition.
Motion carried unanimously.
The developer has asked that the final plat also be approved tonight.
They have paid their $10.00 final plat filing fee. Mr. Schrantz
said that he had no problem with this.

MOTION by Vistad, seconded by Apel that the Andover Planning and
zoning Commission recommend to the City Council approval of the
Amended Special Use Permit requested by the T.F. James Company
for the property described as PIN 33 32 24 13 0008 to allow for
expansion of self-service gas pumps from 2 to 3, to move the pumps
closer to the building and to allow for a canopy. It should be
noted that a public hearing was held and there was some opposition.
Reasons for approval include:
1) It will not cause traffic congestion or hazards;
2) It will not depreciate surrounding property values;
3) It will not be detrimental to the health, safety or general
welfare of the community;
4) It is in harmony with the general purpose and intent of the
zoning ordinance and the Comprehensive Plan.

A RESOLUTION APPROVING AN AMENDED SPECIAL USE PERMIT REQUESTED BY
THE T.F. JAMES COMPANY FOR THE PROPERTY DESCRIBED AS PIN 33 32 24 13 0008.
WHEREAS, pursuant to published and mailed notice, the Planning
and Zoning Commission has conducted a public hearing and reviewed the
request of the T.F. James Company for an Amended Special Use Permit
to allow for expansion of self=service gas pumps from 2 to 3, to move
the pumps closer to the building and to allow for a canopy on the
property known as PIN 33 32 24 13 0008 (the Speedy Market); and

WHEREAS, after such hearing and review, the Planning and Zoning
Commission has recommended approval of the request with reasons for
such recommendation as 1) it will not cause traffic congestion or
hazards; 2) it will not depreciate surrounding property values; 3)
it will not be detrimental to the health, safety or general welfare
of the community; 4) it is in harmony with the general purpose and
intent of the Zoning Ordinance and the Comprehensive Plan; and

MOTION by Apel, seconded by vistad that the Andover Planning
and Zoning Commission recommend to the City Council approval
of a variance requested by the T.F. James Company to vary from
the 20' setback requirement for parking stalls on the property
known as PIN 33 32 24 13 0008 for the following reasons:
1) It will not adversely affect the existing or pDtential use
of adjacent land;
2) It is in conformance with the Comprehensive Plan;
3) It is necessary to the reasonable use of the land.
Approval is contingent on the handicapped parking being provided
in front of the proposed addition and also that the green area
along Bunker Lake Boulevard and Crosstown Boulevard be landscaped
and if necessary I a curb be provided to prevent cars from slipping
into the tiaffic area.

Enqineerinq Recommendation: Recommendation is requested by the
Engineering Department concerning safety during operations and the
end of each working day. It is recommended to use a fence along
the higher elevation along the excavated area to prevent injuries
from children playing, bike riding, snowmobiles, etc. Another
alternative is to slope the excavated area using no greater than
a 4':1' or 25% at the end of each working day.

A RESOLUTION APPROVING A SPECIAL USE PERMIT REQUESTED BY SAUTER
AND SONS TO MINE SOIL FROM THE PROPERTY KNOWN AS THE MEADOW CREEK
BAPTIST CHURCH I 2937 BUNKER LAKE BOULEVARD.
WHEREAS, pursuant to published and mailed notice, the Planning
and Zoning Commission has conducted a public hearing and reviewed the
request of Sauter and Sons to mine soil from the property at 2937 Bunker
Lake Boulevard; and
WHEREAS, after such hearing and review, the Planning and
Zoning Commission has recommended approval of the request with
reasons for such recommendation as 1) the city has received a plan
dated September 23, 1986 prepared by Caine and Associates, which
documents the previous contours and proposed contours; 2) 10,000 cubic
yards of soil have already been removed and it is anticipated another
10,000 cubic yards will be removed from the site with a one year review;
and
WHEREAS, the City Council is in agreement with the reasons cited
by the Planning and Zoning Commission; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Andover to hereby approve the special use permit requested by Sauter
and Sons, noting the following:
1) Contractor will provide the city with a surety bond
to hold the city harmless against road damage;
2) An agreement by and between the Planning and Zoning
Commission and the hauler will be signed. Said
agreement will state that the hauler will notify
the city of future hauling;
3) Safety precautions will be taken at the end of each
working day to prevent injury to children playing,
bike riders, snowmobiles, etc.

T.H. 47 DISCUSSION
The City Council has asked for further information on the
T.H. 47 relocation proposal.
I talked to the County and was told the City of St. Francis
has requested by resolution that MN DOT and Anoka County
consider the redesignation of T.H. 47 from the City of
Ramsey location to County Road 7 in Andover. The County Staff
doesn't agree with the idea because the County has most of
County Road 7 up to standards and T.H. 47 in Ramsey is not
constructed to standards.
T.H. 47 is evidently a low priority with MN DOT.
I recommend Andover prepare a resolution to MN DOT and Anoka
County opposing the idea.
By Tuesday night, I hope to discuss this with MN DOT.

DEVELOPMENT CONTRACT
THIS AGREEMENT, made and entered into this
day of
,
1986, by and between the Ci ty of Andover,
hereinafter called "City", and
hereinafter
called "Developer".
WITNESSETH:
WHEREAS, the Developer is in the process of creating
building sites on property located within the plat of Oak Bluff,
Anoka County, Minnesota; and
WHEREAS, the Developer desires approval of the division
of such lots for development prior to the completion of all on
site improvement as required under Andover City Ordinances; and
WHEREAS, the Andover Ordinance authorizes the City to
enter into a performance contract secured by a bond or letter of
credit to guarantee completion of all improvements following
final approval of the lot splits;
NOW, THEREFORE, in consideration of the mutual promises
made herein,
IT IS AGREED BY AND BETWEEN THE PARTIES HERETO that the
Developer will provide all labor and mater ial and construct
streets and storm sewer system within the proposed development
on file with the City of Andover according to the standards
established in the Andover City Subdivision Ordinance and by

the City Engineer. Such standards are expressly made a part of
this agreement.
IT IS ALSO AGREED:
ARTICLE ONE
That the streets and storm sewer system shall be
completed by the Developer at his expense according to plans and
specifications prepared by the Developer and approved by the
Ci ty Eng ineer .
In case of any dispute as to what is meant by
the plans and specifications, the decision of the City Engineer
shall control.
ARTICLE TWO
The Developer agrees to cause no home construction to
be made upon any of the lots to be served wi thin said plat or
cause to be filed any application for building permits for such
construction until all Developer's bonds or other security
required by this agreement have been filed and accepted by the
City Clerk and all legal, administrative and engineering
expenses incurred by the City to date have been paid.
That
furthermore Developer shall be granted only
build-
ing permits for the construction of homes within said plat prior
to the completion of all work required in this agreement.
ARTICLE THREE
The City Engineer will inspect the Developer's work by
making per iod ic visi ts to the si te to observe the prog ress and
quality of the executed work and to determine if the work is
proceeding in accordance with the contract plans and speci-
fic ations.
The Developer shall notify the City Engineer

prior to commencement of any construction as to the date when
work will commence. If, on the basis of the Engineer's observa-
tion and review of the work during construction and his final
inspection, he is satisfied that the work has been completed and
the Developer fulfilled all of his obligations under the plans
and specifications he will approve the improvements and recom-
mend to the City that it accept such improvements. The
Developer guarantees and agrees to maintain the stability of all
work and materials done, furnished and installed under this con-
tract for a period of one year after the date of acceptance of
said improvements by the City. The required Developer's bond or
security under Article Four shall be conditioned to include this
warranty.
ARTICLE FOUR
This ag reement is conditioned upon the Developer
obtaining a letter of credit or other surety acceptable to the
City and filing same with the City Clerk. The bond shall not be
less than one hundred fifty (150%) per cent of the total esti-
mated construction cost of the improvements as determined by the
Engineer.
Said estimated cost of the project is

The Developer may make application with the City
Engineer for a reduction in the amount of the required bond,
letter of credit or other surety acceptable to the City follow-
ing completion of various portions of the improvements.
In no
event shall the remaining security be less than one hundred

fifty (150%) per cent of the Engineer's estimated cost for com-
pletion of all items remaining to be installed.
The letter of
credit or other surety shall name the City as obligee and shall
be for the use of the obligee and of all persons doing work or
furnishing skill, tools, machinery, materials, insurance
premiums or equipment and shall be conditioned for the payment
as they become due, of all just claims for such work, tools,
machinery, skill, mater ial s, insurance premiums, equipment,
taxes and supplies for the completion of the contract in accord-
ance with its terms, for saving the obligee harmless from all
costs and charges that may accrue on account of the doing of the
work specified and for the enforcing of the terms of the bond if
action is brought on the bond including reasonable attorney's
fees, in any case where such action is successfully maintained
and for the compliance with the laws appertaining thereto. That
Developer shall provide to the City prior to acceptance of said

improvements evidence that all claims which could give rise to a
mechanic's lien have been paid in full.
ARTICLE FIVE
The Developer shall pay all reasonable fees and
expenses of the City Engineer and City Attorney and City staff
for work performed in regard to the installation of the above
mentioned improvements.
The Developer ag rees to deposi t wi th
the City such sums as required by the City Administrator. Said
amount shall bear no interest and the City shall have the right
to pay all fees and expenses of the Eng ineer and Attorney from

the aforementioned escrow deposit.
Any monies remaining after

payment of said fees shall be returned to the Developer.
ARTICLE SIX
Developer will keep the premises free from accumulation
of waste materials, rubbish, and other debris resulting from the
work and at the completion of the work, he will remove all waste
materials, rubbish and debris from and about the premises as
well as all tools, construction equipment and machinery, and
surplus materials, and will leave the site clean.
Developer
will restore to their original conditions those portions of the
site not designated for alteration by the contract plans.
ARTICLE SEVEN
Developer shall be responsible for all costs of tempo-

rary relocation of public facilities while constructing any por-

tion of the improvements.
Developer shall notify the City at
all times when it shall request temporary relocation of such
facili ties.
ARTICLE EIGHT
Developer, its agents or subcontractors shall purchase
and maintain such insurance as will protect them from claims
under workers I compensation laws, disability benefit laws or
other similar employee benefi t laws, from claims from damages
because of bodily injury, occupational sickness or disease, or
death of his employees, and claims insured by usual personal
injury liability coverage~ from claims or damages because of
bodily injury, sickness, or disease, or death of any person
other than his employees including claims insured by usual per-
o sonal injury liability coverage~ and from claims for injury to

or destruction of tangible property, including loss of use
resulting therefrom, any or all of which may arise out of or
result from Developer's operations under the contract documents,
whether such operations be by himself or by any subcontractor or
anyone directly or indirectly employed by any of them or for
whose acts of them may be legally liable. Prior to commencement
of the work Developer shall provide certificate of insurance to
the City indicating that the above insurance coverages are in
effect during the term of this agreement.
ARTICLE NINE
Developer shall indemnify City against any and all
loss, claims, or suits, including costs and attorney's fees, for
or on account of injury to or death of persons, damage to or
destruction of property belonging to either City or other,
Developer hereby agreeing to repair or replace such property if
requested so to do by City occurring by reason of the act of
neglect of Developer, its employees, or agents, including sub-
contractors, in connection with the performance of this
contract.
ARTICLE TEN
In addition to the liability imposed by law on
Developer on account of damage to property or personal injury,
including death, arising through operations under this contract,
Developer agrees to indemnify City against any expense, liabil-
ity or payment for damage to property or personal injury,
including death and including injuries to Developer's employees,

ARTICLE ELEVEN
The Developer shall commence construction and have com-
pleted all improvements required under the terms of this agree-
ment on or before , 19___ In the event any term
or condition is breached by the Developer, the City shall have
the right to withhold issuance of building permits on any of the
lots within the plat of Oak Bluff subdivision in addition to any
other remedies available by law.
ARTICLE TWELVE
The terms and provisions hereof shall be binding upon
and inure to the benefit of the heirs, representatives, succes-
sors and assigns of the parties hereto and shall be binding upon
all future owners of all or any part of the development and it
shall be deemed covenants running with the land. City shall be
entitled to record a copy of this Development Contract to place
all future owners on notice of the requirements herein. Upon
completion of the requirements of this contract the City shall
provide to the Developer a release of this property from the
terms and conditions of this Development Contract.
