Re: Anoka County Qualification for 1987-89
Community Development Block Grant Program
Dear Mayor Windschitl:
The Department of Housing and Urban Development has informed Anoka
County that it is time to complete the process which will qualify the County for
the 1987 to 1989 Community Development Block Grant Programs. As part of
that process we are now notifying you of your opportunity at this time to "opt-
out" of Anoka County's program and to terminate your Joint Cooperation
Agreement with Anoka County.
If you should choose to opt-out, you must notify Anoka County and the
Minneapolis-St. Paul HUD office of that decision tz September I, 19B6. A
decision to withdraw from the Anoka County CDB program would mean a
three-year ~xclusion for your community, from 1987 through 1989.

The Joint Cooperation agreements will remain in force indefinitely in the
absence of a community's decision to opt-out. However, we will be drafting an
amendment on distribution of excess property to comply with State statute.
The amendment will be forwarded to participating communities by August 15 so
we may submit all executed documents by September 15.
Since 1981, we have received awards of more than $' 0 million, providing for
more than 150 individual projects. Communities have been able to improve
downtown areas and deteriorating neighborhoods and assist lower income
residents through housing, utility and public service programs. Anoka County
recognizes that our reputation as a model CDBG recipient has been largely the
result of good cooperative efforts with the communities. We look forward to
continuing in this manner.

In order to continue as an "entitlement" county, we need the populations from
all of the communities. We are pleased with the results of five years' of CDBG
projects in Anoka County and expect that future activities will be equally
successful.
Once again, any decision to "opt-out" of the 1987 to 1989 Anoka County CDBG
program must be communicated by September I, 1986. If you have any

Restoration of Deferral of CDBG Funds
Dear Jim:
As a result of the enactment of the Urgent Supplemental Appropriations Act, a
large part of the cut of '986 CDBG funds has been restored. Your budget for
the 1986 CDBG Program has been increased by $18,724.00.
Please take this information to your City Councilor Town Board for their
action on use of the additional funding and notify me of the results. I will then
take the appropriate action at the County, including public notice of the
community's intention. You are not required to conduct a public hearing.
Since one public notice for all of the participating communities is most
efficient, please submit your proposed use of funds to my office by
September 12, 1986.

attachments to be opened August 1, 1986 at 10:00 A.M. we are pleased to quote

1 - New ROSCO Model MTAH3 Fully Streamlined Street Flusher
with enclosed compartment at rear, full hydrostatic drive with
air shift pto, single stage centrifugal water pump, 1900 gallon
capacity stainless steel tank with elliptical flange and reinforced
heads, baffles, 2211 diam. pressure relieving manhole, 311 diam.
overflow, float type empty indicator with electric indicator in
cab, steel sills, steel fender above wheels, rear mud flaps,
lights as specified, 8' spraybar with cab controls, three flushing
shoes with cab controls, fill line with air gap, prime and finish
paints same color as cab.
Price Factory-Mounted on customer's truck and delivered to Andover,

We received two quotes on this tank for the Water truck.
Ruffridge-Johnson of Minneapolis, MN., placed a quote of
$24,455.00 for Stainless Steel Tank)$3.000~00 less if we
went with Steel Tank. Our spec's were for Stainless
Tank. They also had problems supplying the extras.
Engle Fabrication, Inc. Sauk Centre, MN placed a quote of
$16,400.95, for Stainless Tank. They meet our spec's
plus they were able to bid the extras such as the Cabinet,.
Hose Rack, and Hand Held Spray Nozzle, $3,705.85, even with
the extras they have a total bid of $20,106.800. They
come in $4,348.20 less than next bidder.
I would recommend we have Engle Fabrication build our
tank.

Dear Mr. LaPanta:
The Environmental Services Committee, at its meeting of May 29, 1986, requested
that you inform them as to the date by which you would be in compliance with
the required old waste tire processing ratio and will have made up your delinquent
old waste tire processing for the period July I, 1985 - June 30, 1986. It is my
understanding that you have advised the Environmental Services Office that
you will accomplish the foregoing by December 23, 1986.
In order to accomplish this work you will have to process approximately 4i
old waste tires for each new waste tire received during the period July through
December 1986. On several occasions you have told me that you found it difficult
to comply with the 3:1 processing ratio required as a condition of licensure.
This matter is scheduled to be considered by the Environmental Servcies
Committee at its meeting of July 31, 1986 (3:00 P.M.; County Board Room).
I feel that it is imperative that you attend this meeting and explain to the
Committee how you plan to accomplish this work. We have invited the MPCA
to attend this meeting in order to facilitate coordination of the state and county
programs relating to this site.

SUBJECT: Tire Dump Abatement
In 1984 the legislature enacted legislation relating to waste tire management and
tire dump abatement. This act prohibited the land disposal of waste tires after
July I, 1985 and directed the MPCA to adopt rules regulating the management of
waste tires.
The MPCA has adopted emergency (temporary) waste tire dump abatement rules.
These rules provide for a 60 day period for collector/tire dump operators to notify
the MPCA of their operation in .order to qualify for up to $IO/ton clean
reimbursement. County Staff notified the MPCA of the three known sites in Anoka
County. The MPCA also recieved notices from: () Cecil and Pat Heidelberger,
Tonson Inc., and Waste Recycling Inc., concerning the Andover site; 2) Robert Ottis
concerning the Coon Rapids site; and 3) Mr. Mossberg concerning the Oak Grove
site.
The MPCA has prepaerd a waste tire dump abatement priority list. This list consists
of 12 sites at present. The Andover site is listed as the number one site on this
priority list. The other two Anoka County sites do not appear on the priority list
at this time (Oak Grove site-13; Coon Rapids site - 47>. Other sites will be added,
and rankings modified in the future.
The MPCA Board, at its meeting of June 24, 1986, issued a Request For Abatement
Action (RFAA> on the Andover tire dump. This RFAA was issued to Cecil and
Pat Heidelberger, Tonson Inc., and Waste Recycling Inc. The responsible collector
for this site can elect to either: () submit an abatement plan for the site clean
up and receive up to $IO/ton reimbursement; or 2) voluntarily surrender the waste
tires collected before November 21, 1985 to the MPCA for abatement. The RFAA
required the responsible tire collector to respond by July 15, 1986 as to their
intentions for abatement action.
Both Cecil Heidelberger and Waste Recycling, Inc., have notified the MPCA that
they intend to submit a plan for the abatement of the Andover tire dump. The
abatement plan is to be submitted to the MPCA by August 15, 1986. The MPCA
review of the plan and preparation of a draft stipulation agreement will take
approximately six weeks (end of September 1986). The stipulation agreement
negotiations are to be completed within 60 days of receipt of the draft stipulation
agreement.
The MPCA staff has indicated that they would like the County and City to participate
in the plan review and stipulation agreement negotiation.

SUBJECT: Tonson, Inc.; Processing Ratio
Tonson Inc., has been required as a condition of licensure, to process at least
three tons of old waste tires for every ton of new waste tires received. During
the past license year (July I, 1985 - June 30, 1986) the licensee has failed to comply
with the processing ratio license condition (July 1985-February 1986= 1.5 tons
of old waste processed for each ton of new waste tires received) (operating reprots
have not been submitted for March-June 1986).
In light of the foregoing the Environmental Services Committee, at its May 29,
1986 meeting, required that the licensee advise the County of the date by which
its delinquent processing ratio for the period July I, 1985 - June 30, 1986 would
be brought into compliance. Tonson, Inc., has advised us that they will correct
this processing ratio deficit, for the period July I, 1985 - June 30, 1986, by
December 23, 1986.
This matter is being brought back to the Committee for further consideration
and direction of staff.

SUBJECT: Waste Disposal Engineering Landfill; Detailed Analysis Report
The WDE generator group submitted the Detailed Analysis Report on June 16,
1986. This report was due on June 3, 1986.
The MPCA & EPA review of this document indicated that it did not comply with
the consent order requirements and was not acceptable. The MPCA notified
the generator group of its rejection of the report on July 3, 1986.
The gernator group met with the MPCA on July II, 1986 to discuss MPCA's problems
with the report. At this time the generator group asked to be allowed to re-draft
the report. The MPCA indicated that it was willing to allow the generator group
to redraft the report provided: I) the genrators provided acceptable written
commitment; 2) it was a technical re-draft (not an attorney's re-draft>; and 3)
the re-draft submission date was acceptable to the MPCA.
On July 16, 1986 the MPCA, County and generator group (consultant and technical
advisors) met to commence the re-drafting of the report. A work schedule has
been developed which calls for re-evaluation of a number of items (gradients
in the lower sand aquifer; lime sludge; discrete sources; leachate seeps; till
integrity; health risk assessment; off-site disposal; incineration; remedial
alternatives evaluation). The re-draft will be due September 15, 1986.

of the feasibility study and proposed remedial action.
Response Action (RA)
1. Responsible party prepares a detailed engineering and implementation plan
for the selected remedial action Or actions.

2. Responsible party implements the remedial action plan.
Review of Submittals
I. PCA reviews each submittal within 30 calendar days of receipt and notifies
responsible party by the 31st calendar day of findings.
2. Within 21 calendar days the responsible party shall submit any necessary
revisions to correct inadequacies, respond to the modifications, or state in
writing why the submittal as originally submitted should be approved.
3. If after 21 days from the date of the responsible party's revised submission
the parties have not reconciled all issues, the director shall make final
modifications of the submittal as he deems necessary.
Resolution Of Disputes
I. The responsible party shall, within 21 days of the PCA action which led to
the dispute, submit a written statement supporting its position.
2. PCA will issue an order with respect to the issue in dispute.
3. Responsible party shall within 14 days notify PCA whether they intend to
comply. If notice is not received, it shall be construed as a waiver of the
right to challenge the order.
3. If the responsible party gives notice that it does not intend to comply, PCA
shall within 45 days give the responsible party notice of any work PCA
intends to undertake. PCA may then perform any of the work pending and
seek to recover expenses.
4. If PCA elects not to do any work required by consent order, the responsible
party may bring an action challenging PCA's order. Failure of the
responsible party to bring action shall be construed as a waiver of the right
to challenge the action.

The City Council requested cost for the city to install
the Storm Drainage improvements namely two culvert pipes,
one at 160th Lane and one across Enchanted Drive.
We are e~timating that Burt Kraabel will quote a price
of $2,500 for furnishing & placing pipe and restoration
of the two pipe crossings.
We can finance the work fr~m the General Fund Storm Drainage
Budget where there is $2,500 available under Rental
& Supplies.
Or
We can charge it to the Special Assessment Fund where
it will be carried as a deficit until the Special Assessment
Fund has a bond paid off with excess funds.
I recommend we change it to the Special Assessment Fund
under the orignial project number 79-2.

AN ORDINANCE AMENDING ORDINANCE NO. 10, KNOWN AS THE SUBDIVISION
ORDINANCE OF THE CITY OF ANDOVER.
THE CITY COUNCIL OF THE CITY OF ANDOVER HEREBY ORDAINS:
Ordinance No. 10 lS hereby amended as follows:
Section 14. Restrictions on Filing and Recording Conveyances.
14.01
When a property owner, either residential or commercial, wishes to
move interior lot lines and by doing so does not create any additional
lots by moving said property lines, and the moving of said property
lines does not create any lot which is below the standards for the
applicable zoning district in which it lies, such new property
descriptions may be approved by the Zoning Administrator if the
resulting configuration will have no adverse effects on surrounding
property. Should the Zoning Administrator determine the moving of
interior lot lines may have an adverse effect on either adioining
property or may circumvent other applicable zoning restrictions, the
administrator then shall require the request be processed in the normal
manner as a variance to Ordinance 10, The Subdivision Ordinance, by
both the Planning Commission and the City Council.

and zoning Commission recommend to the City council appr
of the preliminary plat of Oak Bluff legally described as
'The north half of the Northwest Quarter of section 26, Town-

feet thereof' being developed by Continental Development Corpor-
ation for the following reasons:
1) A public hearng was held; there was considerable opposition;
2) The plat is in conformance with the Comprehensive Plan;
3) The plat has been reviewed by the City Engineer;
4) The plat has been reviewed by the Anoka County Highway
Department and their letter is on file;
5) The Park Board recommendation has been received;
6) The plat meets the city ordinances with the following variances:

The soils engineers evaluated closely their soil borings and recommend

bituminous pavement is adequate.

Drainage - The drainage consists of 3 ponding areas that are being
excavated for storage and one ponding area that exists as a lowland/wet
area in the N.E. corner of the plat. The pond in the outlot will be
impacted by or impact the 2nd phase. The pond requires 15.4 acre-feet
of ultimate storage. Example: 2 pond 4' deep will need to be nearly 4
acres 13.9 acres). Storm sewer is possible to construct to the south
along Bluebird Street or east to Hanson Boulevard, then south along Hanson
Boulevard until the pipe can drain by the Highway ditch. $50,000+ estimated
cost without R/W.
Lowest Floor Elevations - The sbils report recommends that the basement/
lowest floor near test hole #4 be above an elevation of 895 - this requires
that elevations be changed to 895 on the following lots: Block 3, Lots 1,
2 and 3; Block 4, Lot 8. Block 4, Lots 9 and 10 should have a lowest floor
elevation of 894. (Assumed mottled water table to be 2' above the May
water table plus the 4' separation between mottled water table and base-
ment per the soils report.

The Andover Review Committee has reviewed the preliminary plat and their
comments are as follows:
General
OZoning is R-l developing under the density zonlng prOVlSlon of Ordinance
8, Section 4.20 with a Special Use Permit.
The Council approved a special use permit for density zoning at the
June 3, 1986 regular Council meeting.
OAnoka County prefers only two accesses and a sketch plan for the
future development that we have reflects that (dated 3-19-86)
OCoon Creek Watershed District has approved the preliminary plat subject
to a petition to enter the district and receipt of ponding fees.
OSoils - the high ground in the wooded area is Sartell fine sand with
Community development group # of 1 which is good for private sewer
systems.
The northeast corner of the plat, the back yards of the large lots
Block 2, the soils are Isanti fine sandy loam and Rifle mucky peat
Both are not good for development.

The valley through the south westerly part of the property in Phase II
is Lino loamy fine sand, community development group 4 consisting of
poorly drained soils with high water table 2 to 5 feet from the surface.
ODrainage - the drainage is of great concern.

The proposed drainage ponds are proposed to be dug as shown on the
grading plan. Two of these ponds are in conflict with Phase II as
sketched - at that point what would we do with the water as at that
time ponding on site will be much more difficult.
The ponding to the northeast appears to be natural run off.
The property owner that owns the other part of the northeast ponding
has stated at a meeting that the water already floods very close to
Xeon Street.
We believe a permanent drainage solution should be constructed at this
time or so warn the future property owners of a future storm drainage
solution.
I am asking TKDA, who are reviewing our storm drainage plan for
compliance to Chapter 509 legislation, to review the drainage in this
area.
Ponds without outlets haven't proven to be very desirable over the past
3 or 4 years. People seem unable to accept a sudden rise in the pond and
see it flood trees, etc. that may die and the black dead grass that is
left after the pond receeds.
Also, the pond near the center of the large outlot can overflow into
the pond on the south near Bluebird at Hartfiel's plat.
I don't have engineering calculations providing the 100 year ponding
elevations to date.
OStreets - 148th Lane should be extended to Xeon Street as part of the
plat's street project. The 100 feet x 60 feet may have to be acquired.
Xeon Street is maintained as such by the city

OR
Xeon Street should be reviewed. It has a 100' access protection strip
along the west side. How would we construct a street and assess the
cost with a strip of 100' along the street. Should it be moved or
seeing it serves only one house, should it be vacated? Andover has
a number of these long driveways that we plow, do little summer
maintenance but they appear to be driveways (7th Avenue North north of
165th Avenue; University and Crosstown). Xeon Street doesn't have a right
of way for a turnaround - we trespass when we turn around plowing.

MOTION by Councilman
to adopt the following:
A RESOLUTION APPROVING FINAL PLANS AND SPECIFICATIONS AND
ORDERING ADVERTISEMENT FOR BIDS FOR PROJECT NO. 86-12, FOR
154th LANE AND NIGHTINGALE ESTATES 3rd ADDITION STREET
CONSTRUCTION.
WHEREAS, pursuant to Resolution No. R107-86, adopted
by the City Council on the 17th of July, 1986, Bonestroo,
Rosene, Aderlik & Asso., Inc. has prepared final plans and
specifications for Street Construction on 154th Lane and
Nightingale Estates 3rd Addition; and
WHEREAS, such final plans and specifications were
presented to the City Council for their review on the 5th
day of August, 1986.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Andover to hereby approve the Final Plans and
Specifications for Project No. 86-12 for Nightingale Estates
and 154th Lane Street Construction.
BE IT FURTHER RESOLVED by the City Council of the City
of Andover to hereby direct the City Clerk to seek bids as
required by law, with such bids to be opened at 10:00 A.M.
Friday, August 29, 1986 at the Andover City Hall, 1685
Crossto~n Blvd.
MOTION seconded by Councilman
and adopted
by the City Council at a Regular Meeting this 5th day of August,
1986 with Councilmen
voting in favor of the resolution and Councilmen

A RESOLUTION ACCEPTING WORK AND DIRECTING FINAL PAYMENT
TO H & S COMPANY FOR PROJECT NO. 85-1 FOR THE IMPROVEMENT
OF STREET CONSTRUCTION IN THE FOLLOWING AREA:
CEDAR HILLS RIVER ESTATES.
WHEREAS, pursuant to a written contract signed with
the City of Andover on May 21, 1985 H & S Asphalt Company
of Anoka, Minnesota has satisfactorily completed the following
improvement of watermain and sanitary sewer construction
in accordance with such contract.
NOW, THEREFORE, BE IT RESOLVED by the City of Andover,
Minnesota. The work completed under said contract is hereby
accepted and approved; and
BE IT FURTHER RESOLVED that the City Clerk and M~yor
are hereby directed to issue a proper order for the final
payment on such contract, taking the contractor's receipt
i n full.

which approved the lot split request of Norbert Temple and
which was adopted on May 20, 1986.
Mr. Temple has sold the property and the new owner wishes to
build his house in the middle of the proposed two lots. There-
fore, he does not want the lot split to be recorded. (The lot
split was not recorded)

We received two quotes, one from GMC & Coach Operations
Fleet Sales and nne from Boyer Ford Trucks. We also
received a letter from Blaine Dodge saying they have
nothing in their inventory at this time and its too late
for them to order a new unit this year.
GMC placed a bid of $25,000.00. The unit they bid looks
real good. They have $12,DOO Front Axle, we asked for $9,000.
They have $23,000 Rear Axel, we asked for $9,000. They
have Air Brakes with an Air Dryer, Heavy Duty Frame with
Reinforcement. They didn't bid a Engine Heater & Back up
Alarm. I called them about this and they would have to
add $100.00 to install these. Their full total would
be $25,100.00.
Boyer Ford Trucks bid was for $25,200.00. They also
meet the specs.
Both of these trucks are two long and have to be cut
down. The GMC 138" Cab to Axel and the Ford 186",
either one we would get, would have to be cut to 120"
from Cab to Axel. Engle fabrication Inc. will cut to
length for a price of $650.00.

I would recommend we purchase our new truck from GMC
Truck & Coach Operation 3001 Broadway NE., Minneapolis,
MN. for $25,100.00.

We received two quotes on this tank for the Water truck.
Ruffridge-Johnson of Minneapolis, MN., placed a quote of
$24,455.00 for Stainless Steel TankJ$3~000~00 less if we
went with Steel Tank. Our spec's were for Stainless
Tank. They also had problems supplying the extras.
Engle Fabrication, Inc. Sauk Centre, MN placed a quote of
$16,400.95, for Stainless Tank. They meet our spec.s
plus they were able to bid the extras such as the Cabinet,
Hose Rack, and Hand Held Spray Nozzle, $3,705.85, even with
the extras they have a total bid of $20,106.800. They
come in $4,348.20 less than next bidder.-~
I would recommend we have Engle Fabrication build our
tank.

A RESOLUTION DECLARING USE OF COMMUNITY DEVELOPMENT BLOCK GRANT
FUNDS.
WHEREAS, the City of Andover has determined the area along
Bunker Lake Boulevard (junkyard area) is experiencing blighted
conditions; and
WHEREAS, acquisition, demolition, cleaning and improvements
to the land are desirable; and
WHEREAS, it is the Council's desire to use Community Develop-
ment Block Grant funds to improve the blighted conditions.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Andover to use its Community Development Block Grant fULds
for acquisition, demolition, cleaning and improvements to the land
for the blighted area along Bunker Lake Boulevard between Thrush
Street and Hanson Boulevard.
