I attended the above-referenced. rreeting on June 24, 1986, and make the fOllowing notations: I spoke on behalf of the City and made the following carrnents: 1. That the City had a special use permit for the operation of this tire recycling operation with Minnesota Tire Recycling and Milton LaPanta as its owner/operator. 2. Second, that the City wishes to have the opportunity to respond to any agreement arrived at between the r-1PCA and the "tire =llectors" so that we might make any caments, if necessary. 3. Ask what effect this Abatement process will have on the Special Use Penni t issued by the City to Minnesota Tire P,ecycling, especially as it pertains to the chipping and rerroval of waste tires presently on the site as well as those waste tires received at the site on a daily ba~is. 4. Is 5 years a reasonable length of ti..nE to rerrove 555,000 tires plus the new tires that are received on a daily basis? Has that been calculated out so that that number works? Does it allow for "down-time" for equir:m=nt repair? Does this =nsider a nonnal schedule of operation (Le., 8:00-5:00 or sanething very similar to regular hours of operation1.? Anne Cohen, Special Assistant Attomey General responded that they would be working with both the County (who holds their license) and the City as it pertains to this agreement as they do not want to interrupt the flow and working process that is on-going. Attomey Elim Baer lsp?) representing the Heidelbergers raised the fOllCMing issues: There is currently a lawsuit pending which deals with the question of who awns what. The Court ruled in November of 1984 that LaPanta awns the tires and holds a lease on the land for 5 years, ~, that bas been appealed (June of 1986) and a decision is expected by September of 1986. Interesting... Anne Cohen suggested that two agreements be executed - one with LaPantaand the =rporations (who have =ntrol of the site and the tires) and one with HeiCielbergers (who claim to = the tires and hold the title to t:.1e land under which the tires are stored) . Baer pointed out that that is =ntrary to nonnal procedures as the MPCA usually enters into only one agreanent per parcel of land. There was a little further discussion, but the end result is ... 'Ihe notion was made and seconded to allow the MPCA staff to lssue a Request for Abaterrent as proposed. 'Ihe staff also pointed out that they ~uld not begin the process as outlined in regard to non-response until such ti.nE as the Court of Appeals has ruled. 'Ihey are, in the meanti.nE however, going to begin to draft the Agreement chosen by the "tire =llectors" so that they can begin to l=k like they are <:x:R1plying with the State Law (appeasing action).
