The project was brought to the attention of the City Council at a regular
meeting April 15, 1986. A feasibility report was ordered April 29, 1986.

Special Conditions

made with City Project 86-3 to the Red Oaks Pond East.
Separate estimates are provided for Phase I (Menkveld property) to be laid
with Project 85-5A.

OPossible items from the floor:
Dan Radens, l41st Avenue in Green Acres, wants a
stop sign at Flora street to slow down the traffic.
He has threatened to take the city to court along
with Smith, the developer, and get an injunction...
eedar erest pond is flooding again - we raised the
lot up 3 to 4 feet last year. Owner of adjacent
lot wants the pond pumped again.
Herman truck terminal on erosstown???
Sirkora's road is flooded.
OTower lettering: orientation should be decided. Andover
north and south side; logo on east and west?
OI have talked to Metro eouncil staff about revising MUSA
line for the year 1987-2000. Andover is almost to the 1990
households now - about 140 permits to go.

The eouncil is requested to consider vacating a portion
of the utility and drainage easement running along the
west side of Lot 3, Block 3, Northglen.
The owner of the property, Ronald Kujawa, wants to build
a swimming pool in his back yard and without vacating
a portion of the easement, he would not be able to build
the pool.
A public hearing on this item has been scheduled for
7:30 P.M.
ENGINEERING eOMMENTS
The consideration on the drainage utility ~asernent: can
the purpose be served with part of the easement vacated?

The easement as shown was provided to allow for ponding
around the beehive storm sewer inlet that drains the back
yards in the area.

Therefore, the main concern is storm water' storage - Lficthe
swimming pool doesn't appreciably change the storage volume
the purpose would be served.

The easement can be vacated to the following line: starting
10 feet east of the NW corner of the lot, thence southerly in
a straight line to a point on the south line of the lot that
is 10 feet easterly of the southerly most corner.

public hearing at 7:30 P.M., Tuesday, May 20, 1986
at the Andover eity Hall, 1685 erosstown Boulevard
NW, Andover, MN to consider the request of Ronald
Kujawa to vacate a portion of the drainage and utility
easement located across the west portion of the property

MOTION by Apel, seconded by Rogers that the Andover
Planning and zoning eommission recommend to the eity
eouncil approval of a lot split requested by Norbert
Tempel for the property described as Lot 1, Block 1,
eountry Estates for the following reasons:
1) The proposed lot split will not be detrimental
to the health, safety or general welfare of the
eommunity;
2) The proposed lot split will not cause an increase
in traffic;
3) It will not depreciate surrounding property values;
4) It is in conformance with the Zoning Ordinance,
eornprehensive Plan and Ordinance 40 in regard to
width and area.
The lot split will be subject to the following conditions:
1) A park dedication fee will be required if one was not
paid when eountry Estates was platted;
2) If the lot split is approved, new legal descriptions
will be drawn up;
3) Prior to the issuance of a building permit, an
additional sewer stub will be installed.
Motion carried unanimously.
NOTE: The park dedication fee for eountry Estates was
paid on 1/17/77.

WHEREAS, pursuant to advertisement for bids as set out in
eouncil Resolution No. R036-86, bids were received, opened and tabulated
according to law for Project No. 86-4, with results as follows:

enter into a eon tract with American eontracting in the amount of
$339,861.30 for construction of Improvement Project No. 86-4 for water-
main, sanitary sewer, storm drain, streets with concrete curb and
gutter in the area of Hidden ereek; and direct the eity Clerk to return
to all bidders the deposits made with their bids, except that the
deposit of the successful bidder and the next lowest bidder shall be
retained until the eontract has been executed and insurance and bond
requirements met.

Andover's experience with the low bidder is somewhat to
be desired.
We have said that Andover wouldn't enter into a contract
with this contraQtor,.
Good Value also is having trouble with this contractor on
one of their own projects - yet they are willing to have
him as a contractor. They haven't experienced any time
delays or inferior quality of work.
Andover's project with Woodland we believe to be well
constructed but frequent hassels and unwillingness to do
other work made the project difficult.
A committee of the eity eo~ncil (at least the mayor and I)
should meet with the contractor before he is awarded the
contract - and explain our concerns - let the contractor
realize what lowest responsible bidder means and it
doesn't mean just lowest price.

MOTION by Pirkl, seconded by Apel that the Andover Planning
and zoning eommission recommend to the City eouncil approval
of a Special Use Permit for density zoning requested by eon-
tinental Development eorporation for the property described
as the North one-half of the northwest one-quarter of Section
26, Township 32, Range 24, Anoka eounty, Minnesota, except the
east 100 feet thereof for the following reasons:
1) The proposed use will not be detrimental to the health,
safety, or general welfare of the community;
2) It will not cause serious traffic congestion;
3) It will not seriously depreciate surrounding property values;
4) It is in harmony with the general purpose and intent of
the zoning Ordinance and the eornprehensive Plan.
A public hearing was held and there was opposition. The Commission
finds the development is of a unique nature and requires this
Special Use Permit for its best use.
Reference should be made to the eity eouncil minutes of April
15, 1986, specifically Page 8, the second paragraph regarding
the possibility of assessments.
The minimum lot size in the plat for which this Special Use
Permit is required will be 39,000 square feet of buildable land.

MOTION by Apel, seconded by pirkl that the Andover Planning
and zoning Commission recommend to the City Council approval
of a variance requested by Continental Development Corporation
to retain the open space in private ownership by the developer
for the following reasons:
1) In order for the philosophy behind the request for the
Special Use Permit to work as has been attempted, this variance
should be granted;
2) It will not be detrimental to the health, safety or general
welfare of the community;
3) It is in conformance with the Comprehensive Plan;
4) It is necessary for the reasonable use of the lan.
If granted, the developer must agree as part of the protective
covenant not to petition for public utilities until such public
utilities adjoin the property.
Approval of this variance is contingent upon the approval of
the Special Use Permit requested by Continental Development
Corporation.
Approval is pursuant to Ordinance 8, Section 5.04.

The results indicate that part of the grant funds should be
spent for a study. We have discussed, as a committee, a $10,000
study - $5,000 of the $25,000 grant and $5,000 matching fund from
the cities or $2,500 per city.
The Coon Creek Watershed has agreed to participate, with matching
funds, for the study in the amount of $5,000.
This means the cities would match the remaining $20,000 or about
$10,000 each.
Coon Rapids has set aside funds in their 1986 budget to match if
Andover matches, etc. Coon Rapids, at their 5-13 meeting,
approved the study concept - strongly indicated that the lake
property would be expected to pay a part of the share.
Andover hasn't set aside dollars at this point, but should make
a decision that we are or are not going to participate in the
amount of $10,000. This amount may not be due until 1987 with the
$5,000 contribution of CCWD for the study.
The Homeowners Association has donated $500 as matching funds.

The City Council is requested to approve the estimated
costs for watermain improvements from Crosstown Boulevard
from 139th Avenue to 140th Avenue.
Typical lot of 100'x200' calculates out using other current
projects to about $3,100.
I propose that we assess by the unit at $3,100/unit 1986
dollars - adjusting in the future by the ENR index.
We have constructed the project as a trunk project which
will allow hook up on an individual basis.
I have suggested to those I have talked to that they petition
for improvements as a group if they want tq be assessed and
not pay a $3,100 charge at hookup/permit time.
The city can't have 12 individual assessment rolls.

AN ORDINANCE TO REGULATE LICENSING OF TRANSIENT AND ITINERANT
MERCHANTS, VENDORS, AND PEDDLERS
Section 1. DEFINITIONS
(1) A "Transient merchant" is any person whose business in the City is
temporary or seasonal and consists of selling and delivering merchandise
within the City, and who in furtherance of such purpose uses or occupies
any structure, vehicle, street, or other place for the exhibition and sale
of such merchandise, either privately or at public .auction; provided,
however, that a transient merchant shall not be construed to mean any
person who while occupying such temporary location, exhibits only samples
for the purpose of securing orders for future delivery only.
(2) A "Peddler" is any person traveling from place to place and house
to house who carries his merchandise with him, offering and exposing the
same for sale, and making deliveries to purchasers, or any person who,
without traveling from place, shall sell or offer merchandise for sale
from a vehicle or conveyance; provided, however, that "peddler" shall
include the words "hawker" and "huckster", but shall not be limited to
them.
Section 2. LICENSE REQUIRED
A license shall be required for any transient merchant or peddler to
operate in the City.
Section 3. EXCLUSIONS
(1) No person shall be required to obtain a license in the following
instances:
a. Salesmen selling goods to retail or wholesale stores or to
professional or industrial establishments.
b. The conduct of "garage sales" or "rummage sales" when conducted
in a non-profit institution by the members thereof, or on the
premises of the owner of the rummage or other articles being
offered for resale, provided that such sales do not last longer
than seventy-two hours and provided further that such sales
are adequately advertised either by notice in a paper of local
distribution or by placing a sign on the premises.

(2) In the case of non-profit organizations, the following requirements
shall apply:
a. Only one license for the organization shall be required. The
license shall contain the names of all individuals working under
the organizations license.
b. In lieu of a badge being issued by the City to each individual,
the organization must provide some means of identification
such as a uniform, sign, badge, or other identification device
approved by the City Clerk.
c. No license fee shall be charged to non-profit organizations.
Section 4. APPLICATION
The application shall include:
1. Name and description of the applicant;
2. Permanent home address and full local address of the applicant;
3. A brief description of the nature of the business, the goods
to be sold, and the applicant's method of operation;
4. If employed, the name and address of the employer, together
with credentials establishing the exact relationship;
5. The length of time which the applicant intends to do business
in the City, with the approximate dates;
6. The place where the goods or property proposed to be sold, or
orders taken for the sale thereof, are manufactured or produced,
where such goods or products are located at the time said application
is filed, and the proposed method of delivery;
7. A photograph of the applicant, taken within 60 days immediately
prior to the date of filing of the application, which picture
shall be 2" x 2", showing the head and shoulders of the applicant
in a clear and distinguishing manner;
8. A statement as to whether or not the applicant or the person
managing the business has been convicted of any crime, misdemeanor,
or violation of any municipal ordinance, involving activities
licensed under this Chapter, the nature of the offense and the
punishment or penalty assessed therefor;
9. If a vehicle is to be used, a description of the same, together
with license number or other means of identification;
10. A statement of the nature, character and quality of the goods,
wares, or merchandise to be sold or offered for sale by applicant,
the invoice value and quality of such goods, wares, and merchandise,
whether the same are proposed to be sold from stock in possession
or by sample, at auction, by direct sale, or by taking orders
for future delivery;

A brief statement of the nature, character, and content of the
advertising done or proposed to be done in order to attract
customers;
Credentials from the person, for which the applicant proposes
to do business, authorizing the applicant to act as such
representative.
12.
Section 5. LICENSE FEE
(1) At the time of filing the application, a registration fee of $15
shall be paid to the City Clerk to cover administrative costs and the
cost of investigation.
(2) The license fee which shall be charged by the City Clerk for such
license shall be $1 per day, $5 per week, $10 per month, $20 per year.
(3) The yearly fee for a license issued on or after July 1, of any
year, shall be one-half (~) the amount stipulated in Subsection 2.
Section 6. INVESTIGATION AND ISSUANCE
(1) Upon receipt of the application, the original shall be referred
to the Police Department, who shall cause such investigation of the
applicant's business and moral character to be made as he deems necessary
for the protection of the public good. The comments and findings of the
Police Department shall be attached to the application and returned to
the Clerk.
(2) Licenses shall be issued not earlier than three business days
subsequent to the filing of the application unless the Police Department
files a report showing good cause for denial. If the Police Department
has not completed its investigation within the three day period, the
license shall nevertheless be issued, subject to revocation or denial
of a license.
(3) It shall be sufficient grounds for revocation or denial of a license
under this section if the applicant or his employer shall have been
convicted of a felony or any crime involving moral turpitude in the
ten years preceding the date of application; or if the applicant or
his employer shall have been convicted of perjury or any felony or gross
misdemeanor involving truth telling ability within the last ten years,
or if the applicant or his employer shall have been convicted of any
crime involving fraud within the last ten years, unless the applicant
complies with the provisions of Minnesota Statutes, Section 364.03.

(4) The Police Department shall promptly report the results of their
investigations to the City Clerk. If grounds for denial or revocation
are not discovered in the Police investigation, the City Clerk shall be
so instructed and shall issue a license to the applicant upon payment
of the license fee. Such license shall contain the signature and seal
of the issuing officer and shall show the name, address, and photograph
of said licensee, and the kinds of goods to be sold thereunder, the amount
of fee paid, the date of issuance, and the length of time the same shall
be operative, as well as the license number and other identifying description
of any vehicle used in such soliciting or canvassing.
Section 7. BADGES
The City Clerk shall issue to each licensee at the time of delivery
of his license a badge for each individual licensed under this Ordinance.
The badge shall state the period for which the license is issued and
the number of the license in letters and figures shall be plainly discernable.
Such badge shall be worn constantly by the licensee on the front of his
hat or outer garment in such a way as to be conspicuous during such
time as said licensee is engaged in the occupations hereby regulated.
Section 8. TRANSFER
No license or badge issued under the provisions of this Ordinance shall be
transferred nor used or worn at any time by any person other than the
one to whom it was issued.
Section 9. SEPARATE LICENSES
In the event that such person or persons applying for said license shall
desire to do business in more than one place, separate licenses may be
issued for each place of business and shall be posted conspicuously in
each place of business.
Section 10. DUTY OF POLICE TO ENFORCE.
(1) It shall be the duty of the Police Department to examine all places
of business and persons in their respective territories subject to the
provisions of this Ordinance, to determine if this Ordinance has been
complied with and to enforce the provisions of this Ordinance against
any person found to be violating the same.
(2) Use of Streets. No peddler shall have an exclusive right to any
location in the public streets, nor shall any be permitted a stationary
location, nor shall he be permitted to operate in any congested area
where his operations might impede or inconvenience the public.

Section 11.
RECORDS
The City Clerk shall report the license number of all licenses with the
Police Department and shall keep a record of all such licenses and of
any complaints and violations. The Police Department shall report to
the City Clerk any complaints against any licensee and any conviction
for violation of this Ordinance.
Section 12. REVOCATION OF LICENSE
The license issued pursuant to this Ordinance may be revoked by the
City Council after notice and hearing, for any of the following reasons:
1. Any fraud, misrepresentation or false statement contained in
the registration or in the application for license;
2. Any fraud, misrepresentation Or false statement made in connection
with the selling of goods, wares or merchandise;
3. Any violations of this Ordinance;
4. Conviction of the licensee of any felony or of a misdemeanor
involving moral turpitude; or
5. Conducting the business licensed under this Ordinance in an
unlawful manner or in such a manner as to constitute a breach
of the peace or as to constitute a menace to the health, safety
or general welfare of the public.
Section 13. PROHIBITED PRACTICES
No person under this Ordinance shall:
(1) Call attention to his business or to his merchandise by a loud,
unusual noise; provided, however, that the ringing of a bell or the
playing of music is permissible for a period of 5 seconds in each minute,
except between the hours of 4:30 P.M. and 6:00 P.M.;
(2) Sell or solicit after the hour of 9:00 P.M. or before 9:00 A.M.
unless a previous appointment has been made:
(3) Enter or conduct business upon premises where a sign or plaque
is conspicuously posted, stating in effect that no peddlers or solicitors
are allowed. Such sign shall have letters at least one-half inch high.
Section 14. EFFECTIVE DATE.-
This Ordinance shall be in full force and effect from and after its
passage and publication as required by law.

THE CITY COUNCIL OF THE CITY OF ANDOVER HEREBY ORDAINS:
Ordinance No. 10 and 101 are hereby amended as follows:
SECTION 9.06 - Lots
all) Municipal Sanitary Sewer. In areas served by municipal
sanitary sewer systems, no lot shall contain less than 11,400
square feet nor have a width of less than 80 feet at the build-
ing setback line. Corner lots shall be a minimum of 96 105
feet wide with a 35 foot front setback, except for two-family
lots which shall be required to be 150 percent of a single
family minimum area and width. Any subdivision, lot split or
replatting of existing developments shall be required to meet
the standards of the original development or to meet the average
size of the existing lots. On continuing streets where hOHses
were constructed prior to the adoption of Ordinance 10H, adopted
April 5, 1983, the setback shall be 35 feet unless the existing
structures would indicate a lesser setback to maintain uniformity
in R-2, R-3 and R-4 districts.

RESOURCES FORM THE STATE OF MINNESOTA AND THE METROPOLITAN COUNCIL TO IMPLEMENT
RESPONSES TO IDENTIFIED RIVER CROSSING NEEDS IN THE NORTH METRO AREA
the long standing need for additional river bridges is a critical
issue for the Counties and Cities adjacent to the Mississippi River
in the North Metro Area; and
the North Metro Traffic Task Force composed of elected and appointed
officials from the Metropolitan Council, Anoka and Hennepin
Counties, and the Cities of Andover, Anoka, Brooklyn Center,
Brooklyn Park, Champlin, Coon Rapids, Dayton, Fridley and Ramsey was
established to serve as a forum to study and discuss relevent issues
associated with river bridges in the North Metro Area, to establish
a basis for coordination of transportation planning activities among
affected jurisdictions, and to facilitate achievement of consensus
among member jurisdictions on appropriate alternatives to meet
identified bridge needs; and
the North Metro Traffic Task Force has appointed a Technical
Committee to evaluate the need for additional river bridge crossings
to serve the North Metro Area; and
the North Metro Traffic Task Force has accepted and endorsed the
recommendations of their Technical Committee regarding identified
short term improvements to existing facilities and long term needs
for additional river crossing capacity and potential alternatives to
satisfy long and short term bridge crossing needs; and
the North Metro Traffic Task Force has concluded that local
communities, State of Minnesota ~nd Metropolitan Council
cooperation, assistance and funding is essential to specifically
define short term deficiencies and construct appropriate long term
bridge crossings to serve the important, unmet needs of the North
Metro Area and that this support should legitimately receive
priority relative to other transportation studies and construction
of other transportation system improvements in the Metropolitan Area.
NOW, THEN, BE IT RESOLVED, by the (Governing Body) of the (Jurisdiction) that
the (Jurisdiction) strongly supports and concurs with the
conclusions of the North Metro Traffic Task Force that additional
bridge crossing capacity is urgently needed to serve the short and
long term transportation system needs of the North Metro Area.
BE IT FURTHER RESOLVED, that the (Jurisdiction) respectfully requests that the
State of Minnesota and the Metropolitan Council allocate, on a
priority basis, all necessary resources to identify, design, and
construct appropriate facilities to satisfy identified North Metro
Area river bridge needs.

Attached is a drawing "storm sewer trunk" that outlines
the drainage basin that is tributary to a storm drainage
system in Coon Rapids/Coon Creek Watershed.
Andover should participate in this project because part
of the area includes Good Value's property and property
that may have been purchased by a Coon Rapids developer
and if so, will be developed soon.
Attached are proposed costs and an assessment policy for
storm drain.
ALSO attached is a drawing "Andover Sanitary trunk" that
outlines the area that can be served by a Coon Rapids
sanitary sewer trunk.
This should be investigated because, like storm water,
sewage runs best downhill. This would save Andover a great
deal in sanitary sewer depth.
Coon Rapids has down-zoned so the capacity is in their trunk
syst~m. The Andover trunk & the trunk that serves this area
join just south of this area.
Also, attached is a draft joint powers agreement discussing the
storm sewer, sanitary sewer and watermain cost sharing.

SUBJECT: Joint Powers Agreement
City of Andover and the
City of Coon Rapids
As you are aware, the City of Coon Rapids proposes various
improvements including sanitary sewer, watermain, storm drain,
and street which will serve an area in the City of Andover as
well as areas within the City of Coon Rapids. Several
discussions have taken place concerning sharing of these costs.
The following is my understanding of what we have tentatively
agreed to. It would be appreciated if you could put together a
draft joint powers agreement for consideration of both cities.
SANITARY SEWER
Trunk: Trunk sanitary sewer system being constructed within
the City of Coon Rapids will have capability of serving
63 acres of land within the City of Andover. Timing of deve-
lopment plus reduced construction cost make it desirable to
serve this area through the City of Coon Rapids' system.
In exchange for providing this capacity, the City of Andover
agrees to serve 63 acres within the City of Andover
through the Coon Rapids system <and agrees to pay the City
of Coon Rapids for this capacity as development takes place
wi thin the City of Andover. Payment shall be made at the
same rate per acre assessed to Coon Rapids residents. Said
rate to be determined at the completion of Project 85-1.
Estimated rate is $1,886 per acre. An addition 8% annual
interest rate shall be added commencing from the date of
final assessment of Project 85-1 by the City of Coon Rapids.
Maintenance: Maintenance of the trunk sanitary sewer system
shall be the responsibility of the City of Coon Rapids at no
additional charges to the City of Andover for maintenance of
the trunk system.
Lateral: Lateral sanitary sewer systems within the City of
Andover which discharge into the trunk system shall be
constructed and maintained by the City of Andover.

STORM DRAIN
Trunk: The trunk sewer system to be constructed by the City
of Coon Rapids will drain 126 acres within the City of
Andover. It is agreed that serving this area through the
Ci ty of Coon Rapids is the most economical way to provide
storm drain facilities to serve this portion of the City of
Andover. The proposed storm drain system is delineated and
explained in the feasibility study prepared by BRW, Inc.
entitled Feasibility Study, Improvement Project 86-16, Oaks
of Shenandoah 9th Addition. The estimated cost of the total
system is $983/weighted acre. It is agreed that the cost of
this system will be shared on a proportional basis based
upon weighted acreage in each community. Highlands are a
weighting factor of 1, lowlands are a weighting factor of
3/10, wetlands are a factor of 1/10. The attached Exhibit A
is agreed upon as a basis for lowland and wetland weighting
factors. Andover's share of the cost of the system is
estimated at $ The system will be constructed in
phases. The City of Andover agrees to pay the City of Coon
Rapids at a rate to be determined as part of the assessment
of Project 86-16 by the City of Coon Rapids as development
takes place in Andover. Interests will be added at a rate of
8% per annum from the date of assessment of the project by
the City of Coon Rapids.
Some portions of the trunk system lie within the City of
Coon Rapids and some within the City of Andover. The first
phase from the detention pond,. easterly of Osage Street
running easterly to Jay Street, lies in the north half of the
proposed 133rd Avenue alignment within the City of Andover.
It is agreed that this portion will be constructed by the
City of Coon Rapids. Future phases will be constructed by
either community under supplemental joint powers agreement.
Lateral: Storm drain lateral system lying within the City of
Andover, which discharges into the trunk system, will be
constructed and maintained by the City of Andover. Each City
will be responsible for maintenance of their portions of the
system lying within their respective community.

WATERMAIN
Trunk, Source, and Storaqe: The City of Coon Rapids
and the City of Andover finance watermain trunks, wells, and
storage facilities through a fixed rate updated at the time
of assessment with the Construction Cost Index and/or the
Consumer Price Index. At this point no facilities are pro-
posed to be constructed wi thin the City of Andover in con-
junction with the Coon Rapids projects. The City of Coon
Rapids would agree to serve with water all or any part of the
areas to be served with sanitary sewer trunk as indicated in
this agreement. In payment for use of existing Coon Rapids
Trunk, Source, and Storage facilities, Andover customers
would be charged a surcharge of .09 per 1,000 gallons.
Lateral: Any lateral system to be connected to the Coon
Rapids system will be constructed and maintained by the City
of Andover. It is herein agreed that the City of Andover
will have the right to disconnect from the Coon Rapids system
at any time in the future upon 30 day written notice to the
City of Coon Rapids.
STREETS
Construction of a proposed collector street generally along
the corporate limit line between the City of Coon Rapids and
the City of Andover has been proposed. It is herewith agreed
any construction which takes place in the City of Andover
will be paid for by the City of Andover and any construction
that takes place within the City of Coon Rapids will be paid
for by the City of Coon Rapids. The actual construction
could be contracted for by either community with arrangements
for construction to be included in a supplemental joint
powers agreement.
Each community will be responsible for the maintenance of
that portion of the roadway lying within each respective com-
munity. It is however agreed that the roadway will be seal
coated at five year intervals with the cost being shared by
each community based upon the proportional area lying within
each respective community. The contracting agency for the
seal coating will be jointly agreed upon prior to the actual
work.

SEWER AVAILABILITY CHARGES - SEWER AND WATER CHARGES
Sewer availability charges equal to those charged by the City
of Coon Rapids shall be collected by the City of Andover and
turned over to the City of Coon Rapids for payment to the
Metropolitan Waste Control Commission. Sewer service charges
equivalent to those charged to Coon Rapids customers shall be
collected by the City of Andover and turned over to the City
of Coon Rapids. Water charges equal to those charged to the
Ci ty of Coon Rapids residents, plus a surcharge of .09 per
1000 gallons, shall be charged to Andover residents and turned
over to the City of Coon Rapids.

A hearing will be held at 9:00 p.m. as requested by Dennis Barta, Manager of
Andover Auto Parts, on the city council's denial of a junkyard license for
calendar year 1986. The reason for the denial was that vehicles are stored on
the streetside of the screening fence in violation or city ordinance # 44.
Dave Almgren has made a site inspection on several occasions and always found
the same violation to exist. Notice of the denial and notice of the hearing
has been sent to Barta, Robert & Bonnie .Pears - owners of the property, and
John Speakman, their attorney. The place of business and/or Mr. & Mrs. Pears
had been notified several times prior to the license being denied that the
violation existed and that the license could not be granted until the cars were
moved behind the screening fence.
I have asked Dave to make another inspection the day of the hearing.
Andover Auto Parts has complied with city requirements for insurance, bond,
application and fee.
Attached are copies of appropriate correspondence.

or allow to be blown off the business premises."
Section 5, 5.2 - Where junk is kept outdoors, the area shall
be enclosed by a solid vertical wall or fence..."
Inspection of your yard reveals parked vehicles on the street-
side of the fence. You are hereby given notice to bring this
business into compliance with City Ordinance within ten (10)
days or the Council will take action denying the renewal
request of your junkyard license.
