HEART/HERO (Home Economics and Related Training) is an on-the-job
training program for students interested in a career in food service,
child care, fashion and apparel production, interior design and
cosmetology.
Developing leadership skills and getting involved in school and community
activities are 2 purposes of the program.

ORDINANCE NO.
AN ORDINANCE ESTABLISHING AND SETTING A CURFEW FOR MINORS.
The City Council of the City of Andover does hereby ordain:
SECTION 1. Definitions
1.1 Curfew - a regulation enjoining the withdrawal of specified
persons from the streets, avenues, parks and public property
within the City of Andover at a stated hour.
1.2 Minor - a person who has not attained majority (age 18).
SECTION 2.
Regulations
2.1 It shall be unlawful for any person 16 years of age and under
to be present on any public street, avenue, park or other
place in the City of Andover between the hours of:

SECTIDN 3. Prima Facie Evidence
3.1 It shall be unlawful for any parent, guardian, or othei person
having the lawful care, custody, or control of any minor to
allow or permit such minor to violate the prpvisions of this
Ordinance.
3.2 The finding of any minor in violation of the curfew shall
be prima facie evidence that a parent, guardian, or other
person having lawful care, custody, or control allowed or
permitted the violation.
SECTION 4. Curfew Procedures
4.1 Any Police Officer or Sheriff's Deputy upon finding a minor
in violation of this Ordinance shall notify the.parents,
guardian, or person having custody or control of such minor,
and the juvenile authorities.

SECTION 5. Validity
5.1 If any section, subsection, sentence, clause or phrase of
this Ordinance is for any reason held to be unconstitutional,
such decision shall not affect the validity of the remaining
provisions of this Ordinance.
SECTION 6.
Penalty
6.1 Any person violating any provision of this Ordinance is guilty
of a misdemeanor defined by State Law and subject to the
penalties therefor.
SECTION 7.
Effective Date
7.1 This Ordinance shall take effect and be in force upon its
passage and publication as required by law.

MOTION by Rogers, seconded by Bose11 that the Andover
Planning and Zoning Commission recommend to the City
Council approval of the preliminary plat of Smith's Green
Acres described as 'Part of the Southeast Quarter of the
Southwest Quarter of Section 28, Township 32, Range 24,
Anoka County, Minnesota' for the following reasons:
1) The plat is in conformance with the City Zoning Ordinance
and the Comprehensive Plan;
2) The engineer has reviewed the plat;
3) The Park Board has recommended cash in lieu of land for
park dedication.
It should be noted that a public hearing was held and there
was some opposition.
Lot 1, Block 2 will require a variance for lot depth and
width. A variance is also recommended for the width and
depth of all of the lots in the plat, as they were platted
to conform to the existing lots in the area.
A cul-de-sac at the property lines of Block 1, Lot 6 and
Block 2, Lot 7, 30 foot radius will be a permanent blacktop
turnaround which abuts the edge of Phase I.
At the time Phase II is fina1ed, the vacation of Dahlia Street
will be held at a public hearing.
In Phase II, Lot 4 will be Outlot A, Lot 7 will be Outlot B
and the remainder of the property will be Outlot C.

A RESOLUTION APPROVING THE PRELIMINARY PLAT OF SMITH'S GREEN ACRES
AS BEING DEVELOPED BY FOREST OAKS CONDOS IN SECTION 28-32-24.
WHEREAS, pursuant to published notice thereof, the Planning
and zoning Commission has conducted a public hearing on the Preliminary
Plat of Smith's Green Acres; and
WHEREAS, as a result of such hearing and review, the Planning
and Zoning Commission is recommending approval of such plat, citing as
reasons for such recommendation as being 1) the plat is in conformance
with the City Zoning Ordinance and the Comprehensive Plan, 2) the City
Engineer has reviewed the plat; and
WHEREAS, the City Council acknowledges that a recommendation
has been received from the Park Board for dedication of cash in lieu of
land, and
WHEREAS, the City Council is in agreement with the reasons
given by the Planning and zoning Commission.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Andover to hereby approve the Preliminary Plat of Smith's Green
Acres, noting the following:
1) A variance will be granted for lot depth and lot width
bn Lot 1, Block 2.
2) A variance will be granted for all of the lots in the
plat for lot width and depth as they were platted to
conform to the existing lots in the area.

The Andover Review Committee has reviewed the preliminary plat and
offers the following comments:
General Comments:
oProposed plat is in an R-3 zoning district.
OName of plat is close to existing names
OThe majority of the property is below the 100 year flood level
which is 867.5 with a lowest floor elevation of 868.5.
OWater table is generally 863.00 whicD will not govern the house
elevations.
oOverlay plan proposes a cul-de-sac 500+ feet east of Heather Street
N.W.
The cul-de-sac is recommended by staff because the east part of
the property, Phase II, is generally low and has peat depth up to
8 feet. We don't believe that in the foreseeable future that
Phase II will developi t~erefore, the city would be left with a
stub street without a turnaround.
The overlay allows for the future if land values would make it
feasible to fill and remove the peat and construct another cu1-de-
sacfroITl l41st Avenue.

NOTICE OF PUBLIC HEARING
The City of Andover Planning and Zoning Commission will hold a
public hearing at 7:30 P.II., Tuesday, November 12, 1985 at the
Andover City Hall, 1685 Crosstown Boulevard N.W., Andover, MN
to consider the preliminary plat known as "Smith's Green Acres"
being developed by Gerald Smith taka Forest Oaks Condos). The
property proposed to be platted is described as "Part of the South-
east quarter pf the Southwest quarter of Section 28, Township 32,
Range 24" (approximate location 141st Lane and Heather Street).
Also included in this proposal is a request for the vacation of
the existing road easement for Dahlia Street across the east 66
feet of the subject property.
All opponents and proponents of said preliminary plat and street
vacation will be heard at the above time and location.

The City Council of the City of Andover hereby ordains:
Ordinance No. 46, known as the Swimming Pool Ordinance, is
hereby amended as follows:
SECTION 3. FENCING
a. All outdoor pools hereafter constructed shall be
completely enclosed by a fence or wall of the non-
climbing type, so as to be inpenetrab1e by toddlers,
afford no external handholds or footholds, and a
minimum of 4 feet in height, except that above-ground
pools with a side wall height of at least 4 feet need
not be fenced but shall have removable steps.

Franchise Amendments
For the last several months, Group W Cable of the Quad Cities
and the Quad Cities Cable Communications Commission, on your
behalf, have been negotiating certain franchise amendments
relating to public access equipment and facilities, interactive
services, access staff, franchise fee payment, and rates. At
its meeting of October 24, 1985, the Commission passed a
resolution recommending amendments to the cable television
franchise ordinances of its member cities relating to the
scheduling of the payment of franchise fees and rates.
Please find enclosed for your review and action a Cable Communica-
tions Ordinance Amendment Agreement No. 2 incorporating all of the
terms of the agreement between the Commission and Group W Cable.
The Commission adopted this Amendment Agreement and recommends it
to its City Councils for approval.
Also included and resulting from the negotiations are two proposed
Ordinance Amendments. The proposed changes occur in the Ordinance
sections regarding the time for payment of the franchise fee and
Exhibit A dealing with rates.

With each of the enclosed Ordinance Agreements, please find
enclosed a red-lined copy. This copy has underlined all additions
to the original franchise language and is marked with a hyphen in
those areas where franchise language was deleted in the compromise
negotiations. This information may be utilized by yourselves,
your City Council members, or your City attorneys in any analysis
you might undertake of the Franchise Amendments.

Amendment Agreement No. 2 should be adopted by resolution of your
City Council. I have enclosed a sample resolution for your use.
The Resolution serves four purposes:
1. Adopts Amendment Agreement No.2;
2. Approves the two Ordinance Amendments;
3. Authorizes the necessary signatures to the Agreement;
and
4. Approves and adopts the Ordinance Summary for
Publication.
If your City Council adopts the Resolution, please affix the
necessary signatures to Amendment Agreement No. 2 and return the
signed Resolution and Agreement to my office as soon as possible.
When I have received executed Agreements for each City, I will
forward them to Group W Cable for their execution. If your City
elects not to adopt the Agreement or the Ordinance Amendments,
please notify me in writing.
Finally, I have enclosed an Ordinance Summary which may be used
to satisfy the publication requirements upon adoption of the
Amendments. Please forward to me an Affidavit of Publication as
soon as you have received said document.
In summary, the three documents which should be returned to my
office are:
1. A copy of the signed Resolution;
2. The original signed Amendment Agreement No.2 (which
will be returned to you after Group W signs it); and
3. An Affidavit of Publication for the Ordinance Summary.

RESOLUTION ADOPTING CABLE COMMUNICATIONS ORDINANCE
AMENDMENT AGREEMENT NO. 2
WHEREAS, Group W Cable of the Quad Cities, Inc. (here-
inafter "Group Wff), a Minnesota Corporatioq, has constructed
a cable communications system in the City pursuant to City
Ordinance No. ~ and
WHEREAS, the Quad Cities Cable Communications Commission
has recommended certain amendments to the Ordinance and the
execution of "Amended Agreement No.2" between the City and
Group W, a copy of which is attached hereto as Exhibit 1,
and hereby made a part hereof; and
WHEREAS, the Council finds that the adopting and
approval of the recommended amendments and Amendment Agree-
ment No. 2 are in the best interests of the City;
NOW, THEREFORE, BE IT RESOLVED, by the City Council:
1. That Amendment Agreement No. 2 is adopted by City.
2. That the Cable Communications Ordinance No. ,
is hereby amended at Article VI, Section 4.B.(1) and Exhibit
A as delineated in Attachments I and II, respectively in
Amendment Agreement No.2.
3. That the Mayor and the City Administrator are
authorized and directed to execute Amendment Agreement No. 2
for and on behalf of the City and to deliver it to Group W
for execution.
4. That the attached ordinance summary related to the
ordinance amendments adopted pursuant to paragraph No.2,
hereof, is a fair and accurate summary of said ordinance
amendments and is hereby authorized for publication.

CABLE COMMUNICATIONS ORDINANCE
AMENDMENT AGREEMENT NO. 2
City of Andover
THIS AGREEMENT, made and entered into this day of
, 1985, by and between the City of
Andover, a municipal corporation of the State of Minnesota
(hereinafter "City" or "Grantor"), and Group W Cable of the
Quad Cities Inc., a Minnesota corporation (hereinafter
"Grantee"). The Grantor and Grantee hereinafter may
co11e~tive1y be referred to as "Parties".
WITNESSETH:
WHEREAS, pursuant to City Ordinance No. , the
Grantor has granted and the Grantee has accepted a non-
exclusive revocable Franchise to operate, construct,
maintain and reconstruct a cable television system within
the City ("Franchise Agreement"); and
WHEREAS, the Parties desire to modify and clarify
certain provisions contained in the Franchise Agreement;
NOW, THERFORE, in consideration of the mutual covenants
contained herein the Parties agree as follows:
1. Franchise Fee--The franchise fee specified in
Article VI, Section 4.B (1) of the Franchise Agreement
is hereby modified as specified in Attachment I to this
Agreement to provide that quarterly payments of fran-
chise fees will be made within ninety (90) days after
the end of each quarter with adjustments at year-end for
actual Gross Revenues.
2. Rate Regulation and Services--Grantee's
Schedule of Rates and Services as set forth in Exhibit A
to the Franchise Agreement is amended in its entirety as
set forth in Attachment II to this Agreement.
3. Reimbursement to Commission--Within thirty
(30) days after the effective date of this Amendment
Agreement No.2, Grantee shall pay the Quad Cities Cable
Communications Commission for all costs incurred in the
renegotiation of the Franchise Agreement, said payment
shall not be construed as an advance on past or future
franchise fees.

4. Survival of Other Terms of the Franchise
Agreement and of Offering--AIl other provisions con-
tained in the Franchise Agreement and Offering shall
remain in full force and effect, unless specifically
modified by this Agreement or subsequent amendment of
said Franchise Agreement by City.
5. Absence of Admissions--The Parties agree that
nothing contained herein shall be deemed an admission by
either Party that it has either failed to perform any
obligations ~nder the Franchise Agreement or breached
that Franchise Agreement in any manner.
6. Governing Law--This Agreement shall be con-
strued and interpreted in accordance with the Laws of
the State of Minnesota.
7. Authority of the Commission--Nothing in this
Agreement shall modify the responsibility and authority
previously delegated by the City to the Commission.
8. Acknowledgement--Grantee acknowledges that it
has had an opportunity to review the terms and condi-
tions set forth above in this Agreement and that under
current law Grantee believes that said terms and condi-
tions are not unreasonable or arbitrary, that Grantee
believes that the City and Grantee have the authority to
enter into this Agreement and that Grantee and City
agree to comply with all terms of this Agreement and
that Grantee and City agree that they will not challenge
the terms and conditions set forth above in this Agree-
ment.
9. Effective Date--This Agreement shall become
effective upon the last effective date of the above
mentioned ordinance amendments in all member cities of
the Quad Cities Cable Communications Commission and upon
its acceptance by the Grantee within sixty (60) days of
the last effective date of said ordinance amendments.

FRANCHISE FEE, RATES, CHARGES, CHANGES IN FEES
AND PROCEDURES

B. Franchise Fee.
* * *
(1) Throughout the term of this Franchise, Grantee
shall pay to City, within ninety (90) days after
the end of each quarter of the fiscal year of
Grantee, a franchise fee of five percent (5%) of
all Gross Revenues, with adjustments at year end
for actual Gross Revenues. No payment will be
allowed of any fee that is different from five
percent, other than the filing fee and payment
required of the successful applicant as established
by City to recover the costs of franchising.
Grantee agrees to support any waiver required by
the FCC for the established franchise fee. The
annual fee may be subject to renegotiation at such
time as federal or state authorities no longer
regulate the amount of the fee. If Grantee and
City do not agree in renegotiations, the Franchise
fee shall remain unchanged.

AND GROUP W CABLE OF THE QUAD CITIES, INC.
The Council of the City of Andover does ordain:
1. Article VI. SYSTEMS OPERATIONS
Section 4.
Franchise Fees, Rates, Charges, Changes
in Fees and Procedures
The franchise fee specified in Article VI, Section
4.B.(1) of the Franchise Agreement is amended to provide
that quarterly payments of franchise fees will be made
within ninety (90) days after end of each quarter with
adjustments at year end for actual Gross Revenues.
2. Amended Exhibit A - Rates
Group W's Schedule of Rates and Services as set
forth in Exhibit A to the Franchise Agreement is amended
in its entirety to provide for the rates and services as
set forth in Attachment II of Amendment Agreement No.
2. The complete Attachment II is available for inspec-
tion at the city offices.
These amendments shall take effect and be enforced

(1) Throughout the term of this Franchise, Grantee
shall pay to City, within ninety (90) 68 days after
the end of each quarter of the fiscal year of
Grantee, a franchise fee an ann~ei ree of five
percent (5%) of all Gross Revenues, with
adjustments at year end for actual Gross
Revenues. No payment will be allowed of any fee
that is different from five percent, other than the
filing fee and payment required of the successful
applicant as established by City to recover the
costs of franchising. Grantee agrees to support
any waiver required by the FCC for the established
franchise fee. The annual fee may be subject to
renegotiation at such time as federal or state
authorities no longer regulate the amount of the
fee. If Grantee and City do not agree in renegoti-
ations, the Franchise fee shall remain unchanged.

WHEREAS, pursuant to a written contract signed
with the City of Andover on August 8, 1984, Forest Lake
Contracting, Inc. of Forest Lake, Minnesota has satisfactorily
completed the following improvement of street construction,
84-1, 84-2, and 84-3, in accordance with such contract.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of Andover, Minnesota. The work completed under said contract
IS hereby accepted and approved; and
BE IT FURTHER RESOLVED that the City Clerk and Mayor
are hereby directed to issue a proper order for the final pay-
ment on such contract, taking the contractor's receipt in full.

Enclosed please find the 4th & Final Request for Payment and Change Order No.
I for the above referenced projects. The project overran the revised contract
amount by $9,119.99 or 1.5%. The principal reason for the overrun is minor
variations in the plan quantities as compared to actual constructed quantities.
We recommend the City Council accept the project and make final payment to
Forest Lake Contracting.
Change Order No. 1 provides the placement of concrete curb and gutter on South
Coon Creek Drive from the bridge to a point 615' east as requested by the City.

Enclosed please find two (2) signed copies of the 4th & Final Request for Pay-
ment for the above referenced project. The project overran the original con-
tract amount by $6,738.52 or 5.7%. The principal reason for the overrun is
additional muck excavation and several extra driveway requests by the property
owner. These overruns amount to $4,357.80. The other differences are minor
variations in plan quantities as compared to actual constructed quantities.
We recommend the City Council accept the project subject to the warranty pro-
visions of the. specifications and make final payment to Forest Lake Con-
tracting.

been contacted and asked to submit a proposal on the uti I ity extension
along Round Lake Boulevard to serve Mr. Lawrence's property.
Channei Construction subm Itted a proposal of $11,800 for the uti Ilty
construction plus an additional $1,170 far a hydrant, for a total bid of
$12,970.00.
Dawson Construction submitted a proposal of $12,987 for the uti I Ity
construction plus an additional $1,200 for a hydrant, for a total bid of
$14,187.00.
American Contracting chose not to submit a proposal.
In our ,November 26, 1985 telephone conversation, you recommended the
ut/l It/es be extended to the north property I ine if the cost did not exceed
the $15,000 /Im/t. Channel Construction wi/ I extend the watermaln and
sewer to that point for an additional $1,045 for a total bid of $14,015.00.
As per our discussions, we have notified Channel to proceed. Construction
is set to begin on or about Monday, December 2, 1985.

I WOULD LIKE TO EXTEND MY APPRECIATION TO YOU AND YOUR FELLOW
FIREFIGHTERS FOR THE EXPEDIENT HANDLING OF THE FIRE TO THE
GAS COMPANY PROPERTY ON 7TH AVENUE. THE COLD WEATHER AND THE
HEAVY SNOW HAD TO HAVE MADE YOUR DUTIES VERY DIFFICULT.
FROZEN FINGERS. TOES AND FACES HAD TO HAVE BEEN THE NORM.
MYSELF. AFTER CALLING MY NEIGHBORS. I BUNDLED THE KIDS IN THE
CAR AND TOOK OFF TO WHERE WE DIDN'T KNOW WHERE. THE KIDS AND
I WERE IN A COMPLETE PANIC. FOR THE LAST SIX YEARS OR SO WE
HAVE WATCHED THE COMPANY EXPAND BEHIND US WITH A LOT OF
APPREHENSION. NO ONE HAS BEEN ABLE TO ANSWER ME TO THE FACT
THAT THERE IS NO DANGER OF THOSE MASSIVE TANKS EXPLODING IN A
FIRE SITUATION.
I WOULD LIKE TO KNOW IF THE GAS COMPANY HAS BEEN GETTING
PERMITS FROM THE CITY OF ANDOVER EACH TIME ONE OF THE MASSIVE
TANKS IS BROUGHT IN.
ARE ANY STIPULATIONS OR RESTRICTIONS AS TO THE LOCALITY OF
THE TANKS BEEN IMPLEMENTED.
HAVE BUILDINGS CODES BEEN INFORCED FOR SUCH A HAZERDOUS
OPERATION SUCH AS WELDING ON FLAM ABLE MATERIALS.
DO YOU SUPPOSE THAT SOME TYPE OF EARTH FIRE BARRIER AROUND
THEIR PROPERTY WOULD BE IN ORDER ?
WITH THIS BEING THE SECOND FIRE ON THE PROPERTY IN SIX YEARS
I HOPE THAT THE GOOD CITY FATHERS GIVE THIS A LOT OF
CONSIDERATION WHEN THE GAS COMPANY PUTS IN A RECUEST TO
c:> REBUILD.

street systems and advisabilIty of long, dead-end Cul-de-sacs along
Prairie Road. The plat Is located along PraIrIe Road outside of the
urban service district boundary. this Is a large lot development,
without urban services.

The <leve/oper presented proposal s for ml nor thoroughfares or coil ector
systems which would have an Impact on his proposed plat.
The City Engineer presented alternative routing, as established by
TKDA Traffic Engineer for consideration, to deal with the offset
Intersections of Crooked lake Boulevard, Crosstown Boulevard and
Bunker lake Boulevard.
Future traffic projections from this area at fur I development will
require access, both In an east-west and a north-south direction.
Conti nul ty of Crosstown Boul evard to the south seems to favor the
River Boulevard concept east of Coon Creek. this would allow for a
strip park development In the marginal area between the creek and the
road system, and provide publ Ie access to the creek as a recreation
facility.
Other alternatives were to bisect the development with a north-south
roadway or extend Internal street systems to Jay Street. The most
desl rabl e route woul d be a roadway at the south corporate boundary, to
be shared equally with Coon Rapids, and connect Crosstown Boulevard
with Hanson Boul evard at the south corporate boundary of Andover,
north corporate boundary of Coon Rapl ds. '
MUlti-use zoning would be anticipated within the Good Value Homes
properties to Include a potential commercial development at the
Intersection of Crosstown Boulevard and Bunker lake BOUlevard,
southeast quadrant. It Is anticipated that with full development this
would be a signalized Intersection between Crosstown Boulevard and
Bunker lake Boulevard.
The City Engineer pointed out the necessity of dealing with this
potential problem before development takes place so that the necessary
corridors can be protected. Contact has been made with the County
Engineer, and the County would establ Ish a street system In their
construction program for development of the roadways. It Is
antiCipated that the City would be required to provide the rlght-of-
way and the County would pay al I cost of construction of roadways.
Additional City participation may be required for urban services on a
proportlonment basis for curb and gutter, and storm sewer as the
design might dictate.

The Council referred the suggested roadway routlngs back to the
developer for his Engineer to determine the best use and least Impact
corridors related to the plat development. The Council would
determine which route would be In the City's best Interest.

stated he was prepared to review the consultant report, dated July 15,

RE: Repair of Branch Ditch 58-7 (Informational Meeting)
DATE: December 10, 1985
A meeting will be held in Room "0" of the Bunker lake Activities Center on
Tuesday, December 17, at 7:00 p.m., to discuss the repair of Ditch 58-7.
Items to be discussed are as follows:
The project came about because of flooding to the north of Constance Blvd.
The most immediate concern is to the north because of homes and drainfields
being flooded.
The flooding is due to inadequate flow capacity in the ditch becuse of
siltation and debris such as trees and brush accumulating in the channel.
The ditch will be repaired starting north of 157th Avenue N.W. The first step
is the removal of trees and brush along the channe 1. Trees wi 11 either be
removed or left for the property owners to take care of depending on the land
owner's wishes. Trees will be removed from the bank edge about 10 feet on one
bank and 30 feet on the other. The tree removal will probably be done with a
chain saw and a small bulldozer. The ditch cleaning will be done by a
backhoe. '

Approximately one to two feet of material will be removed from the ditch and
deposited on one or both sides of the ditch. The bottom width of the repaired
ditch will be four feet. The side Slopes will be constructed on a 2:1 side
Slope (one foot rise for every two feet in horizontal distance) until the
existing ground level is reach. The channel will be excavated back to the
grade when it was originally constructed in 1918.
The excavated material will be placed in ridges called spoil piles. These
spoi 1 pi les are placed 10 feet from the edge of the bank and a 3: 1 front
slope, a 10 foot top width and a 3:1 back Slope to the existing ground. The
spoil piles will be Sloped and sseeded with perennial rye grass.
The repair project will be financed using the Ditch #58 Maintenance fund.

Resolution Numb~r 85-382, has acted to increase the SAC rate to
$475.00 effective January 1, 1986. The SAC rate for the cJmmunities
