Project 87-10 A&B - is a well and pumphouse project that is to be
constructed near the County's Public Works
Building. This hearing is required for Bonding
purposes.
The well and pumphouse costs are assessed to
every property that benefits by the project
as a area charge and a connection charge.

These cost were discussed in earlier public
hearings, this hearing will present a more
detailed location of the trunk line and clarify
any questions there may be.
ABOUT 2 WEEKS AFTER THIS HEARING THE CITY COUNCIL
WILL BE HOLDING THE ASSESSMENT PUBLIC ,HEARING FOR,.
THE AREA CHARGES FOR WATER AND SANITARY SEWER.
When your particular project is completed the City Council will hold a
hearing and assess your property for water connection charges, water
and sewer lateral and streets and storm drainage where such projects
are being constructed. A few properties receiving this letter do not
have projects for local improvements, but, are being assessed for the
area water and sewer trunk costs.

This letter is to provide formal notice of the cancellation of the Animal
Control Service Contract now in effect between Lake Animal Care, Inc. and
your community. Under the terms of the contract, 30 days written notice
by either party is required for cancellation thereof. Therefore, please
be advised that effective August 31, 1987, our contract for provision of
animal control service is to be cancelled.
I am sorry for any inconvenience this may cause you. However, I will
remain open for reclaim purposes of the already impounded animals as
required by law after August 31, 1987.

Dear John:
I am writing in response to questions you raised
regarding the issues we've been discussing in the City of
Andover's lawsuit against the Watershed District. First, I
have enclosed a listing of the income and expenditures to
date for Ditch 57. It should be noted that a significant
amount of the expenditures were incurred after and as a
result of combining Ditches 20, 23 and 37 with 57.
Second, I have enclosed a copy of the computations for
Winslow Holasek's property using both the viewers original
methodology and the viewer's proposed revised methodology.
In the revised methodology the viewers would find benefits
as follows:

Zone 1 is defined as any land within 1,320 feet of the

Third, we have been reviewing the dispute regarding the
proper depth of Ditch 57 at the Andover-Ham Lake border,
i.e. Station 2 + 51 to Station 4 + 48. It is our under-
standing that the depth used in Israelson's repair plan is
based on the construction depth and not on the original
construction specification's depth. We believe that the
original construction depth is the proper measure to use in

setting the limits for a repair. That belief is based on
Minnesota Statutes, section 112.65, Minnesota Statutes,
section l06A.701 and the case of Petition of Zimmer, 359
N.W.2d 266 (Minn. 1984). Please review these statutes and
this case.

Bond Market Conditions
The municipal bond market again has proven it can be as volatile as other financial
indices. Tax-exempt interest rates during the first quarter of 1987 hovered close to an
average of 6.60%, during which time a number of refunding programs were successfully
marketed. On Apri I 2 the Bond Buyer's Index increased 16 basis points, and jumped 34
more points on April 9. The Index continued climbing until it reached its peak of 8.31 %
on May 21. Since that time some stability has returned to the market, with the current
Index at 7.81%.
The primary factor in this market disruption appeared to be the weakening of the
dollar, caused in large part by concern over increasing trade deficits and renewed fear
for inflation. Interest rates have dropped in recent weeks as the dollar has
strengthened and investors look for new "crises"in the economy.
Most economists are predicting that interest rates will not undergo significant change
over the balance of the year, and that inflation, as measured by the Consumer's Price
Index will ease to a 4.5% annualized increase over the second-half of 1987, after a 5.4%
annualized climb during the first-half of the year. We continue to advise issuers to
arrange their financing based on the timing of the need for money, not on a perception
of what the market might be. It has been our experience that for every winner in
playing the market, there is an off-setting loser.
Arbitrage Rebate Procedures
We continue to get more questions about this subject than any other aspect of the Tax
Reform Act of 1986. Briefly, the arbitrage rebate requirements are applicable to all
tax-exempt bond issues which are not exempt as outlined hereafter. The basic rule is
that earnings on any investment of gross bond proceeds which are in excess of what
could have been earned if they were invested at the bond rate must be rebated to the
U.S. Treasury. Gross proceeds include original bond proceeds, money provided' for
payment of debt service, and any money provided as a security or reserve for an issue,
regardless of the source of that money.
There are three basic exemptions for new money issuers from the rebate regulations.
First, if all gross proceeds, other than a bona fide debt service fund, are expended
within six months of issuance no rebate is required. Secondly, the rebate monitoring
and payment is not required for issuers of less than $5 million of tax-exempt bonds
(excluding private- activity bonds) in any calendar year, if the bonds are not private
activity bonds and 95% or more of the net proceeds are used for local governmental
activities. The final exemption is for tax and revenue anticipation notes if within six
months of issuance the cumulative cash flow deficit being funded exceeds 90% of the
issue amount.
There is a special exemption for bona fide debt service funds which individually have
annual gross earnings of less than $100,000. If you feel you have debt service funds
established for issues sold after September I, 1986 which qualify or may qualify for this
exemption, we suggest you discuss it in detail with your financial advisor or bond
attorney.
If in any year your issue(s) do not meet one of the tests for exemption, you must
monitor your investment of bond proceeds beginning on the day you receive the
proceeds. You must maintain an annual record of the type and term of investment and

reinvestment rate must be deposited into a separate rebate account, and 90% of the
total of those excess earnings, together with earnings thereon, must be remitted to the '
U.S. Treasury at the end of each five-year period. Final arbitrage rebate regulations
have not been promulgated to-date and no one knows what the exact requirements will
be. However, it is certain that rebate will be required and it will be necessary for you
to start a paper trai I of investments which can be audited.
We believe your external auditor is in a good position to assist you with the monitoring
and reporting requirements at the time they perform your post-audit. SPRINGSTED,

that program.
If you are uncertain as to the overall impact of federal tax reform on your borrowing

meetings to discuss tax reform in greater detail.

Taxable Public Purpose Bonds

We are currently working on a number of bond programs which will have to be issued as
taxable obligations. Most of these issues cannot qualify for tax exemption because
more tl1an 10% of the proceeds are benefiting a private party. These issues are
primarily for tax increment projects.
There is a ready market for these bonds, but at a significant premium over tax-exempt
rates. We have been seeing spreads between taxable and tax-exempt rates of between
2% _ 2.5%. There is also a significant difference in the way investment bankers and
underwriters view the pricing of these bonds. In a recent sale with four bidders there
was a difference of 67 basis points, or 2/3 of I % between the best and the worst bid.
This wide difference supports our contention that a public competitive sale serves the
issuer better than a private negotiation with a single designated purchaser.

Like you, we are still evaluating the significant changes made in public finance and
related matters by the Legislature. While there are a number of legislative summaries
out, one of the best which has come to our attention is the "Summary of 1987 Local
Government Laws," which is prepared and distributed by the Minnesota Department of
Revenue. If you have not received a copy, we commend it to you as a good starting
source of information on changes in property tax administration, tax and levy limits,
local government aid and related tax law changes.

Dear Mr. Koshak:
I have reviewed the information you submitted regarding the proposed
Colonial Creek development including 223 single family lots and an
18-hole golf course. A large share of the project falls within the
100-year floodplain of Coon Creek. The floodplain area is designated
as floodway, for the most part, which prohibits the placement of fill
and structures within the area.
There are three (3) locations where filling will occur within the
floodway:
1) Lot 2, Block 1,
2) Lots 5, 6 & 7 of Block 1, and
3) Lots 53, 54 & 55 of Block 1
The area would be filled to allow development of structures on these
lots. In order to accomplish the filling, the city's floodplain
ordinance would have to be amended. The city's controls allow filling
of the floodway by conditional use permit, but do not allow for
placement of residential structures within the floodway. Therefore,
the map must be amended to remove those areas from the floodway
designating them as flood fringe, which would allow placement of fill
and structures on the above-mentioned lots, Any grading and filling
for the golf course development which would occur in the floodway must
also be authorized by a Conditional Use Permit from the City of
Andover. Grading and filling within the floodway must be analyzed
using the U.S. Army Corps of Engineers (USCOE) REC-I! computer model.
This would evaluate the impacts of the grading and filling on the
stage of the 100-year flood at the site.
I have indicated the appropriate Regulatory Flood Protection Elevation
(RFPE) for the project on the enclosed copy of the Flood Boundary and
Floodway Map. They are somewhat different from the elevations you
indicate on your plans. The elevations indicated are taken from the
Floodway Data Table from the flood insurance study which should be
used instead of the Flood Insurance Rate Map for determining RFPE's.

There are no DNR protected waters or wetlands on the site. therefore
no DNR permit is required to work in protected waters or wetlands. If
the development of the project requires groundwater dewatering to
construct utilities in excess of 10,000 per day or 1 million per year,
a DNR appropriation permit is required as provided in Minnesota
Statutes Chapter 105.41.
In order to resolve the floodplain issues associated with this
proj ect. I recolDlllend we meet at the City offices to discuss time
tables and required data prior to further plan development on this

City Council is requested to review the sketch plan and
comments.
The Andover Review Committee has reviewed the sketch plan and
their comments are as follows:
1. The proposed residential development consists of 57 single
family lots. Most of the lots consist of a lot width of 80 feet.
The ARC recommends the developer to consider the wider lots to
give the landowner the oppurtunity to build the larger homes
(3 car garage/etc...).
2. The City of Andover will need a letter from the DNR indicating
what will and what will not be allowed along protected wetland.
The City and Developer are both responsible to work with the DNR.
3. The Commercial lot may be located in protected wetland. The
boundry of the wetland shall be shown on the preliminary plat.
4. It is recommended by the ARC to eliminate cul de sac in the:
NE corner of the development. SEE SKETCH BY THE ARC TO ELIMINATE
CUL DE SAC.
5. Roadways of street intersections shall be rounded by a radius
of not less than 20 feet. Alsocul de sac corners and the straight
portion the street shall have a 20 foot radius.
6. Lot and block numbers are not correct. This will need to be
changed.
7. Lowest basement shall be located 3 feet above the mottled
soil. Soil borings will be necessary. Also, it is recommended
the watertable be monitored using piezometers.

MOTION by Jacobson, seconded by Perry that the Andover Planning and
Zoning Commission recommend to the City Council approval of a lot
split requested by Anthony Emmerich on the parcel of land described
as 'That part of the SE\ of the NE\ of Section 28, Township 32,
Range 24, in Anoka county, Minnesota lying south of the centerline
of County Ditch No. 57, also known as Coon Creek. Subject to the
right of way of an existing Town Road known as South Coon Creek Drive
as now laid out and travelled along the south line of said SE\ of the
NE~. '
The Commission understands that the center parcel (02) which currently
exists is to be split in half with ISO' of frontage on the west and
172 feet on the east.
The Cnmrnission recommends approval of this with the condition that the
150 foot westerly portion of the lot be attached to the westerly parcel
which is 200 feet in width and will result in a 350 foot wide parcel.
This is to be filed with Anoka County at the same time as the lot split.
The lot split approval is contingent upon payment of the appropriate
park dedication fees.
The Commission finds that the lot split will not be detrimental to surround-
ing properties and will result in lots meeting all minimums of the zoning
districts.

to the right of way of an existing Town Road known as South
Coon Creek Drive as now laid out and travelled along the south

WHEREAS, as a result of such review the Planning and Zoning
Commission recommends approval of the lot split noting the follow-
ing I) the center parcel which currently exists is to be split in
half with 150 feet of frontage on the west and 172 feet on the
east; 2) the lot split will not be detrimental to surrounding
property values; 3) it will result in lots meeting all minimums
of the zoning districts; and
WHEREAS, the City Council is in agreement with the reasons
set forth by the Planning Commission.
NOW, THEREFORE, BE IT RESOLVED by the City Council to hereby
approve a lot split requested by Anthony Emmerich contingent upon
the following:
I. The 150 foot lot and the 172 foot lot shall be combined

Dear Mayor Windschitl:
The City of Andover has made application for conveyance of certain tax forfeited
lands. One of these properties abuts certain land owned by Dorothy Conroy. As you may
be aware, a portion of Ms. Conroy's tennis court is located on this tax forfeited parcel.
Ms. Conroy has contacted the County in the past in an attempt to resolve this matter.
Before acting on the applications from the City of Andover, Commissioner
Haas Steffen has requested that the County Board be given assurances that the Dorothy
- Conroy matter will be addressed by the City in an appropriate manner. I understand from
speaking with Jim Schrantz, City Administrator, that plans for resolving the matter are
included in current City plans for that property. We also understand, however, that the
City Council has not taken any action with regard to finalizing those plans.
I would appreciate your contacting me at your earliest convenience so that we may
explore options for resolving this issue which will address the County Board's concerns in a
manner satisfactory to the City. Thank you very much.

Creekridge Estates between Kerry Street,
Coon Creek Drive and 145th Avenue.
The problem seems to be between the Developer and the New Home
Owners. The backyards need to be shaped and vegitation established
to prevent the erosion.
Many of the Home Owners may not like the steep sloped backyards.
Backyard drainage of this type will have problems and concerns every
time there is a heavy rain this type of backyard storm drainage inthis
subdivision should be avoided at all costs.
I will see if the Developer will help resolve the problem by doing
some grading and sodding.

It is with deep regret that I must turn in my resignation
from the Andover Planning Commission.
I have enjoyed my years with the Commission and it has
been a pleasure to be a part of the governmental unit that
has done so much to make Andover what it is today. The
growth has been enormous. I consider it to be one of the
great opportunities of my life to have served on this
commission.
My place of residence in Andover has been sold and I am
in the process of working with a builder to build a new
home in Elk River. I therefore feel it would be to the

A RESOLUTION ACCEPTING WORK AND DIRECTING FINAL PAYMENT TO S.J. LOUIS
FOR PROJECT 86-9 FOR THE IMPROVEMENT OF WATERMAIN, SANITARY SEWER,
STORM DRAIN, AND STREETS WITH CONCRETE GURB AND GUTTER IN THE FOLLOWING
AREA: WOODLAND TERRACE 4TH AND 5TH ADDITION.
WHEREAS, pursuant to a written contract signed with the City of
Andover on July 1, 1986, S.J. Louis of St. Cloud has satisfactorily
completed the following improvement of watermain, sanitary sewer,
storm drain, and streets with concrete curb and gutter. construction
in accordance with such contract.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Andover,
Minnesota. The work completed under said contract is hereby accepted
and approved; and
BE IT FURTHER RESOLVED that the City Clerk and Mayor are hereby
directed to issue a proper order for the final payment on such contract,
taking the contract's receipt in full.

The City Council is requested to approve the joint powers

Frank checked with other agencies using this same type of system
and concludes that electrical costs run about $1,000.00 per month
and the installation and maintenance costs $1,000.00 per year.
It is then estimated the cost will be 2 months operation or
$3,000.00 this is shared with Coon Rapids so Andovers estimated
cost is $1,500.00.
Since the above was writen, Circle Pines called stating their
electrical costs are $450.00 per month. They budget $4,000.00
for 2 units and operate 2 to 3 months per year.
2 units for 2 months for $4,000.00 is $1,000.00 per month for
2 units.
Converted to Andover/Coon Rapids costs it is estimated 2 months
at $1,000.00 per month to cost $2,000.00 or $1,000.00 for each
city.

A JOINT POWERS AGREEMENT BY AND BETWEEN
THE CITIES OF COON RAPIDS AND ANDOVER
FOR THE OPERATION AND MAINTENANCE OF
AERATION EQUIPMENT FOR
CROOKED LAKE
This agreement made and entered this
day of
, 1987,
by and between the City of Andover, a municipal corporation herein
after referred to as "Andover", and the City of Coon Rapids, a munici-
pal corporation herein after referred to as "Coon Rapids".
WITNESSETH:
WHEREAS, Crooked Lake lies partially within the City of Coon
Rapids and partially within the City of Andover, and
WHEREAS, the cities of Coon Rapids and Andover in cooperation
with the Department of Natural Resources have acquired aeration equip-
ment for Crooked Lake, and
WHEREAS, the said aeration equipment is intended to be
operated for the purposes of maintaining an acceptable desolved oxygen
level for maintenance of fish life within Crooked Lake, and
WHEREAS,
the Minnesota Department of Natural Resources
periodically during winter months checks the oxygen level within
Crooked Lake, and
WHEREAS, the aeration equipment is intended to be operated at
such times as the Minnesota Department of Natural Resources determines
an insufficient deso1ved oxygen level within Crooked Lake, and
WHEREAS, the cities of Andover and Coon Rapids mutually agree
to share equally in the cost of operation and maintenance of said

WHEREAS, Minnesota Statute Section 471.59 authorizes political
subdivisions of the State to enter into joint powers agreements for
the joint exercise of powers to each.
NOW, THEREFORE, it is mutually stipulated and agreed:
1) Purpose
The parties are joined together for the purpose of opera-
tion and maintenance of aeration equipment to maintain
deso1ved oxygen levels within Crooked Lake for the main-
tenance of fish life.
2) Storaqe
The City of Coon Rapids will provide storage for the aera-
tion equipment.
3) Operation and Maintenance Costs
The City of Coon Rapids will provide power and maintain
aeration equipment in reasonable operating condition with
the cost thereof to be shared equally between the two
cities.
4) Insurance
Each party will provide public liability insurance in the
amount of $600,000 for protection against claims for
negligent operation of equipment. A Certificate of
Insurance will be provided to the City of Andover con-
firming such coverage. The City of Andover will provide
to the City of Coon Rapids a Certificate of Insurance
conforming similar coverage.

5) Payment
The City of And~ver agrees to pay Coon Rapids one half of
the cost of operation and maintenance annually within 30
days of receipt of invoice from the City of Coon Rapids.
IN WITNESS WHEREOF, the parties hereto have executed this
agreement by their duly authorized officers and have caused their
respective seals to be affixed hereto.

Crosstown Boulevard storm drainage.
The area along Coon Creek next to Crosstown Boulevard is the area
that is agreeable to the Coon Creek Watershed.
TKDA has also discussed this with MPCA - MPCA does not have a
problem because it is down stream of the landfill, the area is
also outside the fenced area.
