ORGANIZING TI-E ANOKA COUNTY
REGIONAL RAILROAD AUTHORITY
WHEREAS, under the provisions of Minnesota Statutes Section 398A.01 to
398A.09, the Regional Railroad Authorities Act, the legislature of the State of
Minnesota has provided a means whereby a county, with State and Federal aids as may
be available, may provide for the preservation and improvement of local rail service
for agriculture, industry, and passenger traffic when determined to be practical and
necessary for the public welfare; and,
WHEREAS, the Anoka County Board of Commissioners has determined that a
regional railroad authority, acting under the Regional Railroad Authorities Act, is
practicable and necessary for the acquisition of rights-of-way and of abandoned
railroad rights-of-way within Anoka County and that the acquisition and pr~servation
of such railroad rights-of-way is in the best interests of the public welfare; and,
WHEREAS, notice of public hearing upon the adoption of this organizational
resolution has been published in the official county newspaper of Anoka County and
has been mailed to the governing body of each municipality and town within Anoka
County in compliance with Minnesota Statutes Section 398A.03, subdivision 2:
NOW, THEREFORE, BE IT RESOLVED that Anoka County hereby organizes and
establishes the Anoka County, Regional Railroad Authority pursuant to Minnesota
Statutes Sections 398A.01 to 398A.09, the Regional Railroad Authorities Act, as a
political subdivision and local government unit of Minnesota to exercise thereunder
part of the sovereign power of the State; that the Board of Commissioners of the
Authority shall be seven in number and the first Board of Commissioners for the
Authority shall be the members of the Anoka County Board of Commissioners, namely

Anoka, Minnesota; that neither the State of Minn.esota, Anoka County, nor any other
political subdivision is liable for the obligations of the Anoka County Regional
Railroad Authority; and that the purpose of the Anoka County Regional Railroad
Authority is the preservation and improvement of local rail service in accordance with
the powers and authorities granted in Minnesota Statutes Sections 398A.0 I to 398A.09.

Dear Natalie,
Since talking with you on April 27 I have been
updated on the status of the Waste Disposal
Engineering Landfill. Thus, I wanted to share
this information with you via this letter as I will
,be out of the office for a few days.
The regional Environmental Protection Agency (EPA)
office in Chicago has the remedial investigation
report and feasibility study. Now, EPA is modifying the
report to meet the Superfund Amendment and Reauthoriza-
tion Act. The regional office expects this process
may take another month, then the design work could
begin. Following completion of the design plan, the
clean up process could begin. The regional EPA
expects it to be a couple of months before the actual
clean up begins, but they assured me that it would
begin as soon as possible.

COON CREEK WATERSHED DISTRICT
BOARD OF MANAGERS MEETING
APRIL 13, 1987
The Board of Managers of the Coon Creek Watershed District held
their April 13, 1987 at the Bunker Hills Activities Center.
Present: Mel Schulte, Ken Slyzuk, Willis Peterson,
Paul Williams. Absent: Gary Beck.
Others: Ed Matthiesen, Al Sannerud. Absent:
Harold Sheff
Chairman Schulte opened the meeting at 8 o'clock P.M. Willis
Peterson made a motion, seconded by Ken Slyzuk, that the agenda
for the meeting be adopted. Motion carried.
The minutes of the meeting held on March 23 were read. Paul
Williams made a motion, seconded by Ken Slyzuk, that the minutes
of the meeting be approved as printed. Motion carried.
Mel Schulte will attend the Issues and Solutions Watershed
Management Planning meeting at the Earle Brown Center on April 16,
19B7.
Ed Matthiesen reported that Bud Sauter .is wondering when the final
hearing will be held on the Ditch 58 project and when he will
receive his final payment for the work. After discussion, the
Board decided that the final hearing will be held sometime after
they can see evidence that the seeding has been done and the
vegetation starts growing; and then the final payment will be
made. The Board instructed the district administrator to inform
Mr. Sauter of this decision.
Gary Steen from the City of Ham Lake requested that the Board
review the boundary lines of the Coon Creek Watershed District and
the Rum River Watershed District as it pertains to Ditch 28 which
is in the area north of Soderville. The Board is in concurrence
that these boundary lines should be reviewed to make sure that
they are hydrologically correct. The Board instructed the
district administrator to contact the other water management
organizations that represent this area regarding the review.
Mel Schulte made a motion, seconded by Paul Williams, that the
bills as presented at the March 23rd meeting be approved as
presented. Motion carried.

Mel Schulte talked to the Board about some proposed legislation
regarding watershed districts. He said that he has talked to
State Senator Gene Merriam regarding the legislation.
Ed I~atthiesen talked about the Crooked Lake Environmental
Assessment worksheet. The board instructed Mr. Matthiesen to
review the worksheet as to how it affects watershed policy and
then respond to the City of Coon Rapids.
Maurice Hyatt, Al Gillund and Dan Rust appeared before the Board
regarding Ditch 60 in Blaine and Engineer Dick Moore of Short,
Elliot, Henrickson, Inc. presented several drawings of drainage
plans for developments upstream of Ditch 60. They discussed the
feasibility of using the holding pond near Pioneer Village as a
one hundred year holding pond with a blockage in Ditch 60. The
property owners felt that Ditch 60 should not be blocked and that
a 36 inch culvert should be put into the ditch so that there is
continuous flow and the water flows freely through the ditch. Mel
Schulte made a motion, seconded by Willis Peterson, that a 36 inch
culvert should be installed and the excess water should be
diverted into the holding pond, Motion carried. The property
owners were in favor of this motion. The holding pond near
Pioneer Village was discussed and also the question of who would
be responsible for keeping the pond clean.

Ed Matthiesen talked to the Board about DNR Wetland Z-6Z8W. The
board instructed Mr. Matthiesent to talk to John Linc Stine, area
hydrologist from DNR, regarding their concurrence with the
project.
Ed Matthiesen presented a permit application from the Minnesota
Department of Transportation for a ponding area and offtake ditch
adjacent to the Anoka County Airport and County Ditch 41 -- a
Trunk Highway 10, stage 1, project. Mel Schulte made a motion,
seconded by Paul Williams, that the permit application be approved
and ~hat erosion control measures be taken where there is any
movement of water.
The meeting adjourned at 9:55 P.M.

Gentlemen:
Because of City ordinances we were required to submit a preliminary plat for
Hills of Bu~ker Lake to include all the property we own. Therefore the
preliminary plat showed our future possible use for all our property and re-
sulted in a total of 511 residential lots. We did not establish a timetable.
We are aware that the preliminary plat expires July 6, 1987, if not extended.
Since approval of the preliminary plat, we have determined that Phase I would
follow the sewer trunk down to Crane Street and Bunker Lake Blvd, which route
is necessary to serve the County Highway Department. That Phase I has been
approved in its final form and has been filed in the Anoka County Recorders
Office and consists of 149 lots. We intend to request Phase II to include
the land East of Phase I and bounded on the East by the tracks. That Phase
would be 65 lots and we would expect to have them ready for use late in 1987.
Phase III would be that land West of Phase I and bounded on the North by the
neighborhood park including the neighborhood business lots. That Phase would
be for 64 residential lots and the four business lots. From what we know now
we expect this phase to be available in 1988. Phase IV would cover the land
North of Phase III and West of Phase I consisting of 75 lots. We predict this
Phase will carry us into 1989. We are not able to predict when the land east
of the tracks might be developed but it will be the last property developed.
We were asked to have an Enviromental Assessment Worksheet done on the total
project, which has been done and distributed.
During this past week we were advised to stop all work on our project by the
Enviromental Quality Board because the project had not had an enviromental
review.
A meeting was held at City Hall on Thursday, April 30, 1987 and attended by
Greg Downing, EQB; Jerry Windschitl, Mayor; Jim Schrantz, City Administrator,

The purpose of the meeting was to discuss the Enviromental Assessment Worksheet.
At the meeting, we brought out the reason for including all of the property
in the preliminary plat. We also stated that we would not be developing the
property east of the railroad until at least 1990. We therefore request
that our preliminary plat be amended to exclude the portion east of the tracks
which brings the approved preliminary subdivision to 353 lots.
We will proceed to amend our Enviromental Assessment Worksheet to exclude the
portion east of the tracks. This Enviromental Assessment Worksheet will be
distributed and the reviews will take place. It is anticipated the review will
be completed by June 17, 1987.
We agree to draw no more than 99 building permits of the 149 approved lots of
record in Phase I prior to the completion of the Enviromental Review Process
and we also agree not to ask for development of the land east of the Railroad
Track until at least 1990.

**The zoning for Andovers Commercial/Industrial Park is GI (General Industrial).
Most of the uses we have talked about are Commercial or light Industrial.
**According to the research department at the League of Minnesota Cities,
a quorum of the Council is required to approve the minutes.
In a City with a 5 member Council such as Andover, 3 Councilmembers are
needed to approve minutes.
**Josephine Nunn would like to meet with the City Council to discuss planning
for the Metro area. (See 4/21/87 packet)
**We have not responded to the Chambers request for $2000 to aid in bring
the Olympic training facility to Anoka County. (See 4/21/87 packet letter
from Joy Prikl)
**Does Andover want an ad in the League Magazine. See attached.
**Hanson Boulevard needs to have a feasibility report accepted and we must
hold a public hearing. The process was stopped, waiting for costs, etc.

NOTICE IS HEREBY GIVEN that the City Council of the City
of Andover will meet in the Council Chambers at 7:30 P.M.,
Tuesday, May 5, 1987 for the purpose of holding a public

RESOLUTION ESTABLISHING A MUNICIPAL HOUSING AND
REDEVELOPMENT AUTHORITY FOR THE CITY OF ANDOVER, MINNESOTA
WHEREAS:
1. The City of Andover, Minnesota ("City"), finds
that in the City:
(a) There exists substandard, slum or deteriorated
areas which cannot be redeveloped without govern-
ment assistance; and
(b) There is a shortage of decent, safe and sanitary
dwell ing accommodations available to persons of
low income and their families at rentals they can
afford.
2. To these ends and for these purposes, it is
necessary that there be established within the City a Housing
and Redevelopment Authority to function for the purposes of
remedying the above referenced problems.
3. It is recognized that a Housing and Redevelopment
Authority is a means to these ends and that the City is
authorized and empowered to establish a municipal Housi,ng and
Redevelopment Authority under the provisions of Minnesota
Statute S462.425.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Andover, Minnesota, as follows:
1. Establishment of Commission. The powers of the
Authori ty shall be vested in the commissioners thereof then in
office at any time, a majority of whom shall constitute a quorum
for all purposes. Such commissioners shall be five (5) in
number, shall be residents of the City, and shall be appointed
by the Mayor with the approval and consent of the Council.
Those initially appointed shall be appointed for terms of one
(1), two (2), three (3), four (4) and five (5) years, respec-
tively. Thereafter all commissioners shall be appointed for a
five (5) year term. Each vacancy in an unexpired term shall be
filled in the same manner in which the original appointment was
made. Any member of the Council may be appointed and may serve
as a commissioner of the Author i ty. The Council may set the
terms of office for any member of the City Council appointed as
a commissioner to coincide with his or her term of office as a
councilmember. Comm issioners shall hold office until the ir
successors have been appointed and qualified. A certificate of
appointment of each commissioner shall be filed with the City

Clerk and a certified copy thereof shall be be transmitted to
the Commisioner of the Department of Economic Development of the
State of Minnesota. Whenever the membership of the Authority is
changed by reason of a new appointment, a certificate of that
appointment and a certified copy thereof shall be promptly so
filed. A certificate so filed with the City Clerk shall be
conclusive evidence of appointment or change of memberShip.

3. Adoption of By-Laws and Rules. The Authority may
adopt by-laws and rules to govern its procedures and for the
transaction of its business and shall keep a record of attend-
ance at its meetings and of resolutions, transactions, findings
and determinations showing the vote of each member on each
question requir ing a vote, or if absent or if abstaining from
voting, indicating such fact. The records of the Author ity
shall be a public record, except for those items classified by
law as non-public data.
4. Employment Staff. Subject to approval of the City
Council and within limits set by appropriations or other funds
made available, the Authority may employ such staff, techni-
cians, and experts as may be deemed proper, and may incur such
other expenses as may be necessary and proper for the conduct of
its affairs. Members of the Authority may receive a salary or
fee as determined by the City Council for their services and may
receive necessary travel, per diem, and other expenses while on
official business of the Authority if funds are available for
this purpose.
5. Appropriations, Fees and Other Income. The City
Council shall make available to the Authority such appropria-
tions as it deems fit for salaries, fees, and expenses necessary
in the conduct of its work. The Authority shall have the
authori ty to expend all budgeted sums so appropr iated and
recommend the expenditures of other sums made available for its
use from grants, gifts, and other sources for the purposes and
activities authorized by this Resolution.

In response to the agenda item dealing with changing the setback
requirements along major arterial streets from 50 feet to 35 feet,
the fOllowing is offered for your consideration.
What the Ordinance says:
Ordinance No. 10, Section 4 - Definitions: la Arterial Roads
are the major traffic carriers feeding to the state highways
system. Community arterials are comprised mostly of existing
County roads in the Community as defined in the Comprehensive
Plan. Minimum new access spacing shall be 660 feet.
Ordinance No. 10, Section 9.02 Street Plan (c) states: No
preliminary plat shall be approved wherein lots front on the
right-of-way of state, county, or Community Arterial or
Collector roads. Such lots may front on service roads with
entrances to the above or at intervals of 660 feet for
Arterials and 330 feet for Collectors.
Ordinance No. 10, Section 9.06 Lots (g) Access to Thorough-
fares provides that: In those instances where a plat is
adjacent to a limited access highway or other major highway
or thoroughfare, no direct vehicular access shall be permitted
from individual lots to such highway.
As documented above, the Ordinance restricts access onto major
arterial roads and thus, the setback change that is recommended
deals only with sideyard and rearyard setbacks as the City makes,
every attempt to not allow direct frontage onto major arterial
roadways. This item would also apply to new plats. Any existing
lots are weighed on an individual basis and the City uses the
60% figure to determine whether the lot is useable.

A visual inspection of the clearing of Crosstown Boulevard north
of County Road 20 provides a graphic example of why the 50 foot
dimension should be retained. Reducing this dimension to 35 feet
would:
greatly diminish the ability to provide screening on
the parcel (in those cases where this is the lot front
or sideI
provide minimal protection for life and property for
that occasional run-away vehicle that hops the road
bed
limit visual consistency (i.e., the parking of large
vehicles in driveways such as motor homes, large
trucks, etc.)
seriously limit the flexibility of use (except in the
case of the rearyard) in that there is little space
left to work with
be cause for concern as it pertains to the noise level
generated therefrom (screening being limited and still
maintain any yard)
cause great concern from a safety standpoint both in
relation to accesses (which are allowed on a limited
basis) as well as supporting good sound traffic plans
as they pertain to arterial roads.
It is, therefore, the recommendation of the Staff that this section
of the Ordinance NOT BE CHANGED.

MOTION by Pirkl, seconded by Vistad that the Andover Planning
and zoning Commission recommend to the City Council approval
of a variance requested by Al Parent to vary from the front yard
setback and the side yard setback on the property located at
3166 - 149th Avenue N.W. (Lot 6, Block 2, East Round Lake
Estates), for the following reasons:
1) A hardship is created due to a mistake in calculations.
2) It will not adversely affect the existing or potential
use of adjacent land.
3) It is in conformance with the Comprehensive Plan.
4) It is necessary to the reasonable use of the land.
The Planning Commission also recommends that the Council, after
holding a publci hearing, approve the vacation of the utility
easement on the east proper~y line and the drainage easement in
the rear.
Motion carried unanimously.
BUILDING OFFICIAL'S COMMENTS:
Lot 6 Block 2 East Round Lake Estates. High water elevation of 881.5 must be
lowered to 880.0 to accomodate the septic system.
Total storage needed is 0.76 AF or 33,106 Cu. Ft.
Area shown from elevation 877.20 to 880.00 = 11,400 Cu. Ft., therefore,
804 Cu. Yds. must be removed.

1. Front setback - too close to front lot line by
about a foot plus or minus.
2. The back of the house and the septic system encroach
upon the drainage easement. Before a variance can
be granted on this, the owner will have to provide
calculations as to the water storage area required
and the elevation required. The septic system may
have to be moved north out of the easement.
A variance may be granted for the house encroachment
into the drainage easement.
3. Side Yard Setback - The easement is 10' platted;
therefore, the question is, is the 10' utility/
drainage easement necessary? If not, it may be
vacated, corrected on the plat.
If the easement remains, there may have to be a lot
split, taking property from the adjacent lot and
adding it to this lot.

On January 14, 1987 or firm staked a house on the subject lot. A
deck that was proposed for the easterly side of the house was
inadvertently overlooked at the time the house was placed on the
lot. The surveyor, the owner-contractor, and the city building
inspector all failed to notice that the house placement would not
properly accomodate the proposed deck. The house was constructed
at the location shown on the attached site plan.
Due to the unfortunate circumstances in this matter, we ask that
you please give consideration to allow construction of a deck
between the house and the existing easement.

A RESOLUTION APPROVING A VARIANCE REQUESTED BY WILLIAM E. BRAUN
TO VARY FROM THE REAR YARD SETBACK ON THE PROPERTY LOCATED AT
910 - 158TH AVENUE N.W.
WHEREAS, The Planning and Zoning Commission has reviewed
the request of William E. Braun for a variance from the rear
yard setback of 50 feet to 38 feet on property located at 910 -
158th Avenue N.W.; and
WHEREAS, as a result of such review, the Planning and Zoning
Commission recommends approval of the request citing the following
as reasons for approval 1) It will not adversely affect the
existing or potential use of adjacent land; 2) it is necessary
to the reasonable use of the land; 3) by adding the garage and
entry to the house, it will show proper alignment of the front
to 158th Avenue; and
WHEREAS; the City council is in agreement with the reasons
as set forth by the Planning Commission.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Andover to hereby approve the request of William E.
Braun to vary from the rear yard setback on the property located
at 910 - 158th Avenue N.W. from 50 feet to 38 feet.

ZONING ADMINISTRATOR'S COMMENTS:
Pursuant to Ordinance No. 52 known as the Scenic River Ordinance, notice was to have
been forwarded to the Department of Natural Resources thirty (30) days prior to the
planning commission meeting at which this item was discussed.
That criteria was not met.
Further, the Ordinance requires that the City Council shall notify the Commissioner
of the Department of Natural Resources within ten (10) days of its decision.
It is my recommendation that if the City Council approves said variance request, it
should be contingent on receipt of certification from the Commissioner or the passing
of thirty (30) days, whichever occurs first.

A RESOLUTION APPROVING A VARIANCE REQUESTED BY LLOYD BEARL
TO VARY FROM THE SETBACK REQUIREMENT FROM THE ORDINARY HIGH
WATER MARK AND FROM THE SETBACK REQUIREMENT OF 30 FEET FROM
THE BLUFF LINE ON PROPERTY KNOWN AS LOT 4, BLOCK 1, CEDAR HILLS
RIVER ESTATES.
WHEREAS, the Planning and Zoning Commission has reviewed
the request of Lloyd Bearl to vary from the setback requirement
from the ordinary high water mark and from the setback requirement
of 30 feet from the bluff line on property known as Lot 4, Block
1, Cedar Hills River Estates; and
WHEREAS, as a result of such review, the Planning and Zoning
Commission recommends approval of the request, citing the following:
1) A hardship is created due to the topography of the land; 2)
it will not adversely affect the existing or potential use of
adjacent land; 3) it is in conformance with the Comprehensive Plan;
4) it is necessary to the reasonable use of the land; and
WHEREAS, the City Council is in agreement with the reasons
given by the Planning Commission.
NOW, THEREFORE, BE IT RESOLVED by the City Council to hereby
approve a variance requested by Lloyd Bearl to vary from the
setback requirements on property known as Lot 4, Block 1, Cedar
Hills River Estates.

Minnesota, lying East of the West 1216 feet thereof and lying
south of the North 780.14 feet thereof. Except the following
described parcel of land: That part of the Northeast Quarter

described as beginning at a point 951.80 feet South from the
Northeast corner of Section 24~ thence west at an angle of 90
degrees, a distance of 250 feet~ thence south and aprallel with

NOTICE OF PUBLIC HEARING
The City of Andover Planning and Zoning Commission will hold
a public hearing at 7:30 P.M., Tuesday, March 10, 1987 at
the Andover City Hall, 1685 Crosstown Boulevard N.W., Andover,
MN to consider the preliminary plat of Rum River Ranch
Estates being developed by Clyde Smith, legally described
as 'That part of Government Lot 5, Section 13, Township 32,
Range 25, Anoka County, Minnesota described as follows:
Commencing at the northwest corner of said Government Lot
5; thence North .89 degrees 52 minutes 28 seconds East along
the north line of said Government Lot 5 a distance of 215.50
feet, to the point of beginning of the land to be described;
thence continue North 89 degrees 52 minutes 28 seconds East
803.59 feet to a point which is 289.00 feet west of the
northeast corner of said Government Lot 5; thence on a bearing
of South and parallel with the East line of said Government
Lot 5 a distance of 177.50 feet; thence North 89 degrees 52
minutes 28 seconds East and parallel with said north line
289.00 feet; thence on a bearing of South along the East line
of said Government Lot 5 a distance of 287.07 feet to a point
which is 464.57 feet south of the northeast corner of said
Government Lot 5; thence south 89 degrees 48 minutes 17 seconds
West 1055.00 feet more or less to the easterly shore line of
the Rum River; thence northwesterly along said shoreline t6
the intersection of a line which bears South 29 degrees 27
minutes 28 seconds West from the point of beginning; thence
North 29 degrees 27 minutes 28 seconds East 230.00 feet more
or less to the point of beginning there terminating. For the
purpose of this description the East line of Government Lot 5
Section 13, Township 32, Range 25 has an assumed bearing of
South. (approximate location is 159th Avenue and Marystone
Lane) .
All opponents and proponents of said preliminary plat will be
heard at the above time and location.

A RESOLUTION APPROVING THE PRELIMINARY PLAT OF RUM RIVER RANCH
ESTATES BEING DEVELOPED BY CLYDE SMITH IN SECTION 13-32-25.
WHEREAS, pursuant to published and mailed notice, the Planning
and Zoning Commission has conducted a public hearing and reviewed
the preliminary plat of Rum River Ranch Estates being developed by
Clyde Smith in Section 13-32-25; and
WHEREAS, as a result of such hearing and review, the Andover
Planning and Zoning Commission recommends approval citing the
following: 1) the plat has been reviewed by the City Engineer;
2) the plat meets the City ordinances;
WHEREAS, the Park Board recommendation for cash in lieu of
land in the amount of $3,670 has been received; and
WHEREAS, the City Council is in agreement with the reasons
given by the Planning Commission.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Andover to hereby approve the preliminary plat of Rum
River Ranch Estates with the following variances:
1) Lots 3 ~nd 4, Block 1 for lot area.
2) Lots 2, 3 and 4, Block 1 as the width at the front
setback line does not meet the 300 foot requirement.

Dear Paul:
The City of Fridley Public Works personnel have been investigating a
computerized mapping system called Ultimap. This Ultimap System was
developed jointly by the City of MinneaIX>lis and Hennepin County about ten
years ago. The software utilizes AIX>l1o computer equipnent. Many Public
Works Directors in this area and Paul Ruud, Aooka County Engineer, have had
the optX>rtlU'lity to see and re\l'iew the Ultimap demonstrations held by the
HinneaIX>lis Public Works and Hennepin County DefClrtments. If you desire, a
group or individual presentation can be scheduled at your convenience.
The AIX>l1o Ultimap System provides the caJ:6bility of electronic drafting
and computerized mapping for such needs as assessing, engineering,
J:.1&r.Iling, proJ:..erty Oescriptions, utilities, surveying, police and fire
data.
Ramsey ColU'lty and the LCX;IS Consortiun currently purchased the system and
are i)l the process of implementing it. Washington and Dakota Counties are
cooetving Ramsey ColU'lty's process and considering implementation of the
U~iimap System in the very rear future. In order to provide caJ:6bility and
cconsistency within the metroIX>litan area, it is extremely important that
AnO~ColU'lty also adopt the Ul timap System.
Ultimap can be an extremely efficient system for Anoka County and its
cities. Because the foundation for the system is the property section
data, the Anoka County Land Surveying Office is the best organization to
input this information. The County municipalities could then add and
expand the base data for both the ColU'lty and their individual use.

Paul Ruud, the Anoka ColU'lty Engineer, and his staff are supportive of the
Ul timap System but indicated it is essential that the County Camnissioners
become knCMledgeable of our desires and need; in order to incorIX>rate this
requirement into the 1988 Budget cycle.

The City Council is requested to review prior to approval of the Final Plat
for Kensington Estates Phase I.
1) The Final Plat is in conformance with the preliminary plat except for
a couple minor corrections which are recommended to be discussed.
a) 100 year flood plain is needed to be shown along Cdon Creek.
b) In Block 1, Lot 10 it is not indicated on Final Plat.
c) The drainage and utility easement that is needed for the construction of
storm sewers and trunk sanitary sewer along lots 10 & 12 and Lots 11 & 12
where the lots border each other is being determined from the plan
design.
2) The Park Board has made a motion to except cash in lieu of land. Park
dedication is $11,582 for the entire preliminary plat.
3) The City Council has not yet adopted a resolution 'awarding the project for
sanitary sewer, water, streets, etc.
4) The title opinion is being prepared but has not been received by the City
of Andover as of May 1,.1987.
5) The Developer needs to enter into a Development Contract with the City of
Andover. The escrow deposit for the project is $98,672.
6) The Developer shall deposit enough security sufficient to cover legal,
engineering, consulting fees and street signs of $2700 prior to final
plat approval .
7) Site grading to date for Phase I is not complete. Developer shall deposited
a grading escrow which will be determined by the City Engineer.

1. The City must publish a public notice stating that it
(the City) prohibits discrimination based on the
handicap status of the applicant. A sample Notice is
attached for your use.
2. The City must adopt a Grievance Procedure in regard
to any alleged discrimination. The Affirmative Action
Policy No. 10 which presently exists in the City does
not meet the requirements of the law and therefore, the
City must take action to adopt such a procedure.
Attached is a verbatim copy of the recornrnended procedure
as provided by the Office of Revenue Sharing. .
3. The City must conduct a self-,evaluation to determine
whether or not the City facilities meet the require-
ments of handicap accessability and if not, adopt a
transition plan to implement such compliance. The City
council should direct that that evaluation plan be
completed. May I suggest that Dave Almgren and Frank
Stone complete that self-evaluation plan as they are
most familiar with the physical facilities we have at
the City.
I am confident that we will not need to adopt a
transition plan, however, if we do, direction for the
implementation of that plan can come from the City
Council at a later date, if so desired.

its accompanying attachment from the auditor. If yOU have any

31 CFR 51.55 of the Revenue Sharing Regulations, as
published in the Federal Register on October 17, 1983.
Section 51.55 prohibits discrimination against qualified

On October 17, 1983, the Office of Revenue Sharin;) published final
regulations in the Federal Register implementing the handicapped discrimination
administrative requirements (48 FR 46982, 31 CFR 51.55). Sections 51.55(c) and
(k) of the Revenue Sharing Regulations provide that all governments which
receive entitlement funds must prepare a self-evaluation and,~ifdeemed~necessary
by the self-evaluation, ;,a transition plan: Sections 51.55(d) and (e) provide
that governments receiving $25,000 or more per entitlement period must also
designate a program COOrdinator, make a public notification against handicapped
discrimination, and must adopt a grievance procedure. Further, the name of the
coordinator must appear on the public notification. In addition to the notifi-
cation published in the Federal Register, in a series of four letters mailed in
J anuat:y, July, October and November, 1984, the ORS further advised each recipient
of Revenue Sharing Funds of these requirements.
The Office of Revenue Sharin;) is in receipt of an audit report for the year
ending December 31, 1985, prepared by George M. Hansen Canpany (copy enclosed),
which indicates that your government is in violation of the above cited provisions
of the Revenue Sharing Act and Regulations. Specifical1x,th~~portindicates
that your govemnent has failed to make public' notifiCati6nt~adOpta grievance '

appliCable). Please ensure that the deficiencies cited above and in the auditor's

~e have examined the general purpose financial statements of the City of Andover,
Minnesota for the year ended December 31, 1985. and have issued our report
thereon dated Hay 19. 1986. Our examination was made in accordance with
generally accepted auditing standards and. accordingly. included such tests of
the accounting records and such other auditing. procedures as we considered
necessary in the circumstances.
In connection with our examination, we also (1) performed tests of compliance
with the Revenue Sharing Act and regulations as detailed in the "Commentary on
the Audit Requirements of the 1980 Amendment~ to the State and Local Fiscal
Assistance Act" issued by the Office of Revenue Sharing. U.S. Department of the
Treasury, and (2) compared the data on the appropriate Bureau of Census form with
the audited records of the City of Andover, Minnesota.
In our opinion, for the items tested. the City of Andover. Minnesota complied
with the aforementioned provisions of the Revenue Sharing Act and regulations
except for the following matters:
(1) No notice VAS found of a public hearing held prior to enactment of
the budget.
(2) No notice was found of t~e audit reports availability for public
inspection.
(3) Unable to verify that continuing notification of pertinent
information regarding discrimination have been made.
(4) No established grievance procedure was found.
(5) No self-evaluation review of policies. practices. programs, and
activities to determine if they discriminate was found.
(6) Unable to determine that a transition plan has been prepared in
those instances where the self-evaluation indicates that structural
changes to achieve accessibility for the handicapped is required.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Andover
1. The City Council hereby accepts the Feasibility Report for Project No.
87-6, for the improvements of land development, watermain, sanitary sewer,
streets and storm drainage Project No. 87-6 in the NW! of the SW!
Section 34 and along Verdin Street from 133rd Avenue to Bunker Lake Boulevard
area as prepared by TKDA.
2. The council will consider the improvements in accordance with the report
and the assessment of abutting property for all or a portion of the cost
of the improvement pursuant to Minnesota Statutes Chapter 429 at an
estimated total cost of the improvement of $829,000.
3. A public hearing shall be held on such proposed improvement on the
day of , 19 in the Council Chambers of

published notice of such hearing and improvement as required by law.
