Adjournment *Not on published agenda o o WHAT'S HAPPENING? ***CDBG - I told the County that we plan to continue as in 1986 to elimate Blight. See attached project description. I have revised the 1986 CDGB proposed project to include the residential blight in the Nordeen for the 1987 project. 1986 fund must be spent by July 1, 1987 and the 1987 funds by July 1, 1988. We have received the Bever Land appraisal. If we buy this parcel we will spend the 1986 CDBG and the 1987 funds can be used in the Nordeen Addition area. 1987 fund will amount to about $36,000 each year for the next three years. We can revise the project at a later date. The County needed information by the 13th of March so I revised the project per the motion of the Council to consider the Nordeens Addition. We must purchase some parcel by July 1, 1987. ***1 promised not to put the Pocket Gopher bounty on the agenda. Anoka County will pay 40~ per gopher. Helena is not afraid of gopher feet and I am sure would be willing to collect the feet and count them. I discussed this at the last staff meeting and some staff people thought it would be a good idea to have Andover pay 10 or 20 cents additional to help get rid of the gopher problem. We would pay the trappers from petty cash and document for reimbursement from the County at 40~ per gopher. ***Reminder the deadline for the March/April newsletter is March 16, 1987. We need "you" for articles. The editor Valerie is getting tough on me, she wants the newsletter out on April 1st. We should be timely so people that are announcing events can depend on us being published before their event. ***NOTE: George Hoff, the City's Attorney was unable to meet the Council scheduled for March 17 at 7:00. See item 6c resetting the meeting for 3/31/87 at 7:30 pm. THE LIGHTER SIDE OF THINGS ***1 will be in Arizona from 3/15/87 to 3/26/87. I have been called down there to take pictures, horseback ride and sun. Project Name: Andover Economic Development Project & Urban Renewal II, Project Activity: The project is located ln the South ~ of Section 34 and NW 1 of Section 24. The project involves land acquisitions and administrative costs. The neighborhood around the blightedsiteswill benefit, ECONOMIC DEVELOPMENT AREA By iniproving'the area,--new business will be attracted to redevelop the area. The redevelopment will attract new jobs, estimated to be 25 people. URBAN RENEWAL It will improve living conditions and increase land values in the renewal area. III. Project Duration: The project is planned to be a one to three year project with stages to be completed by July 1, 1987, 1988 & 1989. IV. Community Problem Project Addresses: The project will remove blighted areas - a very unsightly junkyard, and some rundown houses. V. Summary of Findings: The total revenue needed for the property acquisition is estimated to be $90,000 with the C.D.B.G. funds needed to be $90,000 for each area. The city will be using tax increment financing and private funding to redevelop other areas. VI. Cost of Activity: Acquisition of property is estimated to be $90,000 with the final appraised value yet to be determined. o o Economic Development Project Page 2 VII. Project Area: The property is about 11 acres in size containing a small pond, This area should be adequate for 8 small businesses or about 1 acres lots. The residential area has about four to five blighted lots. The Economic Development area has ordered water and sanitary sewer trunk for the area which will be constructed in front of the project property. The businesses in the area are estimated to be over 40 years old. The residents are low value and rundown. VIII. Project Part of Large Project: This is the first project in what may be many. The City is establ ishing a tax increment financing project and the City is planning to renovate a much larger area as funding from the T.I.F. becomes available. IX. Project Contact Person: Jim Schrantz, the City Administrator, lS the project person. X. Resolution of City Council: The resolution is pending, XI. The gas pumping facilities will be increased to two islands with 12 hoses. AMENDMENT TO MOTION by Jovanovich, seconded by pirkl that approval fo the amended Special Use Permit is contingent upon the following: 1. Inspection by the appropriate city and state inspectors; 2. Leak detectors will be installed; 3. Construction shall be in conformance with the standards contained in National Fire Protection Association Pamphlet 30, Flammable and Combustible Liquids Code (1973 Edition as amended). James Company to vary from the land- scape requirements of Ordinance 8, Section 8.04 requiring a depth of 20 feet or more along all streets for the following reason: 1) The Commission has considered visibility at this inter- section and consider safety as a primary concern. Twenty feet of green area is necessary to protect safety. It is further recommended that the City Council reduce the size requirement for parking stalls as has been done at the Downtown Center to 9' x 18'. This would still allow for a proper traffic pattern which was the purpose of the proposal. Reasons for approving the 9'x18' parking stall size are: 1) It would not be in conflict with the Comprehensive Plan; 2) It meets the spirit and intent of the zoning ordinance; 3) It would not be detrimental to the health, safety or general welfare of the community. JAMES COMPANY FOR LANDSCAPE REQUIREMENTS ON THE PROPERTY LOCATED AT 13725 CROSSTOWN BOULEVARD N.W. WHEREAS, the Andover Planning and Zoning Commission has reviewed the request of the T.F. James Company to vary from the landscape requirements on the property at 13725 Crosstown Boule- vard N.vJ.; and WHEREAS, as a result of such reVlew, the Planning and Zoning Commission has recommended denial of the variance request, citing as reasons for such denial as 1) visibility at this inter- section and safety are a primary concern and twenty feet of green area is necessary to safety; and WHEREAS, the City Council is in agreement with the reason given by the Planning and Zoning Commission for denial. BY: Vicki Volk MOTION by Bosell, seconded by Pirkl that the Andover Planning and Zoning Commission recommend to the City Council approval of a Special Use Permit requested by Gerald and Carol Windschitl to develop the site identified as Kensington Plaza on a drawing dated February 16, 1987 based on the following criteria: 1) A public hearing was held. Input was received from the public. Concern was expressed regarding the site of the proposed Neighborhood Business area; 'however, it was felt that this is a proper site. 2) Developing this piece of property under a PUD allows flexibility in such things as screening, etc. There are specific restric- tions that also apply and it is felt that with these restric- tions and a commercial site plan application, the City will have proper control for the development of this parcel. 3) The PUD would not negatively impact the environment of the area and does not put itself in conflict with the Comprehensive Plan or its intent or spirit. It was noted that no variances have been requested with the development of this parcel. ~t the time the slte plan is submitted those specifics would be dealt with. R A RESOLUTION APPROVING A SPECIAL USE PERMIT FOR THE DEVELOPMENT OF A PLANNED UNIT DEVELOPMENT IN SECTION 27-32-24 REQUESTED BY GERALD AND CAROL A. WINDSCHITL. WHEREAS, pursuant to published and mailed notice thereof, the Andover Planning and Zoning Commission has conducted a public hearing and reviewed the request of Gerald and Carol A. ITEM Lot Division/Russell- NQ 4.f.Stack Addition BY: James E. Schrantz FOR The City Council is requested to authorize the administrator or clerk to stamp for recording a lot division in the Russell- Stack Addition. The lots in the Russell/Stack Addition were established when they were brought into the city from Ramsey. In 1982 when the city assessed the streets, the lot in question was assessed. Land Purchase/Bever/CDBG 4g BY: James E. Schrantz The City Council has requested Bill Hawkins to get appraisals on the Bever property and the Sonterre property. We have received the appraisal on the Bever property and Bill Hawkins has asked to discuss this with the City Council. 1986 CDBG fund is 100,000 plus with estimated 1987 fund of $36,000. BY: Ray Sowada Attached are copies of Ordinance 63, SeGtion 4 regarding fire code standards. The City Council is requested to read the attached to determine whether NFPA 13-D is a part of the ordinance. On connections for sprinklers, the water line should be before or after the water meter. If it is before the meter, it will eliminate friction loss through the meter. Also, a valve (back flow) should be installed in the sprinkler line. Jeff Meinzer, Brooklyn Park Fire Marshal, said that Olson Fire Protection recommends that a solenoid valve which shuts off the domestic side of the system when the flow switch on the sprinkler system trips should be installed. This would provide better pressure to the sprinklers. The solenoid valve is not required or addressed by the code. Bob Imholt, State Fire Marshal, talked about a bill going to the State Legislature dealing with licensing of sprinkler contractors. The licensing and enforcement would be under the State Commissioner of Labor and Industry. PUBLIC WORKS DIRECTOR'S COMMENTS: Attached is the arrangement preferred by the Building Dept. & Public Utilities Dept. I~ a builder submits a plan for sprinkling, the plan will be submitted to the Flre ~arshal for a~proval ~nd inspecti?n. If installed without a plan submitted, the Flre.Marshal wlll not lnspect the lnstallation. Public Utilities will ckeck to see if there is a back flow valve installed when the water meter is installed. The solenoid valve mentioned in Ray's comments above, would be acceptable to the Public Works and Building Department. ADOPTION OF THE UNIFORM FIRE CODE There is hereby adopted by the City of Andover for the pur-pose of prescribing regulations governing conditions hazardous to life and property from fire or explosion, that certain Code and Standards known as the Uniform Fire Code, including Appendix Chapters l-A, l-B, ll-B, II-C, 11-0, III-A, III-,B, III-C, IV-A, V-A, VI-A, VI-B, VI-C, VI-D, and the Uniform Fire Code Standards published by the Western Fire Chiefs Associations and the International Conference of Building Officials, being particularly the 1982 editions or any subsequent editions adopted by the State of Minnesota thereof and the whole thereof, save and except such portions as are hereinafter deleted, modified or amended by Section 7 of this ordinance of which Code and Standards of which one copy has been and will be on file in the office of the Clerk of the City of Andover and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this ordinance shall take effect the provision thereof shall be controlling within the limits of the City of Andover. SECTION 2. ESTABLISHMENT AND DUTIES OF BUREAU OF FIRE PREVENTION. A. The Uniform Fire Code shall be enforced by the Bureau of Fire Prevention in the Fire Department of the City of Andover which is hereby established and which shall be operated under the supervision of the Chief of the Fire Department. B. The Fire Marshal in charge of the Bureau of Fire Prevention shall be appointed by the voting Fire Department membership and City Council approval on the basis of examination to determine his qualifications. C. The Chief of the Fire Department may detail such members of the Fire Department as inspectors as shall from time to time be necessary. The Chief of the Fire Department shall report to the City Council the employment of technical inspectors, who, when authorization is made, shall be selected through an interview and review written qualifications to determine their fitness for the position. The interview shall be open to members and non-members of the Fire Department and appointments made after examination shall be for an indefinite term. Fire Chief may at his discretion add or delete names of technical inspectors based on their qualifications or their performance. SECTION 3. DEFINITIONS A. Wherever the word 'jurisdiction' is used in the Uniform Fire Code, it lS the City of Andover. o o B. Wherever the words 'Chief of the Bureau of Fire Prevention' are used, they shall be held to mean the Fire Marshal. C. Wherever the term 'corporation council I is used in the Uniform Fire Code, it means the City Attorney of Andover. D. Wherever the word 'Fire Prevention Bureau' is used, shall mean: A fire prevention bureau is established within the Fire Department under the direction of the Fire Chief, which shall consist of such Fire Department personnel as may be assigned thereto by the Fire Chief. The function of this bureau shall be to assist the Fire Chief in the administration and enforcement of the fire provisions of this code. E. Wherever the word 'hotel' is used it shall mean any building containing six (6) or more guest rooms intended or designed to be used, or which are used, rented or hired out to be occupied or which are occupied for sleeping purposes by guests. F. Wherever the words 'apartment house' are used they shall mean any building or portion thereof which contains three (3) or more dwelling units. SECTION 4. AMENDMENTS MADE IN THE UNIFORM FIRE CODE. The Uniform Fire Code is amended and changed in the following respects: Section 2.303 paragraph (b) is amended as follows: Whenever this code is inapplicable for any reason to any situation involving the protection of persons and the materials, method of construction, installations, practices or operation necessary to provide such protection shall, to a reasonable degree, be in accordance with nationally recognized and accepted standards, principles, tests and generally recognized and well established methods of Sixteen (16) Volumes of the 1982 edition of the National Fire Code, of the National Fire Protection Association, technical or scientific organizations, which are adopted by reference as part of this code as though set forth herein. Section 11.204, paragraph (b) is added and reads as follows: a) the use or display of natural or resin bearing trees or decorations in hospitals and nursing homes is prohibited; b) the use, display, or storage of natural or resin bearing trees without open flames or electric light decorations is permitted in schools, churches, places of assembly, hotels and mercantile occupancies; c) the use or display of flame retardant artificial trees decorated with U.L. listed electric lighting systems is acceptable in all occupancies; d) natural or resin bearing trees shall not be stored on balconies or grounds of hotels, apartments, convents or monastaries (each accommodating more than 10 people). Section 11.101, paragraph (a) referenced to Section 4.101 is amended and reads as follows: The Minnesota Pollution Control Agency Rule APC8, Open Burning, 6M.C.A.R. 4.008 as amended on May 13, 1976 is hereby adopted and incorporated into the code in whole as if herein set out in full. This section of the code shall be administered and enforced by the Chief of the Fire Department or his official designee. One copy of this rule APC8 shall be on file in the office of the City Clerk. Section 11.205, paragraph (c) is to be added and reads as follows: It shall be un- lawful for any owner or occupant of any structure containing three (3) or more residential units to maintain in an operable condition or operate within a garage, whether attached or detached, used as an accessory use to such residential unit, the following: 1) an open flame-type heater or stove; 2) welding or torch cutting equipment; 3) any other equipment utilizing an open flame. These lines are included as an aid to the user in identify' ing changes from the previous edition, Origin and Development of NFPA 130 Recognizing the need to reduce the annual life loss from fire in residential occupan' cies (about 50 percent of total loss of life by fire), the Committee on Automatic Sprin. klers appointed a subcommittee in May 1973 to prepare a Standard on the Installation of Sprinkler Systems in One- and Two-Family Dwellings and Mobile Homes. The Sub, committee was composed of members of the Committee on Automatic Sprinklers and other technically competent experts, The standard was submitted and adopted at the Annual Meeting in Chicago, IL on May 12,16, 1975, The 1980 edition was a complete rewrite of the 1975 edition including SI units where appropriate. The 1980 edition incorporated the results of the residential sprin, kler test program administered by the National Fire Protection Association, and fund, ed 'bya research grant from the United States Fire Administration. Factory Mutual Research Corporation and the Los Angeles City Fire Department conducted the dwell, ing tests. Factory Mutual Research Corporation, McNeary Insurance Consulting Ser' vices and the Charlotte, North Carolina Fire Department conducted the mobile home tests. A valve which allows flow in one direc- tion only, Control Valve,* A valve employed to control (shut) a supply of water to a sprinkler system. I Design Discharge. Rate of water discharged by an automatic sprinkler expressed in gallons-per-minute, Dry System. A system employing automatic sprin. klers attached to a piping system containing air under at- mospheric or higher pressures. Loss of pressure from the opening of a sprinkler or detection of a fire condition causes the release of water into the piping system and out the opened sprinkler. Dwelling. Any building which contains not more than one or two "dwelling units" intended to be used, rented, leased, let or hired out to be occupied, or which are occupied for habitation purposes. Dwelling Unit. One or more rooms arranged for the use of one or more individuals living together as in a single housekeeping unit, normally having cooking, liv. ing, sanitary and sleeping facilities, Labeled. A-I-5.1.4 Testing of a system can be accomplished by filling the system with water and checking visually for leakage at each joint or coupling. Fire department connections are not required for systems covered by this standard, but may be installed at the discretion of the owner. In these cases hydrostatic tests in accordance with NFPA 13, Standard for the In. stallation of Sprinkler Systems are required. Dry systems should also be tested by placing the system under air pressure. Any leak which results in a drop in system pressure greater than 2 Ib/sq in. (0,14 bars) in 24 hours should be corrected. The embossed letters on the first street signs purchased by the city have lost all of their reflective paint and cannot be seen at night. Others are missing due to theft or other damage. Some areas of replacement are: Red Oaks: 56 name plates Chapman's: 10 name plates Northwoods 13 name plates Sub 82: 28 name plates Total 107 name plates There are also another 129 name plates around ,the city that must be replaced. The total number of plates to replace is 236 for the year 1987. Earl F. Anderson gave us a bid of $12.95 per name plate for a total of $3,056.20. Gopher Sign gave us a bid of $12.67 per name plate for a total of $2,990.12. We put $1,985 in the budget for new street name plates. I also budget~d $750 for a post puller. But as bad as the street signs look, ihis $750 should be used for signs. The puller can be put in the budget for 1988. This would give us $2,645.00 from the 580 capital outlay of street signs, general. The balance needed, $345.12, could come from 210 Operating Supplies. This should take care of the street sign replacement for 1987. BY: Vicki Volk R The City Council is requested to approve the 1987 junkyard license for Andover Auto Parts. At the Council meeting of February 17, 1987 the attorney was authorized to begin proceedings for revocation of the license because of noncompliance because the insurance had been cancelled and the fire lanes were not clear. Since that time, a new certificate of insurance has been received and the Fire Marshal has inspected the junkyard (see attached report). Approval of the junkyard license is recommended. We are recommending the firm of Eugene A. HICKOK and Associates to provide the technical information and Holmes & Graver (Charles Weaver) to provide the Legal expertise and represent the cities before the County Board and other agencies. If the City Council approves these firms, the Committee will negotiate a work plan and fee schedule to be approved. This year with more streets I estimated around 180 hours or 95 hours per machine. If we go with the low quote, it comes to a total of $9,810. We furnish the water truck and dump truck. We also use our water truck to flush off our streets without curb. With any luck we should have some rain before this time which makes for less sweeping. COUNCIL ACTION MOTION BY TO SECOND BY o o Street Sweeping Page 2 In 1985 Ramsey purchased a Pelican Sweeper for $60,000. For the last two years they have swept up to 80 miles a year with no break- downs. I think that in 1988 we should budget $70,000 in our streets and highway budget for a sweeper. We could sweep our streets up to twice a year. This also saves the storm sewers by not having everything washing down the sewer. The Sanitary Sewer goes to Jay Street and the watermain will serve the County shop. . John will be at the meeting with the plans and specifications and will review them with the City Council. WHEREAS, pursuant to Resolution No. R 020-87, adopted by the City Council on the 12th day of February, 1987, TKDA has prepared final plans and specifications for Watermain and Sanitary Sewer; and WHEREAS, such final plans and specifications were presented to the City Council for their review on the 17th day of March, 1987. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Andover to hereby approve the Final Plans and Specifications for Project No. 87-3A for Watermain and Sanitary Sewer. He said that materials (hoods, engines and vehicles) will be removed and kept out of the fire lanes. A cul-de-sac at the west end will be kept opened for a turnaround. The holes in the fire lanes will be filled with dirt to make the fire lanes passable. Also, the tire pile in the middle of the lot will be handled by the owner to keep the pile small. I will re-inspect the junkyard prior to the city council meeting.
