Dear Jim:
One year ~o, we considered the Minnesota Metropolitan Revenue Distribution Law (Fiscal Disparity
Bill) to be In jeopardy. To protect our interests, we employed the services of Holmes and Graven to
represent school districts and other agencies (municipalities and Anoka County). On the basis of
results, this was a very sound investment.
The 1987 Legislature will be considering proposals to modify and/or abolish the law which has
benefited many North Suburban communities. As a beneficiary of the law, the Anoka- Hennepin School
District is again coordinating an effort to block proposals which would threaten the current system of
distributing revenue. The School Board has authorized the Superintendent to negotiate an agreement
similar to that of one year ago. This agreement (with Holmes and Graven) will stipulate specific
services to be rendered by the firm and the fees to be paid for such services. A maximum of $30,000
has been estimated as the total cost of such representation.
Mr. Charles Weaver, a member of the firm and former legislator, was an original author of the law.
He will be the primary person working on our behalf. However, other members of the firm have
considerable expertise and experience in such matters and seem ideally suited to serve our needs.
In analyzing the degree to which various agencies benefit from the current law, it is proposed that the
Anoka-Hennepin School District assume responsibility for one-half the total cost of such
representation, Anoka County one-quarter, and the remaining quarter divided equally among other
agencies who participate. If the estimated maximum were to be expended, it would cost the school
district $15,000, Anoka County $7,500, and the remaining $7,500 would be divided equally among the
participating agencies.
Loss of revenue generated by fiscal disparity would be a hardShip to those communities located in the
Northern Suburban area. Of course, employment of a representative will not absolve us from actively
working to retain the law. We need to communicate with our legislative delegation and other key
persons. You are urged to consider, at your earliest convenience, this request for assistance and
cooperation.

Disparities (Tax Base Sharing) and discuss
other Legislative items of concern.
UPDATE: As you may recall, the Delegates at the
last AMM Legislative Policy Adoption
Meeting on November 6, 1986
considered a proposed policy dealing with
Fiscal Disparities and sent it back to
Committee for more work. Arter several
meetings and many hours of work, the
Committee has developed a revised policy
proposal for your consideration. The new
proposal was approved by the AMM Board
on February 19th. at special meeting.
PLEASE NOTE:
A. This notice has been mailed to Mayor, Designated
Delegates and Managers/Administratures. Copies of
the proposed fiscal disparities policy have been
mailed to the Chief Administrative Official only
for distibution to Mayors and Councilmembers.
B This issue effects all member cities and we would
encourage each city to have representatives in
attendance to cast your vote (or votes) on this
important matter.

SUBJECT: Fiscal Disparities Recommendations
1. Background. Based on membership action at the November 6, 1986
meeting to refer Fiscal Disparity (F.D.) Policy back to the Revenue
Committee, a small technical committee was formed by President
Thistle and Chairman Fehst to form a recommendation for Revenue
Committee action.
2. Committee. The committee, chaired by Neil Peterson, Bloomington,
included Bob Bocwinski, Columbia Heightsj Charles Darth, Brooklyn
Parkj Barry Johnson, Minnetonkaj Gene Van Overbeke, Eaganj and Dick
Asleson, Apple Valley. The committee met three times and was
monitored by John Anderson, Shakopeej Diane Lynch, St. Paulj Larry
Lee, Bloomingtonj Bill Barnhart Minneapolis, and Jeff Van Wychen,
Minneapolis who also provided computer runs.
3. Recommendation. The sub committee made recommendations to the
Revenue Committee which met and after some modification has
recommended the attached policy that has been changed as follows:
a. The Committee reached an implied agreement that the program was
intended to narrow the disparity in taxable base rather than rates
which imply mill rate which has variable meanings based on location
and/or local options. Therefore the word BASE replaces RATE in
the bold type policy.
b. The Committee unanimously agreed to eliminate G-5 central
administration based on the fact that Anoka County 'indicated a desire
to continue administration and there is not evidence that a change is
neeaed.
c. Specific recommendation for F.D. factors were to modify the
policy on TIF contribution and contribution rate. The contribution
rate to be reduced by 2% per year for 5 years to 30%. Existing pre
1979 TIF value to be held harmless until the existing bonds are paid
with only new value created through issuance of new debt to be
subject to the F.D. contribution.

G-1 TAX BASE SHARING PROGRAM
o
The basic premise for the need for a tax base sharing 'or tax base
redistribution system in this Metropolitan Area, is that much
commercial and industrial (CIl) development occurs based on location
andlor availability of land or particular services. If the seven
county Metropolitan Area were one political and economic unit, such as
the Houston or Omaha areas, the growth of CII development in any part
would benefi t the whole equally and tax base sharing would be
unnecessary. However, in this area with 139 cities plus many townships
and school districts that is not the case. Thus, there are many cities
that because they are fully developed with no room for expansion, or
they are located away from the center of activity without appropriate
services, or have space but are inconvenient from major transportation
facilities cannot attract C/I development. Whereas, others, more
favorably located or serviced cannot keep C/I development away. This
creates a situation, in general, where the tax base value per area,
per household, or per capita is higher, and the taxing ability of the
governmental unit greater, allowing a lower tax rate or collection of
more dollars to provide service. This, also, creates a situation where
two identical CIl facili ties could have a large disparity in their
property tax rates.
THE AMM SUPPORTS A PROGRAM OR PROGRAMS WHICH CONSTRAIN TAX BASE
DISPARITIES IN THE METROPOLITAN REGION WITHIN A REASONABLE RANGE
WITHOUT STIFLING LOCAL INITIATIVES OR UNIQUE COMMUNITY NEEDS.
G-2 OPPOSE DRASTIC CHANGE
To compensate for these dispari ties, the 1971 legislature passed the
Fiscal Disparities Act, with a rather complicated formula, whereby 40%
of all C/I development and inflation growth from 1971 on is contributed
to a Metropolitan Pot and redistributed based on population and fiscal
capacity. After 15 years of operation, the magnitude of distribution
values both in terms of net value decrease and net value increase is
significant for many cities. If fiscal disparities were repealed in
total with no replacement or adjustments, property taxes in many cities
would increase very significantly just as they would decrease in
others.

G-3 FORMULA MODIFICATIONS
The Association of Metropolitan Municipalities has spent two years of
committee work studying the fiscal disparities formula and the affects
of various modificications to that formula. There are basically two
major policy issues that need to be dealt with in a package to
accommodate the majority of cities. The first is a fairness or equity
question that deals with issues such as the 1971 Base value exemption,
<=> equalization of the contribution, minimum distribution, etc. The

expended. Each variable factor has a major impact on a certain subset
of cities and thus changes must be done carefully.
THE AMM MEMBERSHIP SUPPORTS MODIFICATION OF THE FISCAL DISPARITIES
FORMULA THROUGH INCLUSION OF SEVERAL FACTORS AS A WHOLE. ANY CHANGES
OTHER THAN THOSE REFERENCED IN AMM GENERAL FISCAL DISPARITIES POLICIES
OR SPECIFIED HEREIN OR ANY DELETION OR SIGNIFICANT MODIFICATION OF A
SPECIFIC FACTOR LISTED HEREIN WILL RESULT IN THE AMM OPPOSING ANY
FISCAL DISPARTIY LEGISLATION UNLESS OTHERWISE AUTHORIZED BY THE BOARD
OF DIRECTORS.
FORMULA FACTORS:
-PHASE IN 1971 BASE VALUE AT 5% PER YEAR FOR 20 YEARS FOR CONTRIBUTION
PURPOSES. THE BASE VALUE FOR SOUTH ST. PAUL SHOULD BE THE CURRENT
VALUE.
-EXEMPT ALL VACANT LAND FROM CONTRIBUTION.
-CONTRIBUTION VALUES SHOULD BE EQUALIZED TO 85% BY INCREASING THE
PREVIOUS YEARS RATIO BY UP TO 3% OR THE CURRENT RATIO WHICHEVER IS
GREATER.
-THE SALES RATIO FACTOR SHOULD BE BASED ON A SAMPLE WHICH IS
STATISTICALLY SOUND TO REFLECT ACCURATELY THE REALISTIC LEVEL OF
ASSESSMENT. THIS MAY INCLUDE USING A COUNTY WIDE AVERAGE IF AN
APPROPRIATE NUMBER OF SALES HAS NOT OCCURRED LOCALLY. USE OF THE
MEDIAN RATHER THAN AGGREGATRE RATIO SHOULD BE ADOPTED SINCE THIS
MEASURE IS GENERALLY MORE REFLECTIVE OF LOCAL ASSESSING PRACTICES AND
IS LESS SUBJECT TO WIDE VARIATIONS OF SALES.
-REDUCE THE CONTRIBUTION RATE BY 2% PER YEAR FOR 5 YEARS UNTIL 30% HAS
BEEN REACHED. ALL CONTRIBUTIONS THEREAFTER WILL BE AT THE RATE OF 30%.
-THE FISCAL CAPACITY FACTOR SHOULD BE MODIFIED TO INCLUDE
MANUFACTURED HOUSING AND UTILITY VALUE.
-THE POPULATION AND TIMES TWO MULTIPLIER SHOULD BE REMOVED FROM THE
DISTRIBUTION FORMULA AS MINIMUM DISTRIBUTION FACTORS.
-THE TWO DIFFERENT POPULATION YEARS USED TO CALCULATE THE PER CAPITA
MARKET VALUE AND DISTRIBUTION SHOULD REMAIN AS THEY ARE CURRENTLY
WITHIN THE FORMULA.
-EXISTING VALUE IN PRE 1979 TIF DISTRICTS SHOULD REMAIN EXEMPT FROM
FISCAL DISPARITY CONTRIBUTION UNTIL EXISTING DEBT HAS BEEN RETIRED.
NEW VALUE CREATED WITHIN THESE DISTRICTS IN CONJUNCTION WITH NEW DEBT
ISSUED SHALL BE SUBJECT TO FISCAL DISPARITIES CONTRIBUTION.
G-4 TOTAL DISTRIBUTION
There has been some suggestions made to utilize the fiscal disparity
formula as a mechanism to create a separate transportation or
development fund by only distributing 90% of the tax dollars raised.
This would be a hidden property tax.
THE AMM STRONGLY OPPOSES USE OF FISCAL DISPARITIES TO CREATE A
METROPOLITAN TRANSPORTAITON, HIGHWAY, OR DEVELOPMENT FUND.

We also took quotes on lawn and park cleaning units for things such
as leaves, pop cans and branches. Some of our parks in the peat areas
have to be mowed twice a week because of the dead grass build up.
The City Hall front yard also grows very fast and has to be raked or
swept. The little pull-behind sweeps don't hold up to this type of use.
They are mainly for home lawns.
Also, with the City Park Complex being sprinkled, I'm sure we'll have
the same problem. I would hope you would consider the purchase of one
of these units if you bond.

units. MTI has the rubber finger picker plus vacuum.
The John Deere from Scharber and Son is the lowest in price and looks
like a very good unit with a two year warranty.
The Toro we have had for the last three years is also a very good
unit. I think either machine would be a good selection.

I recommend we temporily finance the above equipment from the Equipment Fund
until we have the next equipment bond sale then bond and repay the equipment
fund.

the new exemption of 5000 S.F. instead of 2000 S.F.
The floodproofing regulation we have to adopt because we have flood plains
and flood ordinance #50.
The fee schedule must be adopted separately if different from the Building
Code. The proposed fee schedule is the same as last year's schedule. If
the fee schedule from the 1985 D.B.C. were used the fee for a $100,000 house
would more than double from $507.00 to $1,109.18.

PERMITS AND COLLECTION OF FEES THEREFORE; PROVIDING PENALTIES FOR THE
VIOLATION THEREOF: AMENDING ORDINANCE NO. 19F OF THE CITY OF ANDOVER.
The City Council of the City of Andover does ordain as follows:
Section 1. Building Code. The Minnesota State Building Code, established
pursuant to Mn. Stats. 16B.60 through 16B.73, one copy of which is on file in
the office of the City Clerk is hereby adopted as the building code for the
City of Andover. Such code is hereby incorporated in this ordinance as
completely as if set out in full.
A. Administration required. The following chapter of the code must be
administered by any municipality.
1. Chapter 1300 - Code Administration.
2. Chapter 1305 - Adoption of 1985 Uniform Building code by Reference.
a. Required Provisions - UBC Appendix chapter 35.
3. Chapter 1315 - Electrical Code.
4. Chapter 1320 - Elevators and Related Machines.
5. Chapter 1325 - Solar Energy Systems.
6. Chapter 1330 - Technical Requirements for Fallout Shelters.
7. Chapter 1340 - Facilities for the Handicapped,
8. Chapter 1345 - Minnesota Heating, Ventilating, Air Conditioning, and
Refrigeration Code.
9. Chapter 1350 - Manufactured Homes.
10. Chapter 1355 - Plumbing Code.
11. Chapter 1360 - Prefabricated Structures.
12. Chapter 1365 - Variation of Snow Loads.
13. Chapter 4215 - Model Energy Code Amendments.
B. Administration Optional. The following chapters of the code are not
mandatory but may be adopted without change by any municipality.
1. Chapter 1305.6905 - Special Fire Suppression Systems with Group
B-2 5000 or more gross sq. ft.
2. Chapter 1335 - Floodproofing Regulations, Parts 1335.0300 to 1335.1200,
Sections 200.2 to 205.3.
Section 2. Organization and Enforcement. The organization of the Building'
Department and enforcement of the Code shall be as established by Chapter 2
of the Uniform Building Code 1985 Edition. The Code shall be enforced within
the incorporated limits of the City, and extraterritorial limits permitted
by Minnesota Statutes, 1984.
The Building Department shall be the Building Code Department of the City
of Andover. The Administrative Authority shall be a State Certified "Building
Official".

Section 3.
A. Permits, Inspections and Fees. Permits, inspections, and collection
of fees shall be as provided in Chapter 3 of the Uniform Building Code,
1985 Edition. (The method of establishing permit fees and the amounts of
the permit fees for activities encompassed by the code are a local
option. Local fee schedules should include permit fees for prefabricated
structures and manufactured (mobile) homes.) See attached fee schedule.
B. Surcharge. In addition to the permit fee required by item 1 above,
the applicant shall pay a surcharge to be remitted to the Minnesota
Department of Administration as prescribed by Minnesota Statutes 1984,
Section 16B.70.
Section 4. Violations and Penalties. (The penalty described in the
Uniform Building Code, 1985 Edition, Section 205 as amended shall be in keeping
with Minnesota Statutes 609.033 - 609.034 which provides for a maximum fine of
$700.)
Section 5. ~his ordinance shall become effective from and after its
passage and publication as required by law.

The City Council is requested to approve the water & sewer budget as corrected.
The computer costs were adjusted as requested by the Council.
NOTE: The general fund budget when it was approved proposed! of the cost should
come from the Public Utilities Budget. The general fund budget has $9520 for
principal and interestas, awp,roviedi.
Using 50% General fund and 50% Utilities for the computer principal and interest
and maintenance, the General fund expenditure was $17,484, now with 80%
going to the general fund, the General fund expenditure will be $27,974 or
$18,454 over budget.
As the Public Utilities Budget was presented 2/26/87 the General fund was $7964
over budget.
The surplus in the water and sewer budget is $13,920 as presented 3/3/87.
A Public Utilities employee at $7.00/hr. with over head costs is $16,520Iyear
or for 10 months is $13,760.
WATER CONNECTION CHARGE RE-IMBURSEMENT
In a previous study by the Attorney and Auditor, they believed there were funds
available to temporily fund project 87-3, therefore, if we do not need these
funds to temporily fund 87-3, there should be funds to reimburse the 1975 - 1976
connection ~harge in sewer fund 'A'.

The City Council is requested to approve the resolution declaring the adequacy
of petition and ordering the preparations of a feasibility report.
The petition was for sanitary sewer, watermain and streets. The street part
was crossed out on the petition. This was done because some property owners
had a concern about a paved street increasing traffic.
There are 17 parcels with 9 parcel owners petitioning for improvements. I
did not count the two lots facing Crosstown Boulevard nor did I include
the low land alnng Osage Street.
The petition is adequate.
The feasibility report should be ordered for watermain, sanitary sewer, and
streets. At the public hearing, the petitioners and the Council can decide
on the streets along with the water and sewer.

Jim: In doing some research for Barry Robinson, the question arose
as to whether or not the action of the City Council on February 17th
(excerpt of minutes is attached) constituted "action" by the Council
to deny the license of Andover Auto Parts. In checking with Barry
who in turn checked with Bill, it is felt that the City Council
should "take action" on this license renewal and formally deny the
license based upon the criteria set out; i.e., they are not
currently insured and they do not meet the fire code-requirements.
Therefore, it is requested that this be put on the City Council
agenda tonight as an "add on" and that the Council take action.
Then the applicant needs to be notified of the action taken by the
City Council and apprised of the hearing process as set out in
Section 9 of the Ordinance.

SandY MYrre. operator of the Round Barn - asked if they would be
able to expand their business given the conditions of the permit.
They are considering an expansion If business warrants. Also. they
may want to expand their hours of operation. Council dlscuesed the
hours of operation and agreed It would not be necessary to state them
In the permit. They also advised If there is a desire to Increase
floor space, they would have to come to the City requesting an amended
Special Use Permit.
Counci lman Drttel Changed the Motion to: Item 6, referring to hours
of operation be deleted from the Resolution. Second Stands.

JUNKYARD LICENSE RENEWALS
MOTION by Orttel, Seconded by Knight, that we renew licenses for ATV
Salvage, Bob's Auto Parts. Rite Away Auto Salvage, Commercial Auto
Parts. and Anoka Auto Wrecking by legal description of those
properties for 1987. Motion carried unanimously.
Because Andover Auto Parts is not in compl ictnce with the ordinances,
it was agreed to refer it to the Attorney for legal action.
MOTION by Orttel. Seconded by Elling. that we submit the matter of
Andover Auto Parts noncompliance with the Junkyard Ordinance to the
City Attorney for action of revocation. Motion carried unanimously.
COMMERCIAL BUILDING ORDINANCE
MOTION by Knight. Seconded by Orttel. Ordinance 78. an Ordinance
relating to commercial building construction and setting forth
standards and regulations within the City of Andover as presented with
the change In Section II. A. "All buildings within this district
ahal I be of maeonry construction. Its equivalent or better. Upon
approval of the Review Committee, wood frame may be considered as
equivalent to masonry. Walls of such buildings.....

The City Council is requested to authorize TKDA to continue with the permit
application for project 86-22, Crosstown Relocation.
DeWayne Olson has completed the preliminary work, now the remaining work can best
be done by TKDA as they are developing storm drainage plan for that area.
The work to be done by TKDA is not to exceed $1000 without further Council
action.
