***Anoka County Solid Waste Master plan comment period ends February
16, 1987.
***A decision on the Anoka County Business Assistance Network proposal
has not been made.
***Andover needs to plan how, where, and when TIF moneys are spent for
redevelopment along Bunker Lake Bouelvard.
Contracting with someone to oversee the TIF program, planning
and managing of fund may be a wise use of some of the administrative
funds.
***Ham Lake's Festival is off for 1987. (See Star article)

Planning and zoning
MOTION by vistad, seconded by Jacobson that the Andover
Planning and zoning Commission recommend to the City Council
disapproval of the lot split requested by Sonney and Patti
Lowell for the property at 13990 Flora Street N.W. for the
following reasons:
1) A hardship is not created due to the shape of the land;
2) It will adversely affect the existing use of adjacent land;
3) The lots do not meet the requirements for an R-3 district,
front yard setback and rear yard setback;
4) This lot split would create a butt lot.
Amendment to motion that the Commission finds under Ordinance 40
criteria that lot splits should not be approved if the lots do
not meet the requirements. Ordinance 8 definitions indicate that
the lots do not meet the requirements for lot width and lot depth.
Motion carried unanimously.

The City Council is recommended to table the approval of
the final plat of the Hills of Bunker Lake until the following
items are completed:
a) City Attorney give a title opinion.
b) Project 87-2 has been ordered for sewer and water.
The plat is consistant with the preliminary plat except
the developer needs to make corrections on final plat
concerning the drainage easements involving the 100
year flood plan in Block 10 Lots 6,7.
Note Ordinance 8 allows for~' setback garage side
but Ordinance 10 requires 10' side lot drainage and
utility easements.
Ordinance 10 should be revised to require 5' drainage
and utility easements on each lot.

AN ORDINANCE AMENDING ORDINANCE NO.8, KNOWN AS THE ZONING ORDINANCE
OF THE CITY OF ANDOVER.
THE CITY COUNCIL OF THE CITY OF ANDOVER HEREBY ORDAINS:
Ordinance No. 8 is hereby amended as follows:
Section 3.02 Definitions

Waste Tire: a tire that is no longer suitable for its
original intended purpose because of wearr damage or defect.

Waste Tire Collector: a person who owns or operates a site
used for the storage, collection, or deposit of more than
fifty (50) waste tires.
GGGGG Waste Tire Processor: A person engaged in the processing
of waste tires.
Section 5.03 Special (Conditional) Uses
(B) Criteria for granting Special Use Permits
4. Waste tire collection and processing shall be
permitted by Special Use Permit only in a GI
District, subject to the following:
a. Detailed drawings of the parcel shall be
submitted including the dimensions of the
parcel, the location of any buildings, and
the location of the waste tires.
b. Detailed drawings of the waste tires including
twenty (20) foot fire lanes separating any
buildings from the tires and such other fire
lanes as may be required by the City Fire Marshal.
c. A general inventory of said waste tires in-
cluding a maximum inventory anticipated.
d. Location and type of fencing and/or screening
so as to completely enclose and protect from
public view said waste tires.
e. The applicant shall provide such other information
as the City may require to determine whether or not
the proposed use will be a nuisance or will be
harmful to the health, safety or general welfare
of the Ci_~
f. Subject to inspection and annual review by the
City.
Section 7.03 Special Uses:
INDUSTRIAL DISTRICTS

GI District Only:
Waste tire collection and processing
Section 8.01 Exterior Storage:
lfl In GI Districts
1. Any waste tire collector or waste tire
processor which has more than five hundred
(500) waste tires in their possession within
the City shall obtain a Special Use Permit,
except as provided herein.
2. No person shall transport or cause to have
transported any waste tires to any area
within the city which will cause to exceed
five hundred (500) waste tires at any site
unless:
a. The site is exempted from the above
requirements as set out in Section 4
below.
b. The site has been granted a Special Use
Permit.
c. The site is a licensed Solid Waste Dis-
posal site so designated by the CitYr County
of Anoka and State of Minnesota.
3. No waste tire collector or waste tire processor
shall be sited in any residential district.
4. A Special Use Permit is not required for:
a. A retail tire seller for the retail selling
site if no more than five hundred (500)
waste tires are kept on the premises;
b. An owner or operator of a tire retreading
business for the business site if no more
than three thousand (3,000) waste tires
are kept on the premises;
c. An owner or operator of a business who,
in the ordinary course of businessr removes
tires from motor vehicles, if no more than
five hundred (500) waste tires ate kept on
the premises.

THE CITY COUNCIL OF THE CITY OF ANDOVER HEREBY ORDAINS:
Ordinance No. 40 is hereby amended as follows:
SECTION V - FEES
B. Where parkland was dedicated or a park fee paid at the time
the original parcel was created, there shall be no park fee
assessed or land dedicated at the time of the lot split

nor land dedicated as set out in B above, the park fees shall
be assessed at ten percent (10%) of the value of the newly
created lot at the time of the lot split, or ten percent (10%)
land dedication in lieu thereof, as set by City Council
resolution for each lot created under this ordinance.

MOTION by Jacobson, seconded by Rogers that the Andover
Planning and Zoning Commission recommend to the City Council
adoption of an ordinance known as \IAn Ordinance Relating to
Commercial Building Construction and setting .1;orth Standards
and Regulations with. the City of Andover", with. the follow-
ing changes to the dra.1;t: It Section III, Other General
Requirements, will be deleted; 2I Section 1.1, Building Con-
struction Standards, Subsection A, the last sentence will be
deleted. Also, in Section II, the first sentence will read
'All buildings, except by Special Use J'ermit, shall be con-
structed. . . . '
The coriunission recommends adoption 0.1; this Ordinance as
revised for the reasons set .1;orth. in Section I, Statement of
Legislative Purpose and Intent.
It should be noted that a public hearing was held and there
was no public input.
Motion carried unanimously.
STAFF COMMENTS:
We request Section II, Building Construction Standards,
Subsection A, remain as proposed. The whole intent of this
Ordinance was to eliminate the metal roof, metal sides, and
the pole barn look of newly constructed buildings and to
upgrade the City in the commercial area.
We request that Section 3, Other General Requirements, and
Subsections A and B not be removed for the following reasons:

Commercial Development Ordinance
It was assumed that the matter of exterior storage is handled
in Ordinance 8, Sections 4.31 and 8.01. We would like to
draw your attention to just a couple of after-the-fact
problems. .
In Section 4.31, Exterior Storage, the section provides that
the governing body may order ... a special use permit ...
provided it is found that said us.e constitutes a threat to
the public health .... This section deals with an after-
the-fact problem in regard to exterior storage Copen usel.
In Section 8.01, Exterior Storage, (Bl In All Districts,
again it provides that the governing body may require a
special use permit for any exterior storage if it demonstra-
ted that such storage is a hazard to the public health ....
Again, by and large, this would apply to an after-the-fact
situation upon which. the City has received a complaint.
Section 3 of the proposed Ordinance gives guidelines and
parameters under which to operate before the fact.
Therefore, we request that that section remain in the
proposed Ordinance.
To add the language "except by Special Use Permit" without
having specific criteria for granting the special use
permit is not enforceable.
We further recommend that the Ordinance he entitled "An
Ordinance Establishing Standards for Commercial Development
within the City of Andover" so that it not only includes the
actual building construction but also the landscaping,
exterior storage, etc.
AS stated before, the purpose of the proposed Ordinance is to
exclude tile pole type building in the.coironercial districts of
the City.

The City Council of the City of Andover hereby ordains:
I. STATEMENT OF LEGISLATIVE PURPOSE AND INTENT
The City Council of the City of Andover. Minnesota finds that
certain lands within the City of Andover are uniquely suited
for light industrial development, by reason of their proximity
to major transportation routes, soil type and quality. adjacent
land uses. and market value. In order to preserve the general
welfare and safety of the citizens of Andoverr to promote
economic growth and employment opportunity, to promote orderly
industrial growth and to protect and enhance a substantial
municipal investment in industrial park improvements, the City
of Andover finds it necessary to implement zoning controls with-
in the lands zoned industrial and commercial.

B. Fencing
In order to discourage theft and attractive nuisance, no
fence. shall be permitted which..does not. completely screen.
the contents of the fenced area from exterior view. Where
chain link type fencing is used, such fencing shall be fully
screened either by the use of vegetation or shrubbery, or by
the use of other additional fencing made of totally opaque
materials. The fencing is to be a minimum of 6 feet high and
a maximum of 12 feet high.

Landscaping and Ground Cover

All areas of any lot in any area not utilized for building
location, sidewalks, parking areas, storage areas. or
driveways, shall be covered with a suitable ground cover,

All exterior areas which will be open to the general
public or to employees for the purpose of ingress or
egress [rom tile buildings, or for the purpcsc of loading
or unloading supply trucks or other vehicles, or for the
purpose of parking light trucks or passenger motor vehicles,
other than for storage of such vehicles, shall be paved
with bituminous material or concrete.

III. OTHER GE~ERAL REQQ~REMBNT$~
A. Outside Storage
There shall be no outside storage of any inventory. waste
material. refuse. parts, raw materials. or any other loose
items. or items used in connection with the activities
carried on on any parcel, unless such storage be totally
and completely screened from view by fencing which meets
the above criteria. In addition, no motor vehicles shall
be parked upon any premises overnight, unless the same be
stored indoors, or totally screened from view. That
containers used for periodical pickup will be permitted.
No hazardous materials of any sort shall be stored outside
in any type of containers.
B.
Semi-Trailers
Semi-trailers utilized on any commercial or i.ndustrial
parcel of land for the delivery or pickup of materia Is used
in connection with the owner's business may be stored or
p.:ld:...:d in iln area that is not screened from vie,.; for con-
tinuous time periods of not more than seven (7) days, and
not to exceed ten (10) days in any given month. The usage
of such semi-trailers for warehousing or storage of any
type of materials is prohibited, and such usage shall be
limited strictly to items either being shipped to the
business or being shipped from the business. The parking
of any semi-trailer in excess of the above limits shall
be limited to areas which are totally screened from view.

IV. NON-CONFORMING USES AND STRUCTURES
A. Any structure or use lawfully existing upon the effective
date of this Ordinance may be continued at the size and
in manner of operation existing upon such date as herein-
after specified.
'B. No structural alteration shall be made.

c. Whenever a non-conforming structure shall have been damaged
by fire, flood, explosion, earthquake, war, riot or act of
God, it may be reconstructed and used as before if it is
reconstructed within twelve (12) months after such calamity.

V. PENAI,TY
Any person who violates any provision of this ordinance shall
be guilty of a misdemeanor and upon conviction thereof, shall
be punished according to prevailing State Laws.

MOTION by Sabel, seconded by Kieffer to request the City Council
to direct Frank Stone, Public Works, to go out for bids for grading of
Hawkridge Park as shown on attached grading plan with the change of the
soccer field being moved to the west (about fifty feet) as shown on the
plan. The cost of grading cannot exceed $23,000. Motion carried
unanimously.
Note: This plan was originally approved 3/25/85 but money was not
available at that time.

This is to notify you that the Anoka-Hennepin District No. 11 School Board
has rejected the proposed site for an elementary school on the/county land
at Hanson Boulevard and Bunker Lake Boulevard. The site that is preferred
is the city land just south of your City Hall, however, we would have to
have municipal sewer and water.
We hope that we can settle this as soon as possible because we need to have
a school ready to go by August, 1988.
Please let me know if there is anything we can do to help expedite this
ma tter.

WHEREAS, the City Council has reviewed the feasibility study and declares
the improvement feasible, for an estimated cost of $1,227,000.00.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Andover to hereby receive the feasibility report with an estimated total cost
of improvements of $1,227,000.00, waive the public hearing and order the improvement
of sanitary sewer, watermain, storm drain and streets with concrete curb and
gutter for Hidden Creek East under IP NO. 87-1.
BE IT FURTHER RESOLVED by the City Council to hereby direct the firm of
TKDA to prepare the plans and specifications for such improvement project.

Avenue.
Coon Rapids per previous agreement have let the improvement for
Water, Sanitary Sewer, Storm Drainage and 133rd AVenue street
construction from relocated CSAH 18 and Jay Street.
The plan is to construct a 44' street for an Andover cost of
$150,285 for the 22' street width (18' section is $127,743).
Coon Rapids is constructing the utilities under the roadway.
Coon Rapids has taken bids and will start the construction this
spring. The street has been graded by the developers in the area.

Subject: 133rd Avenue Improvements
Dear Jim:
Enclosed per our most recent conversation is a joint powers
agreement calling for the City of Coon Rapids to construct various
utilities and street within the 133rd Avenue alignment in the
City of Andover and spelling out the cost to the City of Andover
for these improvements. Enclosed is also a breakdown of the cost
to the various properties within the City of Andover and a calcu-
lation sheet indicating engineering, administration, fees, etc.,
that will be added to the construction cost. We do need a decision
from Andover on the pavement width on 133rd Avenue collector. As
can be seen by the cross breakdown, the difference in cost going
from a 18 foot half section to a 22 foot half section, amounts to
$12,500. As you are aware the City of Coon Rapids, at the pre-
sent time, is proceeding on the basis that a 44 foot pavement
will be constructed.
Please have this agreement executed at your earliest possible
convenience and return a signed copy to me for Coon Rapids
execution.

A JOINT POWERS AGREEMENT BY AND BETWEEN THE
CITIES OF COON RAPIDS AND ANDOVER FOR THE
CONSTRUCTION AND MAINTENANCE OF CERTAIN PUBLIC UTILITIES
WITHIN THE CITY OF COON RAPIDS
AND THE CITY OF ANDOVER
This agreement made and entered this
day of
1987, by and between the City of Coon Rapids a municipal corporation
herein after to referred to as "Coon Rapids", and the City of Andover
a municipal corporation, herein after referred to as "Andover".
WITNESSETH:
WHEREAS, Coon Rapids and Andover share a common border, and
WHEREAS, development in both cities along said common border
is either occurring or expected to occur within the near future, and
WHEREAS, the City of Coon Rapids proposes to construct
various public improvements including sanitary sewer, watermain, storm
drain, and street which will serve areas in Andover as well as areas
in Coon Rapids, and
WHEREAS, a determination has been made by the City Council of
both communi ties that such improvements should be constructed, and
WHEREAS, the City of Coon Rapids has prepared plans and spe-
cifications for Coon Rapids Project 86-38 and which are on file in the
office of the Coon Rapids City Engineer, and
WHEREAS, said plans include utility and street construction
within the City of Andover, and
WHEREAS, said utility and street construction benefits areas
within the City of Andover as well as the City of Coon Rapids, and
WHEREAS, the cities mutually agree to share in the cost for
such improvements on the basis of the relative benefit to properties
c:> lying within each municipality, and
WHEREAS, Minnesota Statute Section 471.59 authorizes politi-
o ca1 subdivisions of the State to enter into Joint Powers Agreements
for the joint exercise of powers to each.
NOW, THEREFORE, it is mutually stipulated and agreed:
1. Purpose: Parties are joined together for the purpose of
construction of roadway, storm drainage, sanitary sewer,
and watermain wi thin proposed 133rd Avenue and areas
south of 133rd Avenue within the City of Coon Rapids as
described in the plans and specifications Coon Rapids
Project 86-38 on file in the office of the City Engineer,
Coon Rapids, Minnesota and incorporated herein by
reference.

2. Method: The City of Coon Rapids will provide all
engineering services and shall cause the construction of
said Coon Rapids Project 86-38 in conformance with said
plans and specifications.
3. Improvements: Improvements to be constructed shall be as
indicated in attached Exhibit A.
4. Cost: The project cost of the work shall constitute the
actual "construction cost" and shall be so referred ~ to
herein. "Estimated cost" are good faith projections of
the cost which will be incurred for this project. Actual
cost may vary and shall be the cost for which the City of
Andover will be responsible. The estimated cost to the
City of Andover is $296,206.00. This estimated cost includes
$222,711.00, construction cost plus an estimated 33% for
engineering, staking and inspection, administration,
advertising, construction interest, and assessment
spreads.

Ci ty of Coon Rapids will provide the City of Andover
c:> with a final cost broken down into various elements i.e.,
sanitary sewer, watermain, storm drain, and street and
broken down into benefits to individual properties within
the Ci ty of Andover. Upon completion of construction,
the City of Andover will pay to the City of Coon Rapids
upon written demand by the City of Coon Rapids, its por-
tion of the construction cost of the project estimated at
$296,206.00.
5. Sewer Availabilit.y Charges: One lot within the City of
Andover is proposed to be served through the City of Coon
Rapids lateral sewer and water system. Upon issuance of
a building permit on said lot, Andover will collect a
sewer availability charge equal to that charged by Coon
Rapids. Said charge will be paid for by Andover to Coon
Rapids for payment to the Metropolitan Waste Control
Commission.

6. Sewer and Water Services Charges: Upon connection to the
Coon Rapids sewer and water system, the property owner
will be billed for sewer and water service in accordance
with Coon Rapids' policies and rates. Should the property
owner fail to pay charges when due, or when found
uncollectable through normal Coon Rapids collection
processes, the City of Andover agrees to assume any
unpaid charges, including any penalties and interest, and
to pay upon request to the City of Coon Rapids said
delinquent sums. The City of Andover would then have the
option of special assessing these charges back to the

property from which the charges are due.
7. Maintenance: Each community will be responsible for
maintenance of utilities within its respective community
including maintenance of 133rd Avenue. It is hereby
agreed that l33rd Avenue will be sealcoated at five year
intervals with such sealcoating costs being shared by
each community based upon the proportional area lying
wi thin each respective city. Coon Rapids and Andover
will jointly agree upon the contracting agency prior to
any sealcoating commencing.
8. Emergency Water System Interconnect: The proposed system
includes emergency interconnect between the two com-
muni ties. It is mutually agreed that the interconnect
shall not be used without specific approval from the
Mayor, City Manager, or other authorized official of both
communities.
9. Contracts and Purchases: All contracts let and purchases
made pursuant to this agreement shall be made by the City
of Coon Rapids in accordance with applicable state laws.
10. Strict Accountability: The strict accounting share made
of all funds and report of all receipts and disbursements
shall be made upon request by either party.
11. Indemnity Notification: The City of Coon Rapids agrees
to indemnify and hold harmless the City of Andover from
any claims, losses, costs, expenses or damages resulting
from the acts or emissions of its respecting officers,
agents, or employees relating to activities conducted
under this agreement.

12. Entire Agreement Requirement of A Writing: It is under-
stood and agreed that the entire agreement of the parties
is contained herein and this agreement supersedes all
agreements and all negotiations between the parties
relating to the subject matter thereof as well as any
previous agreement presently in effect between the
parties relating to the . subject matter thereof. Any
alterations, variations, or modifications of the provi-
sions of this agreement shall be valid only when they
have been reduced to writing and duly signed by the
parties therein.
IN WITNESS WHEREOF, the parties hereto have executed this
agreement by their duly authorized officers and have caused their
respective seals to be affixed hereto.

The City Council is requested to approve the joint powers
agreement with Anoka County and Coon Rapids for the construction
of CSAHl18 (Relocated Crooked Lake Boulevard).
Note in the cost sharing exhibit "A" that the city pays for
50% of the concrete curb and gutter, 100% of the sidewalk, 100%
of the right of way and the city's share of the drainage.
The city will access its cost to Good Value Homes which in this
case would be curb and gutter, sidewalks if any and the city's
share of the strom drainage. The right of way has been dedicated.

Agreement as revised in accordance with our meeting Friday,
January 23, 1987. Please present this Joint Powers Agreement to
your City Council at your earliest convenience for their
consideration. Upon their authorization of signing this
agreement, please notify me so that I might circulate four (4)
copies of the total agreement for signature. After the agreement
is approved by both City Councils, I will send four (4) copies to
the City of Andover and request that after they are signed,
Andover forward all four copies to Coon Rapids after which Coon
Rapids will return them to the County for County signature. When
the agreements are fully executed, I will send you a copy of the
completed document. In the interm you will have the copy
enclosed for your records.

JOINT POWERS AGREEMENT
o This Agreement made and entered into this day of
1986, by and between the County of Anoka, State of Minnesota, a political subdivision of
the State of Minnesota, 325 East Main Street, Anoka, Minnesota, 55303, hereinafter
referred to as "County," the City of Coon Rapids, 1313 Coon Rapids Boulevard, Coon
Rapids, Minnesota, 55433, hereinafter referred to as "Coon Rapidsn, and the City of
Andover, Community Center, 1685 Crosstown Boulevard N.W., Anoka, Minnesota, 55303,
hereinafter referred to as n Andover. n
WITNESSETH:
WHEREAS, the parties to this Agreement desire to jointly realign C.S.A.H. 18
(Crooked Lake Boulevard) between T.H. 242 and 139th Avenue N.W.; and;
WHEREAS, the parties agree that it is in their best interests that the cost of said
project be shared; and,
WHEREAS, said work will be carried out in accordance with the provisions of Minn.
Stat. S 471.59.
NOW, THEREFORE, IT IS MUTUALLY STIPULATED AND AGREED:
1. PURPOSE
The County, Coon Rapids and Andover have joined together for the purpose of
constructing a new road north from T.H. 242 near Coon Creek to connect with existing
C.R. 18 at approximately 139th Avenue as described in the plans and specifications on file
in the Anoka County Highway Department, Anoka, Minnesota.
2. METHOD
o
All work contemplated by this Agreement shall be mutually agreed upon by all
parties. The alignment shall be mutually agreed to by the County, Coon Rapids and
Andover. Coon Rapids and Andover shall be responsible for the cost and acquisition of
right-of-way for the alignment in their respective jurisdictions. The right-of-way must be
at least 120 feet wide from T.H. 242 for a distance of 500 feet. The right-of-way for the

remainder of the alignment must be at least 100 feet wide in the urban sections and 120
feet wide in the rural design sections and 120 feet wide for a distance of 500 feet north
and south of Bunker Lake Boulevard.
Coon Rapids and Andover must acquire all necessary permits from the
Department of Natural Resources and Corps of Engineers necessary for roadway
construction in their respective jurisdictions.
Actual design and construction may be done by either the County, or Coon
Rapids or Andover, in their respective jurisdictions. Design and construction shall be in
accordance to County State Aid standards. If either Coon Rapids or Andover designs and
constructs segments of the roadway in their respective jurisdictions, repayment by the
County to Coon Rapids or Andover will be made only after the County, Coon Rapids and
Andover agree to an alignment of the road; all necessary permits are obtained for the
entire project; all right-of-way necessary for the realignment is acquired by Coon Rapids
and Andover; and at a time when funds are available to the County.
A t the completion of all construction contemplated herein, the County shall
take those steps necessary to revoke the designation of the existing C.S.A.H. 18 alignment
from T.H. 242 to l39th Avenue N.W. as a County State Aid Highway and, upon approval by
the Commissioner of Transportation, State of Minnesota, shall quit claim all its interest in
said roadway to Coon Rapids and Andover. Upon said revocation, Coon Rapids and
Andover hereby agree to accept said segment of road lying within their respective
jurisdictions as a city street.
3. COSTS
Construction and design costs will be divided between Coon Rapids, Andover
and the County according to Exhibit A, attached hereto and incorporated herein by
reference.

4. TERM
This Agreement shall continue until (1) terminated as provided hereinafter, or
(2) until the construction provided for her.ein is completed and payment provided for
herein is made, whichever of (I) or (2) shall first occur.
5. DISBURSEMENT OF FUNDS
All funds disbursed by the County, Coon Rapids or Andover pursuant to this
Agreement shall be disbursed by each entity pursuant to the method provided by law.
6. CONTRACTS AND PURCHASES
All contracts let and purchases made pursuant to this Agreement shall be
made by the County, Coon Rapids or Andover in conformance to the State Laws.
7. STRICT ACCOUNTABILITY
A strict accounting shall be made of all funds and a report of all receipts and
disbursements shall be made upon request by any party.
8. TERMINATION
This Agreement may be terminated by either party at any time, with or
without cause, upon not less than thirty (30) days written notice delivered by mail or in
person to the other party. If notice is delivered by mail, it shall be deemed to be received
two days after mailing. Such termination shall not be effective with respect to any
solicitation of bids or any purchases of services or goods which occurred prior to such
notice of termination.
9. MAINTENANCE
The new roadway will be maintained by the County. The existing
C.S.A.H./County Road 18 alignment will become part of the Coon Rapids and Andover
street system and will be maintained by the respective cities.

10. AFFIRMATIVE ACTION
In accordance with the County's Affirmative Action Policy and the County
Commissioners' Policy against discrimination, no person shall illegally be excluded from
full time employment rights in, be denied the benefits of, or otherwise be subject to
discrimination in the program which is the sUbject of this Agreement on the basis of race,
creed, color, sex, marital status, public assistance status, age, disability, or national
origin.
11. INDEMNIFICATION
Coon Rapids, Andover and the County mutually agree to indemnify and hold
harmless each other from any claims, losses, costs, expenses or damages resulting from
the acts or omissions of the respective officers, agents, or employees relating to
activities conducted by the parties under this Agreement.
12. ENTIRE AGREEMENT/REQUIREMENT OF A WRITING
It is understood and agreed that the entire agreement of the parties is
contained herein and that this Agreement supersedes all oral agreements and all
negotiations between the parties relating to the subject matter thereof, as well as any
previous agreement presently in effect between the parties relating to the subject matter
thereof. Any alterations, variations, or modifications of the provisions of this Agreement
shall be valid only when they have been reduced to writing and duly signed by the parties
herein.

The County pays for 10096 of a Standard Median Design such as plain concrete. If a
community requests decorative median such as red brick, stamped concrete, or
exposed aggregate concrete the City will pay the additional cost above the cost of
standard median.

In communities less than 5,000 people the County pays for 10096 of the cost of the
.. traffic signal effective in March of 1986. The County collects on behalf of the
cities (less than 5,000) "Municipal State Aid Dollarsn since they do not themselves
qualify for state aid funds. These funds are used to pay the City Share.

In the event that the City requests purchase of right-of-way in excess of those
right-of-ways required by county construction the cities participate to the extent an
agreement can be reached in these properties. For instance a city may request a
sidewalk be constructed alongside of one of our roadways which would required
additional right of way, in this case the City may pay for that portion of the right of
way.

The City Council is requested to review the attached staging
of trunk sanitary sewer map and water trunk benefit map.
The staff has redrawn the January 14th map from the input at
the public hearing.
The hearing was continued to February 12, 1987 at 7:30 pm.
at which time further comments on the redrafted map may be
received.
The plan is to mail the attached revised sewer map and water
map to the respective benefit areas along with a cover letter
to the same property owners as before, advising them of the
continued public hearing and that we plan to present this plan
to the Metro Council for approval as Andover's Comprehensive
plan amendment..
SANITARY SEWER TRUNK
The sanitary sewer trunk benefit area will be assessed trunk
area charges at this time, project 87-3 with the connection
charge and lateral charge collected with the local/neighborhood
project.
WATERMAIN TRUNK
Water trunk will be extended and trunk assessed to the areas where
1987-1988 development areas are planned along Bunker Lake Boulevard,
Hills of Bunker Lake, Shady Knolls/Kensington Estates area.
The water connection and lateral charge will be assessed with the
local/neighborhood projects.
We hope presenting project 87-3, the sanitary sewer trunk and the
water trunk along Coon Creek to Hills of Bunker Lake and the
water trunk along Bunker Lake Boulevard to Hills of Bunker Lake and

only trunk area charges at this time will be less confusing. The
small amount of lateral benefit on the trunk previously presented
can be assessed with the local/neighborhood project which is the

Santa's tree farm has a staging plan that has not been incorporated
into this plan.
SCHEDULE
2/3/87 - Council approve a sanitary sewer map, a water trunk
map and the cover letters.
2/4/87 - The maps and letters will be mailed to the property
owners advising them of the revised map from the public
hearing input to date and reminding them of the continued
public hearing.
If all can be accomplished we will request that project 87-3, Water
and Sewer trunk be ordered so the plats that have petitioned can
be served.

Property Owners in Sanitary Sewer and Water Southeastern Area of the City
RE: Proposed Project 87-3 & Sanitary Sewer staging plan (reminder of continued
Public Hearing from January 14, 1987)
At the public hearing on January 14, 1987 the staging plan for Sanitary Sewer
trunk was discussed. Also project 87-3 the areas that will be assessed for
Water and Sanitary Sewer trunk were discussed.
The staging plan has been redrawn from the input received at the public hearing
and letters received since the hearing. Property owners in subdivisions may not
have seen their time schedule changed as they requested due to others in the
neighborhood requesting improvements.
If your property is benefited by Sanitary Sewer trunk proposed staged improvements
you will find a Sanitary Sewer map included.
If your property is benefited by Water trunk proposed improvements you will find
a Water area benefit map included.
The Sanitary Sewer trunk area assessment is $821 per acre (1987 cost).
The Water trunk area assessment is $875 per acre (1987 cost).
You received the public hearing notice back in December of 1986 with a cover
letter dated December 31, 1986.
The Council will consider additional commentson Thursday, February 12th at 7:30 pm.
The City after the meeting on the 12th will proceed to amend the Comprehensive
plan (Sanitary Sewer Section) with the Metropolitan Council using the approved
Sanitary Sewer staging plan.

Attached please find the License Conditions for Tonson, Inc. in
regard to the operation of Tonson Waste Tire Processing at the
above-address. These license conditions were approved by the
Anoka County Board at their meeting on January 21, 1987.
At that meeting on the 21st Jim Schrantz and I were in attendance
and advised the County of the limitations placed upon this
operation by the City Council of Andover; i.e., the 24 month time
limit with no extensions. The Board was also advised that I,1ilton
LaPanta hadsigned the Stipulation Agreement with the MPCA and
that that Agreement will be presented to the MPCA today at their
meeting with the request that it be approved.

General
1. The licensee shall provide financial assurance in the amount of $12,500 for the
operation and closure of the facility by irrevocable~ letter of credit in a form
acceptable to the County Attorney. Correction of said financial assurance documents
shall be submitted within 30 days of request by the County.
2. The licensee shall obtain necessary City of Andover permits and/or licenses.
3. The required submission of engineering plans and report is waived.
4. The licensee shall provide and maintain all equipment necessary for the conduct of the
operation. Such equipment shall include, but not necessiarily be limited to scale,
shredder(s), and tire moving equipment.
5. The licensee shall advise the County and City of any changes in the operation or
ma...agement of this facility, the agreement 1,Idth Cecil and Patricia Heidelberger, or
the ownership of the property at least 60 days prior to the effective date of such
cha"lge. This license shall be valid only so long as there are no changes unless such
changes are first approved by the County.
6. All applicable provisions of the Anoka County Solid Waste Ordinance, as amended,
shall apply.
7.
Submission of monthly operating reports and the old to new waste tire processing
ration, as required by license conditions "Operation - 1 and 4," shall beheldjn
abeyance provided the licensee complies with the following conditions: a)a siipwatio"
agreement, acceptable to the Department, for the abatement of the Andover waste
tire dump is executed by February 1, 1987; b) the terms of the remedial action

Site
1. The site shall consist of the approximately 15 acres as described in Exhibit A and
shown in Exhibits B & C. The site may be reduced by the County, according to such
terms and conditions as the County may require, upon application by the licensee and a
showing that the property to be removed from the site is free of waste tires and is not
reasonably necessary to conducting the licensed activity.
The "Receiving/Processing Area" shall be confined to that portion of the site as shown
in Exhibit D.
All processing and storage shall take place in, and be limited to, the areas identified in
Exhibit E.
The site shall have only one point of access, which shall be off of Bunker Lake Blvd.,
beween the Kline and Marian Heidelberger properties, and shall be adequately secured
to prevent unauthorized access and/or use immediately.
5. The "Receiving/Processing Area" shall be screened by a fence at least eight feet, but
not more than ten feet in height so that none of the activities in the
"Receiving/Processing Area" can be seen from the public right-of-way.
6. No operations shall occur in wetland areas, except to facilitate the removal of existing
waste tires in that area.
7. A sign shall be placed at the site entrance stating the site name, hours of operation,
charges, and rules. The sign and its placement shall be subject to approval by the
Department.
8. Sanitary facilities and shelters shall be provided.
9. Electrical service for operations and repairs shall be provided.
10. Firefighting facilities adequate to insure the safety of employees shall be provided
immediately.
11. Emergency first. aid equipment to provide adequate treatment for accidents shall be
provided immediately.
12. Portable water for site personnel shall be provided immediately.
13. A telephone shall be provided immediately.
14. The site shall be locked when an attendant is not on duty.
Operation
1.
An operating report shall be submitted to the Department and City by the fifteenth
day following the end of the month. Such operating report shall include at least the
following information: quantity of new waste tires received; quantity of new waste
tires graded for recapping; quantity of waste tires shredded; quantity of whole tires
shipped; quantity of shredded tires shipped; quantity of old waste tire inventory

reduction; quantity of new waste tires remaining unprocessed; and receivers of waste
tires and/or waste tire products. The Department may require additional information
necessary to monitor this operation.
2. The maximum number of waste tires stored in the "Receiving/Processing Area" shall
not, at any time, exceed 2.5,000 tires (automobile equivalent>. Upon reaching the
maximum storage limit, no further receipt of new waste tires shall occur until the
excess storage is brought into compliance with the stated limits. For purposes of
determining compliance with this condi tion, 2.5,000 tires (automobile equivalent) shall
mean a pile(s) of waste tires of .50,000 cubic feet of volume.
3. Fire access shall be maintained in accordance with the City of Andover requirements.
4. A quarterly net reduction of the old waste tire inventory of at least three (3) ton of
old waste tires processed for each ton of new waste tires received shall be
accomplished, however, under no conditions shall the monthly reduction be less than 2
ton of old waste tires processed for each I ton of new waste tires received.
.5. No new waste tires shall be received if processing equipment is not present on site.
6. Upon cessation of operation, all tires and tire products in the "Receiving/Processing
Area" shall be removed from the site. For purposes of this requirement cessation of
operation shall include failure to shred any tires during any thirty consecutive days.
7. All new waste tire receiving and storage, recap casing grading and storage, and
shredded tire storage shaIl be limited to the areas designated in Exhibit E.
8.
The reduction of the old waste tire inventory shall first clear the
"Receiving/Processing Area" and then the fire lanes as shown in Exhibit F. Thereafter
the old waste tire inventory reduction shaIl progress by work areas identified in
Exhibit F. No variation from this progression shall occur unless first approved by the
Department.

9. If containers of. hazardous wastes are encountered, the licensee shall immediately
discontinue work in the area, notify the Department, and secure the area to prevent
spillage or container damage.

10. Receipt of new waste tires shall not occur before 7:00 a.m. or after 6:00 p.m. or on
Sundays and holidays as set forth in MS 64.5.44, subdivision.5. Processing of waste
tires shall not occur before 6:00 a.m. or after 12:00 a.m. or on Sunday or holidays as

11. The licensee shall maintain haul routes within I mile of the site free of waste tires.
12. Noise shall not exceed 8.5 decibels at the property line.

16. A minimum separating distance of five (.5) feet shall be maintained between site
operations and the adjacent property line.

The licensee shall engage the services of a qualified exterminator or
operator, acceptable to the Department, to inspect and
"Receiving/Processing Area" when deemed necessary by the Department.

18. An attendant shall be on duty at the site at all times while it is open for public use.
19. The premises and entrances shall be maintained in a clean, neat and orderly manner at
all times.
20. All incoming and outgoing traffic shall be controlled by the licensee in such a manner
as to provide orderly and safe ingress and egress.
21. Records acceptable to the Department shall be maintained indicating the quantity of
waste tires passing through the site and the site operations. These records shall be
available at all times for review and inspection by the Department.
22. Prior to cessation of operation the licensee shall:
a. Notify the Department at least 90 days before cessation of operation.
b. Notify regular customers of record, if any, at least 4.5 days, but not more than 6']
days, before cessation of operation.
c. Public notice in local newspapers distributed in the area served by the station at
least 45, but not more than 60 days, before cessation of operation and up:-"
cessation of operation.
d. Post a sign at the gate and attendant's window from at least 60 days before to
120 days after cessation of operation.
e. These notices and signs shall identify the. date on which the station will close and
alternate services available. . ..
23. Upon cessation of operation the licensee shall:
a. Remove all waste tires, used tires, tire products and other solid waste from the
site (receiving/processing area) within one week.
b. Pick up litter and remove salvaged materials within one week.
c.
Administer closed building pest eradication to the building, and surrounding
grounds, by a qualified pest control operator acceptable to the Department
within one week following completion and the building and grounds cleaning.

d. Secure the site to prevent unauthorized disposal activities.

e. Notify the Department of closure work completion within one month of cessation
of operation.
24. The operational bond in effect at the time of closure shall continue until the station is
properly closed and approved by the County.
2.5. Approval of this plan or waiver of any plan requirement, does not in any way limit or
reduce the licensee and owner's obligation or responsibility to properly close this site
and to maintain it in such a manner that it does not degrade the soil, waters, or air of
Anoka County or create a nuisance or endanger the public or to take remedial action
to correct such degradation.
26. If financial assurance documents are not satisfactory to the County Attorney's Office,
corrected documents in proper form are to be submitted within 30 days of request by
the County.
27. The licensee shall not accept large heavy equipment tires or any other waste tire
which cannot be processed by the equipment on site. It is recognized by the County
that the operator is not required to process the large heavy equipment tires currently
on site.
