and Property Damage.
These fireworks would be displayed during the City Celebration.
Also attached is the memo from Ray Sowada that was given to
you at the last Council meeting.

This is the regulations or laws on giving a
Fireworks Display.
Debbie, the coordinator of the fireworks display,
has,also been given a copy of these regulations.
It will be up to your decision if you want to follow
the regulations or not.

REGULATIONS ABOUT FIREWORKS
o
ARTICLE 78
FIREWORKS
BOND FOR FIREWORKS DISPLAY REQUIRED
Sec. 78.103. The permittee shall furnish a bond or
certificate of insurance in an amount deemed adequate by the
chief for the payment of all damages which may be caused
either to a person or persons or to property be reason of the
permitted display and arising from any acts of the permittee,
his agents, employees or subcontractors.
APPENDIX C
SUGGES~ED REGULATIONS OF THE STATE FIRE MARSHAL FOR THE PUBLIC
DISPLAY OF FIREWORKS APPLICATION FOR PERMITS
1. Application for permit to operate a display of fireworks
in conformance with the terms of .......... of the General
Laws of .......... shall be made in writing on forms
provided by the state Fire Marshal to the chief of the
fire department of the city, own or municipality in or
near which the display is to be held.
2. Such application shall set forth:
a. The name of the organization sponsoring the display
together with the names of persons actually in charge
of the firing of the display.
b. Evidence of financial responsibility.
c. The date and time of day at which the display is to be
held.
d. The exact location planned for the display.

e. A description setting forth the age, experience, and
physical characteristics of the persons who are to do
the actual discharging of the fireworks.
f. The number and kinds of fireworks to be discharged.
g. The manner and place of storage of such fireworks
prior to the display.
h. A diagram of the grounds on which the display is to be
held showing the point which the fireworks are to be
discharged, the location of all buildings, highways
and other lines of communications, the lines behind
which the audience will be restrained, and the
location of all nearby trees, telegraph or telephone
lines or other overhead obstruction.

3. Upon receipt of such application at least 15 days in
advance of the date set for this display, the Chief of the
Fire Department shall make, or cause to be made, an
investigation of the site of the proposed display for the
purpose of determining whether the provisions of these
regulations are complied with in the case of the
particular display. He shall confer with the Chief of the
police Department about the application and whether
issuance of a permit would be consistent with public
safety. Being satisfied that the display is properly
lawful, the Chiefs of the police and Fire Departments
shall together endorse the application, stating that they
approve the display as being in conformance with all parts
of the law and with these regulations. Failure to approve
the application by either the Fire Chief or police Chief
shall be sufficient cause for the state Fire Marshal to
deny permit.
4. The application, following endorsement by the Chiefs of
the Fire and police Department, shall be sent to the state
Fire Marshal who shall then, upon receipt of evidence of
financial responsibility as required by law in such cases,
issue a nontransferable permit authorizing. '

The City Council is requested to approve two resolution~for
Project 88-2B Ward Lake Drive (North-South part).
1. Resolution holding MNDOT and etc. harmless for the
variance to create a tee intersection.
2. Resolution awarding part "B" to Forest Lake. Part "B"
was change ordered out of the original project and will
be added back in by change order.
The City Council is also requested to approve the change order in
the amount of $76,36~.10 putting Part "B" back into the project.

RESOLUTION FOR VARIANCE UNDER RULE 8820.9912.
WHEREAS, the City of Andover was granted a variance from Rule
8820.9912 so as to permit a substandard design speed in a curve 1/4
mile ease of Hanson Boulevard; and
WHEREAS, the variance is conditioned on a hold harmless clause.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Andover that the City of Andover indemnifies, saves and holds
harmless the State of Minnesota and all its agents and employees of
and from any and all claims, demands, actions or causes of actions
of any nature or character arising out of or by reason of, in any
manner, the construction of MSAS 103 (Ward Lake Drive) from Hanson
Boulevard to a point 1/2 mile east of Hanson Boulevard in any other
manner than as a minimum 30 m.p.h. design speed in accordance with
Minnesota Rule 8820.9912 and further agrees to defend at Andover's
sole cost and expense any action or proceeding commenced for the
purpose of assertin~ any claim of whatsoever character arising as a
result of the granting of this variance.

to adopt the following:
A RESOLUTION ACCEPTING BIDS AND AWARDING CONTRACT FOR THE IMPROVEMENT
OF PROJECT NO. 88-2B FOR STREET CONSTRUCTION IN THE AREA OF WARD LAKE
DRIVE.
WHEREAS, pursuant to advertisement for bids as set out in Council
Resolution No. R078-88, bids were received, opened and tabulated
according to law for Project No. 88-2, with results as follows:

NOW, THEREFORE, ~E IT RESOLVED by the City Council of the City of
Andover to hereby accept the bids as shown to indicate Forest Lake
Contracting as being the apparent low bidder, award subject to MNDOT
receiving the hold harmless resolution on the variance.
BE IT FURTHER RESOLVED TO HEREBY direct the Mayor and City Clerk
to enter into a contract with Forest Lake contracting in the
amount of $76,361.10 for construction of Improvement Project No. 88-26
for street construction; and direct the City Clerk to return to all
bidders the deposits made with their bids, except that the deposit of
the successful bidder and the next lowest bidder shall be retained
until the contract has been executed and bond requirements are met.

City Council at a special meeting this 21st day of July, 1988, with
