Dear Mr. steine:
I live on the north shore of Round Lake in Anoka County. The lake
appears to be deteriorating rapidly, and I wish to express my
concerns about the situation.
I live in a recently developed residential area. The back of my
lot had a low swampy area when we built our home. Three of my
neighbors--the Peases, the Petersons, and the Ramsayers~-had
similar situations on their lots. We have all cleaned up the
,swampy areas, and developed nice ponds to enhance our lots as
well as to attract wild life.
When myself and two of my neighbors dug our ponds last summer,
they quickly filled, up with water to a depth of perhaps two feet
or so. Needless to say, the lack of rain this summer and the hot
winds we experienced have had a deleterious effect on the water
levels in the ponds to the point they are nearly dry.
However, we believe that the loss of water from our ponds has
been accelerated by the construction last spring of a 'drainage
ditch on the east side of Round Lake Blvd., County #9. The
drainage ditch always has water in it. We believe that the
drainage ditch is lowering the level of Round Lake, and along
with it, the levels of the ponds in the area. Round Lake is
beginning to look terrible, and if things continue as they are,
it appears that we may lose the lake and the ponds.
There is nothing anyone can do to eliminate the effects of the
drougth and hot winds. However, if the newly installed drainage
ditch is also draining the lake as we feel, something can be done
about that. It is a man-made situation which can be reversed.
I respectfully request that a study be made of the effects of the
drainage ditch on the water level of Round Lake, and if it is
lowering the level, then corrective action must be taken.

SETTLEMENT AGREEMENT
THIS SETTLEMENT AGREEMENT by and between the City of
Andover (hereinafter referred to as "City") and The Menkve1d
Company (hereinafter referred to as "Developer").
WHEREAS, Developer is the owner of the Southwest
Quarter of the Northwest Quarter of Section 34, Township 32,
Range 24, Anoka County, Minnesota7 and
WHEREAS, said Developer wishes to plat such property
into a subdivision known as Red Oaks Manor Fifth Addition7 and
WHEREAS, Developer has submitted to the City for
approval a preliminary plat of Red Oaks Manor Fifth Addition:
and
WHEREAS, Developer is the owner of twelve (12) acres
located contiguous and easterly of the subject parcel which
Developer desires to develop: and
WHEREAS, Ordinance No. 10 of the City requires the
Developer to dedicate to the City ten (10%) per cent of the
proposed developments for parkland purposes: and
WHEREAS, the City needs addi tiona1 property which is
located within the plat of Red Oaks Manor Second Addition for
drainage and utility purposes.
NOW, THEREFORE, IT IS HEREBY AGREED by and between the
parties as follows:
1. That the Developer shall convey to the City by
Warranty Deed, upon the approval of the final plat of Red Oaks
Manor Fifth Addition, Outlot A and Outlot C as shown on the

preliminary plat of Red Oaks Manor Fifth Addition presently on
file with the City.
2. That in consideration of the conveyance of said
Outlot A and Outlot C Developer shall be deemed to have
satisfied all park dedication requirements for the proposed plat
of Red Oaks Manor Second Addition and the parcel owned by
Developer contiguous and easterly of the property of Red Oaks
Manor, more specifically described on Exhibit A attached hereto.
3. That as and for further consideration the City
shall pay to the Developer at the time of delivery of such
Warranty Deeds to such Out1ots A and C, the sum of Twenty
Thousand and no/lOO ($20,000.00) Dollars.
4. That Developer agrees to execute a release in the
form attached hereto and made a part hereof as Exhibit B,
releasing any and all claims or causes of action that Developer
may have against the City wherein Developer alleges the City is
improperly draining water onto any part of Red Oaks Manor Fifth
Addition. Sucb release shall be executed contemporaneously with
the execution of., .the above mentioned Warranty Deeds and should
be delivered at the same time.

5. That upon satisfying all requirements of Andover
City ordinances, Anoka County ordinances and any other
regulatory agencies, the City will approve the final plat of Red
Oaks Manor Fifth Addition.
6. This Agreement shall supercede and take precedence
over any and all other agreements and obligations heretofore

FOR AND IN CONSIDERATION of the payment to me at this
time of the sum of Twenty Thousand and no/lOO ($20,000.00)
Dollars and the credit for parkland dedication as more
specifically described in the Settlement Agreement with the City
of Andover of same date hereof, we do hereby release, quit and
forever discharge the City of Andover, Minnesota, of and from
any and all actions, causes of actions, claims, demands,
damages, costs, loss of service, expenses and compensation, on
account of, or in any way growing out of, and any and all known
and unknown damage to the Southwest Quarter of the Northwest
Quarter of Section 34, Township 32, Range 24, Anoka County,
Minnesota resulting from the drainage of storm water thereon by
the City.
IT IS UNDERSTOOD AND AGREED that this settlement is a
compromise of a doubtful and disputed claim, and that the
payment is not to be construed as an admission of liability on
the part of the City by whom liability is especially denied.
THIS RELEASE contains the entire agreement between the
parties hereto, .and the terms of this release are contractual
and not merely recital.

2. Street lights will be installed in existing subdivisions

Dear Mayor and Council:
Attached Isa memorandum dated June 21, 1988, which analyzes the present
water use and projected water system needs for the 1995-2000 time frame.
Based upon this report, and the attached graphic representation, we
recommend the fol lowing:
1. A minimum additional 500,000 gal Ions of storage wll I be needed by
1 991 .
2. Well No.4 wll I be required by 1995.
It requires approximately two years to effect a water tank construction,
from the authorization through completion. Approximately 18 months Is
required to place another water wel I on the system, depending on the
I ocatl on.
Recommendation
1. A one million gal Ion el evated water storage facility be consl dered In
the area of the present City offices. Authorization should be granted
In early 1989.

In 1986. we reviewed Andover's water use (1985) to determine when Well No.3
and Elevated Tank No.2 should be constructed to keep pace with development.
It was estimated that Tank No.1 and Wells No.1 and No. 2 woul d be adequate
to serve the needs of approximately 1,000 connections. Construction of Wel I
No.3 and Tank No.2 would provide for an additional 700 connections.
Water well records have been obtained for 1987 and the first six months of
1988, along with connections Installed during this period. With the
completion of Pumphouse No.3 this summer, It wll I be desirable to plan either
the construction of Tank No.2 or Wel I and Pumphouse No.4.

Attached Is a memorandum dated June 21, 1988, which analyzes the present
water use and projected water system needs for the 1995-2000 time frame.
Based upon this report, and the attached graphic representation, we
recommend the fol lowing:
1. A minimum additional 500,000 gal Ions of storage wll I be needed by
1 991 .
2. Well No.4 will be required by 1995.
It requires approximately two years to effect a water tank construction,
from the authorization through completion. Approximately 18 months Is
required to place another water wel I on the system, depending on the
I ocatl on.
Recommendation
1. A one m II lion gallon el evated water storage facility be consl dered In
the area of the present City offices. Authorization should be granted
In early 1989.

Dear Mayor and Council:
Attached Is a memorandum dated June 21, 1988, which analyzes the present
water use and projected water system needs for the 1995-2000 tl me frame.
Based upon this report, and the attached graphic representation, we
recommend the fol lowing:
1. A minimum additional 500,000 gal Ions of storage wll I be needed by
1 991 .
2. Well No.4 will be required by 1995.
It requires approximately two years to effect a water tank construction,
from the authorization through completion. Approximately 18 months Is
requl red to pi ace another water well on the system, dependl ng on the
I ocatl on.
Recommendation
,1. .A one mil lion gal Ion elevated water storage facility be considered In
the area of the present Clty'offlces. Authorization should be granted
In early 1989.
2. Location and site acquisition for Wel I No.4 should be considered In
the platting process north of the City Hal I along Hanson Boulevard, or
east of Winslow HII Is 1st Addition along 150th Lane NW.

In 1985. we reviewed Andover's water use (1985) to determIne when Wel I No.3
and Elevated Tank No.2 should be constructed to keep pace with develofXllent.
It was estimated that Tank No.1 and Wel Is No.1 and No.2 would be adequate
to serve the needs of approximately 1,000 connections. Construction of Well
No.3 and Tank No.2 would provIde for an additional 700 connectIons.
Water well records have been obtaIned for 1987 and the fIrst sIx months of
1988, along with connections Installed durIng thIs perIod. WIth the
completIon of Pumphouse No.3 thIs summer, It wll I be desIrable to plan eIther
the construction of Tank No. 2 or Wel I and Pumphouse No.4.
