BENT CREEK ESTATES
CITY PROJECT 88-20
ANDOVER, MINNESOTA
Location and Description
The proposed Bent Creek Estates, Project 88-20, Is located In the NW 1/4 of
the SE 1/4 of Section 33, Township 32, Range 24, In the southeast quadrant
of Bunker Lake Boul evard (CSAH 16) and Coon Creek (County Ditch No. 57).
The project proposes 11 lots on approximately 12 acres, of which less than
3 acres are above the f I oodp I a I n. Approxl matel y 1.5 acres of the
floodplain are proposed to be filled. Lot 11 Includes a previously
existing house.
Improvements
1. Sanitary Sewer
The sanitary sewer Is proposed to be extended from an existing manhole
In Bunker Lake Boulevard by Jacking a casing pipe from the proposed
roadway to the outsl de of the manhol e and break I ng I nto the manhol e
from the Inside. An Inside drop structure Is proposed to be
constructed. An 8" diameter lateral sanitary sewer with 4" service
pipe Is th en proposed to be constructed to serve the proj ect. Lot 11
Is currently served from a serv Ice to the trunk line I n Bunker Lake
Boul evard.
Other sanitary service alternatives were studied, but all Involved a
longer length of deep pipe laid along Bunker Lake Boulevard from the
sanitary sewer line Into Hidden Creek to the east. The proposed
alternative does Include the use of an Inside drop, which Is not
recommended under normal cl rcumstances due to safety and mal ntenance
prob I ems.
2. Waterma In
The waterma I n I s proposed to be extended f rom the exl stl ng 12" trunk
line on the north side of Bunker Lake Boulevard. The line Is proposed
to be laid through a jacked casing pipe under Bunker Lake Boulevard
(CSAH 16) and connected to the existing pipe utilizing a wet tap. The
wet tap Is necessary In order to continue to serve the east portion of
the City without shutting off the line to cut In a tee and gate valve.
A 6" watermaln I ateral Is then proposed to be extended to the back of
the cul-de-sac.
This wl/ I require an unlooped watermaln length of more than 600 feet,
or approximately 200 feet more than the recommended maximum unlooped
watermaln length. Looping the watermaln Is only reasonable to Hidden
Creek, but It Is not feasible due to the confl let with existing homes
and trees.

3. Storm Sewer
A 12" RCP storm sewer lIne wIth a flared end section and trash guard
Is proposed to be constructed from the rear of the cul-de-sac to the
flood plain.
4. Street
The streets are proposed to be standard 33 foot back-to-back width
with 2" of asphalt, 4" minimum of Class 5 gravel, and concrete
surmountable curb and gutter. A 46.5' radIus cul-de-sac Is proposed
to be constructed.
Please note that the roadway entrance location onto Bunker Lake
Boulevard (CSAH 16) has several negative traffic safety factors.
A. The entrance Is located only 300 feet from Crosstown Boulevard
and only 650 feet from Crooked Lake Boulevard. This stretch of
Bunker Lake Boulevard (CSAH 16) between Crosstown Boulevard and
Crooked Lake Boulevard, currently part CSAH No. 18 has been an
area of concern. Although CSAH 18 Is proposed to be relocated
to Verdin Street NW, thIs portIon of Bunker Lake Boulevard Is
stlll'expected to have substantIal traffic entering and exiting
from these Intersections. Combined with the heavy through
traffic along Bunker Lake Boulevard, an addItional roadway
entrance at this point could be a signIficant safety concern.
B. The entrance Is on a vertical curve and Is only 300 feet from
the bridge over Coon Creek.
Anoka County has recommended against an entrance at this point.
Although It Is not a desirable option for those living on the cul-de-
sac, a rlght-In/rlght-out only entrance would rei leve at least some of
the safety concerns.
5. Gradl ng
The project Is generally within the floodplain and will require fill
and unsuitable soil excavation within the flood frInge boundary. The
area Is proposed to be fIlled up to the floodway boundary. No fill
shal I be al lowed within the floodway.
Initiation
The project was InitIated by petition by Thomas C. McCabe (the fee owner),
Steve Campbell of Campbell Real Estate (the subdivider) and Andover City
COuncil action.
Feasibility
The project Is feasible, given the aforementioned qualifications.

Rlght-of-way/Easements
Construction Is proposed to be confined to existing rights-of-way and
proposed easements and right-of-way to be dedicated as part of the platting
process. Temporary construction easements may be required.
Perm Its
Permits wll I be required from the Anoka County Highway Department for work
within the County highway right-of-way, from the Minnesota Pollution
Control Agency (MPCA), the Metropolitan Waste Control Commission (MWCC) for
sanitary sewer extensions, from the Minnesota Department of Health for
watermaln extensions, and from the Coon Creek Watershed District for storm
sewer Improvements. DNR and/or Corps of Engineers permits for work
adjacent to Coon Creek shall be obtained by the developer prior to
construction. All permits related to grading shall be obtained by the
developer.

Dear Mr. Mayor:
Good engineering practice in most endeavors, including pipeline
design, requires a balance between strength and economics. The
design o:f the MITS pipeline is tilted towards the strength side,
surpassing minimum Federal Sa:fety Standards.
You are in receipt o:f the letter :from Minnesota Intrastate
Transmission Systems (MITS) dated June 22, 1988, which represents an
attempt to explain how MITS will equal or surpass pipeline wall
thickness requirements :for Federal Sa:fety Standards relating to the
transportation o:f natural gas by pipeline.
Also, you have the letter :from MITS dated June 28, 1988, con:firming
that 16" 0.0. x 0.281" W.T. pipe will be installed :from immediately
North o:f Ms. Sophie Kozlowski's property to the pipeline termination
point.
MITS has previously described to the City that 0.281" wall pipe will
be installed at railroad and road crossings. One measure to help
assure pipeline sa:fety is designing :for the installation o:f pipe with
adequate wall thickness -- MITS has done this. (Another related
:factor is pipe grade. 0.250" W.T. pipe in X-52 grade is a high
quality pipe, providing excellent strength properties). The
Minnesota O:f:fice o:f Pipeline Sa:fety has reviewed and will continue to
review the design and construction o:f the MITS pipeline.

The city Council is requested to review the proposed
The Andover Review Committee (ARC) has reviewed the sketch plan
and their comments are as follows:
General Comments:
* The proposed sketch plan is located in an R-1 single family
rural zoning district with minimum 2-1/2 acre lot size. 10 lots
are being proposed.
* The ARC is concerned about the lots fronting on the County Road.
Ordinance 10, Section 9.02(c) states that no preliminary plat
shall be approved wherein lots front on the right-of-way of state,
county, or city arterial or collector roads. A service road along
the county roads is possible. (The Anoka County Highway
Department has reviewed the sketch plan. See attached letter.)
* The developer is recommended to meet City Ordinances 8 and 10.
Street construction is to meet standard specifications for rural
residential developments.
Planning Commission Comments:
The Planning Commission generally felt the layout is
acceptable with a few modifications with driveways for lots
fronting on the existing county roads. See sketch plan with
modifications for driveway locations.

Regarding: Sketch Plan for Robert Heliker
Dear Jim:
We have reviewed a sketch plan for Robert Heliker located at
the intersection of Valley Drive and 165th Avenue in the city
of Andover.
Right of way is acceptable as shown being 60 feet from the
centerline of the county highways.
Access for Lot 1 is acceptable as shown at the north end of
the lot. Access for Lots 2 and 3 are acceptable as shown on
the Common Lot Line. Access for Lot 4 we would recommend
being moved to the north end of the lot and the access for Lot
5 be located along the west side of that lot onto 165th
Avenue. This is somewhat different than our normal
recommendation as we normally recommend groupings of driveways
just as shown on the plat. However, in this case the
driveways for Lots 4 and 5 would end up in the right turn lane
when County Road 58 gets reconstructed. Experience has shown
that driveways in the right turn lanes cause problems and
ultimately accidents. In an effort to make the accesses as
safe as possible, we recommend this change for Lots 4 and 5
and feel that this is actually a better situation to have the
extra access point as opposed to accesses in the turn lane.

The City Council is requested to approve Indian Meadows 3r
Addition preliminary plat, grading and drainage plan per
Ordinances 8 and 10.
The Andover Review Committee (ARC) has reviewed the preliminary
plat, grading and drainage plan. Their comments are as follows:
General COmments:
*The proposed preliminary plat is currently zoned R-1, single
family rural, minimum area 2.5 acre lots.
*The proposed preliminary plat consists of 13 single family rural
residential lots.
Other Comments:
*The developer is required to meet the Standard Specifications for
Rural Residential street Construction.
*The proposed preliminary plat indicates no dirt to be removed or
brought onto site.
*AII disturbed areas shall be topsoiled and seeded as required.
*Concrete spillways are being used for the development. The ARC
is concerned with the intersection of 7th Avenue and 153rd Avenue
NW with drainage control. Spillways may be necessary.

Soil borings report have been received. Lowest floor
elevations shall be adjusted 3 feet above the natural
ground water level. Each lot shall have 39,000 square
feet 6 - 1/2 above the mottled soil to support
individual disposal systems (state requirements).

WHEREAS, pursuant to published and mailed notice thereof, the
Planning and Zoning Commission has conducted a public hearing and
reviewed the preliminary plat of Indian Meadows 3rd Addition; and
WHEREAS, the plat has been reviewed by the Andover Review
Committee; and
WHEREAS, there was no large amount of negative comments; and
WHEREAS, as a result of such hearing and review, the Planning and

Addition located on County state Highway Number 7 and 153rd
Avenue.
Access to the plat from CSAH #7 is acceptable at the proposed
location for 153rd Avenue. The right of access from Lot 1

INDIAN MEADOWS 3RD ADDITION PRELIMINARY PLAT PUBLIC HEARING
Todd Haas reviewed the items relating to the Preliminary
Plat checklist for Indian Meadows 3rd Addition. The City is
requiring a drainage easement to be shown on the plat to follow
the 100 year flood elevation.
Ms. Bosell stated that a replat needs to be submitted
showing the existing plat i~ solid lines and the new plat on
dotted lines. Another drawing should be submitted showing
Andover West as it originally was approved and a dotted line to
show the proposed change to meet the ordinance requirement. The
100-year flood elevation issue in regard to the pond on Lot 3,
Block 1 needs to be dedicated, and there needs to be an easement
identified on plat as a drainage easement. Lot 1, Block 1 can't
front on 7th Avenue because that's a County road.
Mr. Vistad had a concern in replatting -- when the cul-de-
sac was created, a variance would be needed. To grant a variance
would only be for economical reasons. Mr. Vistad feels the
length of the cul-de-sac should be extended further to the north.
MOTION was made by Commissioner Bosell, seconded by
Jacobson, that the Andover Planning and Zoning Commission
recommends to the City Council approval of the preliminary plat,
grading and drainage plan known as Indian Mills 3rd Addition for
the following reasons:

The Planning Commission has held a public hearing in regard
to the preliminary plat, and there have been no issues raised by
the residents of the surrounding property. The plat has been
reviewed by the engineer for the City of Andover, as well as the
Andover Review Committee and meets with their approval with a
couple of exceptions. The Engineering Department recommends that
a variance be granted pursuant to Ordinance 10, Section 9.03
Subsection 3, as it pertains to the grade of the road. The
proposed preliminary plat has the grade at .8% and the Ordinance
requires 1% for rural development. It is the recommendation of
the Engineering Department that at the .8% grade on the integrity
of the street section can be protected and the streets will meet
the standards set out by the City Ordinances. The Park
Commission has preliminary made a recommendation as it pertains
to this plat under the guides of Andover West; however, the Park

Board will reconsider this plat at its meeting on June 16, 1988
and that recommendation will be forthcoming to the Council. The
developer is responsible to obtain all permits from the Lower Rum
River Management Watershed Board, from the Department of Natural
Resources, and the Corps of Engineers or any other governmental
agency as is necessary. The preliminary plat has one variance
request that is recommended to be approved and that would be Lots
4 and 5, Block 1 do not meet the 300 foot lot frontage at the 35-
foot set-back line. However, pursuant to Sect~on 17, Ordinance
10, the other physical condition that would impact these lots
would be the location of the UPA transmission line and the
placement of the cul-de-sac and the placement of the house pads
is directed related to this transmission line location. There
are three contingencies on the plat:
1) That an easement be described and identified
on the plat setting out the lOO-year flood
elevation and the pond located on Lot 3,
Block 1.
2) The legend be corrected to include at item
11, management of the drainage is regulated
by,the Lower Rum River Watershed.
3) The additi6n of item 15, which would state
street lighting pursuant to Ordinance 86.
The developer is also requested to submit as a condition of
Section 8.02 of Ordinance 10 the preliminary plat of Andover West
showing that it was approved and the overlay of the new plat of
Indian Meadows 3rd Addition on that drawing simply to show the
changes made from the original plat. An amendment to the motion
was recommended by Mr. Jacobson to be added as conditions of the
plat:
4) Lot 1, Block 1 must front on an interior
street.
5) That no dirt will either be removed or
brought into the site.
Roll call: All commissioners voted yes (with two people
voting yes reluctantly - Commissioners Jacobson and Vistadl.

MSA STREETS
CouncIl revIewed the proposed MSA street desIgnations. CouncIlman
EllIng dId not see the need for Jay Street in Watt/s Garden ,Acres. He
also felt the MSA map should be more realistIc, that somethIng should
be designated in the center of the City between Nightengale/Crosstown
and Round Lake Boulevard, probably in the vicinity of 157th. He felt
there should be more east/west roadways through the City. He also
thought Verdin Street should be extended to the south.
Mr. Schrantz stated the City of Ham Lake would like to have University
Avenue from 157th to 166th designated MSA and constructed to a
graveled road, at Ieast north from Constance to 166th. It.was agreed
Councilman Orttel and a representative from Ham Lake wIll discuss thIs
with the adjoining property owners. Mr. Schrantz also stated Ham Lake
is willing to blacktop UnIversity between Andover Boulevard and 150th.
It was then agreed to approve the first two proposed deSignations and
consIder Councilman Elling/s suggestions for next year.

Council noted the revIsion presented this evening, Plan B-1, thinking
it was materially better than that presented in the Agenda material.

After discussion, Council agreed to leave the road alignment as
proposed by the developer. Council also questioned whether an EAW was
needed because thIs Is already an approved prelimInary plat. Mr.
Bachman stated they have begun that process. but wiII ask for an
interpretation from the EQB again.
Council generally agreed with the proposed Plan B-1 as presented, and
advised Mr. Bachman that to change the preliminary plat. he must
proceed through the Planning Commission again. Mr. Haas also stated a
new grading plan will be required.
ORDINANCE AMENDMENT/SIMILIAR HOUSE
General consensus of the Council was to approve the amendment, but it
was felt it should be an amendment to the Building Code. not to
Ordinance 8. Also. rather than creating another Board or placing
another duty upon the Planning Commission, it was agreed the Board of
DeSign Control should be the Andover Review Committee.

Todd Haas explained that the developers would like to revise the preliminary
plat by two lots and work some things out because of the power line ease-
ment. They would like to move the road further to the south.
Commissioner Jacobson asked what occurred to make the original plat needing
to be revised.
Wayne Bachman, Developer - explained that the original property was part of
Andover West developed by Derril Berger. When New Generation Homes platted
Indian Meadows, they ran into some problems with the grading versus the
elevations. They felt that the way the lot grades are working out in the
area and the fact that they hav~ to build so far back on the lots would
make it difficult to market those lots. Mr. Bachman noted that none of the
lots in this area have been sold as yet.
Commissioner Vistad noted that Lot 4 is 2~ acres and if the street is moved
to the south, substandard lots would be created.
Mr. Bachman explained that the lots will become deeper and less w~de on the
south side of 153rd, making the extra acreage being applied to Lot,4.
Todd Haas noted that the only variance would be the two lots at the end of
the cul-de-sac that might not meet the front footage at the setback line.

Discussion was on the traffic flow if the plat is revised, with Commissioner
Jacobson requesting to look at~the entire plat to the north and south to
see what this will do to the traffic flows. Commissioner Vistad asked if
we are revising this plat in order to have more cul-de-sacs. Commissioner

Bosell stated t~at is not the purpose of this re-plat. Mr. Bachman is
trying to get the power lines in the back of the houses instead qf in front
of them. She also noted that the City Council felt that the street
alignment should be left as is. The Planning Commission needs to let Mr.
Bachman know if he should leave the eyebrows in or take them out.
After some discussion on whether Mr. Bachman needs to return to the Planning
Commission with a revised sketch plan, it was decided th~t he should meet
with the Andover Review Committe~ and then proceed with his preliminary
plat. '
Mr. Haas stated that he would look at some of the other rural subdivisions
that have the same problem and see what our..' reasons were for allowing
variances.

three to four year period of time. The density of the proposed subdivision is 1.75
units per acre. The project includes a 7.1 acre wetland area that is being deeded
to the Coon Creek Watershed District, a 14.5 acre nature park along Coon Creek and a
0.65 acre tot lot public park. The project will be served with municipal sewer, water,
storm sewer and street_ All lots will have direct access to local residential streets.
The arterial street serving the development will be Andover Boulevard (Anoka County

Dear Ms. Volk:
In 1982, the Legislatue adopted Chapter 509 requ1r1ng all
watersheds in the Metropolitan area to establish watershed districts or
watershed management organizations. In 1985, a Joint Powers Agreement
was adopted by the cities of Andover, Anoka, Coon Rapids, and Ramsey
which formed the Lower Rum River Watershed Management Organization. We
have now beep working for close to three years to prepare a Water
Management Plan.
We retained the services of Barr Engineering Company to act as a
consultant to our Organization in the preparation of the plan. We have
worked and reworked the plan and feel it is now ready for submission to
the review process called for by the statutes.
Under the provisions of Minnesota Statutes 473.875f Subd. 5, it
is mandatory that upon completion of the preparation of the plan but
before final adoption by our Organization, we submit the plan for review
and comment to all counties, soil and water conservation districts,
towns, and statutory and home rule charter cities having territory
within the watershed. The local cities who expect that substantial
amendment of their local comprehensive plans will be necessary in order
to bring the local water management plans into conformance with the
watershed plans shall describe as specifically as possible within their
comments the amendments to the local plan which they believe will be
necessary.

I am enclosing herewi th a copy of the resolution adopted by our
Organization on May 18, 1988 f directing that the plan should be
submi tted to the four member cities, Anoka County, and the Anoka County
Soil and Water Conservation District for review and comment. A copy of
the plan is enclosed, and the 60 day period will commence to run as of the
date we transmit the plan to the Cities and other agencies. We have
taken input from all of the Cities in preparing the plan, and we have
incorporated suggestions from your representatives which affect your

particular city. We believe that the plan complies with the statutory
requirements and will be a guide to the development and management of the
Lower Rum River. We feel we have met the responsibilities of the Water
Management Act, and we believe that this plan will assist all of our
member Cities in managing the resources of the Lower Rum River
watershed, taking into consideration the watershed as a whole. We
welcome your comments and input in the' process, and upon completion of
the 60 days, the plan will be submitted to the County Board along with
your comments. The next step in the review process will place the plan
before the Metropolitan Council, the DNR, the PCA, and eventually it
will be submitted for approval to the Board of Soil and Water Resources.

Re: Erosion Concerns - Lower Rum River
Dear Mr. Earhart:
The Lower Rum River Watershed Management Organization is a
joint powers organization made up of members appointed by the Cities of
Andover, Anoka, Coon Rapids, and Ramsey. The organization is
proceeding under Minnesota Statutes Section 473.875 to 473.883 in
preparing a Water Management Plan for the watershed. A part of the
stated purposes of the organization is to prevent and alleviate erosion
and to regulate creeks, lakes, and water courses for recreational and
public use across municipal boundaries.
The WMO was recently approached by Mr. Lyle Bradley of 15202
7th Avenue N. W. , Andover, MN 55304. Mr. Bradley indicated to the WHO
his concern with the erosion of the river banks along the Rum River due to
the wake from motor boats using the river. Mr. Bradley suggested to the
WHO that we establish tight controls on the size of the motors allowed on
the Rum River. He reported that the County and the DNR have no controls.
The WHO requested that I review whether the WHO is the proper
agency to adopt some regulation or ordinance which would limit the size
and/or speed of boats and motors on various stretches of the Rum River
which are under their jurisdiction. I, as the attorney for the WHO,
advised them that they did not have jurisdiction to adopt ordinances nor
did the various municipalities have authority individually to adopt
regulations of these waters that cross municipal boundaries. I talked
with Bob Johnson, your County Attorney, and one of his associates who
agreed that the responsibility for controlling streams, creeks, lakes,
and rivers which cross municipal boundaries lies with the County. If
the County determines that this question is one that should be
regulated, they can adopt an ordinance and define which lakes and rivers
are to be covered and what types of regulations are to be adopted and
enforced.

WURST, PEARSON, LARSON, UNDERWOOD & MERTZ
At the regular monthly meeting of the Lower Rum River Watershed
Management Organization on May 18, 1988, the Commissioners agreed that
there probably should be some type of regulation to try to control the
wake from motor boats and to prevent erosion along the river bank. They
directed that I write a letter to you indicating that the Lower Rum River
WMO would probably testify on behalf of the adoption of such an
ordinance. We can not be more specifia in our recommendation because we
don't know what the situation is throughout the entire county, and
obviously there are other creeks, rivers, and lakes which may have
similar problems or which would be subject to an ordinance adopted by the
County. Mr. Johnson and his office have contacted the DNR who indicate
that once the ordinance is prepared, there should be a public hearing.
If the County Board decided to proceed, the regulation would have to be
reviewed and approved by the DNR. It is my understanding they have 30
days for such review.
I am enclosing for the benefit of County personnel who might
study this a copy of regulations imposed by the Lake Minnetonka
Conservation District, and those regUlations relate to watercraft
speed, quiet water areas, and other special rules which apply to certain
parts of the lake and its tributaries. I am also enclosing a copy of
Minnesota statutes 361. 26; a Robbinsdale ordinance limi ting the size of
motors to si~ horsepower on City waters; a separate ordinance as it
relates to boating on Crystal Lake, Twin Lakes, and Ryan Lake; and a copy
of some watercraft regulations on Mooney Lake, Lost Lake, and Hadley
Lake in the City of Plymouth. We are also enclosing a copy of a
Bloomington ordinance.
The WMO feels that the problems brought to our attention by Mr.
Bradley should be reviewed. We favor regulations which will limit
erosion of the banks of the Rum River and would be willing to provide
addi tional testimony to the County if the County is disposed to moving
forward with these regulations.

Dear Mr. Pearson:
I appreciate your letter dated May 19, 1988 regarding erosion concerns along the
Rum River due to motor boats using the river.
The County Board may be willing to consider an ordinance limiting the size,
and/or speed of boats and motors if we knew specifically what the cities
comprising the Lower Rum River Watershed Management Organization wanted the'
County to do in this regard. Perhaps the WMO could develop the basic provisions
regarding horsepower, speed, etc. that such an ordinance would include. You
could then confer with each of the four cities and secure support from each city.
The WMO' s reconunendation together wi th the resolutions supporting the
reconunendation from each city would be sent to the County. This approach would
enable one joint position to be considered rather than differing opinions. You
would not need to be concerned about any other waterways elsewhere in the County;
individual waterways are different and could be handled separately in the future,
if need be, to meet their specific situations. If the City Councils along the
Rum River are convinced that there is a problem and are united in its proposed
solution to address the particular need along the Lower Rum, the County Board
would give the matter serious consideration.

of the Anoka County Board of Commissioners. The County is indicating that
they "may be willing" to consider an ordinance limiting the size and/or
speed of boats and motors on the Lower Rum River. They are asking that our
WMO and the Cities develop the basic provisions with such a limitation, and
they want the support of each of the member Cities. The WMO's
recommendations, together wi th resolutions from the Cities, would then be
sent to the County, and they would take it under consideration for
legislation.
Jim, I think the ball is in our court, and if the four member Cities
and the four Commissioners are desirous of such an ordinance and are uniform
in the type of ordinance they want, it appears the County would probably
enact the ordinance.

This will confirm that you have asked me to obtain copies
of some ordinances or practices of cities in controlling the
size of motors operating on the Rum River. I have contacted
a number of communities and find very little regulation of
that nature. I am enclosing herevlith a copy of Minnesota Statutes
Section 361.26 which relates to waters and watercraft safety
and addresses local regulations. There appear to be a couple
of conflicting statements in that statute. The first indicates
that the local authorities can adopt local regulations not
inconsistent with state regulations. They specifically give
to cities of the first class over 200,000 the authority to
forbid the use of boats of certain classes. In Subdivision
2 of the statutes, the Commissioner of Natural Resources is
granted authority to establish rules relating to the use of
water craft which border upon or are within, in whole or in
part, the territorial boundaries of a County, City, or Town.
The Commissioner then establishes those regulations pursuant
to the manner set forth in the law.
Jim, it appears to me that if the Commission believes
that erosion along the banks of the river is creating serious
consequences, you might want to ask Anoka County or the
individual cities to petition the Commissioner of Natural Resources
to establish regulations. I believe you can see it would be
totally impractical to have each of the cities adopt separate
ordinances which may require 6 h.p. in Andover, 15 h.p. in
Anoka, and 35 h. p. in some other community. I am enclos ing
copies of the ordinances from Bloomington, Plymouth, and
Robbinsdale, but I don't think they are of great help, and
I would suggest that if the Commission determines to pursue

this, it do so by asking the communities abutting the Rum River
to ask the Commissioner to establish regulations. The river,

SubdIvision I. The provisions of this {'hapter. and of other applicablc laws of this
state shall govcrn the operation, equipment. numbering and all other matters relating
thereto whenever any vessel shall be operated on the waters of this state, or when any
activity regulated by this ('hapter shall take plaee thefl'on, Nothing in this chapter shall
be construed as limiting the authority of any political subdivision of this state to adopt
regulations, not inwnsistent with this chapter and the rules of ~he. commiss.ion~r,
relating to the use of waters of this state which are wholly or partly wllhm the temtonal
boundaries of a county, or entirely within the boundaries of a city. A city of the first
class of over 200,000 or the park board thereof, may forbid the use of motorboats or
boats with motors attached thereto on its lakes.
Subd. I a, On or before January I, 1975, the commissioner shall develop and
publish guidelines to assist counties when adopiing water surface use .ordinances for
waters within their jurisdiction.
Subd. 2. (a) Upon request of a county. city or town, the commissioner may, on
determining it to be in the public interest, establish rules relating to the use of watercraft
on waters of this state which border upon or are within, in whole or in part. the
territorial boundaries of the governmental unit.
(b) Such rules shall be established in the manner provided by sections 14.02 to
14.62, but shall not be submitted to the attorney general nor filed with the secretary of
state until first approved by resolutions of the county boards of a majority of the
counties affected by the proposed rules.
(c) Such rules may restrict any or all of the following: (I) the type and size of
watercraft and size of motor which may use the waters affected by the rule, (2) the areas
of water which may be used by watercraft, (3) speed of watercraft, (4) times permitted
for use of watercraft, or (5) minimum distance between watercraft. When establishing
rules the commissioner shall consider the physical characteristics of the waters affected
their historical uses, shoreland uses and classification, and any other features uniqu~
to the waters affected by the rules.
(d) The commissioner shall inform the users of the waters of the rules affecting
them at least two weeks before the effective date of the rules by distributing copies of
the rules and by posting of the public accesses of the waters. However, the failure of
the commissioner to comply with this paragraph shall not affect the validity of the rules
or any conviction for violation of the rules.
(e) The cost of publishing rules and of marking and posting waters pursuant to this
subdivision shall be paid by the counties affected by the rules. as apportioned by the
commissioner.
(I) Regulations or ordinances relating to the use of waters of this state enacted by
a local governmental unit before January I, 1972, shall continue in effect until repealed
by the local governmental unit or superseded by a rule of the commissioner promul-
gated pursuant to this subdivision.

SEC. 5.23. WATERCRAFT CONTROLLEO.
All pleasure and other watercraft operating on any of the public waters within the City
shall comply with the provisions of this Article except that Sections 5.25 and 5.26 of this
Chapter shall not apply to the Minnesota River.

SEC. 5.24. SPEED LIMIT.
No person shall operate any watercraft on the public waters of the City at a speed in
excess of eight land miles per hour during the "hours of sunup to sunset, and between the hours
of sunset and sunup such watercraft shall not exceed the speed of five land miles per hour.

SEC. 5.25. MOTOR CONTROL.
No motor shall be attached to any watercraft to be operated on the publ ic waters of the
City which exceeds six horsepower and any such motor installed, or attached to any such
watercraft shall contain as part of Its equipment a noise governor, which shall be in good
operating order and shall be used when such watercraft is operated on such waters.

SEC. 5.26. RUNNING LIGHTS.
All watercraft operated on public waters of the City between the hours of sunset and sunup
shall contain running lights, which shall be clearly visible, front and rear, at a distance of
200 feet.

SEC. 5.27. AIRCRAFT.

No aircraft of any kind, type Or description, except such aircraft as may be in imminent
danger, may use any of the public waters of the City for any purpose whatsoever.

SEC. 5.28. BEACH AREAS.
On any public waters where there is an established bathing beach or wading area, all pri-
vate watercraft, whether mechani zed or otherwi se, shall not operate wi thin 150 feet of the
shoreline of such beach or wading area.

SEC. 5.29. FLOATABLES.
No person or persons shall use air mattresses, inner tubes, or other inflated articles Or

by this Code.

SectionlS-IOS. UNGI'H. The overall length of boats navigating, docked,
ancmred, or operating on the above stated lakes is not to exceed sixteen (l6)
feet. A special pennit is required for any watercraft longer than sixteen
feet.
Section IS-106. KJFFIER5 REX;;UIRED. It is unlawful to use a boat pro-
pelled in whole or in part by gas, gasoline or naphtha unless the same is
provided with a stock factory IlUlffler, urrlerwater exhaust or other Jrodem
device capable of adequately muffling the sourrl of the exhaust of the engine.
The phrase "adequately nuffling" shall mean that the notor's exhaust shall at
all times be so nuffled or suwressed as rot to create excessive or unusual
roise. The discharge of cooling water through the exhaust of any inboaI:d
engine shall be considered an adequate IlUlffling device. Motorboats may be
operated with cut-<:>uts or nufflers open while actually canpeting in any race
licensed to be held by the City or Village Councils.

Section 15-107. SPEED AND OPERATION OF MOTORBOATS. Every operator of a
motorboat shall at all times navigate the same in a careful and prudent manner
and at a safe speed and along a safe course.
No person shall operate any motorboat at a rate of speed greater than
that which will permit him, in the exercise of reasonable care, to bring the
motorboat to a stop within the assured clear distance ahead.
It is unlawful to operate a motorboat in a careless or reckless manner.
Reckless navigation of a motorboat shall include operating the same in a manner
which unnecessarily interferes with the free and proper use of the navigable
waters of the state or unnecessarily endangers other boats therein, or the life,
limb or property of any person.
It is unlawful to exceed the speed limit of five miles per hour (5 MPH)
while going under ,bridges or through channels.
Section 15-108. OPERATING DISTANCES. No person shall run, operate, navi-
gate or direct any boat, motorboat or watercraft within seventy-five (75) feet
of any area in which a person is fishing or within one hundred (100) feet of any
area in which a person is swimming or within two hundred (200) feet of any area
designated as a public swimming beach or within one hundred fifty (150) feet of
any shoreline, except when said craft is entering or leaving the lake. Any area
designated as a public swimming beach shall be clearly marked with buoys.
Section 15-109. TIME. No mechanically powered boat, motorboat, or water-
craft shall be operated before sunrise or after one hour beyond sunset.
Section 15-ll0. CHANNELS. No person shall obstruct any channel and it is
unlawful for any person to swim or dive from any bridge which crosses a channel.
Section 15-ll1. WATER SKIING AND EURFOOARDING. Water skiing is pro-
hibited in the primary harbor, which is defined as one hundred fifty (150) feet
from shoreline.
Water skiing is permitted from the hours 10 o'clock A.M. to 7:30 o'clock
P.M., and it is unlawful to ski at any other time.
Section 15-112. OPERATION BY CERTAIN PERSONS PROHIBITED. It shall be
unlawful for any person who is under the influence of intoxicating liquor, narcotic
drugs or barbital, or any person who is an habitual user of same, to operate, propel
or be in actual physical control of any boat or watercraft. It shall be unlawful
for the owner of any boat or watercraft or any person in charge or in control of
same to authorize or knowingly permit any boat or watercraft to be propelled,
operated or physically controlled by any person who is under the influence of
intoxicating liquor, narcotic drugs or barbital, or any person who is an habitual
user of same.
Section 15-113. DUTIES OF OPERATOR IN CASE OF ACGrDENT. The operator of
any boat involved in an accident resulting in injury or death to any person or
in damage to property shall immediately stop such boat at the scene of such acci-
dent and shall give to the person struck or the operator or occupants of the boat

Chapter 361 and Chapter 13, NR 200-219 of the Rules of the Commissioner of Natural

set forth herein. A violation of the statute or any rule herein adopted is a
violation of this Code.

garbage, paper, bottles, cans, refuse or debris into the lakes.
1335.05. Radlel Lake; Special Provisions. Subdivision 1. Motor Boats Prohibited.
It is unlawful or any person to operate a motorized watercraft on Hadley Lake.
Subd. 2. Debris. It is unlRwful for any person in charge of or occupying
a boat on Hadley Lake to dump or throw garbage, paper, bottles, cans, refuse or
debris into Hadley Lake.

a unit for the City Park).

This leaves $16,400 to divide up to the properties along 173rd

not going to get the job done.
I have saved $3,000 'on the purchase of cracksealing materials. I
would like to hire this person at $5.00 per hour for 12 weeks and
when cracksealing is done us him for mowing ditches.

Council has conducted a public hearing on the vacation of street

along the southeast side of Northwoods Addition; and
WHEREAS, as a result of such hearing and review, the City
Council recommends vacation of said street easement.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Andover to hereby vacate the 30' service road easement
while retaining a drainage and utility easement along the ,
southeasterly line of Lot 1, Block 3; Lots 15 through 26, Block
2; and Lot 4, Block 1 of Northwood Addition, Grow Township, Anoka
County, Minnesota dated September, 1957 (copy of which is
attached).

Based upon the Municipal State Aid Street System report prepared by
the City consulting engineer the 1988 Construction Fund balance is
$455,298.27. It is anticipated that the City will sell General
Obligation State Aid Street Bonds in the amount of $500,000.00. This
would make available the sum of $955,298.27 for construction projects.
The ordered projects total $678,000.00. The balance of the funds can
be used to fund the following projects:
University Avenue - 15lst Avenue N.W. to l57th Avenue N.W.
University Avenue - l57th Avenue N.W. to Constance Blvd. N.W.
168th Lane N.W. - Round Lake Boulevard to Verdin Street
167th Avenue N.W. - Verdin Street to Hanson Boulevard or
147th Avenue N.W. - 7th Avenue N~W. to Round Lake Boulevard.
In view of the fact that these projects will be considered for con-
struction within the next l2 months, we deem it less costly for the
City to use all of its available state aid bonding capacity at this
time as opposed to selling two smaller bond issues which would result
in greater expense.
Pursuant to Minnesota Statute 162.18f the City has authority to issue
General Obligation State Aid Street Bonds for the purpose of con-
structing and improving municipal state aid streets. The statute
requires that the bonds shall be issued in amounts and on such terms
so that the average annual amount of principal and interest due in all
subsequent calendar years on the obligations does not exceed 50% of
the last annual allotment preceding the bond issue received by the
municipality from the Construction Account in the Municipal State Aid
Fund. M.S. 162.18 further provides that all interest on the obliga-
tions must be paid out of the municipality's normal maintenance
account in the Municipal State Aid Street Fund. State Aid regulations
allow the municipality to allocate one-quarter of the total allotment
for maintenance. The total allotment for 1988 is $333,392.00. This

the Maintenance allotment of $83,348.00. Under Minnesota Statute
the 50% limitation on payment of principal and interest would be
$125,022.00. We have attached to this recommendation letter a
schedule of principal and interest payments on the 1984 bond issue as.
well as a projected principal and interest payment schedule for the
1988 Bond Issue based on an average net interest rate of 7%. Our
projections indicate that the estimated debt service on these two bond
issues would fall within the limitations established by Minnesota
Statute 162. Furthermore based upon the anticipated net interest rate
of 7%, the City would have sufficient revenues in the Maintenance
Account to fund the interest on all outstanding obligations. This was
determined as follows:

We would recommend that you consider the sale of these bonds at your
meeting on June 21, 1988. The bond sale would be held on TueSday,

We recommend that you have a rating on the bond issue from Moody's
Investors Service. The law firm of LeFevere, Lefler, Kennedy, O'Brien
& Drawz will be retained to act as bond counsel on behalf of the City.

A RESOLUTION ACCEPTING WORK AND DIRECTING FINAL PAYMENT TO W.B.
MILLER, INC. FOR PROJECT NO. 87-22 FOR THE IMPROVEMENT OF STREET
CONSTRUCTION IN THE FOLLOWING AREA: HILLS OF BUNKER LAKE 2ND
ADDITION.
WHEREAS, pursuant to a written contract signed with the City of
Andover on November 5, 1988, W.B. Miller, Inc. of Ramsey has
satisfactorily completed the improvements in accordance with such
contract.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Andover,
Minnesota, the work completed under said contract is hereby accepted
and approved; and
BE IT FURTHER RESOLVED that the City Clerk and Mayor are hereby
directed to issue a proper order for the final payment on such
contract, taking the c~ntractor's receipt in full.

The City Council is requested to approve the resolution receiving
the feasibility report and ordering a public hearing for the
following Projects: Project 88-14 Uplander Street. Uplander has
the every other lot requirement. If the City assesses the
unbuildable (at this time) lots, the city of course doesn't
receive the funds to pay the bonds. Does the City allow building
on every lot or does the City encourage the Chapmans to sell the
lots to the adjoining owners?

A RESOLUTION RECEIVING FEASIBILITY REPORT AND CALLING PUBLIC HEARING
ON IMPROVEMENTS OF STREET CONSTRUCTION, PROJECT NO. 88-18 IN
THE DEHN'S ADDITION AREA.
WHEREAS, pursuant to Resolution No. R107-88, adopted the 7th
day of June, 1988, a Feasibility Report has been prepared by BRA for
the improvements; and
WHEREAS, such report was received by the City Council on the
5th day of July, 1988; and
WHEREAS, such report declared the proposed improvement to be
feasible for an estimated cost of $
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Andover that:
1. The City Council hereby accepts the Feasibility Report for
Project No. 88-18, for the improvements.
2. The Council will 'consider the improvements in accordance
with the report and the assessment of abutting property
for all or a portion of the improvement pursuant to
Minnesota Statutes Chapter 429 at an estimated total cost
