In an effort to respond to this community need, the Anoka County
Sheriff's Department has joined with the other law enforcement
agencies in Anoka County in a concentrated effort to rid our
roads and highways of drunk drivers. This joint cooperative
enforcement program has been entitled the Anoka Traffic Accident
Countermeasure, or A.T.A.C.
A $25,000 grant from the Minnesota Department of Public Safety
has been approved to help funding of this effort. Funds will
be used to pay county and local law enforcement officers to
work overtime hours on this project. At selected times, as
many as 20 additional officers could be concentrated in any
area of the county in looking for drunk drivers. Areas to
be targeted will be those where alcohol related accidents
frequently occur.
A variety of enforcement strategies will be used, including
saturation patrols and sobriety check points. Officers involved
in the project search for erratic driving habits caused by
too much alcohol. Law enforcement agencies in Anoka County
have joint cooperative agreements with each other agency, thereby
allowing officers from all participating agencies to be assigned
throughout the county.

Chapter 204c.03 Subdivision 1, School District; County; Municipalities.
No School Board, County Board of Commissioners, City Council, or Town Board of
Supervisors shall conduct a meeting between 6:00 p.m. and 8:00 p.m. on the day that an
election is held within the boundaries of the school district, county, city or town.
Subdivision 3. Public elementary and secondary schools.
Except for regularly scheduled classes, no public elementary or secondary school shall

This letter is in response to your letter of February 29, 1988, requesting the
Minnesota Pollution Control Agency (MPCA) and the U.S. Environmental Protection
Agency (EPA) to reconsider the decision to fill the wetlands between the Waste
Disposal Engineering (WOE) landfill and Coon Creek. Your letter alleges that
the wetlands issue is an arbitrary and improper decision and simply creation of
the Agenci es.
Your letter is incorrect in noting that the Agencies have attempted to classify
the wetlands. Neither the MPCA or the EPA have classified the wetlands, nor was
this necessary. We clearly indicated this point in the meeting with you and
others of the SW-28 Group on September 23, 1987, and in the subsequent letter of
November 4, 1988. No State agencies have classified the wetlands since, as was
already pointed out in the November 4, 1987, letter, the State does not regulate
this type of wetland. The wetlands were classified by the U.S. Fish & Wildlife
Service. The wetlands are identified and classified in the National Wetland
Inventory (Stillwater #1615) in accordance to the Classification of Wetlands and
Deepwater Habitats of the United States (publication FWS/08S-79/31 of the U.S.
Fish & Wildlife Service - December 1979). The wetlands north of the WDE Site
are classified as PEMC-D (Persistent Emergent Semi-permanently flooded wetland _
drained). I have attached a copy of the map (Attachment 1) identifying and

locating the wetlands (the WOE Site and immediate area are generally circled).
Attachment 2 contains material from Classification of Wetlands and Deepwater
Habitats of the United States which explains the characteristics of the
persistent-emergent classification.
In addition, Mr. Stan Smith of the U.S. Fish & Wildlife Service visited the WOE
Site in the spring of 1987 and outlined four specific areas which he identified
as wetlands (PEMC-O classification) along the northeast fringe of the landfill,
south of Coon Creek. His visit was simply part of a general effort of the U.S.
Fish & Wildlife Service to assess the impacts of response actions on wetlands at
all sites on the National Priorities List. The sizes of the four wetlands range
over 0.25-1 acres (total area of 2.5 acres). It appears that these wetlands are
largely within the property boundaries of the WOE Site. I have enclosed Mr.
Smith's sketch map made in the fi el d, del i neati ng the 1 ocati ons of the wetl anas""
(Attachment 3). The types of vegetation he identified in these wetlands include
willow, cattails, sedges, and reed canary grass. The fact that the National
Wetland Inventory also identified these as PEMC-D wetlands (based on aerial
photography interpretation and ground survey confirmation) simply reinforces the
wetlands designation.
The cost figures for filling of these wetlands were generated from Conestoga-Rovers
and Associates own cost estimates for hauling and placing clean fill at the WOE
Site. You are correct in noting that the costs for replacement have not been
developed. There are a wide variety of alternatives to be considered for
compensation of the filling of the wetlands along the northeast fringe of the
landfill. One option proposed by Mr. Smith is to upgrade the quality of
existing wetlands on or near the WOE Site. We tried to be flexible on this
point and did not wish to commit to a single course of action in the Record of
Decision. One possible alternative is to develop more open water in the
wetlands southwest of the landfill (shown as open water (POW) and persistent
emergent wetland (PEMC) in both the National Wetland Inventory and in Mr.
Smith's field map). Another alternative is to tie in some wetland improve~ent
with the stormwater control plan for the overall WOE Site as part of the
Remedial Design. Again, there are a number of options available, short of
creating a brand new wetland.
As the Agencies and the SW-28 Group - Technical Committee representatives agreed
at a meeting on April 6, 1988, representatives of the Technical Committee and of
Conestoga-Rovers & Associates,Stan Smith and Jim Leach of the U.S. Fish &
Wildlife Service, and I to make a Site visit on April 13, 1988, so that the
"wetlands" are clearly identified to all parties. The Site visit was made, with
Steve Mockenhaupt of Conestoga-Rovers and Gregory Fontaine of Dorsey and Whitney
being present. During this visit, we confirmed the wetlands originally
identified by Mr. Smith and we inspected the wetlands to the southwest of the
Site and an open area northwest of the landfill, but still on Site property, for
suitability for upgrading as wetlands in compensation for the wetlands lost 0
north of the Site.

In closing, your characterization that the decisions of the MPCA and EPA
regarding these wetland are incorrect, inaccurate, arbitrary, and capricious is
clearly, in itself, false and inaccurate. The wetlands are not a creation of
the Agencies, but rather have been identified by an independent federal
department in a separate (and previous) activity. The wetlands do, in fact,
exist based on our Site visit. As we indicated in our meeting on April 6, 1988,
we are attempting to maintain as much flexibility on this matter as possible and
the Fish and Wildlife Service staff has offered their services to resolve this
matter. Likewise, the interests of the City of Andover and the Coon Creek
Watershed District must be tied into these discussions as well. If you have any
further questions or wish to discuss these matters more fully, feel free to

one of the most widespread classes in the United

closets. It will also require a floor drain to be installed in the
same room as the water meter, plus there is a section on the
abandonment of wel Is.
Council discussion was on how the ordinance would be applied under
various circumstances. Mayor Windschitl felt the new provision would
needles~ly require people to tear up their basements to have water
installed. He didn't didn't see the need for a floor drain.
Councilman EllIng agreed with the Mayor.
Others also questioned the need for a floor drain in the same room as
the water meter. Mr. Almgren explained they are trying to get the
meters out of the crawl spaces and closets because they are too
difficult to get at to read. He was agreeable to deleting the
floor drain requirement. Mr. Almgren also explained the State Code
requires a specific procedure to abandon wells, which is what is being
referenced in this amendment.
MOTION by Knight, Seconded by Orttel, an Ordinance amending
Ordinance No. 55, known as the MunicIpal Water System Ordinance as
presented, and change Section 32 to read: The meter shall be readily
accessible to the meter reader and shall not be located In crawl
spaces, closets, or under stairways. Motion carrIed on a 3-Yes, 2-No
(Elling, Windschitl) vote.
Mr. Almgren stated there is an old 4-inch well on the City property at
7th and 159th that must be abandoned. He estimated it would cost
about $700 to abandon that well. It is full of dirt and has to be
opened up, the rod taken nut, and filled with concrete. Council felt
it was expensIve to abandon it, asking Mr. Almgren to look at other
alternat!ves such as capping it.
ANDOVER VOLUNTEER FIRE DEPARTMENT
MOTION by Elling, Seconded by Knight, that we have the check for
$1,193.56 from the League of Minnesota Cities Trust and put it in the
Fire Department budget to pay for repairs on the grass rig. Motion
carried unanimously.

Fire Chief Bob Palmer asked the Council's opinion of donating the old
Coon Rapids tanker to the Medicine Lake Fire Department.
MOTION by Elling, Seconded by Apel, to al low the Fire Department to
offer the old tanker first to Oak Grove or any other Anoka County
municipality for $1; and if that fails, allow them to sell it to
Medicine Lake. Motion carried unanimously.

This Agreement made and entered into this
day of
1988, by and between the County of Anoka, State of Minnesota, a political subdivision of
the State of Minnesota, 325 East Main Street, Anoka, Minnesota, 55303, hereinafter
referred to as "County," and the City of Andover, hereinafter referred to as "City".
WITNESSETH:
WHEREAS, the parties to this Agreement desire to jointly cause the construction of
traffic actuated traffic control signals at the intersection of Round Lake Blvd. (C.S.A.H.
#9) at 140th Lane; and,
WHEREAS, the parties agree that it is in their best interest that the cost of said
project be shared; and,
WHEREAS, said work will be carried out in accordance with the provisions of Minn.
Stat. S 471.59.
NOW, THEREFORE, IT IS MUTUALLY STIPULATED AND AGREED:
1. PURPOSE
The County and City have joined together for the purpose of installing traffic
control signal systems at the intersections of Round Lake Blvd. (C.S.A.H. #9) and 140th
Lane as described in the plans and specifications numbered 02-609-07 on file in the office
of the Anoka County Highway Department and incorporated herein by reference.
2. METHOD
The County shall provide all engineering services and shall cause the
construction of Anoka County S.A.P. 02-609-07 in conformance with said plans and
specifications. The letting of bids and the acceptance of all bid proposals shall be done by
the County.

3.
COSTS
A. The contract costs of the work, or if the work is not contracted, the cost
of all labor, materials, normal engineering costs and equipment rental required to
complete the work, shall constitute the actual "construction costs" and shall be so
referred to herein. "Estimated costs" are good faith projections of the costs which will be
incurred for this project. The estimated costs are attached as Exhibit A, and incorporated
herein by reference.
B. The City shall pay for engineering services at a rate of eight percent
(8%) of its actual construction costs.
C. The City shall pay 75% of the cost of construction of the traffic control
signals plus engineering costs as provided herein. The estimated cost to the City is:

Construction:
Engineering (8%)
D. Upon final completion of the construction the City shall pay to the
County, upon written demand by the County, the actual cost of construction and
engineering, estimated to be $67,500.00. The City share of the project shall include only
construction and engineering and does not include administrative or other expenses
incurred by the County.
3. TERM
This Agreement shall continue until (1) terminated as provided hereinafter, or
(2) until the construction provided for herein is completed and payment provided for
herein is made, whichever of (1) or (2) shall first occur.
4. DISBURSEMENT OF FUNDS
All funds disbursed by the County or City pursuant to this Agreement shall be
disbursed by each entity pursuant to the method provided by law.

5.
CONTRACTS AND PURCHASES
All contracts let and purchases made pursuant to this Agreement shall be
made by the County in conformance to the State Laws.

6.
STRICT ACCOUNTABILITY
A strict accounting shall be made of all funds and report of all receipts and
disbursements shall be made upon request by either party.
7. SIGNALIZATION POWER
The City shall install or cause the installation of an adequate electrical power
source to the service pad or pole, including any necessary extensions of power lines, and
upon completion of said traffic control signal installation the ongoing cost of electrical
power to.the signal shall be at the cost and expense of the City.
8. MAINTENANCE
Maintenance of the completed signal and signal equipment will be the sole
obligation of the County. All other maintenance, including the ongoing cost of electrical
power to the signal, will be the responsibility of the City.
9. TERMINATION
This Agreement may be terminated by either party at any time, with or
without cause, upon not less than thirty (30) days written notice delivered by mail or in
person to the other party. If notice is delivered by mail, it shall be deemed to be received
two days after mailing. Such termination shall not be effective with respect to any
solicitation of bids .or any purchases of services or goods which occurred prior to such
notice of termination.
10. AFFIRMATIVE ACTION
In accordance with Anoka County's Affirmative Action Policy and the County
Commissioners' policies against discrimination, no person shall illegally be excluded from
full-time employment rights in, be denied the benefits of, or be otherwise SUbjected to
discrimination in the program which is the SUbject of this Agreement on the basis of race,
creed, color, sex, marital status, pUblic assistance status, age, disability, or national
origin.

11. NOTICE
For purposes of delivery of any notices hereunder, the notice shall be effective
if delivered to the County Administrator of Anoka County, 325 East Main Street, Anoka,
Minnesota, 55303, on behalf of the County, and The City Manager of the City of Andover,
1685 N.W. Crosstown Blvd., Andover, MN 55304, on behalf of the City.
12. INDEMNIFICATION
The City and the County mutually agree to indemnify and hold harmless each
other frem any claims, losses, costs, expenses or damages resulting from the acts or
omissions of the respective officers, agents, or employees relating to activities conducted
by either party under this Agreement.
13. ENTIRE AGREEMENT REQUIREMENT OF A WRITING
It is understood and agreed that the entire agreement of the parties is
contained herein and that this Agreement supersedes all oral agreements and all
negotiations between the parties relating to the sUbject matter thereof, as well as any
previous agreement presently in effect between the parties relating to the subject matter
thereof. Any alterations, variations, or modifications of the provisions of this Agreement
shall be valid only when they have been reduced to writing and duly signed by the parties
herein.

have been sold on a Contract for Deed and we have informed
these people and asked for their response and comments. A

The City Council is requested to approve the variance request by
Riccar Heating and Air Conditioning. A variance is requested to
reduce the building setback requirement of Ordinance 8, Section
6.02 from 50 feet to 40 feet.

Riccar has purchased Lot 1, Block 1 of the Andover Commercial
Park (2387 - 136th Avenue N.W.). This is a corner lot in which
the front of the proposed office/warehouse building will face
136th Avenue and the side will face the new Verdin Street (County
Road 18). Since Verdin will be a major arterial when completed,
a 50 foot building setback is required by Section 6.02 of
Ordinance 8.
However, there is conflicting wording in Ordinance 8 because
Section 4.15, Setbacks Along Thoroughfares, states that "the
minimum setback from the thoroughfare for all buildings shall be
forty (40) feet from the planned right-of-way line."
In addition, Verdin Street already has a full right-of-way (120
feet adjacent to Riccar's new lot) which is unlikely to be
expanded.
I will soon be proposing an amendment to Ordinance 8 that will
bring the setback requirements of Sections 4.15 and 6.02 into
harmony.

Regrading land before development has become popular since Oaks of
Shenandoah off Hanson Boulevard was totally regraded - the
developer mined the sand soil off 100 acres or more. I believe
the fill was used for the 610 Bridge approaches. The developer,
after the material was removed, regraded the land and there is a
nice development with rolling land that looks natural.

The next planning meeting has a number of mining permits on the
agenda.
Two large areas - Indian Meadows and Leroy Johnson's.
Leroy Johnson's land had a permit approved a couple of years ago
but it wasn't used and has expired.
Andover has a mining permit application form. About the only
thing that is not included is an escrow for restoration. Most of
the mining permits over the last 6 years have involved projects
with the City or County and the projects were able to handle the
restoration concerns.
Attached is Andover's mining permit application and Ham Lake's
Ordinance relating to excavation in a R-1 area.
Also included is a permit form to be issued to complete the
process. Now people come to a Council Meeting and we never
complete the requirement or are able to inform them of the
stipulations. They just start the work.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HAM
LAKE AS FOLLOWS:
Article Eleven of the City Code is hereby amended by
adding thereto an Article 11-660, to read as follows:

1. The following activities are hereby declared to be
nuisances, and prohibited, subject to the exceptions
A. In any areas which are zoned R-l, it shall be
unlawful to actively conduct or permit the conducting of any
plowing, disking, grading, or other activity which displaces or
destroys ground cover vegetation for any period of time, and
leaves the land wholly or partially barren of ground cover
vegetation, thereby contributing to the blowing of dust, soil, or
sand to adjacent areas. It shall be unlawful to maintain land in
areas zoned R-l which are barren or devoid of ground cover, after
any determination by the City Council that such land constitutes
a public nuisance by reason of blowing sand, dust, soil or other
material related to the land or ground cover. Any' of the above
are, for the purposes of this ordinance, hereafter referred to as
"activity". The following shall be specifically excluded from
prohibited activity.
1. Preparation of soil for a secondary activity
such as grass seeding, landscaping, gardening, flower bed
planting, tree planting, or other bona fide or residential
purposes, provided, that any such secondary activity shall be
implemented within a reasonable time after soil disturbance, and
in the case of introduction of seed, shall be evidenced by
sprouting within a reasonable time following the activity.
2. Activity which is a part of a bona fide
construction project, of a structure, private road or driveway,
or subdivision development, provided that in order to qualify
under this exception, the following criteria must be met:

permit must have been issued prior to the activity.

4. Activity incident to bona fide installation
or repair work involving structures, or fixtures in connection
with structures, whether or not permits are required.

B. The owner of land shall be presumed to have intended
to violate the provisions of this ordinance, if, within ten days
after receipt of notification that the land has been declared a
public nuisance by resolution of the City Council. such owner
shall have failed to take steps to ameliorate the nuisance on a
permanent basis, including but not limited to the planting of
seed. seedlings, or sod in such a manner as may reasonably be
expected to abate the nuisance.

STREET FROM 157TH AVENUE TO 161ST AVENUE AREA.
WHEREAS, the City Council is cognizant of the need for
improvements, a Feasibility Report has been ordered and prepared by
BRA for the improvement of street construction on Tulip Street
from 157th Avenue to 161st Avenue.

WHEREAS, such report was received by the City Council on the
19th day of April, 1988; and
WHEREAS, such report declared the proposed improvement to be
feasibile for an estimated cost of $211,730.00.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Andover that:
1. The City Council hereby accepts the Feasibility Report for
Project No. 88-9, for the improvement of street
construction in the Tulip Street from 157th Ave. to 161st
Ave. area as prepared by BRA.
2. The Council will consider the improvements in accordance
with the report and the assessment of abutting property
for all or a portion of the improvement pursuant to
Minnesota Statues Chapter 429 at an estimated total cost
of the improvement of $211,730.00.
3. A public hearing shall be held on such proposed
improvement on the day of May, 1988 in the
Council Chambers of the City Hall at 7:30 and the
Clerk shall give mailed and published notice of such
hearing and improvement as required by law.

TO ALL-TERRAIN VEHICLES, PROHIBITING THEIR
ROADWAYS WITHIN THE CITY' OF HAM LAKE,
BE IT ORDAINED BY .THE CITY COUNCIL OF THE CITY OF HAM LAKE AS
FOLLOWS:
That Article 6-400 of the City Code of the City of Ham Lake is
amended as follows:
1. All-Terrain Vehicles.
A. . Definition. An all-terrain vehicle (ATV) shall
be as defined by Minnesota Statutes Chapter 84.92,
Subdi.vision 8, 'and any subsequent amendments
thereto.
B. Prohibition and Operation on Public Roadwavs.
No ATV shall be operated within the right-of-way
o~ an1public roadway within the City)of Ham Lake.
C. Prohibited Area. The phrase "right-of-way of any
public roadway" shall includ~. but is not
necessarily limited to, the e~tire right-of-way
between property lines, including the paved
portions as well as all banks, ditches,
shoulders, and backs lopes and for roadways
which exist by adverse possession. said

whether or not paved, plus all ditches,
medians and backs lopes used in connection
with said roadways., "
D. Crossing at Right Angles Permitted. Notwith-
standing the foregoing, the operator of an ATV
may enter upon the right-of-way of a public
roadway for the sole and exclusive purpose of
crossing the roadway. Such entry and crossing
shall be as close as possible to right angles
with the direction of the roadway crossed.
E.Exceptions, Permits. This ordinance shall
not apply to the use of any ATV in furtherance
of any bona fide industrial. commercial or
public purpose. provided that to be eligible
for this exemption. the operator shall first
have obtained a permit from the City Zoning
Officer. Application for a permit shall be
made on forms to be prescribed by the Zoning
Officer, in whose sole discretion shall rest

the authority to issue the p~rmit. No permit
shall be issue~ unless the Zoning Officer shall
find that the purpose of the pe~mit i~ the
furtherance of a bona fide industrial, commercial
or public purpose, and any permit so' issued shall
limit the operator to such purposes. An adverse
decision by the Zoning Officer may be appealed to
the City Council. The-eiception herein granted.

AN-ORDI-NANCE-REGULA"r-ING-THE-, OP~ERATION OF
ALL-TERRAIN,VEHICLES
IN THE CITY OF, EAST BETHEL
The City Council of the City of East'Bethel ordains:
Section 1. Incorporation.
Any person operating an all-terrain vehicle as defined in
Minnesota Statutes, Section 84.92, Subd. 8, in the City of East
Bethel, unless provided otherwise herein. shall be subject to the
. .
provisions of Minnesota Statutes, as amended, Sections 84.92 to
84.929, inclusive, and to the Rules of the Commissioner of
Natural Resources and the Commissioner of Public Safety; which
are incorporated in and made a part of this Ordinance as
completely as if set out here in full.
Section 2. Operation on Private Property.
No person shall operate an all-terrain vehicle upon private
property or upon lands not belonging to the operator of such
vehicle without the permission of the landowner(s) ,or other
person(s)' entitled to the use and possession of such property
provided that --in the case- of "oral permission, II the landowner(s) H

or other person(s) entitled to the use and possession of the
property is present.
Section 3. Operation on Public Property.
A. No person shall operate an all-terrain vehicle in ,the
City of East Bethel upon public lands, waters or property under
the jurisdietion of the City or upon streets and highways within
the City except as provided in the following paragraphs:

A direct crossing of a street or highwaY,is
permitted if (a) made at an angle of approximately

90degrees-to ,the dir.e.ction,_of the highway and at a
place where no ,obstruction prevents a quick and
safe crossing; (b) the vehicle is brought to a
complete stop before crossing the shoulder or main
traveled way of the highway; (c) the driver yields
the right-of-way to all oncoming traffic that
constitutes an immediate hazard; (d) in crossing a
divided highway, the crossing is made only at an
in~ersection of the highway with another public
street or highway; and (e) if the crossing is made
between the hours of one-half hour after sunset to
one-half hour before sunrise or in conditions of
reduced visibility. only if both front and rear
lights are on.
An all-terrain vehicle may be operated upon a
bridge, other 'than a bridge that is part of the
main traveled lanes of an interstate highway, when
required for the purpose of avoiding obstructions, ,.
to travel when no other method of avoidance is
possible; provided the all-terrain vehicle is
operated in the extreme right-hand lane, the
entrance to the roadway is made within 100 feet of
the bridge, and the crossing is made without undue
delay. '
3. An all-terrain vehicle may be operated upon a
public street or highway other than as provided by
paragraph 1. in an emergency during the period of
time when and at locations where the condition of
the roadway renders travel by automobile
impractical.
2.
Section 4. Penalty.
Any person, firm, corporation, or association which violates
any provision of this ordinance shall be guilty of a misdemeanor,
and upon conviction thereof, may be punished with a maximum fine
of Seven Hundred ($700) dollars or ninety (90) days in jailor
both.
SectionS. Effective Date.
This ordinance shall be in full force and effect from and
after its passage and publication according to law.

The City Council is requested to consider implementing
a gopher bounty once again. I have had quite a few
requests from residents asking that we start this program
as our gopher population is on the rise.
Following are the amounts paid by surrounding cities:
Ramsey - 75~ per pair: they must be frozen,
in plastic bags and in an ice cream
bucket.
Ham Lake - presently pay $.60 per pair but this
is proposed to be raised.
East Bethel - pays $1.00 per pair.
The County will reimburse us 75~ for each pair.

recent meeting of Tuesday, March 15, 1988, adopted Resolution 1188-29,
Placing a Bounty on the Destruction of Pocket Gophers. a copy of which is
attached hereto.
This resolution establishes that Anoka County will reimburse $.75 for each
pocket gopher. Previously. the bounty had been established at $.40 for each
pocket gopher.

WHEREAS, the Anoka County Board has the authority to place a bounty on the
destruction of pocket gophers in the County of Anoka pursuant to Minn. Stat. 348.12
and 348.13; and,
WHEREAS, the Anoka County Board desires to place a bounty of seventy-five
cents per pocket gopher for the destruction of pocket gophers in those municipalities
or townships that elect to pay the individual at least seventy-five cents per pocket
gopher and where said municipality or township will certify to the County the number
of pocket gophers destroyed by each individual:
NOW, THEREFORE, BE IT RESOLVED that Anoka County will reimburse
seventy-five cents per pocket gopher in accordance with Minn. Stat. 348.12 and
348.13, to those municipalities or townships that elect to pay an individual at least
seventy-five cents per pocket gopher and each municipality or township shall certify
to the County the number of pocket gophers destroyed by each individual.

The cost of raw steel will increase after April 22, 1988:
therefore, we would like to order this work to be done now.
Also, we would like to discuss the possibility of the Fire

the Fire Department.

conversion of your step van into personnel amd equiptment van.
This quote takes a very hard look at cost and is relying on a
lot of labor to be done by The Fire Department personnal. All work
will be supervised by L.A.W. and all or any changes from the way it
has been discussed between Leroy Walkner and The Fire Department
Personna 1 Glen Smith and Roger Noyes, will or may change the cost.
All electrical work is to be done by The Fire Department
personnal. L.A.W. will provide help where needed and all brakets and
switch panels to fit their needs.
The Quote Price is $17,645.00 complete except paint and
lettering. The price is based on the cost only. There will be no
markup of the materials or the labor and there will be no charge for
the time spent by Leroy Walkner or The Fire Department Personnal.
The Breakdown of Cost is:

I assumed she wanted the cost assessed but, I talked to her Friday 1
morning and she will pay the costs.
I have included a resolution in case Bill thinks we should pass a
resolution for our records.
The lot has some problems:
l. The 33' easement that is 10 feet of
Hagen's property.
2. Should we assess the 33' easement.
3. Can we get Hagen & Rosella to exchange
property or whatever is necessary.
4. A 1" service needs to be pushed under
Round Lake Boulevard - is this a trunk
or lateral cost?
The Council is requested to give some direction. We will then
bring this item on the first meeting in May.

The City Council is requested to approve the resolution accepting
the feasibility report, waiving the public hearing, ordering the
improvement and directing the preparation of plans and specs for
project 87-11B storm drainage to Oak Bluff, Old Colony Estates and
Hartfiel's Estates.

The storm drainage is being bid along with the sewer and water
trunk. The bids will be received Friday morning - so the bid
prices will be available for Tuesday's meeting.
Discussion: The Council has a couple of choices:
l. Proceed as I have set up the project by waiving the
public hearing and proceed - not assess the Hartfiel's
Estates until they get water and sanitary sewer. Then
assess the storm drainage cost as work previously done
(Like we do T.S.S. costs for wells & pumphouses). We
have waivers from Old Colony and Chuck Cook on their
projects. We can get a waiver of hearing specifically
for the storm drainage.
2. Change the resolution to accepting the feasibility
report and ordering a public hearing. Hold a public
hearing, assess Hartfiel's Estates and defer the
assessment until they get water and sewer. In the
feasibility report, Hartfiel's Estates estimated costs
are $20,385.
The feasibility report was presented at the work session April
12th.
Information: In December of 1987, the Council passed a resolution
receiving the supplement to the 87-11 report and ordered a public
hearing after the large landowners discussed the report with the
Council. A hearing was never held and the report was revised a
number of times until the April 12, 1988 report that was feasible.

We have reviewed the proposed sketch for an entrance to a
parking lot in the Hidden Creek Park. The access off of
Bunker Lake Boulevard is acceptable as shown being opposite
the entrance to the Speedy Market. currently a by-pass lane
exists on Bunker Lake Boulevard on the intersection with
Crosstown Boulevard and with this situation, the entrance to
the parking lot is not ideal. However, it appears to be the
best that can be achieved at the present time. If a new
county Road 18 alignment is constructed further to the east,
it appears appropriate that the by-pass lane at the
intersection with Crosstown be eliminated to create a safer
entrance and exit from the parking lot.
