The City Council is requested to consider the 1988 MSA
Construction program.
The funds available for 1988 are $455,000 plus Andover has
the ability to bond for another $500,000, or $955,000 total.

We only have old petitions from Tulip Street and University

We have for a number of years told people on Tulip Street that
next year we will finish the South part of Tulip Street
(161st Ave. South to County Road 20/157th Ave.)
Public hearing should be ordered for the projects the council
wishes to proceed with. We have started the MSA Street projects
using the 429 assessment procedures, so if we need to pay for
R/W wewon'thaye to start over. Besides, a public hearing
is necessary to inform the property owners of the project.

1. Paulette, the Engineering Secretary is returning to her
previous job.
2. I will be on vacation from 10:00 a.m., March 16 until
8:00 a.m., March 28.
3. City water is in the boulevard in front of Crooked Lake
School. The School District is planning, if the tests
do come back bad, to hook up to city water immediately,
if the samples are o.k., they will hookup after school
is out for the summer.
The hookup will require them to dig up the parking lot.
4. Fiscal Disparity Legislation - there is a meeting on a
bill on March 14th, 3:00 p.m. - 4:30 p.m. in Room 546
at the Capitol to plan to lobby against the bill. The
bill, I have been told, will drastically change the present
allocations.

Subject: Extension of Schedules - Response Action Final Design Report,
Waste Olsposal Englneering (WOE) Site, Anaover, Mlnnesota
In a 1 etter to Kenneth Haberman of the f1i nnesota Poll uti onContro 1 Agency (MPCA)
staff and Kerry Street of the U.S. Environmental Protection Agency (EPA) staff,
dated February 16, 1988, the SW-28 Group (Respondents) requested a ninety day
extension to prepare and submit the Response Action Final Design Report (Report)
on the WOE Pit and Landfill. The Report is required in Exhibit A, Part VI, Task
E and Exhibit B, Part VI, Task E of the March 21, 1984 Administrative Order and
Response Order by Consent (Order) between the Respondents, MPCA and EPA.
In the February 16, 1988, letter, four reasons are given for the 90 day extension
request. The MPCA staff does not believe the institutional constraints
identified in the February 16, 1988, letter caused significant delays, and do not
constitute an adequate reason for approving an extension. However, the MPCA
staff does agree that, due to the complexity of various uncompleted engineering
and testing activities discussed in the February 16, 1988, letter, there is good
cause for granting the requested extension. Therefore, based on the MPCA staff
review, the following extension is granted in accordance with Part XXII of the
Order.

be submitted within the time frame specified above, but also in a form that will
avoid another lengthy modification process as was the case with the WOE Detailed

We have had several complaints regarding a dog (Doberman) owned
by Glen Behrends, 16441 Argon Street N.W., running at large
and attacking other dogs.
On February 19, 1988 I mailed to Mr. Behrends a copy of the
dog ordinance and a letter explaining that his dog needs to be
kept tied, in a kennel or under his control at all times.
Since that time, we have continued to have complaints about the
dog and the residents in the area would like the Council to
declare the dog a nuisance.
This particular dog is not currently licensed.
Area residents will be at the meeting with more information.

The city Council is requested to review and make comments about
the proposed residential development
The Andover Review Committee has reviewed the sketch plan and
their comments are as follows:
-The location of the proposed plat is the property between Hidden
Creek and Coon Creek just south of Bunker Lake Boulevard.
-The proposed plat is located in the Metropolitan Urban Service
Area.
-The property is properly zoned R-4, single-family urban.
-~he developer has discussed regional ponding with the Coon Creek
Watershed District. SEE ATTACHED
-Sewer and water is available to serve the property. See
attached comments from City Consultants.
-The ARC recommends that all lots be filled and graded according
to the attached diagram. The lots should have a buildable area
of at least 100 feet in depth and finished grades one foot above
the 100 year flood elevation.
-Lowest floor elevations shall be no less than 865.
-The proposed length of the culdesac does meet the requirement of
500 feet or less.
OTHER COMMENTS
The ARC recommends that the proposed plat meet all requirements
set by Andover Subdivision Ordinance 10 and zoning Ordinance 8.

Dear Review Committee Members:

The fol lowing report Is based on the Sketch Plan of Park Avenue Estates
suppl led by the City of Andover. No grading or utility plans were
submitted. The plat lies In the NW 1/4 of the SE 1/4 of Section 33-32-24,
and proposes nine lots.
Utll ity Information
Sanitary Sewer Is available but wll I not be very accessible. It does not
appear to be feasible to connect directly to the trunk line in Bunker Lake
Boulevard due to the high cost of connection and traffic control. A
manhole was constructed for the Hidden Creek Additions on the south side of
Bunker Lake Boulevard at Crosstown Boulevard but It would require the
sanitary sewer to be laid at depths of 22 to 25 feet at a distance of
approximately 13 feet from the edge of Bunker Lake Boulevard (Rim 880,
Invert 852.6), This would require substantial shoring and traffic control,
assumably at an equally substantial cost. A manhole Is also located on the
southeast corner of Coon Creek and Bunker Lake Boulevard, but It would
require a fairly deep sewer adjacent to Bunker Lake Boulevard, and In front
of an existing home. This route does not appear to be feasible, due to Its
location and confl lets with right-of-way, trees, creek and home.
A I ine may be able to be extended between Lots 1 and 2, depending on future
use of the Hidden Creek outlot, or a line may be able to be extended from
Hidden Creek Drive, between lots. However, due to the location, grade, and
elevation of the proposed lots, It may be difficult to economically serve
the development.

Watermaln Is available on the south side of Bunker Lake Boulevard at
Crosstown and cold fairly easily be extended to the plat, If the existing
house on Lot 1 were removed and the right-of-way cleared. However, the

length of the cul-de-sac would require looping to provide for fire
protection, and to prevent stagnant water problems. The water may be able
to be looped Into Hidden Creek along a lot line, depending on house
locations. As with the sanitary sewer, the economic feasibility of the
layout wll I need to be determined.

Storm Sewer should be no problem since an outlet Is readily available.
Streets are proposed to be built to Andover City Standards. The entrance
location must be approved by Anoka County. Its proximity to major
Intersections at Crooked Lake Boulevard and Bunker Lake Boulevard should be
reviewed by the County to determine the best option for entrance design.
Grading wll I require substantial fll I within the 10o-year floodplain. Lots
5 through 9 are completely or substantially within the floodplain. AI I
property further than approximately 140 feet from Coon Creek Is noted as
floodway fringe and could be fll led. AI I land closer to the creek Is noted
as floodway and cannot be fll led without a permit. The National Flood
Insurance study lists the 10o-year elevations as 863.6 under present
conditions and 864.1 under future conditions, If floodway fringe Is fll led.
This would mean the lowest road elevation would be approximately 866.1.and
lowest pad elevation would be approximately 867.6. This amount of fll I
(6.5' !) may require some fll I In the floodway area to meet pad width and
lot slope requirements.
Conclusion
It appears as If the development has some I Imitations due to Its location
and elevation. Sanitary sewer and watermaln service are available, but may
or may not be economically feasible. It Is recommended that utility
availability be discussed as soon as possible.
Corps of Engineer permits wll I be required. Much of the fll I may be
covered by a nationwide permit, but fll I Is also anticipated In the
floodway.

Dear Mr. Campbell:
At the December 28, 1987 Coon Creek Watershed District Board of
Manager's meeting, the Board reviewed the engineer's findings
regarding the proposed pond adjacent to'Ditch 57 and south of
Bunker Lake Blvd. A copy of the engineer's report is enclosed
for your review.
The Board concurred with the engineer's findings that a pond at
this location would not be beneficial to the District.

This information was added to the current TR-20 run for the
entire watershed. A cross-section was added to show the existing
condition at this site.
The model was run twice with this section added; one to show the
existing condition and one with the pond added. A structure was
not added, since the base flow in this ditch is fairly
substantial, and the bridge downstream already ~estricts the
flow.
In concluding the study, I have found that a 25 ac/ft pond in
this location did not change the water surface elevation and thus
is not useful to toe watersheds flood control regional ponding.
If the pond were dug separately from the ditch to collect water
from the development, it would have some effect on floods lbss
. than the 100 years flood. Since the proposed location is in the
100 years flood plain, it will have little effect 'on this flood.

Most of the proposed changes are a housekeeping matter so that
wording will be the same in LB, NB and SC zoning Districts as it
is in the GB and I districts that were amended on October 6, 1987
and November 3, 1987, respectively. The non-housekeeping changes
are as follows:
LIMITED BUSINESS
1. Add day-care centers as a permitted use. This use would
be consistent with the district provisions of the LB zoning
District, which is to act as a buffer between more intense
commercial districts and residential districts. This is also
allowed in similar zoning districts in other, surrounding
communities.
2. Eliminate general office as a permitted use. General
offices are redundant with professional offices, which are also a
permitted use in this district.
3. Eliminate photo and radio-television studios as
permitted uses. These uses would be included under the
definition of professional studios.
4. Eliminate urban agricultural as a permitted use.

institutions, dental clinics, mortuaries and funeral homes, and
personal services as permitted uses. These uses would be
consistent with the district provisions for the NB Zoning
district which call for "retail sales and services in such scale
as to serve the surrounding neighborhood needs." Also, these
uses are permitted in similar zoning districts in other,
surrounding communities.
2. Eliminate retail shopping as a permitted use. This term
is very broad and permits uses which may be in compatable with
the district provisions of this zoning district, such as:
department stores and hotels. Convenience stores and personal
services are added as permitted uses in this district to help
qualify the types of retail uses compatable with the district
provisions of this zoning district.
IN ALL DISTRICTS

1. Eliminate sanitary landfill as a special use. Landfills
were included under a list of uses excluded in all districts when
the General Business section of Ordinance 8 was amended on
October 6, 1987. Eliminating sanitary landfill as a special use
would remove this conflicting wording. Landfills then would not
be permitted in this city.
2. Add definitions for the terms "personal services" and
"convenience store" as proposed to be added to the list of
permitted uses in the NB zoning district.

The City Council is requested to approve the final plat for Hills
of Bunker Lake 3rd Addition .improvement project no. 88-5.
The final plat is in conformance with the preliminary plat.
It is recommended that the plat be approved subject to the
following:
1. The City Attorney has presented a favorable title opinion.
2. Security in the amount of $2,800.00 to cover legal,
engineering, street sign and installation costs.
3. The developer escrow for the uncompleted grading of the site
which is to be determined by the City Engineer.
4. Park dedication will include the entire neighborhood park
located just east of Hanson Boulevard. Grading and seeding to
be done by August 1, 1988.
5. Not to be signed by the Mayor or Clerk until there is an
executed Development Contract, escrow paid (15% of the total cost
for the improvements for the property (streets, utilities,
etc. . . ) )" and a construction contract awarded.

3RD ADDITION IMPROVEMENT PROJECT NO. 88-5 AS BEING DEVELOPED BY
HILLS, INC. IN SECTION 26 and 35, TOWNSHIP 32 RANGE 24.
WHEREAS, the City Council approved the preliminary plat of
Hills of Bunker Lake 3rd Addition; and
WHEREAS, the developer has presented the final plat of
Hills of Bunker Lake 3rd Addition; and
,J WHEREAS, the City Attorney has presented a favorable Title
opinion on the property being platted; and
WHEREAS, park dedication will include the entire
neighborhood park just to the east of Hanson Boulevard.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Andover to hereby approve the final plat of Hill of
Bunker Lake 3rd Addition contingent upon receipt of the
following:
1. Security in the amount of $2,800.00 to cover legal,
engineering, street sign and installation costs.
2. The developer escrow for the uncompleted grading of the
site which is determined by the City Engineer.

The city Council is requested to consider renaming 140th
Lane N.W. to South Coon Creek Drive.
The Andover Review Committee has reviewed the request. It is
recommended to deny the requests for the following reasons:
1. One half of l40th Lane N.W. is platted and been recorded
with the County. Addresses have been established.
2. South Coon Creek Drive is not part of the Andover street
grid system.
3. If changed to South Coon Creek Drive this could set a
precedent with other developers to name their own streets.
4. Fire Department is concerned about streets not being on
grid system.
5. Other emergency equipment such as Police and Hospital
Rescue may be confused.

1. The City Council is requested to receive the attached
community Development Report.
2. The City Council is requested to approve the attached
purchase agreement by Riccar Heating and Air Conditioning,
with one exception: the lot purchased be an interior lot
instead of a perimeter lot. The Planning Department
recommends an interior lot for Riccar for the following
reasons:

a. At a joint meeting of the City Council and the Planning
Commission on September 8, 1987, it was agreed that
lighter uses be placed around the perimeter of the
Commercial Park and heavier uses be placed in the
interior. Given this criteria, Riccar should locate on
an interior lot.
b. The two entryway lots (Lot 1, Block 1 and Lot 1, Block
2) are the most visible and most accessible lots in the
Commercial Park phase 1. The uses that locate there
will set the tone for the whole Commercial Park.
Retail and office uses may not locate in the Commercial
Park if the perimeter lots are occupied by industrial
uses. The uses that locate there will project the
image of the Commercial Park. They will also help
determine our success in achieving the goal of the TIF
District: to clean up the properties in the area and
develop an attractive commercial park.

c. There is a concern about the large quantity of vehicles
that would be parked on the property. Ordinance 78
states that "no motor vehicles shall be parked upon any
premises overnight, unless the same be stored indoors,
or totally screened from view." In addition, any
outside storage would require a special use permit. A
use that requires screening for outdoor storage, motor
vehicle and/or otherwise, would best be suited to an
interior lot.
I would recommend selling Riccar a lot in our Commercial Park as
they are a valuable business in our city. But I recommend that
lot be an interior one. I would suggest selling them an interior
lot at a reduced sale price.

COMMUNITY DEVELOPMENT REPORT
We have had a number of inquiries from parties expressing an
interest in developing in the Commercial Park. About a half
dozen would be considered more serious inquiries and about
another 6-8 would be classified as mainly "feeler" inquiries. We
have also had some inquiries about developing in other areas of
the TIF District.
Of the more serious inquiries, two have chosen lots that they
would like to purchase. Two others (one was proposing to develop
a speculative office building) have stated that they will not be
expanding (developing) at all this year, in Andover or anywhere
else, due to financial constraints. One potential restaurant
developer indicated that his market study showed the City of
Corcoran to be a better location for his business.
Of the two actively interested parties, one, Riccar Heating and
Air Conditioning, is an industrial use and the other, Twin Oaks
Dental, is an office use. Riccar is currently located in Andover
but needs to relocate by this summer. They are interested in Lot
1, Block 1 of the Commercial Park. Twin Oaks Dental needs to
expand their office this summer and would like to locate on Lot
1, Block 2 of the Commercial Park.

Riccar has signed a purchase agreement and Twin Oaks Dental has
stated that they may do the same this week. Representatives of
both of these firms may be present at the meeting this evening to
discuss their plans.
I would also like to bring up for discussion the possibility of
contracting out for services to assist us with the marketing of
the lots in the Commercial Park. Now that the building season is
upon us, I feel that we must be more aggressive in our approach
for marketing these lots. We could utilize a brochure, newspaper
and/or trade magazine ads or a combination of the two. This
would require professional assistance.

MINUTES
A Special Meeting of the Andover City Council was called to order by
Acting Mayor Ken Orttel on September 8, 1987, 6:10 p.m., at the
Andover City Hal I, 1685 Crosstown Boulevard NW, Andover, Minnesota.

JOINT MEETING WITH PLANNING COMMISSION/COMMERCIAL PARK REZONING
Planning and Zoning Commission members present: Chairperson Marge
Perry, Bill Bernard, d/Arcy Bosell, Bev Jovanoeich, Don Jacobson, and
Wayne Vistad

The Council and Planning Commission discussed the potential uses in
the City's commercial park, agreeing the entire area should be
considered at this time, not just the City-owned property.
Chairperson Perry reviewed the Planning Commission'S considerations to
date, stating they have been looking at the General Business and
Limited Industrial zones, staying away from the heavy uses. They also
wanted to have as many uses as possible permitted in those zones
rather than have a long list of special uses.
Mr. Morey reviewed his memo of September 3, 1987, where he recommended
two zones for that area. He indicated the General Bus1ness zoning as
it exists with some modifications would be appropriate, leaving in
place the Limited Industrial with some changes. He felt the existing
changes with some modifications would meet the intent of the area
rather than creating a new commercial zone for the park. It was also
his opinion that the City would not want a large motor freight
terminal next to a retail business such as McDonalds, and the two-zone
concept would prevent that.

Discussion centered around suggestions as to the types of businesses
desired in the commercial park and on controlling the appearance of
the area, especially outdoor storage. Several on the Planning
Commission noted Ordinance 78 provides clear specifications as to what
is allowed in the way of construction, storage, etc., and the Review
Committee would also control that. It was also felt the City must
strictly comply with Ordinance 78 and not vary from it at all to
maintain a high-quality development.

Acting Mayor Orttel was concerned that the lots in the park are too
large for the types of businesses desired. He feared that would
encourage unslightly outside storage. Chairperson Perry again noted
Ordinance 78 does not allow outside storage without fencing, and that
needs to be strictly enforced. Several other Councilmen suggested
natural screening between the residents and the businesses should be
required, such as a three- to four-foot berm plus shurbs.

It was generally agreed the City does not want any businesses that
would be offensive from noise, traffic, odor, etc. Mr. Morey
suggested a transportatIon terminal would meet the Intent of the
dIstrict, but a large motor freight terminal would not. The proposed
ordInance revision for the GB zone would specifically exclude auto
reductIon yards, junkyards, landfills, toxic waste storage, and other
uses which may be detrimental to the health, safety, welfare and
morals of persons residing or working In the vIcinIty.

Acting Mayor Orttel wondered If It wouldn't be better to retain the
General Industry zone In that area but revIse the ordInance so the
zone would permit only those types of busInesses desIred In the
commercIal park. Then one of the zones could be elImInated. He felt
some of those heavIer uses In the GI are not desIrable in any part of
the City and therefore should be taken out of the ordInance
altogether. That would also elImInate the need for rezoning the
commercIal park area.
Rather than rezonIng the area, ActIng Mayor Orttel also questioned the
possibility of contract zoning with the property owners as they begin
to develop their property. The uses could then be limIted at that
poInt and the area would not need to be rezoned at this tIme. After
discussing the proposal, the majority preferred a specific zoning be
placed on the properties rather than determlng use through the
platting processd.
After further dIscussIon It was generally agreed that a mIlder zoning
such as retail or combination retail and manufacturing be placed as a
narrow buffer zone basically around the fringes of the commercial park
-- on the City-owned property to the west, along Bunker Lake Boulevard
behind the service road on the north, and along Hanson Boulevard to
the east. The Internal zone would al low heavIer uses called either GB
or GI. The ordinance should then be changed to eliminate one of the
zones entirely and incorporate al I the desIred uses into the zone
called GB or GI. The internal zone would al low all uses, but the
external buffer zone would only allow the ligher uses.

There was some discussIon on the termInology of General Business
versus General Industry, though no specific direction was gIven. The
Planning Commission was asked to make a proposal on that issue and to
proceed wIth the zoning of the commercial park as agreed to.

PURCHASE AGREEMENT
RECEIVED OF Renner Arent Properties, a part-
nership, Buyer, the sum of One Thousand and
no/lOO ($1,000.00) Dollars as earnest money
and in part payment for the purchase of
property situated in the Andover Commercial
Park in the City of Andover, County of Anoka,
State of Minnesota.
Lot 1, Block 1, Andover Commercial Park,
according to the map or plat thereof on file
and of record in the office of the County
Recorder in and for Anoka County, Minnesota
Thirty-nine Thousand One Hundred Eighty and
no/lOO ($39,180.00) Dollars,
which Buyer agrees to pay in the following
manner:
Earnest money paid herein: One Thousand and
no/lOO ($1,000.00) Dollars, and Thirty-eight
Thousand One Hundred Eighty and no/lOO
($38,180.0Q) Dollars on or before July 15,
1988, the date of closing.
Subject to performance by the Buyer, the
Seller agrees to execute and deliver a
War ranty Deed conveying marketable title to
said property, subject only to the following
exceptions:
1. Building and zoning laws, ordinances,
State and Federal regulations,
2. Restrictions relating to use or improve-

The parties hereto agree that the real estate
taxes due and payable in the year 1988 shall

a calendar year. Buyer shall pay all of the
taxes due and payable in 1989 and all years

thereafter. Buyer and Seller shall each pay
one-half of all levied and pending special
assessments due against the property at the
date of closing.
This agreement is contingent upon the follow-
ing items:
Acceptance by the Ci ty Council of Andover.
In the event that the City Council has not
accepted this agreement and authorized the
execution hereof by the mayor and clerk
within forty-five (45) days after the
execution of this agreement by the Buyer,
this agreement shall be null and void.

subject to the purchaser of Buyer's building
located at 3095 162nd Lane N.W., Andover,
Minnesota obtaining a commitment for
financing to purchase such building on or
before May 1, 1988. In the event that such
commitment financing is not obtained, this
agreement shall be null and void.
(3) Subject to Buyer preparing complete plans and
specifications for construction of a building
upon the subject property. Such plans and
specifications shall be submitted to the
Seller not less than for ty-f ive (45) days
prior to the date of closing. Seller shall
have the right, in its sole discretion, to
approve all plans and specifications for
construction of a building on the subject
property. In the event that Seller does not
approve in writing such plans and specifica-
tions, either the Seller or the Buyer may
declare this Purchase Agreement null and void
and all earnest money paid hereunder shall be
refunded. Buyer agrees that a restr;j;.ction
shall be inserted in the deed from the S~ller
to Buyer which shall require Seller's approv-
al of all plans and specifications for any
buildings constructed on the subject property
and Buyer shall enter into a Development
Contract wi th the Seller to insur e pI' opel'
completion of the proposed building according
to such plans and specifications includ ing
financial guarantees of same.
The Seller further agrees to deliver posses-
sion not later than the date of closing

provided that all conditions of this agree-
ment have been complied with.
Seller shall, within a reasonable time after
acceptance of this agreement, furnish an
Abstract of Title, or a Registered Property
Abstract, certified to date to include proper
searches covering bankruptcies, State and
Federal judgments and liens. Buyer shall be
allowed ten (10) business days after receipt
for examination of title and making any
objections, which shall be made in writing or
deemed waived. If any objection is so made,
Seller shall be allowed one hundred twenty
(120) days to make title marketable. Pending
correction of title, payments hereunder
required shall be postponed, but upon
correction of title and within ten (10) days
after written notice to Buyer, the parties
shall perform this agreement according to its
terms. If title is not corrected within one
hundred twenty (120) days from the date of
written objection, this agreement shall be
null and void, at option of Buyer, neither
party shall be liable for damages hereunder
to the other, and earnest money shall be
refunded to Buyer.
If title is marketable or is corrected within
said time, and Buyer defaults in any of the
agreements herein, Seller may terminate this
agreement, and on such termination all pay-
ments made he reunder shall be retained by
Seller, as its interest may appear, as liqui-
dated damages, time being of the essence
hereof. This provision shall not deprive
either party of the right of enforcing the
specific performance of this agreement,
provided this agreement is not terminate.d and
action to enforce specific performarfi::e is
commenced wi thin six (6) months after such
right of action ar ises. In the event Buyer
defaults in his performance of the terms of
this agreement, and Notice of Cancellation is
served upon the Buyer pursuant to MSA 559.21,
the termination period shall be thirty (30)
days as permitted by Subdivision 4 of MSA
559.21.
The provisions of this purchase agreement
shall, to the extent applicable, survive the
closing.

Closing
The closing shall take place on July 15,
1988. Buyer is hereby accorded the privilege

COSG funds available to the City of Andover in 1988 equal
$35,563.00 (minus $1,000.00 County Administration fee). The 3
year allocation, 1987-89, is $106,690.00. We also have
$36,000.00 + left over from 1986. In addition, the money we
receive from the sale of the 3 lots in Nordeen's Addition will be
sent to the County and placed in our pool of CDSG funds.
We need to start thinking about possible uses for expenditures of
these funds. The County now requires that we hold a public
hearing at such time when expenditures of these CDSG funds will
be decided.

approved by HUD. As you can see, it is a little more than we had estimated.

Please note that the" 1988 Allocation" and "3- Year Allocation" figures are the
1988 actual funds and the 1987-89 estimate respectively. The Area totals are
provided for communities who cooperate in 0 three-year funding cycle and
represent the total funding available for the communities to share during the
1988 CDBG program.
As was the case with the earlier budget estimate, the $1,000 per participating
community has not yet been removed for administration. Please deduct that
amount from your budget shown on the attachment before submitting your
proposed use of funds.

Bid Award and Acceptance
Bids will be received at the Andover City Hall, 1685 Crosstown
Boulevard NW., Andover, Minnesota, until 10:00 a.m., February 16,
1988, at which time and place bids will be opened and considered.
Bids may be considered by Andover City Council on March 1, 1988.
Award shall be based on, but not necessarily limited to, the
factors of price, delivery date, City's experience with the
products proposed, City's experience with the services proposed,
City's evaluation of the bidder's ability to service the City in
the terms of the requirements as called for in these
specifications, quality of merchandise offered, analysis and
comparison of specifications detail, and bidder's ability to meet
delivery requirements.
The City reserves the right to accept or reject any or all bids or

The Contractor shall furnish a one-year warranty on entire unit
from time of delivery as a minimum and shall promptly replace or

pickup for equipment that is inoperable and covered by warranty.

The vehicle and equipment called for herein shall be a new,
currently advertised standard production model incorporating
all the latest changes and features, including those called
for herein.

Vehicle and equipment shall meet all Federal safety standards,
including those mandated by OSHA, noise level requirements,
and ICC requirements.
D.
To facilitate comparison of proposals and to provide a means
of checking adherence to the specifications detail, each
bidder shall submit with this proposal descriptive literature.
Wher~ the equipment bid differs from the specifications detail
set herein, a list of variations shall also be submitted on
the form provided. Where variations are not cited it shall be
assumed that the bidder proposes to meet all the requirements
of the specifications.
All brand names used in these specifications are intended to
be used as examples of the type of quality considered
acceptable, a bidder may substitute a brand of equal or higher
quality. Decision of quality of substitute rests with the

Bidder should quote delivered price. The vehicle called for
hereunder shall be delivered to the public works Garage located at

Delivery Date
Bidder shall indicate on th~ attached proposal form the number of
calendar days after receipt of order by which time the vehicle
shall be delivered to the City.
Manufactu~er's Specifications
A complete set of manufacturer's specifications and illustrated
descriptions, including all attachments, shall be furnished in
duplicate with each bid. Successful bidder shall complete
specification questionnaire provided by the City.
Licenses
The City shall obtain its own vehicle license, but the vendor must
supply the City with the necessary papers properly completed and
signed to enable the City to secure each license and/or title.

Training of Operator
Bidder must provide factory representative to train one or more
city employees in the operation of equipment.
Intent of Specifications
It is the intent of these specifications to obtain bids on a dump
truck, including sander, plow and wing. It should include all of
the standard manufacturer's features, as well as the additional
equip~ent listed in the equipment specifications.
Bid Security
Money deposited as represented by certified check, cashier's
check, dr bid bond accompanying the bid shall be held until
delivery is completed and accepted.
Errors and Omissions
The bidder shall not be allowed to take advantage of any errors or

in the specifications, the bidder shall promptly notify the city

Rockwell components listed below which have been installed by an original equipment manufacturer as
original equipment in an on-highway vehicle will be free from defects in material and workmanship. For
components other than oil seals, this warranty covers failures occurring after the date the manufacturer's
vehicle warranty (including any prorated coverage) applicable to such components expires, to the end of
from the date of purchase by the first Owner, or
or 800,000 km of use, whichever comes first. Oil seals on rear axles are covered for three years from the date
of purchase by the first Owner, or 300,000 miles/480,000 km of use, whichever comes first. Components
installed as replacements under this warranty are warranted only for the remainder of the period covered

The exclusive remedy under this Warranty shall be repair or replacement of the defective component at
Rockwell's option. This is the entire agreement between Rockwell and the Owner about warranty and no
Rockwell employee or dealer is authorized to make any additional warranty on behalf of Rockwell.
The first Owner must return the registration certificate delivered with the vehicle to Rockwell within 30
days after delivery to get coverage under this warranty. This warranty may be transferred by sending the
new Owner's name and address to Rockwell at the address on the registration certificate.
To obtain service under this warranty, the vehicle may be taken to any participating new truck/trailer

HAZARD ANALYSIS
PURPOSE:
The purpose of this plan is to provide a guide for emergency operations.
The plan is intended to assist key City officials and emergency
organizations to carry out their responsibilities for protection of life
and property under a wide-range of emergency conditions.
Tornadoes, floods, blizzards, and other natural disasters can affect the
City of Andover. In addition, major disasters such as plane crashes,
fires, explosions, accidental releases of hazardous materials, and enemy
attack pose a potential threat to public health and safety in the City
of Andover. An Emergency Plan is needed to ensure the protection of the
public from the effects of these hazards.
2 EMERGENCY ACTION PLAN
EMERGENCY ACTION PLAN
This Plan is designated the City of Andover's Emergency Action plan and
is coordinated with, and supported by, the Anoka County Emergency
Management Plan.
The authority of this Plan was established by Public Law 920, 21st
Congress, Minnesota Statutes, Chapter 12, as amended.
The mission of this Plan is to establish and maintain an emergency
operational capability to save lives, minimize the effects of a
disaster, provide for continuity of government, and to mobilize
resources to recover from an emergency.

MAYOR & COUNCIL PROCEDURES
In the event of a natural or man-made disaster, the Mayor will be
contacted by the City Administrator and may be requested to report to
the Administrative Headquarters located at City Hall.
The Mayor will act as liaison between the Council and City Administrator
and will maintain contact with the City Administrator. The Council may
be requested to come to the Administrative Headquarters. Under no
circumstances do they report to the emergency scene.
In the event the Mayor cannot be reached, the Acting Mayor will preside.
Upon recommendation, the City Administrator may be requested to declare
a state of Emergency in order to request State and Federal assistance.

6 WARNING SIGNALS
Actions to be taken by local government officials, Civil Defense
Director, and Emergency Service Chiefs under readiness conditions as
follows:
READINESS CONDITION 3:
Advise all staff personnel of situation, review all plans and
procedures, and check condition of equipment and status of supplies.
READINESS CONDITION 2:
Service Chiefs or designee report to Administrative Headquarters. Alert
all staff personnel and government officials. Ready all equipment for
use, making repairs if necessary. Standby personnel report to
Administrative Headquarters and make preparations to operate on around-
the-clock basis. Correct all supply deficiencies and staff remain on
alert. Check communications.
READINESS CONDITION 1:
All emergency staff personnel designated to do so, report to
Administrative Headquarters and commence 24 hour operations. Activate
and operate communications. Establish communications with Anoka County
Civil Defense and report City of Andover's status.
TYPE OF WARNING:
1. ALERT SIGNAL
(Steady tone for 5 minutes)
This signal will be used for any type of natural disaster. This
includes, but is not limited to tornadoes, explosions, radiation
accident, chemical accident, floods, etc. Public should turn on
radio or TV for specific instructions.
2. Test - First wednesday for each month - 1:00 PM

Officer will:

from the Administrative Headquarters in the event of an emergency.

Should the above Administrative Headquarters location become inoperable,
the alternate location for the Administrative Headquarters will be

ACTIVATION:
The City Administrator will initiate the activation. Staff (when
alerted) will report to the Administrative Headquarters and take action
according to their service check list.
COMMUNICATIONS:
Telephones will be available in the Administrative Headquarters. For
additional telephones call Vicki Volk.
Radio - Communications Chief will activate all communications according
to plan.

When an emergency occurs, all Service Chiefs will review this list and
take action as required for his particular service.
FIRST PRIORITY IS TO SAVE LIVES!!!
When alerted of an emergency, call your staff workers and report as
ordered.
Review your service plans, S.O.P.'s, and resources.
After briefing, issue instructions to your staff.
Obtain damage assessment information pertinent to your service,
report to Administrative Headquarters.
Insure Coordinator and staff are advised of actions being taken.
Register all personnel, confirm they have passes, keep time sheets,
and rotate personnel.
Establish security when pertinent to your service.
Coordinate the activities of your staff with other services.
Use all resources including personnel, equipment, and supplies,
before requesting assistance. Try to anticipate your service needs
for manpower and equipment to meet your needs so they are available
as required. When requesting assistance, be specific - WHAT - WHEN-
REPORT TO WHOM - AND HOW LONG will assistance be needed.
10. Be prepared to make periodic reports on status of operation and
problems remaining to be resolved.
FISCAL AND LEGAL SERVICE :
Insure that all necessary records for emergency operations are
available.
Provide advice and guidance to staff.
Set-up procedures to acquire equipment and supplies during
emergency.
Establish record system for all legal obligations.
Insur& that all payments or restitutions are made.
Represent the City in all matters requiring legal interpretation,
prosecution, and claims.

1. Coordinate with Civil Defense Coordinator, and key staff on
essential information to be disseminated to the Public.
2. Take appropriate action to insure the timely dissemination of
pertinent information by expeditious means.
3. Prepare releases for distribution to Media, subject to approval of
City Administrator.

COMMUNICATIONS SERVICE:
1. Maintain a current roster of all personnel.
2. Develop plans to obtain, operate, and maintain, all communication
equipment required for emergency operations in the City of Andover.
3. Coordinate communication activities for emergency operations.
4. Maintain communications from the Administrative Headquarters to
County and City Support Administrative Headquarters and shelters as
needed.
5. Coordinate communications with other services including development
of alternate means.
6. Maintain records of all communication activities including incoming
and outgoing message logs.
7. Keep the Civil Defense Coordinator advised of any problems.
8. Local Radio Networks.
LAW ENFORCEMENT CHIEF:
Maintain current roster of all personnel - regulars and reserves.
Notify Staff to report as situation directs.
Chief or Captain will remain in the Administrative Headquarters to
coordinate Police activities with other services.
Officer in charge at scene of emergency will immediately CLOSE OFF
DISASTER AREA to stop and reroute all in-bound traffic and establish
security as needed.
Communications between roadblocks and Administrative Headquarters
will utilize Police radios.
Police car radio will be primary communications to County
Administrative Headquarters in the event of landline failures.
Set-up emergency pass system when needed. Call the Chief of police,
Area Commander, and District Highway Patrol for passes. City Staff
will assist with administration of pass system (be sure persons
issuing passes know the people and the community. Passes should be
for a limited time and re-issued as necessary).
a. Color coded arm bands will be issued to rescue and law
enforcement personnel '(with proper identification), press,
relatives or victims searching for family members, etc.
FIRE AND RESCUE CHIEF:
Maintain current roster of personnel (names, addresses, phone -
business and home).
Notify personnel to report as situation directs.
Chief or Assistant Chief will report to the Administrative
Headquarters to coordinate fire and rescue activities with other
services.
First priority is to rescue injured and trapped persons.
Officer on scene will keep the Administrative Headquarters advised
of the situation, the assistance and equipment needed (type, amount,
where to report, to whom, etc.).
Coordinate with Engineering (Public Works) and Police Services.

from State and Federal agencies.
4. Establish priorities, policies, and guidance, for distribution and
conservation of petroleum products.
5. Establish system for emergency distribution of food supplies.
6. Provide support to other services.

The City of Andover has been awarded a $5,000.00 matching flood
damage reduction grant by the DNR. We are one of only 5
communities in the Metro Region to be awarded one of these DNR
Flood Damage Reduction Grants. The grant is for an inventory of
flood plain structures in the city, the development of a computer
data base, and the creation of an flood plain information
handout.
Funding from the DNR will be available by the end of March. Todd
Haas and myself need to meet with John Stine of the DNR to
finalize contract details, including the final grant amount. We
need to know now if the city would be willing to spend up to the
$5,000.00 match of this grant.
The City of Andover Staff time can be used toward the grant.

SUBJECT: Flood Damage Reduction Grant Program
Enclosed is a set of instructions and forms for the Flood Damage
Reduction Grant Program. The program is intended to assist local
governments in reducing all flood damages and not only for flood damages
which occurred during the July 20 and 23, 1987 floods. Any flood damage
reduction project in your jurisdiction may be eligible for funding.
Some typical projects qualifying under the program are described in the
attached materi a 1 s; re 1 ocat i on of structures, flood-proofing existing
structures, limited and detailed hydrologic/hydraulic studies to map or
re-map floodplains, signing of floodplain areas, information/education
efforts, limited structural projects, etc.
Please take time to develop your list of flood damage reduction
projects; we hope to identify many worthwhile projects in order to seek
continued fynding from the Legislature. There is a December 31, 1987,
submission deadline.

Dear Local Government Officials:
In 1987 legislation was approved to establish a DNR technical and financial
assistance program to help local government units reduce flood damages. This
techni~al and grant assistance program is being administered by the DNR Division
of Waters.
The Division of Waters is now ready to accept applications for funding .
assistance and to provide technical assistance to local government units to plan
for and implement flood damage reduction measures.
The purpose of this letter and the attachments to it are to provide:
1. Information about the Flood Hazard Mitigation Grant Program.
<<=> 2. An application for grant assistance.
3. Examples of Eligible Projects.
4. Criteria to be used by the DNR to evaluate all grant applications.
If you are interested in developing a program or project for reducing flood
damages please read the attached materials and then contact the DNR Area
Hydrologist for assistance in developing your project and your grant
application.
Grant applications will be accepted by the Regional Hydrologists until
December 31, 1987. Applicants will be notified about the status of their
application by February 15, 1988. It is anticipated that successful applicants
will receive their funding on or about March 31,' 1988 with a second disbursement
on or about September 15, 1988.
It is hoped that this program will help to provide a permanent solution to many

FLOOD HAZARD MITIGATION GRANT ASSISTANCE PROGRAM
What is the program?
During the 1987 Legislative Session, Laws of Minnesota Chapter 306 Sections 3-5
established within the Department of Natural Resources a flood hazard mitigation
program to provide state technical and financial assistance to local government
uQits for conducting flood damage reduction studies and for planning and
implementing structural and non-structural flood damage reduction measures.
What flood hazard mitigation measures are eligible for funding assistance?
Financi~r assistance may be available for conducting flood damage reduction
studies and for planning and implementing structural and non-structural measures
including: dams, dikes, levees, flood bypass channels, flood storage and
retardation structures, water level control structures, acquisition of
floodplain lands, relocations, floodproofing, development of flood warning
systems and evacuation procedures, adoption and enforcement of land use control
ordinances and building codes, signs and other notifications of regional flood
areas, provision of flood insurance and public education.
What measures are not eligible for funding assistance?
Certain measures are excluded from this program including deepening or
straightening. existing stream channels, cleaning out public ditches and clearing
and snagging natural watercourses.
Who may apply for funding assistance?
Applications for financial assistance must be made by a local government unit
including a county, statutory or home rule charter city, town, watershed
district or lake improvement district. Financial assistance is not available
directly to individuals, companies or corporations.
How much financial assistance is available?
The Department of Natural Resources may award grants up to $75,000. Grants for
more than $75,000 must be submitted for consideration by the governor and the
legislature before each odd numbered year. Grants awarded under this program may
not exceed one-half of the total cost of the prpposed flood damage reduction
project. .
How are grant requests evaluated?
Grants are to be based on the following considerations:
1. the extent and effectiveness of mitigation measures already implemented by
the local government requesting the grant;
2. the feasibility. practicality, and effectiveness of the proposed mitigation
measures and the associated non-flood related benefits and detriments;
3. the level of grant assistance that should be provided to the local
government~ based on available facts regarding the nature, extent, and
severity of flood problems;
o
4. the frequency of occurrence of severe flooding that has resulted in
declaration of the area as a flood disaster area by the President of the
United States;
5. the economic, social, and environmental benefits and detriments of the
proposed mitigation measures;
6. whether the floodplain management ordinance or regulation adopted by the
local government meets the minimum standards established by the
commissioner, the degree of enforcement of the ordinance or regulation, and
whether the local government meets the minimum standards established by the
commissioner, and whether the local government is complying with the
or~lAance or regulation;
7. the degree to which the grant request is consistent with local water plans
developed under chapters 1108 and 112 and sections 273.875 to 473.883;
8. The financial capability of the local government to solve its flood hazard
problems without financial assistance; and
9. . the estimated cost and method of financing of the proposed mitigation
measures-based on local money and federal and state financial assistance.

The DNR is required to prioritize all grant requests according to the above
considerations.
When will the flood hazard mitigation grant funds be distributed?
Applications for grants this biennium will be accepted until December 31, 1987

distributed by March 31, 1988. The other one half of the funds will be
distributed by September 15, 1988. . The same applications win be used for both
of these funding cycles.
Contact your local DNR Area Hydrologist. The Area Hydrologist will be able to
help you evaluate your flooding problems and may have ideas about how to best
solve your flooding problems. The area hydrologist may also be able to suggest
improvements to the application before it is submitted for the formal review
process. A list of Regional Hydrologists, Area Hydrologists and their locations
is attached.

Examples of Eligible Projects
_ The flood damage reduction grant assistance program is designed to mitigate
damages due to flooding within rural and urban floodplain and shore1and areas.
_ Structural and non-structural mitigation measures are eligible for funding
assistance.
-'Several categories of eligible projects are identified below.
_ Eligible projects have been grouped as generally receiving high-, medium-, or

_ Each project proposal will however be prioritized on its own merit.

- Innovative proposals are encouraged.
HIGH PRIORITY
1.
Projects primarily intended to reduce the flood-related risk to human life
and health:

_ ,improved community flood warning and emergency evacuation measures,
-reloca'tion of dwellings out of flash flood areas,
_ emergency response plans for communities with emergency levees.
Proposals to relocate public arid private structures out of the high
risk/frequently flooded areas (i.e., f100dway or 10-year floodplain high
lake levels areas).
Projects which have the potential for very high benefits to costs:

- improved flood warning and emergency response measures,
_ minor structural measures (levees, water level controls, bypass channels)
which would protect many buildings (most major flood control measures
would not fall under this category),
- emergency f1oodproofing measures.
4. Post Disaster Measures
_ implement post disaster measures that achieve long term damage reduction,
_ develop community post flood disaster mitigation plans as required by
elements of the Federal regulations for disaster assistance.
5. Feasibility studies for any of the above project types of development of an
integrated community wide flood damage reduction plan of action.
~ MEDIUM PRIORITY
1. Projects intended to assist communities in better regulating existing or new
floodplain development:
- improved'mapping or elevation reference marks;
- flood prone structure inventory;

- signing of the floodp1ain.
_ technical studies to accurately determine or redetermine flood elevation
and floodplain delineation. ,
2. Acquisition of flood prone lands - priority would be given to the purchase
of lands in the regulatory floodway or 10-year floodplain. ,
3. Relocation of public or private structures and facilities out of the
regulatory floodway or 10-year floodplain.
4. Floodproofing of public and private facilities (design and implementation):
- permanent closure of low openings
- e~~vating structure
_ elevating furnace, utilities, etc.
- temporary closures
5. Structural measures - physical actions taken to modify the behavior and
extent of floods:
- dams
- dikes
- levees
- bypass channels
- flood storage and retardation structures
- water level control structures.

Pu~lic Education
- radio/television broadcasts.
_ insert in water bills instructing residents of the proper action to take
in the event of a flood warning.
_ sponsorship of a seminar to assist homeowners in floodproofing their
home.
7. Feasibility studies for any of the above project types.
8. Comprehensive watershed studies - urban and rural.
_ identify feasible options to reduce flooding,

LOW PRIORITY
1. Structural projects intended to reduce the flooding of rural undeveloped
lands exclusively.
2. Projects that would solely protect highway/transportation facilities. '
NOT TO BE FUNDED
1. Cleaning of public ditches.
2. Clearing and snagging natural watercourses.
3. Deepening or straightening existing stream channels.

Flood Damage Reduction Project Evaluation Criteria
o
The following are criteria that will be used to rate each application for flood
damage reduction funding assistance. No actual scoring mechanism will be used
but the criteria will be used to make detailed comparisons among applications.
Have floods been caused by:
Lakes?
Streams?
Ponding Areas?
Storm Sewers?
High Groundwater Levels?
OV8~land Flow?
Some combination of the above?
Have floods caused loss of lives or posed health and safety problems?
Have flood damaged residences/farmsteads?
Have floods damaged businesses?
Have floods damaged public facilities/utilities?
Have floods damaged commercial/industrial facilities?
Have floods damaged agricultural or other rural lands?
Has the local government been designated in a Presidential Disaster Declaration?
Does the local government have a floodplain/shoreland management ordinance?
Does the local government adequately enforce the ordinance?
Has the local government conducted public information or education programs
about floods?

Has the local government taken actions in the past to mitigate the effect of
flooding?
Does the local government unit participate in the National Flood Insurance
Program?
Has the local government advised residents that flood insurance is available?
