Carlberg A ; a , REGULAR ANDOVER OPENSPACE ADVISORY COMMISSION MEETING FEBRUARY]], 2015 MINUTES The Regular Meeting of the Andover Open Space Advisory Commission was called to order by Chairperson Gretchen Sabel at 7:04 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. Commissioners present: Aaron Jarson, Kim Kovich, Jim Myers, Bruce Perry and Suzanne Van Hecke Commissioners absent: Jim Olson Also present: David Carlberg, Community Development Director Donna Aasness, Resident RESIDENT FORUM No one wished to address the Commission. OATH OF OFFICE Mr. Carlberg administered the Oath of Office to Commissioner Aaron Jarson. He noted that Commissioner Olson had also been reappointed but is not present tonight to be sworn in. APPROVAL OF MINUTES — January 14, 2015 Motion by Commissioner Kovich, Second by Commissioner Perry, to approve the minutes of January 14, 2015. Motion passed 6 -0. OPEN SPACE ACQUISITION UPDATE Mr. Carlberg stated that staff had hoped the City Council would have discussed the Selmer /Blanchette property during a January Workshop meeting but advised that item has been pushed back to the February 24`1' Workshop. He advised that staff is meeting with Mr. Wold to discuss his plans for an access road out to Hanson Blvd. He provided an update on the negotiations currently ongoing with Mr. Kuiken and confirmed the desire of the Commission to purchase the property. He hoped to have a closed session of the City Council to discuss the property acquisition negotiations on February 17th. MANAGEMENT PLAN UPDATES Mr. Carlberg noted that the management plans had recently been discussed and amended. He referenced the term open space, as well as the type of activity that should occur, and asked for input from the Commission. Chairperson Sabel stated that the lands should be open to the public but with additional controls, such as no bicycles. Mr. Carlberg stated that all of the rules that apply to city parks also apply to open space. He noted that he could bring a copy of the rules list to the next meeting for the Commission to review. Regular Open Space Advisory Commission Meeting Minutes —February 11, 2015 Page 2 Chairperson Sabel provided a draft copy of a document she printed which includes rules for the open space that could be posted in the kiosks. Commissioner Van Hecke suggested the term preservation be used in a statement as well. Mr. Carlberg stated that the Commission has been moving in the direction of providing access to residents and improving wildlife habitat but noted that there is another option to simply preserve the land in a natural setting. He questioned the level the Commission wants to invite residents into the open space properties, noting that a decision would be necessary in order to move forward on grant applications should the Commission make that choice. Donna Aasness stated that there is a middle ground between straight preservation and parks style maintenance and questioned how the public would be made aware of that middle ground. She also questioned how enforcement would occur for those riding bicycles, noting that she has seen bicycles riding through the North Woods Preserve open space area next to them. Commissioner Perry stated that in his opinion if something is named open space it should remain open space. Mr. Carlberg advised that rules /regulations signage had not yet been posted near the North Woods Preserve parking area and noted that would be the next step to be done in the spring. He stated that he will bring the rule /regulations to the March 1 11 meeting and the Commission can review and amend if necessary. Commissioner Kovich stated that in the past the decision had been made to use the park rules but noted that it may make sense to amend those rules specifically to the open space. He stated that the intent of the open space program had been to save land from development and preserve the land in that sense. Commissioner Van Hecke mentioned a comment that had been made by Mayor Trude to request additional parks staff because of the additional workload from open space. She personally did not believe that the open space management requires that much work from the Parks Department. Mr. Carlberg explained that the new 40 -acre park was the primary reason for the need for additional park staff. He explained that park staff works on open space projects when they have time available. He provided the example of tree trimming that is currently underway and advised that the wood chips created from this activity will be used for the open space paths. He explained that certain open space areas will be used more because the surrounding area is developed with homes, compared to other open space areas that are located in rural areas on a cul -de -sac like Martin's Meadows. Chairperson Sabel stated that she would like to see access preserved but would also like more information, such as an assessment. She would also like to see a physical barrier to bicycles. She also believed that signage,,such as a kiosk, should be placed at the southern entlance to North Woods Preserve. ' Regular Open Space Advisory Commission Meeting Minutes — February 11, 2015 Page 3 Mr. Carlberg confirmed the consensus of the Commission that signage should be posted, access should be provided to the public with guidance, and minimal maintenance should occur. Commissioner Kovich provided an example of a 40 -acre open space /park within the city of Champlin that has minimal signage and maintenance. Commissioner Myers did not think that the foot traffic should be limited to trails as he believes that it is important to allow people to wander through the area. Commissioner Kovich stated that most people will stay on the trail but agreed that the area should remain open for people to wander and view. Chairperson Sabel commented that the draft document she prepared could be made larger to display in the kiosks. Commissioner Van Hecke stated that the language could be made more positive. Mrs. Aasness referenced the issue of wildlife adaptation and recognized that while some types of wildlife adapt well, others do not. Mr. Carlberg noted that he would distribute the document from Chairperson Sabel along with the current rule /regulations to discuss at the March meeting. NAMING OF RECENTLY ACQUIRED OPEN SPACE — SELMER/BLANCHETTE PROPERTY Mr. Carlberg noted that he simply placed this on the agenda to continue the thought process. OTHER BUSINESS Chairperson Sabel stated that she and Commissioner Myers are involved in the pollinator task force and believed that perhaps representatives and infonnation from that group could be included at the table that this Commission and the Parks and Recreation Commission share at the Andover Family Fun Fest. a. Next Meeting: March 11, 2015 Noted. Mr. Carlberg hoped that a joint meeting could occur between the Commission and City Council during the month of May. Carlberg CHAPTER 4 PARKS AM D RECREA u IWA AREAS SECTION: ION: 8 -4 -1: Regulations 8 -4 -2: Violations; Penalties 8 -4 -1: REGU A o DONS: The use and occupancy of all city parks, recreation areas, and open space owned, rented and /or leased by and located in the city shall be subject to the following regulations (Amended Ord. 399, 9- 7 -10): A. Abusive Language; Noisy Conduct: Persons engaged in offensive, obscene or abusive language or boisterous and noisy conduct tending reasonably to arouse alarm, anger or resentment will not be allowed. B. Advertising, Selling And Solicitation: No advertising, unapproved selling or solicitation is allowed. An Exclusive Use Permit may be approved by the City Council and issued by the City Clerk for the selling of food, alcoholic or nonalcoholic beverages as established by City Council resolution. C. Alcoholic Beverages: Consumption or possession of alcoholic beverages is not permitte*d unless a permit is obtained under Subsection B of this section. D. Fires 1 : It shall be unlawful to build or attempt to build a fire except in areas designated for such purpose. No person shall drop, throw, or othenniise scatter lighted matches, burning cigarettes or cigars, tobacco, paper or other flammable material. E. Firearms And Explosives: No firearms (as defined by city ordinance) 2 or explosives shall be present or used unless approved by the City Council. Authorized law enforcement officials shall be exempt from this regulation. F. Gambling: Gambling shall not be allowed. G. Golfing: No person shall be allowed to golf or practice golf. I See also title 7, chapter 3 of this code. 2 See subsection 5 -4 -'IA of this code. I. Hours City parts, recreation areas, and open space shall not be occupied or used, nor may any motor vehicles be parked therein, between eleven o'clock (11:00) P.M. and six o'clock (6:00) A.M., except when participating in an activity for which a permit has been granted by tike city. The Slate Park located at Sunshine Part; is not to be occupied or used frorn dusk to dawn. (Amended Ord. 399, 9 -7 -10; Amended Ord. 402, 12- 21 -10) Operation Of Motor Vehicles 1. No person shall ride or drive a vehicle at a rate of speed exceeding that posted in city parks or fifteen (15) miles per hour. 2. Drivers shall confine the operation of any motorized vehicle to roads, parking areas, or other areas specifically designated as temporary parking areas by the City Council and /or their designated representatives. 3. tt shall be. unlaYniil for any self- propelled vehicle, including, but not limited to, "motor vehicles" as defined in Minnesota Statutes Chapter 169, Other self - propelled vehicles, go- carts, and snowmobiles, to travel within city parks, recreation areas, or open space, except on established roadways, trails, or other areas designated for such purpose. Authorized emergency vehicles, city vehicles and wheelchairs for the handicapped or disabled are exempt from this regulation 1 . (Amended Ord. 399, 9 -7 -10) J. Damage To Part: Or Open Space Property: It shall be unlawful to mark, deface, disfigure, injure, tamper with or dispose of or remove any buildings, bridges, playground equipment, tables, benches, fireplaces, railings, paving or paving materials, public utilities or parts or appurtenances thereof, signs, notices (temporary or permanent), monuments, stakes, posts, eq! iipment, facilities or park property or appurtenances, whatsoever, either real or personal. (Amended Ord. 399, 9 -7 -10) K. Pets And Animals: 1. Leashed Animals: All domestic animals (such as dogs, cats and similar animals) roust be kept leashed 2 . Exception: Dogs are allowed to be unleashed in a designated and /or authorized municipal or county dog part: area. (Arnended Ord. 402, 12- 21 -10) 2. Removal Of Excrement: Owners are required to clean up and dispose See title 6, chapter 3 of this code. 2 See also subsection 5 -1A -5A of this code. of their pe't's excrement 3 3. Horses shall not be allowed in any park or open space area including the city trail system. (Amended Ord. 399, 9 -7 -10) 4. lunting, Trapping, Tormenting: No person shall hunt, molest, harm, kill, trap, chase, Lease or throw missiles at any animal. 5. removal Or Possession Of Young Or Eggs: No person without city permission shall remove or have in possession the young or any wild animal or have the eggs or nest or young of any reptile, mammal or bird; exception to the foregoing is made in that snakes known to be poisonous, such as rattlesnakes, and/or otherwise hazardous to human safety, may be killed or removed for the purpose of maintaining native wildlife habitat and population. (Amended Ord. 402, 12- 21 -10) L. Play Areas: No person shall engage in activities that interfere with another park user's active use of designated play areas. This shall be construed, but not be limited to, prohibiting the use of sleds, toboggans, or snowmobiles on any skating rinks, or other such conflicts of use. (Amended Ord. 4.02, 12- 21 -10) M. Protection Of Trees: It shall be unlawful to remove, cut or otherwise deface any tree or ground cover without consent from the Commission and written permission from the City Clerk. �. Posting Signs: It shall be unlawful to post any sign, placard, adver'tisement or inscription, or cause to be erected any sign, unless approved by the City Administrator or designee. O. Glass: No glass beverage containers will be allowed in any designated city part:, park or recreation facility, or open space. (Amd. Any person, firm or corporation violating any of the provisions of Subsections 8- 4-1A, B, 1=, G, H, K, L, NJ and O of this chapter shall be guilty of a petty misdemeanor and, upon conviction thereof, shall be punished in accordance with state law. B. Any person, firm or corporation violating any of the provisions of Subsections 8-4-1C, D, C, I, J and M of this chapter shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished in accordance with state law. Mr. Bednarz advised that this conversation has opened many options for further discussion and negotiation. DISCUSS JOINT MEETING WITH COUNCIL Chairperson Sabel stated that a joint meeting will be held on February 28`h. Mr. Bednarz confirmed that the meeting would be a Worksession with the Council and the OSAC portion of the meeting would take place beginning at 6:00 p.m. Chairperson Sabel stated that she would be in Grand Rapids that day. Commissioner Kovich confirmed that he would speak for the Commission. The Commission further discussed the strategy for the presentation to the Council including a power point presentation which will provide background information. Chairperson Sabel questioned if the Commission should extend an invitation to the Council, at that meeting, to tour the open space areas. Mr. Bednarz confirmed that a structure is developing for a power point presentation which will be used at the joint meeting. He noted that he could develop abase structure that Commissioner Van Hecke could complete. REVISIT MO UNTAIN BIKE DISCUSSION FROM LAST MEETING Chairperson Sabel confirmed that a member of the Parks Commission attend the previous meeting to request mountain biking as an allowed activity in the open space area and confirmed that horses are currently not allowed. Commissioner Olson stated that one or two mountain bikes would not be harmful but noted that numerous bikes could damage the area. Chairperson Sabel questioned if a specific site was identified. Mr. Bednarz stated that a site was not identified but advised that it was proposed to post signs identifying the trails. Commissioner Kovich stated that he associates parks with mountain bikes and not a preserved area, such as open space. Regular Open Space Advisory Commission Meeting Minutes — February 8, 2012 Page 5 Commissioner Olson commented that mountain bike trails usually are meant to be challenging and not intended for a leisurely ride. Commissioner Jarson stated that he would suggest not advocating bikes but also not disallowing bikes. Commissioner Kovich confirmed that the Commission is not interested in advocating for mountain biking in an open space area. Mr. Bednarz stated that he would communicate to the staff member liaison for the Park Commission that the OSAC has concluded their discussion and does not wish to advocate for mountain biking in the open space areas. OTHER BUSINESS a. March/April Newsletter Mr. Bednarz presented the proposed March/April City newsletter and the Commission provided comments and suggestions. Chairperson Sabel suggested that an easier pathway be given for reaching the open space page. Commissioner Van Hecke questioned if easier access to maps could be provided as well. Mr. Bednarz confirmed that there has not been much work put into the website for the Commission and noted that he would accept suggestions. Chairperson Sabel discussed the option to conduct a televised segment which could air on a local television channel. She stated that once this acquisition is complete the Commission could focus on items such as this, and a possible joint segment with the Parks Commission. She suggested that a logo be used to identify the OSAC portion of the newsletter. Chairperson Sabel confirmed that the Commission would like to remove the second story and insert maps in that place. She also confirmed that the mission statement would be included in a future newsletter. b.
