MOTION by Councilman
to adopt the fo~lowing:
A RESOLUTION FOR HEARING ON PROPOSED ASSESSMENT FOR THE IMPROVEMENT OF
STREET CONSTRUCTION FOR PROJECT NO. 88-16, 173RD & NAVAJO.
WHEREAS, by a resolution passed by the City Council on August 17,
1989, the City Clerk was directed to prepare a proposed assessment of the
cost of improvements for project No. 88-16; and
WHEREAS, the Clerk has notified the Council that such proposed
assessment has been completed and filed in her office for public
inspection.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Andover, MN:
1. A hearing shall be held the 5th day of September, in the City Hall
at 7:30 P.M. to pass upon such proposed assessment and at such time and
place all persons owning property affected by such improvements will be
given an opportunity to be heard with reference to such assessment.
2. The City Clerk is hereby directed to cause a notice of the hearing
on the proposed assessment to be published once in the official newspaper
at least two weeks prior to the hearing, and she shall state in the notice
the total cost of improvement. She shall also cause mailed notice to be
given to the owner of each parcel described in the assessment roll not less
than two weeks prior to the hearings.
3. The owner of any property so assessed may at any time prior to
certification of the assessment to the County Auditor, pay the whole of the
assessment on such property, with interest accrued to the date of payment
to the City Treasurer, except that no interest shall be charged if the
entire assessment is paid within 30 days from the adoption of the
assessment. He may at any .time thereafter pay to the City Treasurer the
entire amount of the assessment remaining unpaid, with interest accrued to
December 31 of the year in which such payment is made. Such payment must
be made before Oqtober 15 or interest will be charged through December 31
of the succeeding year.

A RESOLUTION DECLARING COST AND DIRECTING PREPARATION OF ASSESSMENT
ROLL FOR THE IMPROVEMENT OF STREET CONSTRUCTION FOR PROJECT NO. 88-16,
173RD & NAVAJO.
THE CITY COUNCIL OF THE CITY OF ANDOVER HEREBY RESOLVES:
WHEREAS, a contract has been entered into for the construction of
the improvements and the contract price for such improvement is
$28,107.70 , and the expenses incurred or to be incurred in the making
of such improvement amount to $ 8,432.30 and work previously done
amount to $ 0 so that the total cost of the improvement will
be $ 36,540.00
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Andover, MN:
1. The portion of the cost of such improvement to be paid by the City
is hereby declared to be $ 0 and the amount of the cost
to be assessed against benefited property owners is declared to
be $ 36,540.00
2. Assessment shall be payable in equal annual installments extending
over a period of 15 years. The first of the installments to be
payable on or before the first Monday in January 1990, and shall
bear interest at the rate of percent per annum from the
date of the adoption of the assessment resolution.
3. The City Clerk, with the assistance of the City Engineer shall
forthwith calculate the proper amount to be specially assessed for
such improvement against every assessable lot, piece or parcel of
land within the district affected, without regard to cash
valuation, as provided by law, and she shall file a copy of such
proposed assessment in her office for public inspection
4. The Clerk shall, upon the completion of such proposed assessment,
notify the Council thereof.

The Union Mediation Session is scheduled for 9:30 A.M., August 21,
1989.
I would like to have the authority to offer more specific wages
for each employee than the range the City has offered. The range
is okay but each employee would like to know where he is in the
range. The Public Works Maintenance Worker range is from $8.50 to
$12.50 per hour.
I presented a plan to the Council on May 2nd with my
recommendation of individual salaries.
I would like to be able to get the contract signed on the 21st.

A JOINT POWERS AGREEMENT BY AND BETWEEN
THE CITIES OF COON RAPIDS AND ANDOVER
FOR THE CONSTRUCTION AND MAINTENANCE OF
CERTAIN PUBLIC UTILITIES WITHIN THE
CITY OF COON RAPIDS AND THE CITY OF ANDOVER
This Agreement made and entered this ____ day of
, 19_,
by and between the City of Coon Rapids, a municipal corporation
herein after referred to as "Coon Rapids", and the city of Andover, a
municipal corporation herein after referred to as "Andover".
WITNESSETH:
WHEREAS, Coon Rapids and Andover share a common border, and
WHEREAS, development in both cities along said common border
is either occurring or expected to occur within the near future, and
WHEREAS, the ci ty of Coon Rapids proposes to construct
various public improvements including sanitary sewer, watermain, storm
drain, and street which will serve areas in Andover as well as areas
in Coon Rapids, and
WHEREAS, a determination has been made by the city Council
of both communities that such improvements should be constructed, and
WHEREAS, the city of Coon Rapids has prepared a feasibility
report for Coon Rapids Project 89-23, including Kirby Estates addendum
thereto which is on file in the office of the Coon Rapids city
Engineer, and
WHEREAS,
said report includes utility and/or street
construction within the City of Andover, and
WHEREAS, said utility and street construction benefits areas
within the city of Andover as well as the city of Coon Rapids, and
WHEREAS, the cities mutually agree to share in the cost for

such improvements on the basis of the relative benefit to properties
lying within each municipality, and
o
WHEREAS, Minnesota statutes section 471.59 authorizes
political subdivisions of the state to enter into joint powers
agreements for the joint exercise of powers to each.
NOW, THEREFORE, it is mutually stipulated and agreed:
1. Purpose: Parties are joined together for the purpose
of construction of roadway, storm drainage, sani tary
sewer, and watermain within proposed 133rd Avenue and
areas both north and south of 133rd Avenue within the
city of Coon Rapids and the City of Andover as described
in the feasibility report for Coon Rapids Project 89-23,
and the Kirby Estates addendum thereto, on file in the
office of the city Engineer, Coon Rapids, Minnesota and
incorporated herein by reference.
2. Method: The City of Coon Rapids will provide all
engineering services and shall cause the construction of
said Coon Rapids project 89-23, including Kirby Estates
addendum thereto, in conformance with said report.
3. Improvements: Improvements to be constructed shall be
as indicated in the feasibility report for Coon Rapids
Project 89-23, including Kirby Estates addendum thereto.
4. Cost: The project cost of the work shall constitute the
actual "construction cost" and shall be so referred to
herein. "Estimated cost" are good faith projections of
the cost which will be incurred for this project.
Actual cost may vary and shall be the cost for which the
city of Andover will be responsible. The estimated cost
to the city of Andover is $255,510. This estimated cost
includes $192,113, construction cost plus an estimated

33% for engineering, staking and inspection, administra-
tion, advertising, construction interest, and assessment
spreads.
The city of Coon Rapids will provide the City of Andover
with a final cost broken down into various elements
i.e., sanitary sewer, watermain, storm drain, and street
and broken down into benefits to individual properties
within the city of Andover.
5. Upon completion of construction the City of Andover will
pay to the city of Coon Rapids, upon written demand by
the City of Coon Rapids, that part of Andover's share of
costs applicable to parcels PIN 34-32-24-44-0001 and PIN
34-32-24-44-0002. Payment to the city of Coon Rapids
for other parcels within the City of Andover shall be
made;
1) upon subdividing the parcels
2) upon connection to any of the facilities
3) upon extension of storm drain to the east across
Hanson Boulevard
whichever of the above occurs first. Costs to the City
of Andover will be calculated based upon City of Coon
Rapids' assessment policies except where modified
herein. Costs to the City of Andover will be increased
by the change in the Construction Cost Index for the
Minneapolis area for any future payments by the City of
Andover.

6. Acauisition of Riaht-of-WaV: Each city agrees to
acquire that portion of the right-of-way or easement
within each respective community necessary for utility
and street construction. The cost of street right-of-
way acquisition shall be the responsibility of the
community within which the right-of-way lies. The cost
of storm water pond acquisition shall be included in
overall storm drain cost to both cities.
7. Sewer and Water Services Charaes: Upon connection to
the sewer and water system constructed under this
Agreement, the property owners within Andover will be
billed by the City of Andover for sewer and water
service in accordance with rates established by the city
of Andover. The City of Andover will notify the city of
Coon Rapids at such time as any connection is made to
the system. The City of Coon Rapids will quarterly bill
the City of Andover collectively for all services
provided based upon Coon Rapids' policies and rates.
Inasmuch as only one collective billing will be issued
to the City of Andover for all Andover users of the Coon
Rapids' system, and as the City of Andover guarantees
the prompt payment of utility use charges when due, the
city of Coon Rapids agrees to charge only one quarterly
service charge irrespective of the number of connections
served in Andover by the Coon Rapids utility system.
The City of Andover further agrees to provide meter
readings to the Coon Rapids utility Department when due.

8. Facili tv Ownership and Maintenance: The City of Coon
Rapids shall retain ownership and shall maintain
utilities running in an easterly and westerly direction
within 133rd Avenue. Andover shall own and maintain
utilities beginning at the manhole in 133rd Avenue
running northerly for sanitary sewer and for watermain
beginning at the water valve on 133rd Avenue and running
northerly including maintenance of the valve itself. It
is agreed that 133rd Avenue shall be sealcoated at
mutually acceptable intervals with such sealcoating
costs being shared by each community based upon the
proportional area lying within each respective city.
Coon Rapids and Andover shall jointly agree upon the
contracting agency prior to any sealcoating commencing.
9. Future Water Service: The City of Andover retains the
right to serve and supply that portion of the system
owned by Andover with water from the Andover system.
Thirty days notice shall be given to the city of Coon
Rapids before the actual charge is made. The valve
connecting to the City of Coon Rapids system will then
be turned off. It will, however, be retained as an
emergency water system interconnect.
10. Contracts and Purchases: All contracts let and pur-
chases made pursuant to this Agreement shall be made by
the City of Coon Rapids in accordance with applicable
State laws. The City of Coon Rapids shall not let
contracts for work covered under this agreement or
change orders which will result in an increase exceeding

10% of the estimated cost under paragraph 4 herein
without prior approval by the City of Andover.
11. strict Accountability: The strict accounting share
made of all funds and report of all receipts and
disbursements shall be made upon request by either
party.
12. Indemnitv Notification: Each party hereto agrees to
indemnify, defen~ and hold harmless the other from any
claims, losses, costs, expenses or damages resulting
from the acts or omissions of its respective officers,
agents, or employees relating to activities conducted
under this Agreement.
13. Entire Aqreement Requirement of A writinq: It is
understood and agreed that the entire agreement of the
parties is contained herein and this Agreement super-
sedes all Agreements and all negotiations between the
parties relating to the subject matter thereof as well
as any previous Agreement presently in effect between
the parties relating to the subject matter thereof. Any
alterations, variations, or modifications of the
provisions of the Agreement shall be valid only when
they have been reduced to writing the duly signed by the
parties therein.

Dear Mr. Feeney:
RE: Residential Developnents Adjacent to the South Andover Hazardous Waste Site
The Minnesota Pollution Control Agency (MPCA) staff has reviewed your letter
(dated June 6, 1989) requesting an evaluation of the potential threats to hmnan
health and safety for the Red Oaks Manor 6th Addition and Hidden Creek East
residential developnents which are adjacent to the South Andover Hazardous Waste
Site (Site). Based on your letter, we understand that both develor;ments would
be served by municipal water and sewer.
It is our opinion that possible threats fran the Site include hazards to
trespassers on the Site, either through inhalation of airborne dust fran the
Site or direct exposure to hazardous wastes stored at the Site. T:l:espassers on
the Site could also be exposed to hazardous waste in the fonn of contaminated
soil, surface water, and ground water. The U. S. Environmental Protection Agency
(EPA) has recently installed a chain link fence around much of the Site, so we
believe that the risk of residents actually trespassing on the Site has been
reduced.
To date only a limited amount of infonnation is available concerning soil
contamination at the Site. A health risk assessment of the Site, which is
contained in the EPA Remedial Investigation Report for the Site (dated January
1988) suggests that inhalation of airborne dust fran. the Site is not a problem
at this time. However, not enough info:r:mation is available on the soil
contamination to evaluate whether inhalation of airborne dust is a potential
threat to nearby residents during excavation for the remedial action and
developnent of the Site. Additional investigation of the soils will be
conducted over the next year.

Regarding ground water, the health risk assessment states that contaminated
ground water appears not to be a threat to residents living adjacent to the Site'
if they are using municipal water for all domestic purposes.
o This letter should not be construed as an authorization under the Minnesota
Envirorunental Response and Liability Act (MERIA), Minn. Stat. ch. 115B (1988) to
proceed with the develor;ment proposed in the June 6, 1989, letter, nor as a

Subject: signal System At County State Highway #9
(Round Lake Blvd.) and 135th Avenue (Roosevelt st.)
Dear Mr. Schrantz:
Because of budgetary cutbacks proposed for the year 1990
additional cuts had to be made in the 1989 spending program
for the Anoka County Highway Department. Because of that and
because of the uncertainty surrounding the alignment and cross
section of Round Lake Blvd., the signal system for the above
referenced project has been delayed until further study has
been completed. At this time in lieu of a permanent signal
the Anoka County Highway Department is proposing to install
under force account and with department personnel a temporary
signal at the intersection referenced above. This
construction is anticipated to begin early in the spring of
1990 and be completed in the summer of 1990. In concurrence
with our current cost sharing policy neither the City of Anoka
nor the City of Andover will be required to participate in the
cost of the proposed temporary signal system. You will
however be requested to furnish power for the proposed
temporary signal system and an agreement between Andover and
Anoka should be reached and a letter submitted by both of you
to myself indicating the arrangements for furnishing said
power.

The fol lowing are engineering matters that were discussed at the regularly
scheduled Council meeting held at 7:30 PM on Tuesday, August 1,1989:
1. Rosella Sonsteby Sewer ReQuest
Ms. Sonsteby has re:Juested sanitary sewer serv Ice through the Coon
Rapids Interceptor until the CAB Interceptor is available.
Council Action
The COuncil denied the re:Juest, but noted It would review the area
during Comprehensive Plan Study for appropriate service district.
2. Award Bld/Profect 88-35/Elevated Storage Tank No.2 and Trunk
Watermaln COnnection
Mr. Rodeberg reviewed the bids and the possible cost reduction
measures noted In the bid tabulation and recommendation letter.
Council Action
The COuncil awarded the bid for the tank to Pitt-Des Moines for the
Type A Tank with the alternate bid for storage, In the amount of
$992,250.
The COuncil awarded the trunk watermaln connection bid to the tank to
Moser COnstruction In the amount of $42,618.40.

The City Council continued the public hearing from July 25, 1989
so there will be a full Council to vote on the proposed project.
Attached is a petition for street construction with the provlslon
that all lots in the area pay the same, including the south part
of Navajo Street that is paved.
Also attached are two letters opposing the paving of 175th Avenue.
Also, I talked to Frank padula apd gave him a copy of the
feasibility report. He was going to call the Mayor or others with
his thoughts.
I also talked to a lady that lives on the south part of Navajo
Street. She said she would be talking to the Mayor and Council
with her thoughts.
The construction season is growing short.
The project could be ordered 8/15 for 173rd Avenue as we have a
petition and, if we include the Navajo Street and 173rd Avenue
properties by unit, we have an adequate petition.

If the Council chooses to proceed, the Council will need to have 4

the improvement~ The petition we have is for a report with a
petition of more than 35% (Andover has used 50%). The project can
be ordered with 3 votes for the project.

Dear City council Members:
CITY OF ANDOVER
In the event that I am unable to attend the August 15 follow-up
meeting addressing street improvements on 173 Av NW, Navajo and
175 AV NW, I would like my comments publicly entered at the meeting.
While I am not totally opposed to looking at this entire area as
one that needs to be improved, I am totally opposed to the
current methods being used to assess the improvements. Under the
current proposal those of us now living on a blacktopped
road and deriving the least benefit would pay the most for the
improvements.
This is not the first home I've owned where street improvements
have been assessed. It is , however, the first time the proposed
assessments have been so unfairly levied. In both previous cases,
street improvements were assessed based on benefits derived
and value added to the property, and were made according to
frontage on the street---not total acreage, not number of access
roads off the street, not total number of units on the street, and
certainly not for already having the improvement in front of my
home. While the policy of assessing by number of units may have
precedence in Andover, that does not make the policy fair or
equitable to the homeowners involved. As stated in the July
meeting, our area is unique in its configuration. There is no
viable reason that neighbors with homes on 100 foot frontage lots
should be assessed the same amount for road improvements as those
with 300 or 3000 feet. The benefit of blactopped roads, in
addition to having a smooth surface to drive on , is the value it
adds to the property. I find it hard to believe that the value
added is equal when the property sizes are so disparate.

After careful assessment of this proposal, it is hard to
believe that any planning of alternatives was done by the city
council. It seems to me that if someone took the time to figure
out exactly what the total cost of improvements were, someone on
the council could have assessed who would be deriving the most
benefit, whether or not property owners without access roads or
driveways would realize an increase in property values (and if
not, what obligation the city has regarding paving and
o
maintenance of blacktop on that portion of the road) ,what other
communities in similar situations had done to make the assessment
fair to all, and finally which council members should refrain
from voting on the matter based on personal interest and
financial gain.
My last comments involve the original petitioners in this matter.
While it appears that they are willing to pay a voluntary amount
of $1925 apiece to pave 173 AV NW out of the goodness of their
hearts, the fact is they will be deriving considerably more
benefit and value from the proposed road improvements than I , because
they have to drive the entire length of 173 or 175 AV NW to reach
their homes. Their homes will certainly be more marketable with a
blacktop road to reach them, while those of us currently living
on a blacktop road will realize little, if any, gain.
I am petitioning for a fair decision in this matter. If this area
is to be treated as a single entity for road improvements, I
suggest that the council look for the most equitable means of
assessing the improvements, based on the benefits and value
derived. If a decision is made to assess my property as proposed
at the July council meeting, either now or in the future, I
will remand this matter to the District Court.

Re: proposed "improvements" on 175th Ave. N.W.
I am writing this letter to go on record that I and most
of the neighbors in this section oppose "improving" the gravel
road on 175th and parts of Navajo, and we oppose "repairing"
the tar closer to Highway 7 on 175th Ave.
I like the dirt/gravel road in front of my house on 175th,
and it was one of the reasons we bought this house. Tarring
the road would diminish its esthetic value tome, and to any future
buyer I might sell to. I also like the dirt road, because it forces
carsto slow down when they hit it. I have two small kids and
and safety is important to me and my family.
I think that an expensive "repair" to the bottom of
175th is wasteful and unnecessary. I drive and walk that road
almost every day, and it's perfectly serviceable. Money thro\VD into
that only keeps people employed in Andover, and that is frustrating
to this tax payer.
I'm sure that in the not to distant future someone will want
to run sewer and water through here, and we'll get it in the neck,
again, for another new road! If I had wanted tar and all the aspects
of city life, I would have moved into Minneapolis, not Andover.

The City Council has continued the public hearing so staff could
discuss when the cost for the storm drainage would be due and
payable to Coon Rapids.
Bill Ottensmann has revised the Joint Powers Agreement (see
attached) to provide that Andover would pay Coon Rapids when the
land develops, connection is made to any of the facilities or upon
extension of the storm drainage to the east across Hanson
Boulevard (see page 3, section 5.
The other parts of the agreement are the same as the Council
approved before.
Assessments for storm drainage for Kirby's Estates will be due
when the project is completed.
The cost of the right-of-way for ponding will be part of the storm
drainage cost and will be payable by Coon Rapids or credited to
what we pay Coon Rapids (see page 4, section 6 of the Joint Powers
Agreement) .
Hubert Smith's will not be able to split his lot so we should
assess them now when we are buying the ponding area from the
east part of their lot.
The Council is requested to order the condemnation for the pond
acquisition to acquire ponding from Smiths and Olsons with a
deduct from Olson for their share of the pond due to their plat.
I recommend the Council order the improvement and approve the
revised Joint Powers Agreement.

FOR THE CONSTRUCTION AND MAINTENANCE OF
CERTAIN PUBLIC UTILITIES WITHIN THE
CITY OF COON RAPIDS AND THE CITY OF ANDOVER
This Agreement made and entered this ____ day of

by and between the City of Coon Rapids, a municipal corporation
herein after referred to as "Coon Rapids", and the city of Andover, a
municipal corporation herein after referred to as "Andover".
WITNESSETH:
WHEREAS, Coon Rapids and Andover share a common border, and
WHEREAS, development in both cities along said common border
is either occurring or expected to occur within the near future, and
WHEREAS, the ci ty of Coon Rapids proposes to construct
various public improvements including sanitary sewer, watermain, storm
drain, and street which will serve areas in Andover as well as areas
in Coon Rapids, and
WHEREAS, a determination has been made by the City Council
of both communities that such improvements should be constructed, and
WHEREAS, the City of Coon Rapids has prepared a feasibility
report for Coon Rapids Project 89-23, including Kirby Estates addendum
thereto which is on file in the office of the Coon Rapids city
Engineer, and
WHEREAS, said report includes utility and/or street
construction within the city of Andover, and
WHEREAS, said utility and street construction benefits areas
within the City of Andover as well as the City of Coon Rapids, and
WHEREAS, the cities mutually agree to share in the cost for
c:> such improvements on the basis of the relative benefit to properties
lying within each municipality, and
o
WHEREAS, Minnesota Statutes section 471.59 authorizes
political subdivisions of the State to enter into joint powers
agreements for the joint exercise of powers to each.
NOW, THEREFORE, it is mutually stipulated and agreed:
1. Purpose: Parties are joined together for the purpose
of construction of roadway, storm drainage, sanitary
sewer, and watermain within proposed 133r.d Avenue and
areas both north and south of 133rd Avenue within the
city of Coon Rapids and the city of Andover as described
in the feasibility report for Coon Rapids Project 89-23,
and the Kirby Estates addendum thereto, on file in the
office of the city Engineer, Coon Rapids, Minnesota and
incorporated herein by reference.
2. Method: The city of Coon Rapids will provide all
engineering services and shall cause the construction of
said Coon Rapids Project 89-23, including Kirby Estates
addendum thereto, in conformance with said report.
3. Improvements: Improvements to be constructed shall be
as indicated in the feasibility report for Coon Rapids
Project 89-23, including Kirby Estates addendum thereto.
4. Cost: The project cost of the work shall constitute the
actual "construction cost" and shall be so referred to
herein. "Estimated cost" are good faith projections of
the cost which will be incurred for this project.
Actual cost may vary'and shall be the cost for which the
city of Andover will be responsible. The estimated cost
to the city of Andover is $255,510. This estimated cost
includes $192,113, construction cost plus an estimated

33% for engineering, staking and inspection, administra-
tion, advertising, construction interest, and assessment
spreads.
The city of Coon Rapids will provide the City of Andover
with a final cost broken down into various elements
i.e., sanitary sewer, watermain, storm drain, and street
and broken down into benefits to individual properties
within the city of Andover.
5. Upon completion of construction the City of Andover will
pay to the city of Coon Rapids, upon written demand by
the city of Coon Rapids, that part of Andover's share of
costs applicable to parcels PIN 34-32-24-44-0001 and PIN
34-32-24-44-0002. Payment to the city of Coon Rapids
for other parcels within the City of Andover shall be
made:
1) upon subdividing the parcels
2) upon connection to any of the facilities
3) upon extension of storm drain to the east across
Hanson Boulevard
whichever of the above occurs first. Costs to the City
of Andover will be calculated based upon City of Coon
Rapids' assessment policies except where modified
herein. Costs to the City of Andover will be increased
by the change in the Construction Cost Index for the
Minneapolis area for any future payments by the City of
Andover.

6. Acauisition of Riaht-of-Wav: Each city agrees to
acquire that portion of the right-of-way or easement
within each respective community necessary for utility
and street construction. The cost of street right-of-
way acquisition shall be the responsibility of the
community within which the right-of-way lies. The cost
of storm water pond acquisition shall be included in
overall storm drain cost to both cities.
7. Sewer and Water Services Charaes: Upon connection to
the sewer and water system constructed under this
Agreement, the property owners wi thin Andover will be
billed by the city of Andover for sewer and water
service in accordance with rates established by the city
of Andover. The city of Andover will notify the city of
Coon Rapids at such time as any connection is made to
the system. The City of Coon Rapids will quarterly bill
the City of Andover collectively for all services
provided based upon Coon Rapids' policies and rates.
Inasmuch as only one collective billing will be issued
to the City of Andover for all Andover users of the Coon
Rapids' system, and as the city of Andover guarantees
the prompt payment of utility use charges when due, the
City of Coon Rapids agrees to charge only one quarterly
service charge irrespective of the number of connections
served in Andover by the Coon Rapids utility system.
The city of Andover further agrees to provide meter
readings to the Coon Rapids Utility Department when due.

8. Facilitv Ownership and Maintenance: The City of Coon
Rapids shall retain ownership and shall maintain
utilities running in an easterly and westerly direction
within 133rd Avenue.
Andover shall own and maintain
utilities beginning at the manhole in 133rd Avenue
running northerly for sanitary sewer and for watermain
beginning at the water valve on 133rd Avenu~ and running
northerly including maintenance of the valve itself. It
is agreed that 133rd Avenue shall be sealcoated at
mutually acceptable intervals with such sealcoating
costs being shared by each community based upon the
proportional area
lying within each respective

City.
Coon Rapids and Andover shall jointly agree upon the
contracting agency prior to any sealcoating commencing.
9. Future Water Service:
The City of Andover retains the
right to serve and supply that portion of the system
owned by Andover with water from the Andover system.
Thirty days notice shall be given to the city of Coon
Rapids before the actual charge is made.
The val ve
connecting to the City of Coon Rapids system will then
be turned off.
It will, however, be retained as an
emergency water system interconnect.
10. Contracts and Purchases:
All contracts let and pur-
chases made pursuant to this Agreement shall be made by
the City of Coon Rapids in accordance with applicable
state laws. The city of Andover shall approve contracts

for work covered under this Agreement and shall concur
in any changes which will result in an increase
exceeding 10% of the estimated cost under paragraph 4
herein.
11. strict Accountabilitv: The strict accounting share
made of all funds and report of all receipts and
disbursements shall be made upon request by either
party.
12. Indemnitv Notification: Each party hereto agrees to
indemnify, defend and hold harmless the other from any
claims, losses, costs, expenses or damages resulting
from the acts or omissions of its respective officers,
agents, or employees relating to activities conducted
under this Agreement.
13 . Entire Aqreement Requirement of A Wri tinq: It is
understood and agreed that the entire agreement of the
parties is contained herein and this Agreement super-
sedes all Agreements and all negotiations between the
parties relating to the subject matter thereof as well
as any previous Agreement presently in effect between
the parties relating to the subject matter thereof. Any
alterations, variations, or modifications of the
provisions of the Agreement shall be valid only when
they have been reduced to writing the duly signed by the
parties therein.

The City Council is requested to approve the resolution adopting
the assessment roll for Project 86-21.
The City Council has ordered an assessment hearing for Project
86-21 which consisted of:
1. sewer, water and streets to a lot on Shenendoah Drive on
the south side of 133rd, part of Good Value's property;
and
2. watermain along 133rd Avenue to loop the watermain for
Hidden Creek East lots (which the City pays half the cost
because of the one sided benefit); and
3. street construction for 133rd Avenue that serves the two
40 acre parcels of Good Value and the 10 acre parcel owned
by Shamrock Builders; and
4. storm drainage that serves all the listed parcels owned by
Good Value Homes, Shamrock Builders, Boeke and Talbot.
The improvements were constructed by the City of Coon Rapids under
a Joint Powers Agreement.
133rd Avenue street construction was petitioned for by Good Value
and Shamrock Builders.
Attached is the assessment roll and a sheet showing the estimated
cost and the final costs.
Bill ottensmann and Terry Herman have attended two council
meetings to explain the storm drain cost overrun.

A RESOLUTION ADOPTING THE ASSESSMENT ROLL FOR THE IMPROVEMENT OF
WATERMAIN, SANITARY SEWER, STORM DRAINAGE AND STREET CONSTRUCTION
FOR IMPROVEMENT PROJECT 86-21, 133RD AVENUE AND JAY STREET AREA FOR
CERTIFICATION.
WHEREAS, pursuant to proper notice duly given as required by law,
the council has met and heard and passed upon all objections to the
proposed assessment for the improvement of Watermain, Sanitary Sewer,
Storm Drainage and Street Construction.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ANDOVER,
MINNESOTA:
1. Such proposed assessment, a copy of which is attached hereto
and made part hereof, is hereby accepted and shall constitute the
special assessment against the lands named therein, and each tract of
land therein included is hereby found to be benefited by the proposed
improvement in the amount of the assessment levied against it.
2. Such assessment shall be payable in equal annual installments
extending over a period of 10 years, the first of the installments
to be payable on or before the first Monday in January, 1990 and
shall bear interest at the rate of 7.76 percent per annum from the
date of the adoption of this assessment resolution. To the first
installment shall be added interest on the entire assessment from the
date of this resolution until December 31, 1989 To each subsequent
installment when due shall be added interest for one year on all
unpaid installments.
3. The owners, of any property so assessed may, at any time
prior to certification of the assessment to the County Auditor, pay
the whole of the assessment on such property, with interest accrued to
the date of payment, to the City Treasurer, except that no interest
shall be charged if the entire assessment is paid within 30 days from
the adoption of this resolution; and he may, at any time thereafter,
pay to the City Treasurer the entire amount of the assessment
remaining unpaid, with interest accrued to December 31 of the year in
which such payment is made. Such payment must be made before October
15 or interest will be charged through December 31 of the next
succeeding year.

The Andover City Council is asked to review the Comprehensive Plan
Amendment for the Bruce Hay property in Sections 29 and 30, for
Metropolitan Council consideration.
BACKGROUND
The Andover Planning Commission has reviewed the request and
related legal information at both the regular June 27, 1989
meeting and at a special July 13, 1989 meeting. More than four
(4) hours of public testimony is included in the minutes from
these meetings.
The Planning Commission made a motion to recommend approval of the
Plan Amendment. I have enclosed a copy of the motion by Ron
Ferris and second by Don spotts. The vote ended in a tie and is
considered a neutral recommendation from the Planning Commission.
The Metropolitan Council requested that the proposed amendment
include property on either side of the utility easement over
property owned by Rosella Sonsteby. The Council has the authority
to alter the proposed amendment by subtracting property.

Round Lake in Section 29, Township 32, Range 24, Anoka County,
Minnesota.
The approval is contingent upon favorable Metropolitan Council
review and approval within 90 days of the receipt of the
proposed amendment.

Mr. Johnson conc~uded by asking the commission to complete their review and
forward recommendation to council.
Mr. Ferris asked Mr. Johnson if by "swap of acres" he was suggesting
we make a permanent connection to the Coon Rapids interceptor for Mr. Hay's
property and swap off,acreage that might connect there later to the CAB
interceptor.
Mr. Johnson explained he is suggesting' that in a temporary fashion,
areas that are currently within the Coon Rapids interceptor service area, could
be designated as not being serviced until the CAB is constructed and the
switch is made. Jay Blake then stated there is only one property that does
not have a preliminary plat, however it does have a sketch plan that has been
reviewed by the city council. That development is on hold at this time.
It is anticipated that the Planning and Zoning Commission will be asked to
review. Therefore, a'swap cannot be done.
Commissioner Vistad stated the city has a mJ.nJ.mum size requirement of
4 inch pipe for a single family. How can 200 households use a 4 inch pipe?
Mr. Johnson explained there are a number of factors that will affect
outcome of this project. The difference in pipe sizes are a function of whether
the line is a gravity line, where the water flows by running downhill through
the pipe, versus a forced main, where water is pumped through pipe.
Commissioner Ferris made a MOTION to close the public hearing.
Second by Commissioner Spotts. . MOTION passed.
Mr. Ferris examined the concept of adding other neighborhoodS to
application. He recommends making one application to the Metropolitan Council
combining Hay's request with neighborhood request. Jay Blake confirmed that
the Planning and Zoning commission must make recommendation to city council
within 60 days of clos~ of public hearing. This time frame would allow
neighborhoods to gather petition, if they decide to do so. The petition must
be presented directly ,to city council, which will in turn refer request back
to Planning and Zoning Commission for this plan amendment.
d 'A:J:cy Bosel~ reminded commissioners the city council agenda is c~osed
for the July 18 meeting and the following council meeting is 8/01/89. Mr. Ferris
stated that a petition could be presented during the residents forum of the
7/18/89 meeting; to go on the agenda for the 8/01/89 meeting. Jay Blake
determined if the petition was received by the city by July 21, it can be
placed on the agenda for the 8/01/89 meeting.

Minnesota Appeals Court. decision of February 27, 19891 recommend that

for the construction of a manufactured home park of the S.E. 1/4 of the
N.E. 1/4 of Section 30, Township 32, Range 24 Anoka County, Minnesota

Range 24 Anoka County lying nQrtherly of the following described line
commencing at the S.W. corner of said government lot 1 then North
45 degrees 00 minutes west to the shore of Round Lake and there

This expansion would add 'approximately 80 acres to the Urban Services Area.
The proposed manufactured home park would have approximately 220 units.
A temporary change of interceptor area from CAB to Coon Rapids is recommended
based upon the condition that the developer pay the expense to connect
to the Coon Rapids interceptor, approximately 1500 feet away and that
all applicable easements for this connection be granted and upon availability
of the CAB interceptor the developer, at his expense, will connect to
that interceptor. and remove all temporary interceptor connection lines.
The engineering 'analysis' of the Coon Rapids interceptor as presented
by Merila and Associates (1/06/88) and verified by TKDA has shown that
the Coon Rapids interceptor can accomodate the anticipated flow from
the Manufactured home park.
A public hearing-was held by the Andover Planning and Zoning Commission
on June 27,1989 and continued on July 13, 1989. Considerable opposition
was voiced by residents regarding the expansion of the Urban Service
Area for the pur:p<?se. of construction of a manufactured home park. As
a result of this input_the following changes have been.made to the
"Information Submission for Major Comprehensive :Plan Amendment":
A. The general information section now states "this amendment is
being made 'as a result of multiple court actions" and "the
city will require that the developer remove the temporary line
when the CAB becomes available."
B. Impact on:Housing section, section A was modified to remove
reference .to "provide additional low income housing."
C. Implementation Program section, section A was modified to "remove
a proposed change in zoning from Rl to R5."
Other concerns in~luding repair of easement property, failure of the
development, environmental impact studies, DNR wetlands, Army Corps.of
Engineers wetlands and drainage studies would be considered as part of
the developer's "development plan." .
The expansion of. the 'Urban Services Area is not in harmony with the
general purpose and intent of the city's comprehensive plan.
As the expansion of the Urban Services Area is solely to accomodate
development of a manufactured home park, it is felt that approval will
have a negative impact on property values in the su=ounding area.
Furthermore, the. increased traffic pattern on Anoka County Highway 7
will have a negative effect on vehicle and pedestraintraffic.
This recommendation will be reviewed by the city council on August 15, 1989.
If approved, it would then be submitted to the Metropolitan Council for
review and acceptance or rejection on or before November 20, 1989.

approval to amendment for Comprehensive Plan.
Commissioners voting to approve are Rebecca Pease, Gretchen Sabel and

Bev Jovanovich.
The application will go to 'city council on' 8/15/89 with no recommendation
from Planning and zoning commission.

A RESOLUTION APPROVING AN AMENDMENT TO THE ANDOVER COMPREHENSIVE PLAN
AND DEVELOPMENT FRAMEWORK ALLOWING AN EXPANSION OF THE METROPOLITAN
URBAN SERVICE AREA.
WHEREAS, the City of Andover has been mandated by the
Minnesota Court of Appeals to provide sewer service to property
currently owned by Bruce Hay in Sections 29 and 30, Township 32,
Range 24, Anoka County, Minnesota, and;
WHEREAS, the property is not currently served by sewer and
water, nor is it within the existing Metropolitan Urban Service Area
(MUSA) line, and
WHEREAS, applications to the Metropolitan Council and the
Metropolitan Waste Control Commission (MWCC) are needed to provide
sewer and water service to the property, and
WHEREAS, the Planning and zoning Commission held a public
hearing where a large amount public opposition was heard, and
WHEREAS, the Planning Commission, based on public opposition
to the proposed development and on safety concerns, made a neutral
recommendation to the City Council.
NOW, THEREFORE, BE IT RESOLVED, that based solely on the
Minnesota Supreme Court ruling of 1973 and the Minnesota Court of
Appeals decision of February 27, 1989, the City Council of the City
of Andover, approves the Comprehensive Plan Amendment for property
described as: The Southeast 1/4 of the Northeast 1/4 of Section 30,
Township 32, Range 24, Anoka County, Minnesota, and that part of the
north 84 rods of Government Lot 1, Section 29 lying northerly of the
following described line: commencing at the Southwest corner of said

The Andover City Council is asked to review the request of
William Murphy for a 20 foot front yard setback variance to
Section 4.05 (f) of Ordinance 8.
APPLICABLE ORDINANCES
The Andover Zoning Ordinance, Section 4.05 (f) outlines the
requirements for locating an accessory structure in front of a
principle structure. The provision allows the garage to be within
60 feet of the front lot line on a residential lot of more than
one (1) acre in size.
PLANNING REVIEW
The property (2.5 acres) is located on a cul-de-sac, 160th Lane
NW near Round Lake Boulevard in the pine Hills Addition. The
owner has a single family residence with an attached garage. The
proposed structure is a 30' by 40' garage built to store vehicles
and equipment owned by the property owner.
The property is described as Lot 3, Block 4, pine Hills Addition.
This lot has a 50 foot pipeline easement that runs east-west
through the entire property. The home is situated south of the
easement and the proposed garage would be located north of the
easement. The applicant wishes to face the building to the east
(towards the existing driveway).

The accessory structure, as regulated by Section 4.05 of Ordinance

4. Is the variance necessary to allow the property owner the
reasonable use of the property?
I am not convinced that the additional storage garage at the size
'proposed by the applicant is necessary for the reasonable use of
the property. Currently, the property owner has several vehicles
and a trailer on the property. In order for the property to be
kept free of excess vehicles, a storage building would be
necessary, however the size of the building might be considered
excessive.
A variance is necessary for locating any building in excess of 13
feet in width in front of the pipeline easement.
COMMISSION OPTIONS
A. The Andover City Council may approve the variance requested by
William Murphy for a twenty (20) foot front yard setback
variance to allow the construction of a garage in front of the
principle structure on property described as Lot 3, Block 4,
Pine Hills Addition, Anoka County, Minnesota.
The City Council finds that the proposal meets the minimum
criteria established in Ordinance 8, Section 5.04 including:
the strict interpretation of the ordinance causes the
hardship, the hardship stems from the unique shape, topography
or physical features of the land, the variance will not be
detrimental to the public welfare and the variance is
necessary for the reasonable use of the property.
B. The Andover City Council may deny the variance requested by
William Murphy for a twenty (20) foot front yard setback
variance to allow the construction of a garage in front of the
principle structure on property described as Lot 3, Block 4,
Pine Hills Addition, Anoka County, Minnesota.
The Council finds that the proposal does not meet the
requirements set forth in the City'S zoning Ordinance *8,

STAFF RECOMMENDATION
Staff recommends Option #D, due to the large size for the
accessory structure requested by the applicant. Staff believes
that a smaller garage would still allow the applicant reasonable
use of the property.
PLANNING COMMISSION RECOMMENDATION:
The Planning Commission reviewed the proposal at their July 25,
1989 meeting. The Commission felt that alternative locations for
the building existed on the property and that reasonable use of
the property was not precluded by not granting the variance. The
Commission recommended denial of the proposal.

The regularly scheduled meeting of the Andover Planning and Zoning commission
was called to order on Tuesday, July 25, 1989 at the City Hall Offices, 1685
Crosstown Blvd., at 7:30 P.M. by Commissioner Don Spotts.

Approval of Minutes
Ron Ferris questioned the meaning of a split vote. Jay Blake stated a split
vote is neutral. It does not indicate a recommendation of approval or dis-
approval. Ron Ferris made a MOTION to approve minutes from the July 13 Planning
and Zoning Commission meeting. Second by Gretchen Sable. Minutes approved.

Variance, William Murphy, 3260 - 160th Lane
Jay Blake presented to commission request of William Murphy for a 20 foot front
yard setback variance to Section 4.05 (f) of Ordinance 8.
Mr. Blake stated the Andover zoning ordinance, Section 4.05 (f) outlines the
requirements for locating an accessory structure in front of a principle
structure. The provision allows the garage to be within 60 feet of the front
lot line on a residential lot of more than one acre in size.
Mr. Murphy's property (2.5 acres) is located on a cul-de-sac, 160th Lane NW
near Round Lake Boulevard in the pine Hills Addition. He has a single family
residence with an attached garage. The proposed structure is a 30' by 40'
garage built to store vehicles and equipment owned by Mr. Murphy.
The property is described as Lot 3, Block 4, pine Hills Addition. This lot has
a 50 foot pipeline easement that runs east-west through the entire property.
The home is situated south of the easement and the proposed garage would be
located north of the easement. Mr. Murphy wishes to face the building to the
east (towards the existing driveway).

garage or accessory, building shall be located nearer the front line than the
principle building.
Jay Blake responded that Ordinance 8, Amendment U, adopted in 1983, amends
ordinance in that on a residential parcel, where the lot is one acre or more,
a detached garage or accessory building may be constructed closer to the front
lot line than the principle structure, however the minimum distance it may
be from the front lot line is 60 feet. Request is for variance to this amended
ordinance.
Commissioner Ferris asked what the topography is in area of proposed garage.
Mr. Blake replied the area is relatively flat with a line of trees in front.
Ferris questioned the height of the trees. Mr. Murphy stated between the garage
and the road the trees are 25 feet high. Commissioner Ferris asked in what way
the trees create a hardship. Mr. Blake answered that protection of the trees
would be the hardship. He noted that state statutes say protecting unique
features of the property i.e., large trees, can be justification for a variance.
Mr. Vistad asked Mr. Murphy if he could build garage elsewhere on lot, where he
would not need a variance.
Mr. Murphy said he could not, without taking down trees. Mr. Vistad pointed
out a large area on Mr. Murphy's property that could accomodate a garage, without
requiring a variance. Mr. Murphy stated the driveway would hC!-ve to run through
the front yard to have access to the garage in that location.

Mr. Blake reminded Mr. Vistad that commission has in past allowed variance to
save trees, and state statutes consider saving trees justifiable reason for
variance.
Mr. vistad said previous variances to save a tree or trees involved a small
number of feet, and Mr. Murphy is requesting a 20 foot variance.
Mr. Murphy stated that he is not trying to save a single tree but two entire
rows of pine. Mr. Murphy also stated a driveway across the front yard would
look bad.
Mr. Vistad asked Mr. Murphy if he built the house. Mr. Murphy said he did.
The house is a walk-out and was set on lot to take advantage of slope and
positioned to locate the driveway to the cul-de-sac. .
Mr. vis tad stated that when a person buys a lot with a pipeline easement, they
know there will be restrictions. Mr. Vistad feels granting a variance in this
case would set a precedence. Mr. vistad does not see a hardship.
Mr. Ferris noted that there is 80 feet from trees to easement. He suggests
that area could be an alternative. Mr. Murphy stated that area is his front
yard.

the city would not allow.
Mr. vistad made a MOTION that the Andover Planning and Zoning Commission recommend
to the City Council denial of approval of variance request by William Murphy at
3260 160th Lane N.W., Lot 3, Block 4, pine Hills Addition for a 20 foot front
yard setback variance to Section 4.05 (f) of Ordinance 8, to allow for building
an accessory structure in front of a principle structure. The commission finds
the proposal does not meet the requirements of Ordinance 8, Section 4.05. The
applicant failed to show a hardship to topography that would uphold Ordinance.
The landowner will not be denied reasonable use of his property. Commission
has determined there are other places applicant can put structure on his property
that would not require a variance.
Second to motion by Bev Jovanovich. Commissioners were polled and all agreed to
motion.
Don Spotts informed Mr. Murphy denial of request for variance will go to City
Council on 8/15/89. He advised Mr. Murphy to attend City Council meeting.

NOW, THEREFORE, BE IT RESOLVED by the City of Andover to hereby
approve the final plat of Kirby Estates contingent upon receipt of the

1. The City Attorney presenting a favorable title opinion.
2. security to cover legal, engineering, street sign and
installation costs to be determined by the City Engineer.
3. The developer escrow for the uncompleted grading of the site
which is to be determined by the City Engineer or if site
grading is completed, a letter from the surveyor or the
developer's engineer that lots and streets are graded
according to the grading plan submitted to the City.
4. The final plat not to be signed by the Mayor or Clerk until
there is an executed Development Contract, escrow paid (15% of
the total costs for the improvements for the property
{streets, utilities, etc.}) and a contract for the
improvements awarded.
5. Street light costs to be paid to Anoka Electric Cooperative.
6. Park dedication as determined by the Park and Recreation
Commission.
7. Revised preliminary plat and grading plan as needed by the
City.
BE IT FURTHER RESOLVED citing the following:
1. Variance from Ordinance 8, Section 6.02 for Lot 1 Block 1 as
this does not meet the lot depth minimum of 130 feet.
2. All lots access through interior city streets.
3. Developer is responsible to obtain all permits from U.S. Army

The Andover City Council is asked to accept the petition from
Gorham Builders and winslow Holosek for the expansion of the MUSA
area to allow for additional development in Winslow Hills.
Staff has a concern over preparing a Comprehensive Plan Amendment
for every individual development. It may be more efficient to
prepare a major Comprehensive Plan Amendment for the entire east
side of the sewer area. I have asked Gary Gorham to submit a
request for both the second phase and also for the entire
development for your consideration.
The City may wish to invite the other developers along or near
Hanson Boulevard to submit similar requests, so that a
comprehensive amendment may be considered.
COUNCIL OPTIONS
1. The City Council may pass a resolution directing staff to
prepare a Comprehensive plan Amendment for Winslow Hills
development (Either 40 acres or the entire sketch plan).
2. The City Council may pass a resolution directing staff to
prepare a Comprehensive plan Amendment for Winslow Hills
development and surrounding developments along and near Hanson
Boulevard.
3. The City Council may accept the petition from Gorham Builders
and prepare the Comprehensive Plan Amendment when the Land Use
Study/Plan is completed by the planning Consultant as part of
the overall Comprehensive plan update.

The Andover city Council is asked to review the enclosed letter
from JoAnn Wright regarding Andover's participation in the Anoka
County Community Development Block Grant Program. The City has
the option to not participate in the program and work directly
with the state of Minnesota and HUD.
JoAnn has informed me that we would not be able to use CDBG funds
for the removal of blight and slums and that the City of Andover
would more than likely not qualify for most of the programs,
STAFF RECOMMENDATION
I would urge the City Council to authorize Staff to draft a letter
to Anoka County and the Area office of the Department of Housing
and Urban Development requesting that the the City of Andover be
included in the 1990 - 1992 Community Development Block Grant
program through Anoka County.

June 30, 1990 marks the beginning of a new three-year cycle .of Community Development Block Grant
Programs. HUD requires that we give the communities an opportunity to 'opt-out' of the Anoka County
CDBG Program at the beginning of each three year cycle.
A community's decision to withdraw from the program reduces the County's CDBG population count
and entitlement amount and technically is effective for three years until June 30, 1993. However, Anoka
County may exercise the option to invite a community that has 'opted-out' of the County CDBG Program
to participate in the second or third year.
If your community desires to have its population excluded from Anoka County's total for the CDBG
program, please provide notice in writina t.o J.oAnn Wriaht. Anoka County C.ourthouse and Ms. Edie
Varaas. HUD. 220 S.outh Sec.ond Street. Minneapolis. MN 55401. n.o later than September 15.

All of the communities executed Joint Cooperation Agreements in 1987 that continue in effect so long
as there is a CDBG program and they do not elect to withdraw, However, HUD has required some new

will have to submit our Joint Cooperatl.on Aareements with the addendum and evidence of

The city Council is requested to authorize a land use study
(grading) regarding the TIF District.
The city staff has received the sketch plan for Mardaus property
(Lot 9 of Watt's Garden Acres). During the staff's preliminary
review, there were concerns regarding grading and drainage for the
development and for adjacent properties.
The property north of the Mardaus property has significantly
changed in elevation due to past mining operations. The concern
that currently exists with the proposed development of the
property is lots south of the proposed 133rd Lane will require
filling. An alternative to the sketch plan is to push the
proposed roadway further north which will make better use of the
existing conditions,
This may require the properties to be rezoned.

The City Council is requested to consider a Joint Powers Agreement
with Ham Lake to construct University Avenue from 157th Avenue to
Constance Boulevard.
Anoka County is planning to reconstruct the hazardous curves on
Constance Boulevard next summer 1990,
Ham Lake would like to construct university Avenue at the same
time as the County project.
The Road Committees of Ham Lake and Andover met and established
priorities on the various phases of constructing university
Avenue. The councils approved the phasing. Andover constructed
its highest priority and Ham Lake constructed part of their
priority. Ham Lake is interested in continuing the process and
requesting we proceed with university Avenue between 157th Avenue
and Constance Boulevard.

HAM LAKE/ANDOVER JOINT POWERS AGREEMENT II

AGREEMENT, made this
day of
, 1989 between
the Cities of Andover (Andover) and Ham Lake (Ham Lake), both
situate in Anoka County, Minnesota:
RECITALS
Andover and Ham Lake share a common border along the
easterly corporate limits of the City of Andover, and along the
westerly corporate limits of the City of Ham Lake. This common
border extends for approximately six miles. Portions of this
common border contain a borderline road known as the University
Avenue Extension. This roadway is substantially unimproved, and
in some places, no roadway at all exists along the common bcraer.
It is the desire of both communities to jointly cause the
improvement of the University Avenue Extension for ultimate
insertion as a Minnesota State Aid road serving both communities
along or near their common border, This Agreement is made in
furtherance of the implementation of certain portions of that
overall project, as hereinafter described, pursuant to the
provisions of Minnesota Statutes Chapter 471.59, commonly known
as the Joint Powers Act.
NOW, THEREFORE, IT IS AGREED AS FOLLOWS:
I. Definitions. The overall project (the "Roadway")
contemplated by this Agreement shall consist of an improved
roadway to MSA Standards, having as its southerly terminus the
intersection of that border line with the presently improved
o
portion of 157th Avenue N.W. and having as its northerly terminus
the intersection of the newly constructed University Avenue with

the new location of County Road 60, presently under design by
Anoka County (See Exhibit A).
2. Construction. Ham Lake shall be responsible to
implement any required feasibility studies, engineering and
design work, bid procedures, selection of contractor, and
supervision and implementation of construction. When
construction has been completed, Andover shall reimburse Ham Lake
for one-half the costs thereof, Construction costs shall include
all costs incurred by Ham Lake in association with completion
of the Northern Portion, including but not limited to engineering
fees, legal fees, right-of-way acquisition costs, publication
costs, and contractors' fees. Construction shall be deemed
complete when the City Councils of both Ham Lake and Andover have
accepted, by resolution, the construction of the RoaCway upon
recommendation of the City Engineer of each respective community.
3. Soecial Assessment Procedures in Ham Lake. It is
acknowledged between the parties that Ham Lake intends to utilize
Minnesota Statutes Chapter 429 to specially assess benefitted
properties on the Ham Lake side of the Roadway.. Ham Lake shall be
responsible to conduct such public hearings and to implement su~~
other procedures as may be necessary to comply with the terms of
Minnesota Statutes Chapte.r 429.
4. Bondinq. To the extent that either Andover or Ham Lake
utilizes any general obligation bonding to wholly or partially
fund any portion of the costs of the Roadway, both Andover and
Ham Lake will endeavor to cooperate with each other in any
statutorily required procedures necessary to implement such bonding.

5. MSA Fundinq. Both Andover and Ham Lake will cooperate
in all respects in maintaining the eligibility of the Roadway
to receive MSA funding from the Minnesota Department of
Transportation. Furthermore, design standards for the
Roadway shall be as required by the Minnesota State Aid Section
of the Minnesota Department of Transportation.
6. Riqht-of-Way-Acauisition, Both Andover and Ham Lake
shall jointly employ their respective legal counsel, Burke &
Hawkins for Andover, and Dorn Law Firm, Ltd. for Ham Lake, to
acquire such right-of-way as may be necessary to implement the
overall project. Both Andover and Ham Lake shall authorize their
respective legal coun~el to make whatever interoffice arrangements
they deem appropriate in order to implement right-of-way
acquisition, and the legal fees incurred in right-of-way
acquisition shall be billed to Andover for right-of-way
acquisition by Ham Lake and to Ham Lake for right-of-way
acquisitio~ by Andover. These legal fees shall be considered a
portion of the overall costs for eventual reimbursement ~ the
corresponding party. By execution of this Agreement, Andover and
Ham Lake do jointly employ the law firms of Burke & Hawkins and
Dorn Law Firm, Ltd. for the purpose of acquiring, in the name of
both Andover and Ham Lake, any right of way required. In the
absence of agreement between said law firms, Andover shall employ
its counsel to acquire any right of way located within the
corporate limits of Andover; Ham Lake shall employ its legal
counsel to acquire any right of way located within the corporate
limits of Ham Lake. In such event, the costs so incurred shall
remain joint project costs reimbursable as provided in Paragraph
o
3
2 above.

7.
Maintenance.
A. Contractor's Bond and Guaranty. Ham Lake shall
be responsible to enforce any contractor's bond or
guaranty on the Roadway Project. The costs of any
such enforcement shall be borne by Ham Lake, but if
any such costs are incurred, one-half of such costs
shall be reimbursed by Andover.
B. On-Goinq Structural Maintenance. The Roadway shall
be maintained in such a manner as to comply with
on-going maintenance requirements for MSA roads as
established by the Minnesota Department of
Transportation. Both Andover and Ham Lake shall
share equally in the costs of future maintenance,
subject to the condition that the governing bodies
of each agree as to the need for specific items of
future'maintenance.
C. Snowolowina. During the first winter season that
the Roadway is open, Ham Lake shall be responsible
for snowplowing. Thereafter, the Cities shall
alternate responsibility fo~ snowplowing the
Roadway each year. . .
IN WITNESS WHEREOF, the parties have executed this Agreement
the day and year first above written, pursuant to the provisions
of Minnesota Statutes Chapter 471.S9, commonly known as the Joint
Powers Act.

Dear Mayor Elling and Council Members:
We are writing to respectfully request an item be added to your
August 15 City Council meeting regarding the transfer of ownership
of our Outlot A and Outlot C in our Woodland Terrace subdivision.
Both of these outlots are currently drainage and utility easements
and are used as holding ponds for storm drainage. For the past
several years, the city has maintained these properties, and we
feel it would make most sense for the city to own them. We are
recommending that the city accept ownership of these properties
and the appropriate paperwork can be put together immediately
for that transaction.
Thank you for your attention to this matter, and we look forward
to discussing it with you on the 15th.

The Planning Commission concurred that there is no problem with the Planned Unit Development
concept for this property. Commissioner Rogers asked if there will be covenants on the
property. Mr. Adams noted that there will be.
Chairman Jacobson suggested taking a straw vote to see if the Corrmission is. in favor of
the PUD. If they are not in favor, it would not make sense to go ahead with the public
Hearing on the plat.
MOTION by Jacobson, seconded by Apel that the Commission would recommend and approve the
concept of a Planned Unit Development known as Woodland Terrace. Motion carried unanimouslY.
Chairman Jacobson noted once again that this is merely a straw vote stating that the
Planning Commission feels that the PUD is reasonable for this piece of property.
Jim Schrantz noted that he spoke to the County traffic engineer and he stated that Narcissus
Street doesn't line up with the existing street. Chairman Jacobson felt that we should
wait for the county to respond to this plat in writing before doing anything.
Mr. Schrantz also noted that the City of Coon Rapids would like to see Lily Street extended
but would not want Narcissus Street extended into Coon Rapids.
Chairman Jacobson also stated that we would like to have something on record from the Coon
Creek Watershed District. There was some discussion regarding the Rum River Watershed and
the drainage from this plat.
Chairman Jacobson asked Mr. Carlson if he had thought about sidewalks on l33rd Lane. Mr.
Carlson stated that he was not impressed with the suggestion. He stated that he would
prefer changing the street location rather than having to put in sidewalks.
Chairman Jacobson thought that outlots were not allowed in plats. Mr. Schrantz stated
that outlots to prevent access are not permitted. Chairman Jacobson asked how retains
~ the ownership of the outlots. Mr. Carlson stated that he does. Outlots A & B are basically
for drainage. They will be dedicated to the city.
Mr. Carlson presented a plan to the Commission showing single family lots in the northeast
corner where the condominiums are proposed to go. He wasn't sure if the condos would
sell and would like to have the option of changing that area to single family. It was
noted that Mr. Carlson could possibly present two different plans to the Council.
However, when the plat is finaled he will have to choose one or the other.
Outlot C could be given to the property owners adjoining it, subject to the necessary
easements.
This item will be continued on April 9, 1985.
Shoreland Manaqement Ordinance (Comm. i2~85-1)
~he secretary noted that she spoke to Molly Comeau of the Department of Natural Resources
~nd Ms. Comeau would like to have a meeting with the Planning Commission before a public
hearing is held on the ordinance. Ms. Comeau also mentioned that the DNR is not in
favor of the lot sizes and setbacks that the city has listed in the ordinance and asked

REQUEST
The City Council is asked to consider the parental leave request
made by the City's utility Billing Clerk.
BACKGROUND
The City's utility Billng Clerk, Debbie Stalboerger, is pregnant
and has a due date of september 9, 1989. Under Minnesota State
Statutes Section 181.941 subdivision 1, the City must grant an
unpaid leave of absence to an employee who has been employed by
the City for at least 12 months and who is a natural or adoptive
parent in conjunction with the birth or adoption of a child. The
length of the leave shall be determined by the employee, but may
not exceed six weeks, unless agreed to by the employer.
Ms. Stalboerger has asked me to discuss with City Council the
following requests:
* Using all remaining vacation and compensatory time prior
to parenatal leave. This will total approximately three
days and will begin at the onset of labor, as advised by
her physician or September 20, 1989, whichever occurs
first.
* using sick leave to complete a week once vacation and
compensatory time is exhausted. For example, if vacation
and compensatory time were used up on a Thursday, Ms,
Stalboeger would use one sick leave day to complete the
week, If vacation and compensatory time is used up on a
Monday (which would happen if the vacation time began on
a wednesday) she would use four sick leave days.

Parental Leave Request
o
* Taking the six weeks unpaid parental leave as allowed by
state statute.
* Taking an additional two weeks of unpaid parental leave.
Ms. Stalboeger has been employed by the City for over 12 months
and is entitled to the six weeks of unpaid leave,
The City's Personnel Administrative policies do not deal with
parental leave. However, several of the individual policies
can be applied to Ms. Stalboerger's request. The policy on
vactions does not specifically deal with pregnancy. It does
encourage employees to take vacations on a regular basis. It also
says that supervisors should make every effort to accomodate
vacation requests, recognizing that the needs of the City come
first. It is my opinion that the request to use vacation and
compensatory time does not adversely effect the needs of the City.
The policy on sick leave does not specifically deal with pregnancy
and the use of sick leave. The only provision that applies states
that for an employee to be eligible for sick leave payment in
excess of three days, the employee must furnish a physician's
statement verifying the need for timeoff. Minnesota state
Statutes Section 363.03 subdivision 5 deems it an unfair
employment practice "For an employer, an employment agency or a
labor organization, with respect to all employment related
purposes, including the receipt of benefits under fringe benefit
programs, not to treat women affected by pregnancy, childbirth, or
disabilities relating to preganncy or childbirth, the same as
other persons who are not so affected by who are similar in their
ability or inability to work." This means the City must treat Ms.
Stalbeorger's request for use of sick leave consistent with other
employees use.
SUMMARY
Ms. Stalboerger has made four requests which can be acted in any
combination. The City needs to be sure it complies with the State
Statutes in this matter. The applicable Statutes, as mentioned
above, require the City to allow up to six weeks of unpaid leave
(which can be decreased by any paid leave or sick leave used) and
that Ms, Stalboerger be treated similarly to an employee in a
similar condition.
MS. Stalboerger's request will result in the Finance Department
running with one less person than needed. However, I believe that
the current staff will be able to handle the work load, with
only minimal problems, To decrease the potential work load
problems, it may be necessary to increase the hours of the part-
time accounting clerk from 40 hours every two weeks to 48 hours.

RECOMMENDATION
The Finance Director recommends approval of the request as
submitted. In addition, approval of the use of the part-time
accounting clerk for an additional 8 hours per two week period is
recommended.

The Andover City Council is requested to set a budget calendar
that will comply with Truth in Taxation requirements as
interpreted by the Minnesota State Commissioner of Revenue.
BACKGROUND
At a special City Council meeting on June 21, 1989, we discussed
the truth in taxation requirements. With Governor Perpich's veto
of the 1989 tax bill and his intent to call a special session, the
dates as specified in the 1988 law are not practical. John James,
State Commissioner of Revenue has used his authority granted by
law to extend deadline dates by which the City operates.
Based on the revised dates set by Mr. James, the following dates
are the deadlines the City must meet.
* October 1, 1989 - City must certify to the County Auditor
proposed property tax levy.
* November 9, 1989 - City must certify the final property tax
levy to the County Auditor.
* Between these two dates, the City must hold a public budget
hearing which must be advertised in the newspaper.
These dates can change depending on the progress of the special
legislative session.

RECOMMENDATION
Based on the above due dates, the following budget calendar is
proposed:
August 29th - preliminary Budget Discussion for the General
Fund, Debt Service Funds, Special Revenue Funds and
Enterprise Funds. This would be a special meeting
which would need to be scheduled.
september 5th - Amended budgets given to City Council. They
may be discussed if desired, however, no formal action
will be needed.
September 19th - Approve budget and proposed property tax
levy for all funds.
September 30th or earlier - Certify proposed tax levy to
County Auditor.
October 10th - Advertise date and time of public budget
hearing
october 17th - Public budget hearing held during regular
council meeting.
October 24th - Date for reconvening hearing if needed.
November 7th - Approve final budget and tax levy.
REQUEST FOR COUNCIL ACTION
City council is requested to approve the proposed budget calendar,
with any amendments they desire, and schedule the necessary
special meetings.

the roll and ordering the public hearing for Project 88-14,
uplander Street south of 161st Avenue; and 88-18, Dehn's Additions
area.
NOTE: I have proposed the hearing for the regular council meeting
on September 5th at 7:30 P,M. for both hearings.
If the City Council wishes to have the public hearings at a
special meeting, it should be after September 5th.
PROJECT 88-14, UPLANDER
Estimated cost usfng 15 units (as requested by the property
owners and approved by the City Council) was $2725/unit.
Final cost $2993/unit.
PROJECT 88-18, DEHN'S ADDITIONS AREA
Estimated feasibility report was $2720/unit. If we include the
park the estimated cost was $2623/unit.
Final cost $2596/unit including a unit for the park.
Dehn's Addition includes a unit to the park per Council
direction at the public hearing. Keep in mind the park is low
unbuildable property. If the Council would choose not to
assess the park the cost would be $2692/unit.

WHEREAS, by a resolution passed by the City Council on August 1,
1989, the City Clerk was directed to prepare a proposed assessment of the
cost of improvements for Project No. 88-14; and
WHEREAS, the Clerk has notified the Council that such proposed
assessment has been completed and filed in her office for public
inspection.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Andover, MN:
1. A hearing shall be held the 5th day of September, in the City Hall
at 7:30 P.M. to pass upon such proposed assessment and at such time and
place all persons owning property affected by such improvements will be
given an opportunity to be heard with reference to such assessment.
2. The City Clerk is hereby directed to cause a notice of the hearing
on the proposed assessment to be published once in the official newspaper
at least two weeks prior to the hearing, and she shall state in the notice
the total cost of improvement. She shall also cause mailed notice to be
given to the owner of each parcel described in the assessment roll not less
than two weeks prior to the hearings.
3. The owner of any property so assessed may at any time prior to
certification of the assessment to the County Auditor, pay the whole of the
assessment on such property, with interest accrued to the date of payment
to the City Treasurer, except that no interest shall be charged if the
entire assessment is paid within 30 days from the adoption of the
assessment. He may at any time thereafter pay to the City Treasurer the
entire amount of the assessment remaining unpaid, with interest accrued to
December 31 of the year in which such payment is made. Such payment must

supporting the Anoka Soil & Water Conservation district's proposal

the city contributing $3,500. This does not obligate us to a cash
contribution but represents information the city has which will be
used for the study,

WHEREAS. The City of Andover shares the concern and interests of the Anoka
Soil and Water Conservation District in surFace and groundwater qual ity;
and
WHEREAS. The City of Andover supports a study eFFort by the Anoka Soil and
Water Conservation District involving water quality impacts of non-point
sources of pollution that Focuses on the surFace water qual ity of Coon
Creek and groundwater qual ity in both urban and rural portions of the city;
and
WHEREAS. The City of Andover Further supports the Anoka Soil and Water
Conservation District's proposed diagnostic and implementation plan project
to deFine problems within the Coon Creek study area and determine proposed
solutions; and

Dear Mayor Elling:
The Anoka Soil and Water Conservation District is intheprocess of preparing
an application for a Clean Water Partnership Grant for the Upper Coon Creek
area within the cities of Ham Lake and Andover to study surface and ground-
water quality and development of Best Management practices. It is our
desire to seek cooperation from the City of Andover in this project.
The program is based in and around the area of Coon Creek from the northeast
corner of Ham Lake to the southwestern border of Andover. Within this area
the program will cover:
o
A.
Diagnostic Study
1.) Prepare soils erodibility maps
2.) Prepare current land use maps
3.) Assess current land use practices
4.) Do well water sampling and creek water sampling for nitrate/
nitrogen, coliform bacteria, suspended soils, pesticide
scans, etc.
5. ) Land truthi ng and enteri ng of well logs into computer from
this area.
Data Analysis and Assessment
1.) With Hickok and Associates, consultants for Coon Creek
Watershed we will analyze all the above collected data.
2.) We will also need assistance from each city involved in the
collection of information concerning septic systems, number
of wells, current city ordinances, municipal well information,
etc. (This would constitute the $3,500 worth of in-kind
contribution that each city is listed for.)
3.) A full compilation of all data will be made, analyzed and
assessed.
Development of Implementation Plan
1.) The Anoka Soil and Water Conservation District, along with
Hickok and Associates, other state related agencies and
city representatives will develop a plan of Best Management
Practices.

This plan then can be used by the cities and Coon Creek Watershed
District as well as by the County to further the groundwater
planning effort and to create best management practices to further
safeguard surface and groundwater resources.
We have enclosed the draft copy of the grant application and a resolution
that we would ask the Andover City Council to sign and approve.
Please note that the City is listed as contributing $3,500 of in-kind
services to this project. It basically represents that information
that you already have and we will utilize for the study project.
You are not obligated to any cash contribution. The reason for listing
your in-kind contribution is to:
1.) Show cooperation in the over-all project
2.) Show interest in the surface and groundwater quality of your
city.
On behalf of the Anoka Soil and Water Conservation District and the Coon
Creek Watershed District, I thank you for your cooperation and assistance.
This project representas a $100,000 effort in study and plan preparation.
Fifty thousand of that $100,000 represents state dollars brought into this

The Anoka County Soil and Water Conservation District is proposing to
sponsor a grant application to the Minnesota Pollution Control Agency for
funds made available through the Clean Water Partnership Program. This
program provides grants for 50% of the cost for local projects involving
water quality impacts of nonpoint sources of pollution. One such study could
focus on surface water quality of Coon Creek and groundwater quality in the
cities of Andover and Ham Lake, both urban and rural portions of the watershed.
The project would cost $100,000 with 50% of this coming from local sources,
i.e. the Watershed District and the Soil and Water Conservation District. The
Watershed District's share would be $10,000 per year for the two years beginning
in 1990.
The proposal would consist of a diagnostic study and implementation plan.
The diagnostic study would consist of collecting and generating data in the
Coon Creek areas of the cities of Andover and Ham Lake on soils and geology,
land use, and surface and groundwater quality. This data will be used to define
any problems in this portion of the Watershed District while an implementation
plan will propose solutions to those problems identified. The proposal is out-
line as follows:

PART II - PROJECT SUMMARY
o
The Anoka Soil and Water Conservation district will be
responsible for the completion of Phase I and will apply for Phase
II.
o
The following outline describes agency(ies) responsibilities
and contributions to the program:
A. Diagnostic Study
1. Soils & Geology - Anoka Soil and Water Conservation
District will provide personnel, equipment and materials
for the creation of erodibility maps. Soils information
will be taken from the Anoka County Soils Survey and Soil
Conservation Service CAMPS Program Soils Section. Soil
Conservation Service will provide technical assistance
when necessary for mapping.
2. Anoka Soil and Water Conservation District currently
has installed the WELLS Program from Minnesota Geological
Survey in their computer. Anoka Soil and Water Conservation
District staff will be responsible for land truthing well
log data and entering this data into the computer for the
Coon Creek designated project area. Minnesota Geological
Survey will offer any additional technical assistance
needed to Anoka Soil and Water Conservation District staff
for this portion of the project. ' ,
Anoka Soil and Water Conservation District will be
working with Minnesota Geological Survey and Department
of Natural Resources concurrently with this project and
the Geologic Regional Assessment program and additional
data generated from the Regional Assessment will be
utilized in this project.
3. Anoka Soil and Water Conservation District staff will
be responsible for the creation, materials, etc. of the
land use maps. Aerial photos will be used from our local
Agricultural Stabilization Conservation Service.
Additional land use information will be provided by the
cities of Ham Lake and Andover. Further additional
related information will be obtained from Soil Conservation
Service and the Department of Natural Resources.

4. Compil at i on and Assessment of 1 and use practices wi 11 be
done as a group effort by:
- Hickok and Associates/Coon Creek Watershed District, will
subcontract with Anoka Soil and Water Conservation District to
prepare and compile current data and mapping production
- Cities of Ham Lake and Andover - use of source data and mailings
- Soil Consevation Service - Technical advisors
- Anoka County - Technical advisors
- Anoka Soil and Water Conservation District staff to do actual
over all data compilation, survey processing and compilation,
and mapping production.
5. Anoka Soil and Water Conservation District will sub-
contract with a local lab for water testing. Anoka Soil and
Water Conservation District staff will draw samples and compile
results.
B. Data Analysis and Assessment
1. Anoka Soil and Water Conservation District will sub-
contract with Hickok and Associates/Coon Creek Watershed District
for data analysis and evaluation of the erodibility maps, lard
use maps, land use practices and well logging information.
They will also provide current hydrologic information.
2. Anoka Soil and Water Conservation District will subcontract
to have a computer model designed to reflect well log data,
geologic data, in cross sections and interrelate this data with
land use and parent materials mapping.
Anoka Soil and Water Conservation District will provide
to the contracted firm the necessary data, parent materials
maps, land use maps and well log data for digitazation and
preparation.
C. Development of Implementation Plan
Anoka Soil and Water Conservation District will subcontract
with Hickok and Associates/Coon Creek Watershed District to
review all data collected to prepare Best Management Practices
and plan.
City of Ham Lake and Andover will provide ordinance and
regulatory information and cooperative input for future
ordinances and plans.
Soil Conservation Service will provide technical assis-
tance as related to Best Management Practices for agricultural
areas.

cooperatively with all above mentioned for the plan content
and implementation procedures.
With all three parts of the project outline Anoka Soil and
Water Conservation District will seek information and assis-
tance from various other State and Federal Agencies.
The Upper Coon Creek project area is defined below, and
basically outlined within the City borders of Ham Lake and
Andover, Anoka County. The project will concentrate on surface
water quality of Coon Creek and.groundwater quality of the two
afore mentioned cities. The project will focus on three specific
land use areas of; 1) Agriculture,' 2) Ne~lly developing areas,
and 3) well established older urbanized areas.
As described above the surface water quality portion of the
proposed project focuses on the upper portion of Coon Creek.
The creek portion is that which flows in a southwestern direction
from Section 2, T32N, R23W, City of Ham Lake to Section 12,
Section 13, south through Section 24 and Section 25 and west-
ward through Sections 26, 27, 28, 29 and 30 to Section 25,
T32-R24W of the City of Abdover ad flows in a westerly direction
through Sections 25, 26, 27 and 28 then southward through
Section 28, then southward through Section 33 and to Andovers'
southern border. This marks the end of the project area, but
Coon Creek continues southward to join the Mississippi River in
the City of Coon Rapids.
In the Coon Creek watercourse land use changes have pro-
duced increased run-off by current 1 ands I i nabil ity to a 11 ow
infiltration, and by reducing or eliminating pockets of
storage scattered throughout undeveloped land. These changes
in land use are projected to increase peak discharges at the
mouth of Coon Creek by as much as 30% for the 10-year, 24 hour
event (taken fron Enviroscience Study 1982). Current sediment
ponding projects are shceduled or underway, see Section 4~6
Coon Creek Comprehensive Plan.
Coon Creek has been the receiving water'fnr increased
sediment loading and chemical run-off from agriculture and
urban development.

STREAMS
Coon Creek, the principal watercourse, has its headwaters north
of Crosstown Boulevard in the northeasterly end of the Watershed.
Coon Creek flows westerly from its source for approximately 10 miles,
then turns abruptly in the southwest portion of the City of Andover
and flows southeasterly to join the Mississippi River at a point
approximately 0.1 mile downstream of the Coon Rapids Dam, and six
miles upstream from the Minneapolis Waterworks intake.
Coon Creek has a main channel length of 25.4 miles and an
average grade of 2.5 feet per mile except for a three mile section
upstream of its confluence with the Mississippi River where Coon
Creek is in an entrenched section, with an average slope of 7.5
feet per mile.

GROUNDWATER
The Coon Creek project area is 23,400 acres, which is the
hydrologic region in which the groundwater study is based upon. ~
It is also within the local jurisidictional boundaries for the
Coon Creek ~latershed District of whom we are working in close
cooperation with.
Coon Creek Watershed District lies in the geomorphic region
known as the Anoka Sand Plain. The plain is characterized by medium
grain size sand.
The Anoka Sand Plain Aquifer is important with regard to under-
lying aquifers. Direct hydraulic connection between the surficial
aquifer and bedrock aquifers due to permeability and significant
amounts of vertical leakage downward toward underlying aquifers.
Any development affecting the quantity or quality in the Anoka
Sand Plain Aquifer could, therefore, affect quantity and quality of
water in underlying aquifers. Complexities in the total hydrologic
system requires additional data and model studies to adequately
evaluate the response of the system to groundwater development.

The Anoka Sand Plain area is especially vulnerable to contamina-
tion from various sources such as abandoned wells and undergro~d
storage tanks. For further details see Appendix of the Coon Creek
Watershed District Comprehensive Management Plan, pages

Due to the existing and extensive areas within the designated
project area that are serviced by private wells and private septic
systems and coupled wi th the vast areas of hi gh water table sand
soils, organic peat soils, and extreme sensitivity of the Anoka
Sand Plain surficial aquifer, it is very important to further study
existing groundwater conditions and the effect of current land use
practices on the quality of groundwater. The following list was
assembled by our staff as to the number to municipal wells, an
estimate of private wells and private septic systems within each
of the communities.

Description of Project Work Plan according to Work Plan Elements.
A. DIAGNOSTIC STUDY
1.) Soils & Geology
The study area in the cities of Ham Lake and Andover represents ~
approximately % of the total land area of the Coon Creek Watershed
District which is one of the fastest developing areas in the Metropolitan
suburbs. % of this area is urbanized. It is also totally within the Anoka
Sand Plain Aquifer, one of the largest surficial aquifers in the state.
Because of rapid percolation rates, the sand plain aquifer is highly
susceptive to contamination from land-surface activities that could
degrade the quality of water in the underlying aquifers. One very
significant factor in surface water quality is sediment which results
from on land erosion.
a.) Creation of erodibility maps - a map that delineates. by soil
types, each soils erodibility factor, thereby classifying highly
erodible areas that require appropriate treatment.
b.) To collect and verify the location of logs for drinking wells
within the Coon Creek designated project area and associated water
quality information. This information will be entered and
stored into a computerized system called WELLS developed by the
Minnesota Geological Survey.
2. ) Land Use
a.) To prepare specific land use maps of the Coon Creek area
within the cities of Ham Lake and Andover by means of current
aerial photos and land truthing method to determine specific
current land use. A 2.5 acre scale will be used.
b.) To assess existing land use practices as it relates to water
quality within the designated area.
To determine current rural and urban land use practices with
respect to erosion and sediment contol on land practices, chemical
application rates and soils testing practices by means of mailing
survey and in person survey.
3.) Surface and Groundwater Quality
a.) Coon Creek - To do water sample collection and testing to
determine effect of urban and rural land uses from runoff.
b.) Groundwater quality in Coon Creek area within the cities of
Ham Lake and Andover - To sample selected drinking wells to

PROJECT BENEFITS

Project benefits will include a better analysis of non-point
pollutants to the ground and surface water, and how erosion contri-
butes to surface water contamination. It will also give us the ability
to i dent i fy certa in contami nants and di scover thei r ori gi ns. The
project will allow assessment of short terms trends by comparing land
use, land use practices with water quality information and well data
information.
Evaluation and assessment of the above information will result
in the development and implementation of best management practices
that will safeguard both the surface and groundwater quality of this
given area.
The information generated from this study will be extremely
useful to Anoka County and other Counties in the Anoka Sand Plain
Aquifer area. This correlates with other efforts by counties in
the Anoka Sand Plain. It will benefit Anoka County in their
planning and development of a County Groundwater Plan. As a planning
tool this study and the resulting data will be very helpful to the
local municipalities in permitting and establishment of new regulat-
ing ordinances, and the Watershed District in the same manner.
The greatest and most obvious benefit is that to the residents
in the Coon Creek Project area and those downstream residents of
Columbia Heights and the City of Minneapolis which use the Mississippi
River as their main water resource. The protection and preservation
of this water resource is vital to their economic welfare and develop-
ment. Also, obviously, it is important to the health and well
being of those that use Coon Creek for recreational purposes.
The essence of structurally sound water planning comes from well
planned data research and data collection and is ,based and eval-
uated on the same. This is an excellent opprotunity to do a diag-
nostic study to begin the data collection and research process so
that an adequate plan can be developed. We belive the correlation
between surface water and groundwater is extremely important and
should be further investigated.

RESOLUTION OF PROPOSAL TO MINNESOTA POLLUTION CONTROL AGENCY
FOR CLEAN WATER PARTNERSHIP GRANT FUNDS FOR THE UPPER COON CREEK AREA
WATER QUALITY PROJECT BY THE ANOKA SOIL AND WATER CONSERVATION DISTRICT
RESOLUTION

WHEREAS, the Anoka Soil and Water Conservation District is proposing to sponsor
a grant application to the Minnesota Pollution Control Agency for funds made
available through the Clean Water Partnership Program; and
WHEREAS, the Anoka Soil and Water Conservation District is proposing a diagnostic
study of surface and groundwater quality within the Upper Coon Creek Watershed
District boundaries in both urban and rural portions of the Cities of Ham Lake
and Andover within the boundaries of the Coon Creek Watershed District.
WHEREAS, the Anoka Soil and Water Conservation District is proposing as part
of this diagnostic study the production of current land use maps, highly
erodible soils maps, current land use practices index, computer compilation
of well logs, and monitoring programs witin the Coon Creek Watershed
District boundaries and project boundaries of the Cities of Ham Lake and
Andover; and
WHEREAS, the Anoka Soil and Water Conservation District in cooperation with the
Managers and staff of the Coon Creek Watershed District and the City Councils
of Ham Lake and Andover will assess and evaluate above data and formulate an
implementation plan to address surface and groundwater quality within the
Coon Creek Watershed District in cooperation with each municipality; and
WHEREAS, the Anoka Soil and Water Conservation District will agree to support
23% ($23,000) of this project in 1990 - 1991 of in kind labor.
WHEREAS, the Coon Creek Watershed District will agree to support 20% ($20,000)
of this project in 1990-1991; and
WHEREAS, the Cities of Ham Lake and Andover will each contribute 3.5% ($3,500)
of in kind services to support this project in 1990-1991; and
WHEREAS, the Clean Water Partnership Grant from the Minnesota Pollution Control
Agency will match combined funds from Anoka Soil and Water Conservation District,
Coon Creek Watershed District, Ham Lake and Andover of $50,000 = 50% in
1990-1991.

NOW THEREFORE, be it resolved that the Anoka Soil and Water Conservation District
Board of Supervisors support the proposed diagnostic study sponsored by the
Anoka Soil and Water Conservation District and agrees to provide it's share

NOW THEREFORE, BE IT RESOLVED that the Board of Managers of the Coon Creek
Watershed District supports the proposed study sponsored by the Anoka County
Soil and Water Conservation District and agrees to provide its share of
financial support pending approval of the grant application by the Pollution
Control Agency.

The city Council is requested to award the bid in the amount of
$2850 to Waalen and Sabby, Inc. of Blaine for the installation of
a 250' water service to the u.s. West building on 139th Avenue.
We will charge the lot for a water lateral and water trunk source
and storage area and connection charges.
When water is constructed down 139th Avenue the service will be
connected to the lateral pipe in front of the property at that
time.
The service consists of 1" copper line 250' in length with a curb
stop, standpipe and rod, replace black dirt and seed.

The Anoka County Soil and Water Conservation District is proposing to
sponsor a grant application to the Minnesota Pollution Control Agency for.
funds made available through the Clean Water Partnership Program. This
program provides grants for 50% of the cost for local projects involving
water quality impacts of nonpoint sources of pollution. One such study could
focus on surface water quality of Coon Creek and groundwater quality in the
cities of Andover and Ham Lake, both urban and rural portions of the watershed.
The project would cost $100,000 with 50% of this coming from local sources,
i.e. the Watershed District and the Soil and Water Conservation District. The
Watershed District's share would be $10,000 per year for the two years beginning
in 1990.
The proposal would consist of a diagnostic study and implementati.on plan.
The diagnostic study would consist of collecting and generating data in the
Coon Creek areas of the cities of Andover and Ham Lake on soils and geology,
land use, and surface and groundwater quality. This data will be used to define
any problems in this portion of the Watershed District while an implementation
plan will propose solutions to those problems identified. The proposal is out-
line as follows:
I. Diagnostic Study
A. Soils & Geology
Erodibility maps
Well logs, and related groundwater information
B. Land Use
Land use maps
Existing land use practices - i.e. fertilizer/
nutrient and pesticide applications
C. Surface and Groundwater Quality
1. Coon Creek - sample and test creek at various
points to determine the effect of urban and rural
land use practies on surface water.
2. Groundwater in Coon Creek area - sample and
test water from wells at various 'd~si~n~ted rural
and urban sites to determine contaminant levels.

RE: Proposed Upper Coon Creek Area Clean Water Partnership Program
Dear Mayor Elling:
The Anoka Soi 1 and Water Conservation Di stri ct is in the process of prepari ng
an application for a Clean Water Partnership Grant for the Upper Coon Creek
area within the cities of Ham Lake and Andover to study surface and ground-
water quality and development of Best Management practices, It is our
desire to seek cooperation from the City of Andover in this project.
The program is based in and around the area of Coon Creek from the northeast
corner of Ham Lake to the southwestern border of Andover. Within this area
the program will cover:
A. Diagnostic Study
1 . ) Prepare soi 1 s erodi bi 1 i ty maps
2.) Prepare current land use maps
3.) Assess current land use practices
4.) Do well water sampling and creek water sampling for nitrate/
nitrogen, coliform bacteria, suspended soils, pesticide
scans, etc.
5'.) Uand truthing and entering of well logs into computer from
this area.
B. Data Analysis and Assessment
1.) With Hickok and Associates, consultants for Coon Creek
Watershed we will analyze all the above collected data.
2.) We will also need assistance from each city involved in the
collection of information concerning septic systems, number
of wells, current city ordinances, municipal well information,
etc. (This would constitute the $3,500 worth of in-kind
contribution that each city is listed for.)
3.) A full compilation of all data will be made, analyzed and
assessed.
C. Development of Implementation Plan
1.) The Anoka Soil and Water Conservation District, along with
Hickok and Associates, other state related agencies and
city representatives will develop a plan of Best Management
Practices.
