City Code 12-11requires a Conditional Use Permit (CUP)for drive-in businesses or businesses with a drive-thru windowin the SC: Shopping CenterZoning District. The applicant is proposing a drive-thruwindow for a proposed bank. Land use guidance for the adjacentpropertiesto the northand south isGC -General Commercial and URL –Urban Residential Low. The land use guidance for propertiesto the east, and west (across Round Lake Blvd) is URL –Urban Residential Low. FUTURE LAND USE MAP EXCERPT FUTURE LAND USE MAPLEGEND BACKGROUND The proposed CUP would allow a drive-thru/drive-upwindow. The lot has been vacant since October of 1986. DISCUSSION The applicant is planning to build a new 2,700square foot(appx.), one-storybank(21 feet in height). The lobby will be open Monday –Friday from 8:00 am to 5 pm. The drive up ITMS (think ATM with a button to talk to a teller) will be open during the same time frame. Two lanes of drive up to ITMS, and a night depository drop will be provided as well. Financial Institutionsare permitted usesin theSC: Shopping CenterDistrict, though a CUPis required for drive-in businesses or those with a drive-thruwindow.In addition to the CUP for the drive-thruwindow, the Andover Review Committee (ARC) is currently reviewing the Commercial Site Plan for the proposed bank site. Parking Parking for commercial uses varies depending on the use within the structure. The applicant is proposing a new parking lot serving the buildingwith spaces. City Code requires 1 stall per 200 square feet. A 2,700 square foot building would require 14 parking stalls. The applicant is providing 14 stalls including one van accessible stall. BuildingSetbacks Theproposedbuilding willcomplywiththeSC: Shopping CenterZoning District building setbacks required by City Code 12-3-5. BuildingExterior Building and dumpster enclosure elevations are attached. Exterior building materials include cast stone masonry veneer, EIFS, fiber cement board. The building would also have staggered flat roofs. Any rooftop mechanical equipment will require screening. Drive-Thru The proposeddrive-thru ITMS and after-hours deposit will be on the east side of the building with space for vehicles stacking around the east and south sides of the building. The proposed drive-thru appears to have space to accommodate a large number of vehicles before traffic from the drive-thru would back into the parking area or onto the street. This bank differs from some other banks in that it does not have a drive-thru teller window; the drive-thru area would be limited to the ISTM and night depository drop. This should also limit the number of vehicles stacked in the drive-thru. However, it is important for the City to consider that a CUP would run with the property, and a subsequent building occupant might use the site as a traditional drive-thru, sothe site should be designed to ensure the site also works for a traditional drive-thru. The drive-thru lane will be set back 50+ feet from the eastern property line, which exceeds the City Code requirement. The proposed drive-thru lane will be 24 feet in width and widen out to 31 feet near the drive-thru ITMS and night depository drop and also allow space for the bypass traffic. After leaving the area it narrows back down to 24.4 feet. Staff are currently evaluating the plans through the Commercial Site Plan process. Traffic Circulation th The site is designed to allow vehicles access into the site from 139 Avenue NW. Internal circulation allows for access though the site whether using the drive-thru or the standard parking area. The existing backage drive to Andover Downtown Center to the south will be removed. No access to the southern parcel. Trash Enclosure The trash enclosure will have an exterior offiber cement board, matching theprincipal building, as shown on the site plan. The interior portion of the trash enclosure will need to be concrete or masonry construction to meet city code. The gates are proposed to be tongue and groove cedar boards. Rooftop Mechanical Equipment Any mechanical equipment mounted on the roof or ground will be required to be screened to comply with City Code 12-14-5. Lighting All lighting is required to be shielded to prevent glare. Additional details for each type of fixture are reviewed through the Commercial Site Plan process to ensure adequate shielding will be provided. Screening / Landscaping A preliminary landscaping plan isincluded.The proposed plant quantities meet the requirements of City Code12-14-6 as shown in the noteson that plan. Final adjustments to the landscaping plan will be made through the Commercial Site Plan process. An existing fence is in place along the east property line. Staff is recommending that additional plantings be placed along the fence line outside of the drainage and utility easement in order to “break up” the length of the fencing. This also can help with reduction of headlight glare from the drive-thru. Signage A monument sign is shown along Round Lake Blvd. NW, and all signage will be reviewed through a separate sign permit process and sign permits will need to be obtained before signs can be placed on the property. Timeline for Agency Action If the Commission determines that restrictions greater than what is currently required by City Code are needed, they may recommend those conditions to the City Council as part of the CUP. One of the typical conditions that is included on conditional use permits is a timeline for implementation as defined in Ordinance No. 8, Section 5.03 (D), which states that if substantial progress is not made within one year from approval, the City Council may revoke the CUP. CUP Review Criteria City Code 12-15-7B provides the following general review criteria to consider when granting a CUP. In granting a Conditional Use Permit, the City Council shall consider the recommendation of the Planning and Zoning Commission and: 1. The effect of the proposed use on the health, safety, moral and general welfare of the occupants of surrounding lands. Businesses with drive-thru windows are regulated by City Code as conditional uses. There is an existing fence along the east side of the property providing screening from the residential property and staff have also requested additional planting along the fence to help break up the massing of the fence and may also assist with reduction of headlight glare from the drive thru. 2. Existing and anticipated traffic conditions, including parking facilities on adjacent streets and lands. As part of this proposal the backage drive will be closed and removed. The bank business thth will have an access from 139 Avenue NW. 139 Avenue NW has access to Round Lake Blvd. It is expected the bank business would draw traffic from Round Lake Blvd. The applicant is providing off-street parking for the proposed bank. 3. The effect on values of property and scenic views in the surrounding area, and the effect of the proposed use on the Comprehensive Plan. Financial Institutions are a permitted use within the SC Shopping CentersDistrict,and the area has been guided for commercial uses in the Comprehensive Plan. There are not scenic views in the surrounding area identified in the Comprehensive Plan. Staff believe the CUP of a drive thru will not have a negative effect on surrounding property values. PLANNING COMMISSION REQUESTED ACTION After taking public testimony at the Public Hearing, the Planning Commission is asked to make a recommendation on the proposed Conditional Use Permit Amendment to the City Council for their consideration on November 18, 2025. All other permits shall be obtained, including but not limited to Building, Lower Rum River Watershed Management Organization, etc. 3. The applicant shall provide additional landscaping to screen headlights from vehicles in the drive-thru from residential properties to the northeast. 4. The Conditional Use Permit shall be subject to a time limit for implementation within twelve months after approval of this Conditional Use Permit Amendment, or the permit will be null and void, as per City Code 12-15-7D.
