REGULAR ANDOVER CITY COUNCIL MEETING – SEPTEMBER 16, 2025
MINUTES
The Regular Bi-Monthly Meeting of the Andover City Council was called to order by Mayor
Barthel, September 16, 2025, 7:00 p.m., at the Andover City Hall, 1685 Crosstown Boulevard
NW, Andover, Minnesota.

2. DISCUSSION ITEMS
A. ANOKA COUNTY SHERIFF’S OFFICE MONTHLY REPORT

Commander Brent Erickson provided a monthly report including 1,134 calls for service, two
reported burglaries, 18 thefts, one criminal sexual conduct case, six assaults, and eight damage to
property reports. He shared they made four felony arrests, five gross misdemeanor arrests, and 17

misdemeanor arrests. He noted one of the DWI arrests that took place on August 5 was a second-
degree DWI when they were dispatched to a drunk driver. He shared the driver blew a 0.21, which
is nearly three times the legal limit. He added there was another DWI arrest made on an individual
who blew a 0.41. He shared the Sheriff's Office will have an Open House next Tuesday, September

23, from 4:00 p.m. to 7:00 p.m. He invited the residents to attend this event.
Councilmember Godfrey thanked Mr. Erickson and his Staff for the decline they are seeing in
most of the categories that are being tracked. She noted there has been a 49% increase in warrant
arrests and an 18% increase in felony arrests since this time last year and asked why that is. Mr.
Erickson explained the deputies are being a lot more proactive with enforcement.
B. ANDOVER FIRE DEPARTMENT MONTHLY REPORT
Fire Chief Jones provided a monthly report including 151 calls for service, 58 for fires, 83
emergency medical responses, and 10 motor vehicle accidents. He shared they gave mutual aid 10
times in the month and received mutual aid three times during the month. He noted fire inspections
and plan reviews were steady for the month. He said there were two fire investigations for the
month. He shared they had 160 public education hours. He noted one of their firefighters got a
full-time role at another fire department; however, they have 14 applicants for their next hiring

process. He shared there were two dwelling fires within two blocks of each other on August 15.

He added on August 20, they were dispatched to a call for a premature birth. He shared they were
able to provide life-saving measures to both the mother and the child. He noted the firefighters in
the Fire Academy and EMT training are now halfway through their training programs. He shared

they had a great turnout at their Open House last Saturday. He added that on September 2, the
first day of school, the Fire Department, Sheriff's Office, and School District partnered to welcome
students, teachers, and parents back to school to show their support and presence after the recent
school shooting in Minneapolis. He thanked City Administrator Cotton and Mr. Erickson for their
help with putting this together.
Mayor Barthel thanked the Fire Department for giving up their Saturday to host their Open House.
He said there was an amazing turnout, and he was so pleased to see the firefighters having a great
time.
C. CONSIDER REQUEST FOR AN EASEMENT ENCROACHMENT

The City Council is requested to discuss an appeal to the City Council for a property owner at 450

143 Avenue NW (Ethan Weinzierl and Rachel DuCharme) to allow a fence to remain in a rear
yard drainage and utility easement.

Director of Public Works/City Engineer Berkowitz reviewed the Staff report in regard to an appeal
to allow a fence to remain in a drainage and utility easement.
Paul Rogosheske, the applicant's attorney, came forward and gave a brief background of the
applicant's request. He noted Mr. Weinzierl is a police officer who has a K-9 police dog who uses
the fenced backyard to decompress. He shared the original building inspector had advised the
applicants incorrectly, which is why the fence was put in the drainage and utility easement. He
shared their request to allow the fence to remain within the drainage and utility easement.
City Attorney Baumgartner shared they had decided to pull this from the criminal court system to
put it in front of the Council, as it would make more sense to be decided by the Council. He
reviewed Exhibits 6 and 7, which contain the permit for the fence and additional communication
between the applicants and the City. He noted City Code states that fences shall not be put in
wetlands, drainage easements, or ponds. He said he does not think the City was mistaken in what
they advised the applicants on at the time. He stated the fence was put in the wrong location. He
shared that he is sympathetic to the need for the fenced-in area for the dog; however, he is
concerned with the precedent this would set that fences can stay in drainage easements.

Rachel DuCharme, 450 143 Avenue NW, the applicant, came forward and noted that other cities,
including others that Mr. Baumgartner represents, allow encroachment agreements. She asked for
a logical explanation as to why other cities would allow this, but Andover does not. Mr.
Baumgartner noted he represents Anoka as well, where they have utilized encroachment
agreements in the past, depending on circumstances. He noted Andover City Code states that
fences are not allowed in any drainage areas.
Ms. DuCharme noted it is stated inaccurately in the report that their fence is located in a pond, as
the land that the fence is on is dry and has grass.
Mr. Berkowitz shared the approval that was outlined in an email from City Staff on where the
fence could go back in 2020 was not followed. He noted there has been a lot of discussion about
utilities in this situation; however, they are not concerned with the utilities underground, they are
concerned with what is considered a pond in the rear yard and the encroachment of the fence into
the drainage easement, which is a ponding area. He said the area behind the house is a dry pond,
which was designed by the developer to meet the requirements of the City and the watershed.
Assistant City Engineer Law reviewed the grading plan, which depicts this area as a dry pond. He
explained they are designed to provide stormwater treatment and flooding protection for housing
during storm events. He added these are designed by looking at the water levels and the hundred-
year storm events. He said they have not yet seen the high water level of this pond since the pond
was built in 2015. He shared they have the drainage easements in these areas in the event they do
have a large storm event, and they need the water storage so ponds do not flood properties. He
noted there is a very detailed water study of Coon Creek, which is the best available information
for them on how to determine the high water level.

Mr. Berkowitz explained they do dozens of fence permits per year, and they have to deny these
permits from time to time when they would encroach upon an easement or ponding area. He said
Staff have an obligation to protect the City's infrastructure, which is why they have these rules in
place. He added consistency is extremely important when it comes to enforcing these rules. He
noted if they were to start to allow fences in ponding areas or easements, then they would open up
a can of worms for other requests to come in.
Mayor Barthel asked if the neighbor to the east’s fence is in the drainage and utility easement. Mr.
Berkowitz said no and shared they have an approved permit for this property to have the fence on
the drainage and utility easement line without encroaching into the easement.
Councilmember Shafto asked how far into the easement this fence encroaches. Mr. Berkowitz
shared the permit that was approved was to place the fence 50 feet from the east corner of the
house and 35 feet from the west corner, which would put it just off the patio of the pool. He noted
the fence currently encroaches about 14 to 15 feet into the easement.
Councilmember Shafto said he is struggling to understand how the fence distance was confused.
Mr. Berkowitz shared there was a drawing that showed 50 feet on both sides of the house; however,
the fence lengths were obviously not both 50 feet. He showed what was approved with the permit,
which showed 50 feet being approved on the east side and only 35 feet on the west side.
Mr. Rogosheske noted they had a recent survey done, which shows that the fence is in the water
level model, not the actual pond. He said the pond does not affect this fence.
Councilmember Godfrey said when she looks at the proposed encroachment agreement, she does
not see how this would solve the issue in front of them. She stated in one of the clauses that the
property owners would agree to remove the fence panels within 72 hours of the City's request. She
said if they were in an emergency storm situation involving flooding, then they would need the
panels removed far quicker than 72 hours. She added the agreement also states that the property
owners would be willing to indemnify the City against any potential damage to the property if any
flooding were to occur. She said she does not know what this would mean to all the neighbors in
the area, whom they are currently protecting through the City Code requirements and easements.
She noted they cannot make decisions based on what things look like today, but what things look
like with their best projections, and how to protect the entire City.
Motion by Godfrey, Seconded by Engelhardt, to deny the easement encroachment agreement at

Further discussion:
Councilmember Schue noted this is being put before the Council rather than a court, based on the
protection of the City and the residents. He shared he struggles to understand why the City does
not have encroachment agreements in Andover. He said he is looking at the case on its own. He
stated he does not see how this fence would impede any pond clean-up in a flood event. He shared

he would not be concerned with this setting a precedent, as they would review each encroachment
agreement request as their own item, and the applicant would have to provide the reasons for the
encroachment agreement.
Mayor Barthel shared the easement is not for access in a flooding event, but it is within the
hundred-year flood plain.
Councilmember Shafto said he is willing to review the City Code to make adjustments if they
make sense; however, if they allow this encroachment agreement now with the Code still reading
the way that it does, then the Council will have to review every encroachment agreement that
comes in. He shared this seems to be too broad an encroachment. He suggested making the
agreement conditional.
Councilmember Engelhardt shared he had a similar situation on his property. He explained when
he moved in, there was water at the highest it had ever been. He noted during this time, there was
an impact on their yard and their house. He said they never know what kind of storm events can
happen and how they will impact the whole City. He noted they have rules in place that need to be
followed to protect the City.
Councilmember Shafto shared he is sympathetic to the property owner; however, the way the
encroachment agreement is currently written, he cannot support it.
Mayor Barthel added he is also sympathetic to the property owner. He said he went out to the
property and saw the fence firsthand. He noted it is the City's job to protect every resident in the
event of a flood.
Motion carried 4 ayes, 1 nay (Schue).
D. PUBLIC HEARING - 2026-2030 CAPITAL IMPROVEMENT PLAN
The City Council is requested to hold a Public Hearing to give the public the opportunity to
comment on the proposed 2026 - 2030 Capital Improvement Plan (CIP).
Finance Manager Brezinka reviewed the Staff report concerning the 2026-2030 CIP.
Motion by Schue, Seconded by Shafto, to open the public hearing at 8:15 p.m. Motion carried
unanimously.

Councilmember Godfrey shared the Council and Staff have been working on this at virtually every

Workshop meeting since April.
Councilmember Shafto noted around 60% of the CIP is related to roads, as they are having to catch
up to get the roads back in shape. He added they have increased their focus and investment in roads
to make sure they can better track them for future maintenance.
Motion by Shafto, Seconded by Godfrey, to approve the 2026-2030 Capital Improvement Plan.

E. PUBLIC HEARING - CONSIDER VACATION OF EASEMENT 4431 148 LANE
NW - LOT 1 BLOCK 1 MEADOWOOD (APPLICANTS: BLAKE HONL/CITY OF
ANDOVER)
The City Council is requested to hold a public hearing and make a decision on the vacation of the
easement request, pending any changes by the City Attorney, and acceptance of the new location
of the easement.
Community Development Director Janish reviewed the Staff report in regard to the request for an

Motion by Shafto, Seconded by Engelhardt, to open the public hearing at 8:22 p.m. Motion carried
unanimously.

Blake Honl, 4431 148 Lane NW, the applicant, came forward and shared he is looking to put a
fence on his property, which is why this issue came up. He noted he was aware of the County's
easement but not the City's.
Mr. Janish shared he had received comments from Mark and Kari Miranowski, residents at 4511

148 Lane NW, indicating that they have no objection to the easement vacation at 4431 148 Lane
NW.
Motion by Engelhardt, Seconded by Schue, to close the public hearing at 8:24 p.m. Motion carried
unanimously.

G. CONSIDER A CONDITIONAL USE PERMIT TO ALLOW FOR AN EXPANSION OF

KINGHORN CONSTRUCTION ON BEHALF OF TRANSFORM CHURCH)
The City Council is requested to approve or deny the Conditional Use Permit (CUP) request based
on the materials provided and the recommendation of the Planning and Zoning Commission.
Associate Planner Breen reviewed the Staff report concerning a CUP request to allow for an

expansion of Transform Church at 1657 161 Avenue NW. He shared the Planning and Zoning
Commission’s recommendation for approval.
Councilmember Godfrey asked if Staff or the watershed district had any concerns with the
stormwater runoff with the additional paved area. Mr. Breen said there are no concerns that he is
aware of, and they are reviewing this as part of the commercial site plan.
Mr. Baumgartner shared there is a typo in the CUP and noted the correction.
Motion by Schue, Seconded by Shafto, to adopt Resolution No. R093-25, approving the
Conditional Use Permit request for the expansion of a religious institution on the property at 1657

161 Avenue NW, with the condition as stated by the City Attorney. Motion carried unanimously.
H. CONSIDER A CONDITIONAL USE PERMIT TO ALLOW FOR AN EXPANSION OF
A RELIGIOUS INSTITUTION AT 3155 BUNKER LAKE BOULEVARD NW
(APPLICANT: KINGHORN CONSTRUCTION ON BEHALF OF MEADOW CREEK
CHURCH)
The City Council is requested to approve or deny the Conditional Use Permit (CUP) request based
on the materials provided and the recommendation of the Planning and Zoning Commission.
Mr. Breen reviewed the Staff report in regard to a CUP request to allow for an expansion of
Meadow Creek Church at 3155 Bunker Lake Boulevard NW. He shared the Planning and Zoning
Commission’s recommendation of approval.
Councilmember Shafto asked how putting a religious institution in an area zoned for residential
use impacts the density coverage to the Met Council. Mr. Janish explained a representative from
the Met Council indicated that this would not penalize them in terms of density requirements.

Further discussion:
Councilmember Godfrey applauded Meadow Creek Church for coming up with such a creative
way to effectively use their space and minimize the disruption to this area.

I. CONSIDER A COMPREHENSIVE PLAN AMENDMENT TO ADJUST THE SEWER
STAGING MAP FROM 2031-2035 TO 2020-2025 FOR THE PROPERTY AT 3155
BUNKER LAKE BOULEVARD NW (APPLICANT: KINGHORN CONSTRUCTION
ON BEHALF OF MEADOW CREEK CHURCH)
The City Council is requested to approve or deny the Comprehensive Plan Amendment to update
the Sewer Staging Plan Map for the proposed property at 3155 Bunker Lake Boulevard.
Mr. Breen reviewed the Staff report concerning amending the Comprehensive Plan to adjust the
sewer staging map at 3155 Bunker Lake Boulevard NW. He shared the Planning and Zoning
Commission’s recommendation of approval.
Motion by Engelhardt, Seconded by Godfrey, to adopt Resolution No. R095-25, approving the
Comprehensive Plan Amendment to adjust the sewer staging map from 2031-2035 to 2020-2025
for 3155 Bunker Lake Boulevard NW. Motion carried unanimously.
J. CONSIDER A PRELIMINARY PLAT FOR HARTMANS MEADOWS, A 12-LOT
SINGLE-FAMILY RESIDENTIAL SUBDIVISION TO BE LOCATED AT THE
UNADDRESSED PROPERTY AT 16XXX WARD LAKE DRIVE NW; PID 11-32-24-
41-0003 - (APPLICANT: SW WOLD CONSTRUCTION INC.)
The City Council is requested to consider approval of a Preliminary Plat for Hartman Meadows, a
proposed 12-lot rural subdivision on 35.23 acres.
Mr. Janish reviewed the Staff report in regard to the preliminary plat for Hartmans Meadows. He
shared the Planning and Zoning Commission’s recommendation of approval.
Councilmember Godfrey asked about the two driveways with access on Ward Lake Drive. She
asked about the approximate traffic level on this road. Mr. Berkowitz said the average daily traffic
is under 200, making it a minor collector.
Councilmember Shafto said he appreciates the developer taking feedback from residents and
making this development the best fit in this area.

preliminary plat of “Hartmans Meadows”.
Further discussion:
Mayor Barthel shared when this development was originally proposed at 23 lots, he heard from
many residents in this area with concerns. He noted now there are only 12 proposed lots, he has
not heard from any residents, and he is appreciative of the development making this change.
Motion carried unanimously.
K. CONSIDER ESTABLISHMENT OF AUAR ESCROW
The City Council is requested to consider the establishment of AUAR escrows to cover expenses
for consulting costs and staff review time.
Mr. Janish reviewed the Staff report concerning establishing an AUAR escrow.
Mayor Barthel asked if the City would be able to recoup the costs that they paid for sewer and
water in this area. Mr. Janish said yes.
Motion by Godfrey, Seconded by Engelhardt, to approve the establishment of AUAR escrow.
Motion carried unanimously.
L. CONSIDER AUTHORIZATION OF SANITARY SEWER STUDY FOR RURAL
RESERVE
The City Council is requested to consider authorization of a Sanitary Sewer Study for the Rural
Reserve. This is a study to determine sewer-related information for the Fields of Andover AUAR.
Mr. Janish reviewed the Staff report in regard to authorizing a sanitary sewer study for the rural
reserve.
Motion by Schue, Seconded by Shafto, to authorize a sanitary sewer study for the rural reserve.
Motion carried unanimously.
M. CONSIDER AUTHORIZATION OF MUNICIPAL WATER STUDY FOR RURAL
RESERVE
The City Council is requested to consider authorization of a Municipal Water Study for the Rural
Reserve. This is a study to determine water-related information for the Fields of Andover AUAR.
Mr. Janish reviewed the Staff report concerning authorization of a municipal water study for the
rural reserve.

Councilmember Godfrey asked if the information found through this study would also inform the
Comprehensive Plan adjustments moving forward. Mr. Janish said yes.
Motion by Engelhardt, Seconded by Godfrey, to authorize a municipal water study for the rural
reserve. Motion carried unanimously.
3. STAFF ITEMS
A. RESCHEDULE NOVEMBER 4, 2025, CITY COUNCIL MEETING
Mayor Barthel shared the request to reschedule the November 4, 2025, City Council meeting due
to election night.
The Council was in agreement to reschedule this meeting for Monday, November 3, 2025.
B. ADMINISTRATOR’S REPORT
City Staff updated the Council on the administration and city department activities, legislative
updates, updates on development/CIP projects, and meeting reminders/community events.
(Administrative Staff Report) Ms. Cotton reviewed the Administrative Staff report. She shared as
part of the Met Council’s commitment to connect directly with communities, they are holding a

special meeting on September 17, from 4:30 p.m. to 6:30 p.m. in Champlin. She encouraged any
residents to attend this meeting.
(Public Works/Engineering Department Report) Mr. Berkowitz reviewed the Public Works and
Engineering Department report. He noted there was a discussion this evening at the Meadow Creek
Church about the Heather Street signal that is across from the school. He said the City and the
County made a commitment to make an improvement to this intersection, which has made a drastic
improvement in this area. He shared they have received a lot of positive feedback on this change.
MAYOR/COUNCIL INPUT
Councilmember Godfrey reminded the residents that this week is Constitution Week.
