(612) 755-5100 REGULAR CITY COUNCIL MEETING - OCTOBER 21, 1997 MINUTES The Regular Bi-Monthly Meeting ofthe Andover City Council was called to order by Mayor Jack McKelvey, October 21,1997,7:05 p,m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. Councilmembers present: Bonnie Dehn, Mike Knight, Ken Orttel, John Kunza , Councilmembers absent: None Also present: City Attorney, William G. Hawk'ns City Engineer, Scott Erickson City Planner, John Hinzman Community Development Director, Dave Carlberg City Administrator, Richard Fursman Others RESIDENT FORUM Winslow Holasek, 1159 Andover Boulevard NW - showed pictures of how the pond in Winslow Hills just south of Crosstown Boulevard has been lowered significantly since the dewatering has been taking place north of Crosstown Boulevard for the developments of Hamilton Square and Chesterton Commons, His concern is that the outlet for the pond to the north is three feet higher than the pond in Winslow Hills, That being the case, it seems logical that rather than outlet to the north, the ground water from the Hamilton Square pond will go south and ultimately drain through the Xeon storm drainage system. That system was not built to handle the water from north of Crosstown Boulevard, and he was concerned about that. He didn't know what could be done but suggested the City's engineers research it further. The Council agreed and suggested the Staff determine whether there will be an impact on the Winslow Hills pond rrom the Hamilton Square pond in the 100-year event. Carol Click ] 7657 Round Lake Boulevard - has been a resident since last January, She was concerned that Round Lake Boulevard is beginning to look more and more like a used car lot. One . property has four to six vehicles parked there every day. As she travels north on Round Lake Boulevard, there are items to sell all along the road. She didn't think that is the image she wants visitors coming to her house to have nor what the Council wants as the image for the City of Andover. She talked with Mr. Carlberg who said Staff has talked with one of the property owners in the past. They are not junk vehicles nor offensive, but there are so many of them. PUBLIC HEARING: VACATION OF EASEMENT/14041 ROUND LAKE BOULEVARD NW/RADEMACHER 7:25 p.m. Mr. Hinzman explained the Council is being asked to hold a public hearing to revacate a portion of a drainage and utility easement at Bill's Superette tonight. The vacation of easement was approved by the City Council on December 3, 1996; however, the wrong legal description appeared on the notice of the public hearing and the Resolution for approval. The City does not need the easement for storm drainage as that is being taken care of privately on the site. Staff is recommending approval. Mayor McKelvey opened the hearing for public testimony. There was none. Motion by Knight, Seconded by Dehn, to close the public hearing. Motion carried unanimously. Motion by Knight, Seconded by Dehn, the Resolution as presented (See Resolution R255-97 amending Resolution R276-96 granting the vacation of easement request of Rademacher Companies to vacate a drainage and utility easement at 14041 Round Lake Boulevard NW, Lot I, Block 2, Andover Community Shopping Center). Motion carried unanimously. 7:27 p.m. . PUBLIC HEARING: VACATION OF EASEMENT/637 141ST LANE NW/ASHFORD DEVELOPMENT CORPORATION 7:28 p.m. Mr. Hinzman reviewed the request of Ashford Development to vacate a portion of a drainage and utility easement in conjunction with the construction of a new home at 637 141 st Lane --~ ~----- -+,--.,~..- .. --, . ---~-_.- Regular Andover City Council Meeting Minutes - October 21, 1997 Page 4 (Public Hearing: Vacation of Easement/637 J4Ist Lane, Colltinued) - NW, Lot 4, Block 8, Crown Pointe East Addition. This is excess easement taken on the property. Staff is recommending approval providing the vacation is outside of the IOO-year flood elevation. They are also recommending that an additional five-foot easemem be dedicated to the City along the entire length of the western property boundary for stonn drainage. Mr. Hinzman suggested the Resolution be amended to include language that all easement to be vacated shall be outside of the IOO-year flood elevation. Jerry Windschitl. Ashford Development - stated these lots were the group of interim Jots of the Watershed Board where the back was taken in easement and additional pipe put in the ground that is not part of Crown Pointe East This is the last lot in that category. A future property owner now wishes to construct a house on the lot, and this will correct the easements. The recommendation of the Staffis correct; he agrees with the proposal as presented, including the extra five feet along the western property boundary. Mayor McKelvey opened the hearing for public testimony. There was none Motion by Knight, Seconded by Dehn, to close the hearing. Motion carried unanimously. 7:33 p.m. Motion by Dehn, Seconded by Kunza, the Resolution placed in front of the Council this evening granting the vacation of easement request of Ashford Development Corporation to include the amended verbiage that Mr. Hinzman has indicated regarding the IOO-year flood area. (See Resolution R256-97) Motion carried unanimously. 7:34 p.m. REZONING CONTINUED/I5XXX' HANSON BOULEVARD NW/CHESTERTON PARTNERSHIP Mr. Hinzman reviewed the request of Chesterton Partnership to rezone approximately 60 acres in Section 22 between Nightingale Street and Hanson Boulevard, north of Oak View Middle School, fTomR-I, Single Family Rural to M-2, Multiple Dwelling. The item was tabled at the request of the applicant at the September 16 and October 7, 1997, meetings to develop a definition and plan for senior housing on the site. JellY Windschitl Chesterton Partnership - stated he is still having great difficulty talking about this. He is being advised that if he talks about it, someone has the potential of misunderstanding it and charging him with age discrimination. Given the very complex federal law, it is difficult for him to make any type of commitment. Mr. Carlberg has been trying to be helpful in providing infonnation, which he received and appreciates. Mr. Carlberg stated under the Human Rights act, an exemption - to the discrimination of age based on certain categories is allowed. He talked with the Anoka County Community Development department, who provided language on senior housing. The League of Minnesota Cities has also provided ordinances from other cities. There are ways of constructing housing for seni ors, as other cities such as Ham Lake, have done. Continued) that information available to the Council, but further research on the law is needed. Councilmember Orttel understood Coon Rapids is a]so in that process. - Attorney Hawkins felt there are vehicles for this to be accomplished, but it is incumbent upon the applicant to bring something to the Council, a proposal on how the area wi11 be developed. Mayor McKelvey noted the Council has said an apartment building would be acceptable as ]ong as it is for seniors. He did not have a problem with town homes as long as they are being sold, but he felt an apartment building must be for seniors. Mr Windschitl - stated he would not mind researching this further. He stated in other cities, the market is bringing in the senior housing, which he did not think is discriminatory. The problem is having some definitive statement that says this is only for one group of people. Designating a specific age requirement would prevent a son or daughter from moving in with an elderly parent as the care giver. There has been some discussion about their selling the property. Mr. Windschitl stated their intent is to develop the property, not sell it. Attorney Hawkins recommended the developer contact the City ofLino Lakes where a senior housing complex has recently being developed. The Council noted that in most cases, a developer will come in with a specific proposal and site plan of what wi11 be developed on the site in conjunction with a rezoning request. Without that specific proposal, the options are to change the ordinance to include a zone specifically for senior housing or to contract zone with the property owner. While the amendment to the Comprehensive Plan did not specifically mention it, the Council specifically recalled that when the ]and use for this property was designated for multiples, it was done so with the understanding and intent that it would be for senior housing. In the Council discussion, most did not have a problem with empty-nester town homes or a mixed use like a day care in the development or an apartment facility for seniors similar to the one in Ham Lake on Bunker Lake Boulevard. They wanted assurances, however, that once rezoned, that is how the property will be developed. It was suggested other cities be contacted for the procedures they use in their senior housing developments. Mr Windschitl - stated he would do additional research, specifically with Coon Rapids, Blaine and Lino Lakes. He would also meet with Mr. Carlberg and Mr. Hinzman and agreed to tabling the item to the November 4 Council meeting. Mayor McKelvey then asked for a motion to table the item to the November 4 meeting. "fotion by Dehn, Seconded by Kunza, to so move. Motion carried unanimously. DISCUSS PO V'S SPORT BAR/OPERATION OF BALL FIELDS Mr. Carlberg eXplained the City received a petition ITom residents regarding the noise that is audible from the property line of Po v's Sports Bar, 1851 Bunker Lake Boulevard NW. Apparently there ~~-~---- --_.._.-~ - --------..-- " ! Regular Andover City Council Meeting Minutes - October 21, 1997 Page 6 (Discuss Pov 's Sport Bar/Operation of Ball Fields, Continued) have been a number of softball games that are in progress after 10:00 p.m. The Special Use Permit issued June 7, 1994, granting the liquor license to Brad Povlitzki for a restaurant/bar with two softball fields did not indicate a time when the games would end and field lights would be turned off. The City's Noise Ordinance states noise that is plainly audible at the property line of any structure after 10:00 p.m. shall not be permitted. Mayor McKelvey recalled at the time of the Permit, the Council understood the ball games would be over at 10:30 p.m. and that the City would allow them to keep the lights on until 10:30 or 11 :00 p.m. He also recalled Mr. Povlitzki was to plant trees along the swamp to alleviate the noise in the neighborhood. He is at Pov's often on behalf of the Lions Club, and he stated the times the games go past 10:30 are rare. The Mayor also related one time when the Sheriff was called by a neighbor complaining about the noise at Pov's when it was found the noise actually came from some kids down the block from the neighbor. If the City strictly enforces the 10:00 Noise Ordinance for softball games, he felt it will have to do the same for all games played in the City, including those using the City Hall ball complexes. Councilmember Orttel understood the problem is the noise, not necessarily the lights. The Sheriff has reportcd there were three complaints of noise ITom January through October, all received between September 25 and October 15 from one person between the hours of 10 and 10:35. Without a specific time stated in the Special Use Permit, he felt the Noise Ordinance has to be enforced. Barb Drabant-Duerr 13753 Partridge - stated she didn't have a problem with the lights. She has called Pov's when the lights are on late or when they have forgotten to turn them off, and Pov's has cooperated in turning them off immediately. The problem is the noise and verbiage on the week - nights. She didn't have a problem with Friday or Saturday nights; but it gets very loud on week nights. Most of the neighbors must get up early in the mornings. She cannot leave her windows open because of the noise from the ball fields. She is not comfortable with the male-oriented softball language. She'd prefer a 10:00 limit, but can live with 10:3ú. Anything later than that is very difficult. James Youn!: 13885 Osage - has a problem with the noise. The sound from the games carries very clearly. There have been nights where the games go past 10:30, and often the language is very graphic. He's not expecting them to quit the games, but 10:00 seems like a reasonable time. He has petitioned the rest of the residents and presented another portion of the petition to the Council. He now has 66 signatures regarding the noise ITom the softball games past 10:00. He felt this should be looked at very seriously by the City Council. He understands from City Staff that Pov's is to comply with the 10:00 Noise Ordinance. Mr. Carlberg stated the Minutes reflect that the ball fields could operate until 10:30 p.m., but the 10:00 Noise Ordinance does apply to Pov's. Brad Povlitzki owner of Po v's Bar - stated softball is a sport. He is six acres from the nearest house. Continued) 9:45 to 11 :00; and there have been no problems. He is in a commercial area. His last game starts at 9:15. and the lights stay on until 11:00. He can't stop people ITom swearing during the games. He has security. When this was approved. he specifically received approval to have games until 10:30. He cannot have his games finish any sooner. He expressed frustration that if he's made to stop by 10:00, he will lose about one-third of this business, which he cannot afford to do. There are some make up games left this weekend, but the softball season is now over. The discussion with those neighbors present and Mr. Povlitzki continued on the problem with noise, the concern with the impact on the children because of the language, and suggestions to resolve the problem to the satisfaction of the neighbors and of Pov' s. Residents stated the noise seems to have gotten louder, that some of the trees were bJown over in the storms and that the noise seems to carry through there. The Council suggested something be resolved btween now and the spring season. Mr Povlitzki - stated he win lose 30 percent oflùs teams ifhe can't play that last game. He received pennission before he cleared the property or received his pennit. The 4-foot trees he planted have grown to 15 and 20 feet high, The nearest house is 800 tèet away. The call he received yesterday was the person didn't like the sound of the ball being hit. He can put "no swearing" rules in his rules and will try to work on the issue of obscenities. It is not feasible to start the games earlier. He could plant more trees and or install a fence if the DNR would allow lùm to put the anchors on the adjacent property. He also noted that sign ups for next year begin in January, so this needs to be resolved by then. The Council then suggested the item be referred to the Planning Commission to consider amending the ordinance or to suggest other resolutions. They agreed the neighbors or a contact person will be notified when the P]anning Commission considers the item. CHANGE MEETING TIMElNOVEMBER 4 CITY COUNCIL MEETING Staffinfonned the Council the time of the November 4 meeting wj] begin at 8:01 p.m. because of the election. CONSIDER WAGE SCHEDULES Mr. Fursman explained the wage schedules before the Council are the same as what was presented at the last budget meeting with two changes. The Planner I position will be corrected to a top wage of $37,000 to reflect the actual averages for communities in Andover's group. Mayor McKelvey stated the schedule compares to the average wages for cities up the 25,000 population. Once Andover's population reaches over 25,000, it will fall into another group of cities. He expected that won't happen until 2001 after the census figures come in, so it should be another three years before a major adjustment is needed. APPOINT ZONING ORDINANCE TASK FORCE MEMBERS The Council interviewed applicants for the task force at a special meeting prior to this regular meeting and generally agreed to the following appointments: Richard Erickson Don Olson James Driessen Alternates: Valerie Holthus Guido Westenberg Bruce Bennett Joel Ohnesorge Motion by Dehn, Seconded by Orttel, to approve the appointments and alternates. Motion carried unanimously. MA fOR/COUNCIL INPUT Waivers or deferments for seniors - Counci!member Dehn asked if the City had any type of wavier or deferment for seniors on sewer and water charges. Continued) Crooked Lake Boulevard project - Mr. Erickson stated the watermain in the Crocked Lake Boulevard project has been tested and people can come in to register to hook up to it. He will also let the contractor know about the mailboxes that have not yet been returned to their original location. Crooked Lake School update - Fire Chief Dan Winkel updated the Council on the status of the Crooked Lake School. He and the Building Official have been working with the school district to get 15 classrooms established in the Downtown Center. Those classes will start Monday morning with 375 students attending, Councilmember Dehn suggested that the parking lot and surrounding area be signed that there are students in that vicinity now. Andover Lions Club Halloween Party - Mayor McKelvey announced the Andover Lions Club is hosting the Halloween party for the children at Andover School on October 31.
