SPECIAL CITY COUNCIL MEETING - OCTOBER 3, 1995
MINUTES
A Special Meeting of the Andover City Council was called to order by
Mayor Jack McKelvey on October 3, 1995, 6:40 p.m., at Andover City Hall,
1685 Crosstown Boulevard NW, Andover, Minnesota, to review the
activities of land acquisitions in the area of the salvage yards.
Councilmernbers present: Dehn, Jacobson, Knight (arrived at 6:55
p.m.) , Kunza
Councilmernbers absent: None
Also present: City Attorney William G. Hawkins
City Administrator, Richard Fursman

Mr. Fursman and Attorney Hawkins reviewed the status on the City's
effort to purchase properties in the proposed industrial park south of
Bunker Lake Boulevard:
Leisenger property: Attorney Hawkins reported he spoke with Mr.
Leisenger, who has indicated he would consider an offer from the
City. An appraiser has been retained to get an appraisal of the
property, after which they will begin negotiations.
Wilbers: Mr. Fursman indicated the City has not officially
contacted the wilbers with an offer.
David Heidelberger property: Mr. Fursman noted the sale has been
closed.
Mandy Olson property: Attorney Hawkins explained the purchase has
been negotiated. Mr. Olson's attorney reviewed the purchase
agreement and has asked that it be changed to the City paying
$25,000 in earnest money to be retained by the attorney until
closing. Mr. Hawkins has agreed, though he has not yet received
that signed purchase agreement. He proposed the EDA approve that
purchase this evening contingent upon the receipt of that signed
purchase agreement.
Andover Auto Parts: Mr. Fursman reported the business will lease
the property from the City and will be allowed to operate through
May, 1996 . Attorney Hawkins noted the purchase agreement has not
yet been executed. The seller is asking for another $10,000
because he did not realize he would have to pay the interest on the
assessments for 1995. The property will then be vacated. Mr.
Hawkins did not feel it was appropriate for the City to pay that
interest, and he will be making that recommendation to the EDA this
evening.

ATV: Mr. Fursman reported the asking price to purchase the
property is more than the Mayor, legal counsel and Administrator
are willing to pay. The business wants to move from its two-acre
parcel to a seven-acre parcel and is asking the City to pay the
relocation expenses and additional costs for that move. Staff does
not feel it is appropriate to pay for the expansion and improvement
of ATV's business. Staff is willing to move ATV to a comparable
site with comparable facilities, but not to advance the situation.
Best Auto Parts: Mr. Fursman explained there was contamination
found in the ground water, but it hasn't been determined whether it
has anything to do with the business or is a result of drift from
the WDE site. That needs to be determined before the environmental
situation can be resolved. A price has already been agreed too for
the purchase of the land. Attorney Hawkins stated there is
agreement to extend the closing on the purchase until November 6
with the expectation there will be an answer by then as to the
extend of the cleanup needed. If there are any cleanup costs, it
is the landowner's responsibility.

Pumpkin City site: Mr. Fursman stated the City has purchased the
site.
Tax forfeit property site: Attorney Hawkins explained the county
made an error in its process to notify the individuals who had an
interest in the process. Until those legal requirements are met,
which will be about the middle of November, the City is unable to
proceed with the original plan. In that plan, the county had
agreed to grant the City the right of entry to clean up the site;
and the county will deduct the cost of the cleanup from the
appraised value.
Mom's Auto Parts and Rick Heidelberger's property: Mr. Fursman
stated there will be no negotiations until the owners can resolve
their legal matter on the property.
Sandeen property: Mr. Fursman stated the City has already
purchased the property, and the Fire Department will be doing a
practice burn on the building this weekend.
Commercial Auto: Mr. Fursman stated Mr. Mistelski has not yet been
approached regarding his salvage yard. An appraisal is being done
on the parcel on the corner of Jay Street and Bunker Lake
Boulevard, but those results have not yet been received.
Mr. Fursman also stated there has been no talk about acquiring Anoka
Auto Parts. The intent would be to concentrate on the southern side of
Bunker Lake Boulevard. He was also cautiously optimistic that the
acquisitions and projects slated for the recent TIF bond issue will be
under the proposed budget. He noted, however, that at times the
negotiated price will not be the same as the appraised price because the

City is purchasing the business. The intent is to complete Commercial
Boulevard and the service road along Bunker Lake Boulevard to begin
developing the property along that area. For the next year no road
improvement projects are planned that would impact the present property
owners along Jay Street.
MOTION by Kunza, Seconded by Dehn, to adjourn. Motion carried
unanimously.
The meeting was adjourned at 7:05 p.m.
