HomeMy WebLinkAboutSP December 15, 1993 ~ I J-.jlq~ ~ CITY of ANDOVER SPECIAL CITY COUNCIL MEETING - DECEMBER 15, 1993 MINUTES A Special Meeting of the Andover City Council was called to order by Mayor Jack McKelvey on December 15, 1993, 7:34 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. Councilmembers present: Dalien, Jacobson, Knight, Perry Councilmember absent: None Also present: City Planner, Dave Carlberg JOINT MEETING WITH AUTO RECYCLING/JUNKYARD TASK FORCE Task Force Members present: Councilmember Larry Dalien Andover Auto Recyclers Association members - Penny DeNucci - Anoka Auto Wrecking JoAnne wilber - Wilber's Auto Parts Economic Development Committee member, Mike Auger Members absent: Planning Commission member, Jay Squires Economic Development Committee member, Bill Coleman Andover Auto Recyclers Association member - Harry Haluptzok - Best Auto Parts Planning Commission Chairperson, Bonnie Dehn Also present: Other owners of recycling yards The Task Force reviewed the verbiage on proposed amendments to the non- conforming uses and structures section of the ordinance. Everyone generally agreed with the rewording of the proposed Subsection (3) of the amendment to Section 4.3, as proposed by Councilmember Jacobson. Mr. Carlberg reviewed the existing ordinance requirements regarding fencing, berming, parking, etc. Councilmember Knight felt the entire purpose of an ordinance change would be to make the junkyards more visually pleasing, and he felt that can best be done by berming and vegetative fencing. He wanted to see the ordinance specify fast-growing trees and shrubs that would be acceptable. He also strongly felt the vegetative fencing should include a minimum of three staggered rows planted three to four feet apart. Councilmember Jacobson stated the proposal specifies the trees and shrubbery must be of such quantity and size when planted to assure coverage within a three-year period. The distance between plants would depend on the species. Ms. Wilber noted that no matter what they do, it must first be approved by the City. After further discussion, it was agreed Staff would compile a list of acceptable vegetative species for fencing that would be available, but that list would not be made a part of the ordinance. In addition, an example of vegetative fencing will be sketched to be used as a guide. It was also felt that any reduction of outside storage and subsequent parking space, open space/green space, berming and/or planting of trees or other shrubbery under this subsection must be approved prior to receiving a building permit. It was agreed to add the following sentence after " . . . quali ty approved by the City.": Special Andover City Council Meeting Minutes - December 15, 1993 Page 2 (Joint Meeting with Auto Recyclers Task Force, Continued) "A plan shall be submitted and approved by the City prior to a building permit being issued." There was some question as to whether the enlargement of a parking lot would be legal since these are nonconforming uses; however, the majority felt the intent is to beautify the area, and improved parking would meet that intent. Mr. Carlberg agreed to check with legal counsel on this issue. It was also noted the Zoning Ordinance requires landscaping around all parking lots, which would then be applied to the junkyards. A suggestion was to reference the parking regulations in Ordinance 8, Section 8.08. There was considerable deliberation on the effect of the proposed changes to the ordinance in conjunction with the existing regulations, with various scenarios presented and options discussed. It was determined that for any use of the vacated storage areas, the existing fences would have to be moved. For example, adding parking spaces would be outside of the fence because, those representing the auto recyclers stated, it is not feasible to have customers park inside of the yard; which would mean moving the fence inward. Any berming and/or vegetative fence must be outside the fence and would mean moving the fence inward. The idea is to screen the business from the public. The proposed Subsection 3 applies only to the land vacated of vehicle carcasses; all other ordinance provisions still apply. Mr. Carlberg suggested the amendments be incorporated into Ordinance 44, The Junkyard Ordinance, rather than under nonconforming uses in Ordinance 8. He will prepare a proposed amendment to include the amendment discussed at the November 18 meeting plus the proposed Subsection 3 with the added sentence discussed this evening. He will also reference Ordinance 8, Section 8.08, parking. In addition, he will prepare an addendum on the type of vegetative plantings that would be acceptable to the City and a drawing to be used as a guide for the staggered planting of rows for a vegetative fence. It was suggested the height of the initial plantings should be a minimum of six feet, though ultimately the trees and shrubbery must assure coverage within a three- year period. The intent is that the Council will approve the addendum, and Staff will work with the yard owners and approve their plans prior to issuing a building permit. Mr. Carlberg agreed to submit the proposed amendment to the City Attorney for review, then to the Task Force members, and finally to the City Council for action. MOTION by Auger to adjourn.
