SPECIAL CITY COUNCIL MEETING - APRIL 8, 1993
MINUTES
A Special Meeting of the Andover City Council was called to order by
Mayor Jack McKelvey on April 8, 1993, 7:30 p.m., at the Andover City
Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota.
Councilmembers present: Dalien, Jacobson, Knight, Perry
Councilmembers absent: None
Also present: City Planner, Dave Carlberg
City Finance Director, Daryl Sulander
City Administrator, James Schrantz
(Council opened the Board of Review meeting; however, no resident came
forward. The meeting was held open for a period of time in the event
someone wished to speak. In the meantime, Council discussed the
Ordinance 37 amendment.)
AMEND ORDINANCE NO. 37/SEPTIC SYSTEM ORDINANCE
The City Council reviewed the proposed amendment to Ordinance No. 37
which will require property owners that have on-site sewage disposal
systems to have them inspected on a biennial basis by an MPCA certified
and licensed Individual Sewage Treatment System Professional. The
amendment will satisfy the Metropolitan Council requirement that this be
done prior to their acceptance of the City's Comprehensive Plan.
Mr. Carlberg explained it would be the homeowner's responsibility to
hire the inspector to inspect the system and mail in the results. The
property owners cannot do the inspections themselves. It is presumed
those individuals would be persons associated with individual sewage
treatment systems such as waste disposal or sewer pumping companies.
This is a PCA requirement that will be effective throughout the seven-
county metropolitan area. If the property owner does not arrange to have
the inspection done, the City will do it for a fee.
The Council discussed the merits of the City doing all inspections
versus allowing it to be done by private parties. Points noted where
private parties may be able to do it cheaper than the City can; the City
would need to add a staff position to do just septic system inspections
if all inspections were done by the City; and it may be an advantage to
the residents to have City Staff do the inspections since private
inspectors may have a personal interest in the subsequent need to have
the septic systems pumped.
Council asked Staff to determine the costs for the City to do the
inspections and the fee that would need to be charged the residents.
Mr. Schrantz suggested the amendment become effective in 1994, as it may
take that long to get everything set up. Council gave conceptual
agreement to the amendment, directing that the item be added to the next
regular agenda for consideration.

METROPOLITAN COUNCIL REPORT ON VACANT LOTS
Council noted the latest information on available lots within the City's
Metropolitan Urban Service Area. There are 490 vacant lots, plus 129
within approved preliminary plats and 45 within a sketch plan which was
brought to the City. Staff noted a public hearing was held for
utilities in Hartfiel's Estates two years ago, but the majority did not
want it. The Mayor at that time had indicated the City may choose to
remove that area from the MUSA to place the acreage elsewhere. Because
of the need for additional MUSA acreage, the suggestion has been to
exchange that portion of Hartfiel's Estates for an additional 39 acres
of MUSA expansion.
The Council discussed the need for additional MUSA to cover the City's
costs of the infrastructure already in place, the demands being made by
the Metropolitan Council and alternatives the City has. At this time,
the Council did not wish to request an exchange of removing Hartfiel's
Estates from the MUSA for another 39 acres elsewhere, though they wanted
to keep that option open. They first want to get approval of the 100
acres of MUSA expansion which has been promised by the Met Council.
Mayor McKelvey stated he will explore all options with the Metropolitan
Council regarding the MUSA expansion and the approval of the
Comprehensive Plan.
MINOR AMENDMENT TO COMPREHENSIVE PLAN/1 DO-ACRE MUSA EXPANSION
Mr. Carlberg explained the proposed Minor Amendment before the Council
does not have all the correct figures in it yet. He will correct it
before forwarding it to the Metropolitan Council. The request is for an
allocation of 100 acres of MUSA, which has been agreed to by the
Metropolitan Council. It was a recommendation of the Met Council Staff
that a Minor Amendment be submitted for this request.
MOTION by Knight, Seconded by Perry, to approve the Minor Amendment to
the Comprehensive Plan for 100 acres of MUSA expansion. Motion carried
unanimously.
STREET CONSTRUCTION/GRACE LUTHERAN CHURCH AND CHAPMAN'S ADDITION
Mr. Schrantz asked if the Council wished to hold a public hearing for
the residents regarding the construction plans for providing access to
Grace Lutheran Church. He stated the Church is not in agreement with
the driveway behind the Medical Building which was agreed to by the City
and the county. One of their concerns is the maintenance of the
driveway. There is a meeting with all parties involved on Tuesday,
Apr il 13, 1993, to discuss the issue further.

The Council suggested if an agreement is reached at the April 13 meeting
to construct the driveway behind the Medical Building with no access to
136th, then there is no need for a meeting with the residents since
their wishes are being met. If, however, an agreement cannot be reached
and a street may be put through to 136th, then an informational hearing
should be held to let the residents know what is taking place. If a
meeting is held, the Council requested that a representative from the
county be present and that overhead maps be used to present the project
for that intersection.
Council also agreed that if an informational hearing is held, those
within 350 feet of the Medical Building and Church should receive
written notification of the meeting. Mr. Schrantz suggested those who
signed the petition be notified of the meeting as well.
MOTION by Perry, Seconded by Dalien, that the City Council will hold the
informational meeting if the meeting with the Church on Tuesday, April
13 would mandate one. Motion carried unanimously.
MOTION by Jacobson to adjourn. The meeting was adjourned at 8:56 p.m.
