CITY of ANDOVER SPECIAL CITY COUNCIL MEETING - MAY 26, 1992 MINUTES A Special Meet! ng of the Andover City Council was called to order by Mayor Ken Orttel on May 26, 1992, 6:30 p.m., at the Andover City Hal 1 , 1685 Crosstown Boulevard NW, Andover, Minnesota. Councilmembers present: Jacobson, McKelvey, Perry, Smi th Councilmembers absent: None Also present: TKDA Engineer, John Davidson CIty Administrator/Engineer, James Schrantz Others AGENDA APPROVAL It was suggested the Agenda be changed to: Item 5, Dog Bite; Item 6, Street Sweeping Update; Item 7, Adj ourn ; and that Item 5 be considered first. MOTION by Jacobson, Seconded by Perry, to approve the amended Agenda. Motion carried unanimously. DOT BITE Mayor Orttel explained this past weekend a two-year-old was bitten by a stray dog. The dog Is in the pound, and the ordinance requires it be held for ten days before i t is reJeased. There were no tags on the dog and no one has claimed it. Because of the young age of the child, the doctor feels she is more of a rIsk by waiting the ten days before determIning i f the dog is rabid. The doctor is askIng that the dog be disposed of immedlately and tested for rabies. Bonnie Leslie, mother of thechlld, presented information from the Minnesota Health Department that a stay animal that has bitten a person should be held for three days, then disposed of ImmedIately and tested for rabies. It has been three days since the i r ch i 1 d was bitten. The Counc i I felt that the Clty/s ordinance should coincide with the State Health Department regulations and agreed to amend the ordinance. MOTION by Jacobson, Seconded by Smith, that we update the Dog Ordinance In the area of stray anImals and the biting of stray animals of humans, and that our ordinance fol low the State Statute In that regard. Motion carried unanimously. The Counc i 1 also agreed that in this case, because of the emergency and because the dog was not tagged and no one has claimed it, that they can proceed under the ordinance as amended this evening. Special Ci ty Counci J Meeting Minutes - May 26, 1992 Page 2 APPROVE FINAL PLAT/MEADOWS OF ROUND LAKE Mayor Orttel explaIned severaJ representatIves from the City and the developers met with the Director of the DNR Jast week regarding the extension of Eldorado Street south to CoRd 116 through protected wetlands. The Director saw no reason for disagreeing with his field engineers, who have recommended the crossing not be al lowed because no publlc need has been shown for infringing on the wetland. Untl I the City can show that need, the recommendation is to deny. The City has asked for an extension to the time of denial to allow it to develop more data to show that a public need exists. Mr. Davidson stated there have been lengthy discussions on the traffIc analysis resulting from this plat. He reviewed the proposals to accommodate traffic generated by the development with existing roadways. UltimateJy there would be a signaJ at 143rd and 147th, but at this time they would not meet warrants, They would recommended install ing right turn lanes at 143rd and Round Lake BouJevard and widen the street to 38 feet. Their report shows that a left turn at 147th and Seventh Avenue will cause some traffic delay. Mr. Davidson stated he talked with the State Aid engineer about reinstating the State Aid designation on 143rd. He also asked if the State Aid designatIon could remain on Eldorado to CoRd 116, if State Aid funds could be used to acquire the property for that extension before the crossing is approved, and If the City could do a phased development of 143rd to State AId standards. For now, the State Aid phase would be constructed through the plat from Guarani Street. The other portion of 143rd through the exIsting developments would remain as non-conforming. By using State Aid funds to acquire the property to connect Eldorado Street to CoRd 116, it could be constructed as a State Aid street in the future if the City appeals the DNR decision or as the laws change to be more In line with the federaJ standards which al low this type of construction. Federal standards have already been met, as the wetland has already been mitigated two for one. David Newman. representlnc NedeQaard Construction - stated as of March 13, 1992, Nedegaard Construction became fee owner of the entire parce 1 . On the terms of the development contract, they wi I J be waiving all rights to the Special Use Permit for a mobile home on that property when all things get together. At this point, he understands Nedegaard Construction has that Permit, which runs with the land. Wee Warneka. Andover Neichborhood Preservation Association. 14791 Blackfoot Street NW - commended the Council for the job they have done for this development. He stated the Association has taken the position that they would like to see the plat approved, and they would like assurance that the Counc i I wiJ J continue to pursue some connection to the south to CoRd 116. He also suggested stop signs on the State Aid road to slow traffic to keep i t from becomIng a thoroughfare from the river to Round Lake Boulevard. He was also puzzled as to why Bruce Hay's son has been on the site, wondering if Mr, Hay is sti II involved with the property and whether it can st ill be deveJoped in a mobile home park. Mr. Newman - stated Bruce Hay will be on sIte from time to time, as he contInues to hold a portion of the mortgage on that properpty and he is concerned about his investment. He assured the Council that Nedegaard Construction is the fee owner and the mortgage to Mr. Hay wi I J be paid. Pat ? . 4264 147th Avenue - asked If 147th is going to be widened and what are the plans for traffic controJ between Guarani and Seventh Avenue, WI th the addItional traffic, it could become a thoroughfare, his concern being for the children in the area. Mr. Davidson stated there are no specific plans for traffic contr01 between GuaranI and Seventh Avenue. Mayor Oçttel stated the traffic wi II be monitored to determine i f there Is a problem. If 143rd or 147th would have to permanently carry the traffIc, they wou1d have to be upgraded to State Aid standards, possibly wIth sidewalks for safety. However, theCitywiJJ contInue to work to get the exIt to CoRd 116. Wade Plaski. 4251 144th Lane - asked if there were going to be houses along Eldorado where it would meet CoRd 116. Mayor Orttel explained if the road goes through, there wi 11 be no houses along it on the southern portion. Mr. Newman - felt i t is a good project, noting there has been a lot of give and take on aJl sides. He asked for final plat approval this evening. He also stated he talked with Ms. Sonsteby after last week's Counc i 1 meeting. She indicated she would extend the option to acquire the extension of Eldorado Street from the plat to CoRd 116 for another 90 days. He is wil ling to secure that extension if during that time period the City wants to receive it. Mayor Orttel felt that would be a good idea. MOTION by Smith, Seconded by Jacobson, a Resolution approvIng the final plat of The Meadows of Round Lake as being developed by Nedegaard Construction in Section 29 and 30 of the City of Andover as written, noting the typing correction to be made on Page 2. (See Resolution R077-92) Motion carrIed unanimously. Special Ci ty Counci] Meet i ng Minutes - May 26, 1992 Page 4 AWARD BID/MEADOWS OF ROUND LAKE/IP92-27 MOTION by Jacobson, Seconded by Perry, a ResolutIon accepting bids and awarding contract for the Improvement of Project IP991-27 for sewer and watermain construction in the area of The Meadows of Round Lake, as presented. (See Resolution R078-92) Motion carried unanimously. APPROVE EASEMENT VACATION/PLEASANT OAKS PARK MOTION by Jacobson, Seconded by McKelvey, the Resolution vacatIng the road easement with the dedication as presented, wi th the addi ti on that the Resolution would be subject to review by the City Attorney as to its legality. (See Resolution R066-92 -- dupJicate motion of May 19, 1992, Page 3 of CIty Council Minutes) Motion carried unanimously. STREET SWEEPING UPDATE Mayor Orttel stated it appears the concerns of Public Works of awarding the street sweeping project to the lowest hourly rate bidder were Justified, as the contractor has not completed the Job for the tota1 amount budgeted. They are about $4,000 short of completing the project. Public Works was told to come back to the Counc i ] i f the job was not completed within the budgeted amount. For future reference, Me. Schrantz stated that when awarding bIds on an hour1y basis, the Council can consider other items than just the low bid such as the quality of service, location in relation to the City, etc. The $4,000 wI 1 J be transferred from other portions of the Public Works budget. MOTION by Jacobson, Seconded by Smith, that the City Council authorize an additional $4,000 for the completion of the street sweeping of the City, the $4,000 to come out of the Public Works budget in those areas of the budget to be determined by the City Engineer and Publ ic Works personnel.
