A special j oint meeting of the Andover City Couœil and Park and Recreation Commission
Wð$ called to order by Mayor Jim Elling on May 29, 1990, 7:05 p.m., at the Andover Qty
Hall. 1685 Crosstown Boulevard NW, Andover, Minnesota.

PARK DEDICATION REQUIREMENTS - ORDINANCE 10
The Qty Council discussed with the Park and Recreation Commission the park dedica.tion
requirements; specincally, Section 9.07.6(b) hiring of an appraiser and Section 9.07.11
Metes and Bounds Lm Splits.
Park and Recrcation:
Commission 01airpelson Kieffer stated that the commissionels are not experieœed in
estim.~ting fair rrølket value and cannot justify when an appraisor is or is not required
The commissionels would like to l1ð.ve a set procedure established fOI park dedication on
each property.
Dry Council:
Mayor Elling addre~.sed the concerns of the commission The council feels 1fflt there is
not a problem with ðIIlOlU1tS collected 01 the method used for developer parcels. 111e
present method of fïgUIing park dedication results in disparity for the small land owner,
because he cannot recoop costs. Councilmember Ortell expressed that there is more of a
problem with the appraisor than the system. His concern was that the appraisor didn't u>e
the same system for eæh property; impro\'ements would be included on some but not on
others. Specifically, the lot ordinance refers to unimproved land: couœilmembers
questioned whether the appraisor was aware of 1h~t.

Discl15sion:
Councilmember Pery recalled that council had originally moved th~t it was the
re3poœibility of the Park and Recreation Commission to hire an a.ppraiser. Þ.nother
councilmember added, tha.t with larger parceb coming in for sub-division. it h"\d become
difficult to determine wJ1at the developer had paid for it. COlmcilmember Ortel! felt there
was no support atth.~ttime, for another method of determining dedication; furthermore, it
appeared that the city attorney advised against a per lU1it charge.
I'l!ayor El!ing expressed concern that it might be an illeg.31 procedure if a per unit d1';Jge is

Agreement-
The Par}; and Recrea.tion Commission and Ù1e Andover City Council felt tha.t land
dedication was not a problem with ne;v plots, but wanted to know how a per lU1it char,g,e
could be a.pplied to a lot split and at the same time_ keep the appraiser out of it.
TI1erefore, the council recommended that the commissioners flùly investigate how other
cities incorporate a per unit charge. Councilmember Onel! suggested the possibility of
lobb¡'ing for legislation.
The mayor also indiœted he would contact \~'j]]ja..'1l G. Ha'l1kins, aty Attorney, and
Commissioner Ü1:drperson Kieffer should contact ù1e appr.:dser to solicit their advice
about establishing a fiat value for the rural and urban area and see if mere would be any
trouble ha.'ring that stand up in a cour1 of lav" for appraisal value pmposes. 1hs item 'Hill
be discll5sed at the Jlme 5th council meeting. The Park and Recre,,-tion Commision vrill
5ubsequemly infonn the Planrung ,,;nd Zoning Commission to restore Ordiœnce 40 with a
per unit charge.
KELSEY - ROUND LAKE PARK
Park and Recreation:
Commission Chairperson Kieffer expressed concern over the development of Kelsey -

trying to develop Kelsey-RolU1d Lake Park as a natural area with trail systems for hiking,
cross country skiu1g, bird watching etc.

COU11Cil has supported Kelsey-Round La],;e Park plan. M,,,yor Elling recalled an original
Kel:;e-¡ Park plan where some grant applicati= had been made and refu:5ed. He
suggested studying them to see why they œ.d been tumed down. Councilmember Perv

asked if the commission had investigated potential interest b)' the Anoka Hennepin
School District 11 in the development of a p,:.rk of this kind.
Agreement.-
Consensus wa:; reached with COlU1Cilmember Ortell's suggestion of negotiating with
Indian Mea.dows to acquire land needed.
CAPITAL BUDGET FOR 1991
A) Mayor Elling informed the commissioners about reduced funds a.vaila.ble from the
legislature. The coureil would commit matched fund; to the Kelsey - Round Lake Park
development. if a grant vias att¡Üned.
B) Accorcling to Commission Chairperson Kieffer. two rears ago. park dedication
funding of $10,000 was allowed for prairie grass on the south side of the park. but
neighbors disapproved of controlled bUlning. JI.rea \va:; subequently planted with grass
seed.
C) Ball Park Li~htin~ at City Hall Site: A single fee service charge of $435 for
~ ~ elec1rical facilities to loc.a.te all city lighting conllols and service for fields on the back of
AM buildi"g. JIM would pay the monthly electrical charge Due to high demand for
softbalL this would become a high priority.
D) More maintemœe of ball porks desiBble; subCOntrëoing is being considered.

COMPREHENSIVE PLAN
Park and Recreation Commission:
Commission Chairman Kieffer asked if the comprehensive plan should include a bike trail
system and/or an athletic complex.
Dry Council:

A) Commission expressed that evening use in some parks is abused and might
waHant the closing of p::<rks in e1¡'ening hours.
B) Commissioner Lind3hl suggested hiring a part-time staff for the p,01k system. in
order to check on dedication fees, to work on grantõ; etc. Council open to sttg.ge31iom.

Mayor EUing reque51ed that the commission submit their budget requests earlier than in
the p.351. C01.m:il will aœommod3.te the requests if poõsible. and if not will h3.'ie the
commissioners decide what is kept or cut. ll1e budget is clue approximately the first of
September.
