SPECIAL CITY COUNCIL MEETING - SEPTEMBER 27, 1988
MINUTES
A Special Meeting of the AndoveL City Council was called to oLdeL by
Mayor JeLry Wlndschltl on September 27, 1988, 7:30 p.m., at the
AndoveL CIty Hall, 1685 CLosstown BoulevaLd NW, Andover, MInnesota.
Councilmen pLesent: Apel, EllIng, Knight, OLttel
CouncIlmen absent: None
Also present: BRA Engineer, Glenn Cook; CIty
AdmlnIstLatoL. James Schrantz; and otheLs
AGENDA APPROVAL
It was agreed to amend the Agenda as fol]ows: Add Item 12, Election
Signs and Item 13, MITS Pipeline; and Delete Item 10, OLdlnance 10/
MInIng Permi ts.
MOTION by KnIght, Seconded by E]llng, approval as amended. Motion
caLLied unanimously.

Mr. Cook reviewed the BlueblLd pLoJect, noting the assessment fOL each
of the 16 lots Is $3,585.
Dennis Flaata. 17715 B]ueblLd - asked to have Load LestLlctlon signs
placed on BlueblLd so the tLucks do not use that road. It has only 2
Inches of bituminous, whIch he felt Isn't suffIcient fOL truck
traffic. He only sees a semi-tractor truck on It, but not the sod
trucks. Mr. Schrantz saId the road wIll handle that type of traffIc
but that repeated heavy use. After further discussion, the Counc 11
agreed "No Through Truck Traffic" sIgns should be posted along
BlueblLd.
ML. Cook then Levlewed the Langseth Pine Acres PLoJect, notIng the
assessment for each of the 52 unIts Is $1,655. Al I of the resIdents
but one own two units. That combIned lot was also assessed fOL two
units. Counc i I questioned the numbeL of units assIgned to Mr. Olesen.
Mr. SchLantz stated he was assigned four units, which LepLesents four
100-foot lots or two buIldable lots, which was agreed to at the publIc
hearIng.

Mr. Cook also explained the lower corneL lot off Round Lake Boulevard
which belongs to ML. Langseth was assigned a unit, even though water
dLains to It. The intent was if the City picks up that iot fOL
drainage, the City would pal' the assessment.
John Renao. 17425 Mariaold - counted 54 lots. Mr. Cook explaIned
ML. Oleson is assessed fOL 4 unIts, not 6. He said the count of 52 is
corLect.
Mr. Renao - asked If those those lots would have shaLed In the cost
If the Load was ImpLoved fLom Poppy on 173Ld Lane thLough the first
tIer of lots. The EngIneers stated no; they would have been assessed
on 173Ld if that pOLtion weLe constLucted. The inteLsection was built
under the MSA proJect.
There weLe no comments by Lesidents LegaLding any of the other
Assessment Rolls.
MOTION by Elling, Seconded by Orttel, to accept the Resolutions
adopting the Assessment Rolls fOL PLoJects 88-2, 87-26, 88-4, and
88-23 as presented. (See ResolutIons:

Motion carried unanImously.
TheLe was a bLlef discussion comparing the Lestoration pLoJects of
Langseth's, whIch is very satlsfactoLY, and Wobegon Woods, wheLe the
residents had so many complaints. It was also noted there is a
dIfference In the specifications between BRA and TKDA, as BRA's
contract stated the seed and sod must grow. The Council felt the end
result of BRA's proJects was better, asking the EngineeLing DepaLtment
to review the landscapIng specifications to be used in future
contracts and to Include the spec that the seed and sod must grow.
The hearings ended at 7:50 p.m.
BUDGET DISCUSSION
Mr. Schrantz revIewed the affect of the new tax formula by the State
on the PLoposed 1989 budget. He noted the PLoposed budget Lalses
about $360,000 less than the maxImum, posIng the questIon what happens
in the futuLe If building slows up. According to the new tax law, the
pLoposed budget puts the City at its maximum levy limit.

Counc II discussion noted how complicated the new tax fOLmula is, and
felt theLe was little choice but to approve the levy as proposed.
MOTION by OLttel, Seconded by Apel, a Resolution establishing the
1989 Levy to be certified to the County AuditoL by the City of AndoveL
as pLepared, and note that the non-bonded Indebtedness levy is set at
$906,259 and the bonded Indebtedness levy Is set as listed in the
þrepaLed resoiutlon. (See ResolutIon RI42-88) Motion caLried
unanimously.
COMPUTER CONSULTANT REPORT
It was agLeed to table the item untl I the Attorney and consultants can
be pLesent to discuss the matter. M.. Schrantz was directed to ask
the Attorney whether the matter can be discussed In closed sessIon 1 f
theLe is a potentlai fOL Ii t igat ion.
MOTION by OLttel, Seconded by Elling, to table the item to the next
LegulaL meeting and shown on the Agenda as potential I i tI 9a t i on .

STREET LIGHT POLICY
Mr. SchLantz asked fOL a clarification of the stLeet lIghting policy,
noting all aLeas Leceived notice for a public heaLing to be held;
however, there wi I I be no assessment in Woodland Meadows.
Counc i I didn't think a public heaLing was necessaLY fOL Woodland
Meadows or the areas being done by developeLs and thought the publ ic
hearing notices should not have gone out. They asked that the AttoLney
give an opinIon on the issue. The Counc i ] agreed on the following
thLee scenerios:
1) Woodland Meadows would not need a public heaLing, as nothing is
assessed since there is no installation charge from Anoka
E]ectLic. The Lesidents would be bIlled for usage, f ac I lit I' (a
perpetual charge for the cost of light installation and
interest) and maIntenance.
2) Woodland TerLace OL any otheL developed area that petitions
would follow the 429 procedure to assess fOL the Installation
and lIghts as billed by Anoka Electric. The residents would be
bIlled for usage and maIntenance.
3) In the pLoJects done by the developeLs, the developeL pays the
cost of Installation up front, so no public hearIngs aLe
necessary. The Lesidents would be billed fOL usage and
maintenance at the same rate as under Number 2.

MOTION by OLttel, Seconded by EllIng, that the Council dlLect Staff
to check with the City AttoLney Legardlng the publIc heaLing. If no
public heaLing Is necessary for Woodland Meadows, a letter be mailed
to those people no later than the 29th of SeptembeL advisIng them that
the public heaLing notice was In eLLOL and that none will be held.
Motion carrIed unanImously.
ELECTION SIGNS
Council discussed the issue Lalsed by the Zoning Administrator In heL
August 23 memo Legardlng the Intrepetation of the oLdlnance fOL
election signs. She understood It to say that each election sign needs
a peLmlt. Mr. Schrantz stated he has taken the position that peLmlts
have not been LequlLed In the past for tempoLaLY signs.
Council discussion noted some citIes do not allow any politIcal signs,
and others grant one permIt with a fee. It was generally agreed that
those types of signs have not been a problem In the past and that no
change should be made to the way It has been done. Council noted these
signs aLe not allowed on public property and cannot be placed on the
propeLty south of the City Hal I which Is now owned by the City.
MOTION by OLttel, Seconded by Apel, that the Council concur with the
City AdmlnlstLator regarding the recent Interpretation of the Sign
Ordinance, in paLticulaL SectIon 8.07 of OLdinance 8 LegaLdlng
tempoLaLY signs fOL such things as sales and political signs; and that
the Council refeL that matteL of that OLdlnance and Section to the
PlannIng CommIssion for revision such that it would be similiaL to
surLoundlng cities' ordinances In that Legard, and that the strict
interpretation be suspended until such tIme as the ordinance Is
Levlsed. DISCUSSION: Councilman Elling suggested a sepaLate section
fOL tempoLaLY signs to include rea] estate, electIon, and gaLage sale
signs. Motion carLled unanimously.
MITS AGREEMENT
MayoL Wlndschltl stated he has not signed the agreements with the
pipeline company because MITS has refused to put the thlckeL walled
pipe up to the nOLth half of Section 14 as asked for by the City. ML.
SchLantz reported the AttoLney has advised theLe Is no legal basIs fOL
not sIgning the agreements, as the LequiLement was not Included In the
CondItIonal Use PeLmlt.
MOTION by Orttel, Seconded by Ape!, that the Council dIrect the
MayoL to sign the easement agLeement with the MITS Pipeline Company
where it Is crossing City park propeLty and to sIgn the crossIng
agLeement for City stLeets. Motion caLLled on a 4-yes, I-PLesent

ML. SchLantz reporte wItnesses saw tires beIng hauled into the site,
Lelating the IncIdents that took place today. Counc i ] discussed the
possibility of hIring pLivate sULvelllance of the opeLatlon, though no
decisIon was made at this tIme.
