MINUTES
A Special Meeting of the Andover City Counci I was cai led to ordeL by
Mayor Jerry Windschitl on October 11. 1988. 7:30 p.m.. at the Andover
Ci ty Hal J . 1685 CLosstown Bou1evaLd NW. Andover. Minnesota.

It was agreed to add Item 6, Ordinance 33. The PaLklng Ordinance. and

POLICE DEPARTMENT DISCUSSION
Mayor Windschitl noted the SheLiff's Department has done a good Job of
clearing up the pLob]em with three and four wheeJeLs on the south side
of the City. Deputy Scott RoessJeL stated most of those tagged were
not AndoveL residents.
MayoL Windschitl stated there is about $80.000 available in the 1988
budget for increased police coveLage. plus an additiona] $84.000 or
more for 1989. He felt there is a need for additional coveLage.
feeling the options are to either expand the SheLiff DepaLtment's
coverage or to devote the funds to staLting up a City po]ice fOLce.
Because of the LecruItment process. It would take about three months
for the SheLlff's Department to expand the City's coverage. It was
his opinion that the City needs 24-hour coverage and the power car
should be on for an extLa two days.
The Counc i J Leviewed the pLesent coverage, the needs, the options
a v a i I ab Ie. and the costs associated with each. Deputy RoessleL
Leviewed the needs as he saw it. Councl]man Orttel obseLved a high
cost for an addItional 1 1/2 peLson. that it is only slightly more fOL
two fu J ] sh I fts. The Counc i I also discussed the hours of the sh I fts
in an attempt to provide the best coveLage.
Deputy Roessler didn't feel a total 24-hour coveLage was needed. He
Lecommended leaving the 9 p.m. to 5 a.m. caL and adding two days to
that shIft. Then back up the houLs of the otheL two cars by one or
two hours. so one would staLt at 9 or 10 a.m. and the otheL would
start aLound 1 p.m. That would leave about 4 hours in the morning
wIthout City coveLage, but there is county coverage available at that
time. He felt the extLa CaL dULing the afteLnoon and early evening is

Wlndschitl stated the county is working on the insta11ation of a
signal there. thinking it was to be approved this week.
MOTION by Orttel. Seconded by E1 ling. that the Counc i J direct the
~1ayor to meet with the officiaJs fLom the County SheLiff's Department
to negotiate a contract that would provide 32 hOULS of coverage per
24-hour period for the City of Andover: and to negotiate the best
pLice possib1e: and to discuss the houLs and shifts such that we get
the maximum effect from the increased coverage. DISCUSS ION:
Councilman OrtteJ stated the 32 hours of coverage would add one ful1
shift and two days on the swing caL. Motion carLied unanimously.
MULTI -FAMILY ZONING DISTRICT
M.. SchLantz though t the item was a Lesult of the senior citizens
housing committee on which Charlie Veiman is serving in an attempt to
set aside property for senioL citizen housing if i t is found to be
needed. Me-. SchLantz felt the attoLney's opinion is needed as to the
legality of rezoning propeLty to that specific use.
Mayor WindschitJ felt it wou1d be better to amend the ordinance to
aJ low for such use by Special Use Permit ratheL than by rezoning.
Counc i J discussion noted theLe are seveLaJ areas that wouJd be
appropLiate for senior citizen housing either along Hanson or Bunker
Lake BoulevaLds. They also felt that finding a specific location was
premature.
It was agreed the com~ittee would be toJd there wouJd be areas that
cou1d be made available fOL senioL citizen housing in the City. but
that i t is too premature to discuss specific locations or rezonings.
SAC DISCUSSION
Me-. Schrantz explained that since the 1970s. the City did not tULn
over the SACs paid fLom outside the MUSA area to the MetropoJitan
Waste Control Commission as was required by the Mw·CC. Those SACs
collected are in a City account. though the inteLest accLued on those
funds has not been credited to that same account. The MWCC has
changed its policy to collecting SACs only when there is access to the
Metropolitan Disposal System.

M.. Schrantz asked fOL Council direction on those funds collected but
never paid to the MWCC. Should they be Leturned to the owners.
retained by the City. or paid to the MWCC? One problem is the amount
of the SACs has IncLeased over the years. so the amount coI1ected is
less than what must be paid to the MWCC at this time.
Counc i I discussed the possibility of Leturning the the SAC to the
property owners or to the original owners and the boundarIes beyond
which the SAC would be Leturned. It was noted the pLactice of keeping
the SeweL Availablllty ChaLges rather than fOLwarding it to the MWCC
began in the mid-1970's. Some of the addLesses on the II st show the
SAC was paid In the early 1970s. thinking the City would have
fOLwaLded those chaLges col lected. M.. SchLantz was asked to research
that further and to provide a more accuLate list.
ML. Schrantz was a1so asked to deteLmine where the inteLest from that
money was credited and how much the interest amounts to. It was felt
the interest accLued should have kept up with the Late increases over
the years.
Counc i I then directed the Staff to prepare a letteL to the propeLty
owners in the aLeas outside the yeaL 2000 boundary exp1aining the
situation and that they have the option of claiming the SAC that was
paid or of 1eaving it with the City. If the propeLty owner wants the
SAC retuLned. he would sign the form; and the City will mai I out the
refund. It should be made clear that if the SAC is refunded and they
have to connect to municipal seweL in the future. the SAC would have
to be repaid at the then-cuLrent rate. If the propeLty owneL does
not want the SAC LetuLned. theCitywil1 pal' the MWCC fOL the SAC on
that pLoperty. So no more SAC funds will be retained by the City.
RULES FOR USE OF SENIOR CENTER AND COUNCIL CHAMBERS
M.. SchLantz asked to estab1ish rules and guidelines for the use of
the Senior Citizen CenteL and the Councl1 chambers. He asked if a fee
should be chaLged and whether individual poI i tica1 candidates cou1d
use the faci I i ties.
The Counc i I fe1t the rules and guidelines should be established by the
senior citizens. Since there hasn't been a prob1em. It was fe1t no
change should be made in the pol icies. It was also noted a set of
published Lu]es weLe approved short1y after the SenioL Citizen Center
was constLucted. asking that M.. Schrantz attempt to locate them. No

ORDINANCE 33. PARKING ORDINANCE
Councilman El ling read a proposed amendment to the Parking Ordinance
that would al low parking on the streets for such situations as
sealcoating the dLlveway, pouLlng concrete. etc. The amendment would
requiLe the resident to come to City Hal I to obtain a peLmit for each
vehicle that would be on the street, would be valid for no longeL than
14 days, would be Issued in tLlpl icate fOL the off I ce . Police
Department. and applicant, and would be invalid I f there is a snow
emergency in effect.
Counc i I general II' agreed. aSking that it be typed and placed on the
next Agenda for consideration. It was suggested the amendment be
clarified to state it is appl icable to private propeLty and private
vehicles and that it does not apply to posted streets.
COON CREEK WATERSHED WATER MANAGEMENT ORGANIZATION
Counc i 1 discussed the proposal of dissolving the Watershed and
Leorganizing it as a wateL management organization. simi I iar to the
Rum RiveL WateL Management Organization. AI I fOUL cities would have
to agree. Mayor Windschitl stated he has been asked if Andover would
hold a meeting with all the City managers and MayoLs and have County
and State personnel talk about the possibility of creating a water
management organization LatheL than a wateLshed.
MOTION by Elling, Seconded by Apel, that we authoLize Jim (Schrantz)
to contact the otheL cities and see if we can get a joint meeting of
the Councils and MayoLs and AdministLatoLs. to meet in the SenioL
Ci tizens CenteL to discuss It. Motion caLrled unanimously.
MOTION by Orttel. Seconded by Apel. to adjouLn. Motion carried
unanimously.
