ANDOVER, MINNESOTA 55304' (612) 755-5100 -, SPECIAL CITY COUNCIL MEETING - AUGUST 4, 1988 MINUTES A Special Meeting of the AndoveL City Council was called to oLdeL by MayoL JeLLY Wlndschitl on MaLch 8, 1988, 7:30 p.m., at the AndoveL Ci ty Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. Councilmen pLesent: Apel, Elling, Knight Councilmen absent: OLttel Also pLesent: BRA Engineer Glen Cook; CIty AdministLatoL, James SchLantz; and otheLs PUBLIC HEARING/DEHN'S 1ST AND 2ND/IP88-18 Mayor Wlndschltl Leviewed the Statue 429 proceduLe fOL Improvements. Mr. Cook then Levlewed the pLoposed street impLovement pLoJect, IP88-18, fo~ Dehn's AddItion, estimatIng the cost to be $73,460, divided by 27 units for apPLoximately $2,720 peL unit. They would also match dLlveways OL put in a 10-foot apLon if the driveway Is not Improved. The hearing was then opened to public testimony. MelInda Coleman. 4310 145th Avenue - asked If the 9 percent Interest rate Is fixed or Is the ceilIng. Mayor Wlndschltl explaIned It is an estimate, with the actual Late set at one peLcent over the cost of the bonds. He felt it Is on the high sIde. RoaeL Ames. 4310 144th Lane - asked when sewer and wateL will be comIng thLough; and when it does, wIll theLe then be a double assessment for the Load or wIll they be put In the boulevards. Mayor Wlndschltl stated it Is not possible to Install sewer along the boulevards, so the street would be torn up If sewer comes thLough. The pLoJect wi I I be assessed over a 10-year perIod; so If the sewer comes In before the end of the 10 yeaLs, they would not be assessed for the streets agaIn. If It comes in after that period of time, they could be Leassessed. Mr. Ames - was concerned about cars Lacing thLough the area once It Is taLLed, asking If speed bumps can be put In. Also theLe Is a blind inteLsectlon In the southwest corneL, whlch·he felt will add to the dangeL. MayoL Windschitl noted the City cannot put in speed bumps because of the liability. The EngineeLs wI I I look at the lIne of site thLough that aLea. ML. Cook explained the site dIstance Is restrIcted on that corneL, but he wasn't quite SULe at this point what could be done without having to Lemove all the trees. He dIdn't know why people did that when theLe aLe three dlffeLent approaches to Seventh Avenue but felt I t wi II end up being a Lace tLack through there. He felt they wi I I speed down there two to thLee times as fast as they go now, voIcing hIs obJectIon to the PLoJect. Bob Dean. 14445 GuaLani - was conceLned about the safety factor. WI th the dIrt it Is a playground fOL the caLS. TheLe aLe trucks fLom a business to the nOLth that come down GuaLanl, plus school buses. He felt I twIll be sater wIth blacktop streets than with the dlLt, but he wanted stop signs placed from Guarani to 145th and anotheL one on the westeLly side of that inteLsection. Ms. Coleman - asked why the stLeet wasn't paved when the otheL stLeets were done In that area. Mayor Wlndschitl explained Dehn's Addition Is one of the older subdIvisions done when blacktop was not LequiLed. Some of the aLeas were blacktopped by the developeLs. Also, the Ci ty policy is not to do these types of ImpLovements unless a maJoLity of the residents who will benefIt petition fOL it. Ms. Coleman - thought it made sense to have stop signs on GuaLani and 145th to alleviate some of the tLaffic concerns. She asked it there Is any Indication of a lot of otheL traffic using theiL stLeets such that they should also paLtlclpate In the costs. Mr. Schrantz explained theLe is not enough tLafflc on the stLeet to be a collector stLeet. Pearl Dick. 4260 144th Lane - stated eveLY time it Lalns, they get all the sand In thelL yaLd and driveway. They have even had city maintenance come out to bulldoze it out. And heL neIghbor gets even more sand. That Is whY she petitioned to get the stLeets blacktopped. Plus In the wlnteL the snowplow moves all the gLavel onto heL lawn. She asked what the schedule wIll be fOL the proJect. Mayor Wlndschltl then Levlewed the proposed schedule fOL the PLoJect, noting the completion date Is pLoposed fOL NovembeL 15, 1988. Tom MaLLon. 4311 144th Lane - was conceLned about the sewage, asking if theLe is any guaLantee the sewer will not come thLough a yeaL afteL the streets aLe done. MayoL Wlndschitl again explaIned if seweL comes In befoLe the end of the bond, they cannot be Leassessed fOL the stLeets. ML. MaLLon - asked how the Load will be put In. M.. Cook stated basically the centeL lIne wi I I match what Is theLe right now. It Is about 24 to 26 feet wide now, and the road wIll be 24 feet wIde with a bituminous cULb. So the City doesn't have the ability to servIce that aLea at this time, and it is difficult to pLoJect when that I ine will be avaIlable. It Is scheduled for afteL the year 2010. This Counci I has always wOLked on petItions fLom residents. M.. MarLon - stated the lots aLe small and aLe satuLated with sewage now. He questIoned whetheL It would be detLlmenta] to them if seweL weLe available befoLe the 10-yeaL peLlod, but that the Counc il would not want to Install seweL unt II atter the bondIng peLiod. MayoL Windschitl hoped the Council at that time would look at the hea I th Issue when making Its decIsIon. Rosella Sonstebv - asked about the storm dLainage plan with this stLeet Improvement pLoJect. Mr. Cook stated theLe Is no special plan, that the wateL wIll go where it Is curLently going, reviewing the drainage which ultimately dlschaLges through the park between Lots 10 and 3. Ms. Sonstebv - explained the Dchn's Addition plat was first made in 1965, Leading from that plat the donation of the streets and the park of 2.2 aCLes. The general assessment policy of AndoveL is that all property wIthin the assessment district, private or public, Is assessed in the same manneL, noting that paLkland should also be assessed in this pLoJect. Also, she noted Statutes suppoLting heL contention that the parkland cannot be used as a ponding aLea. It is paLk PLopeLty, but the Ci ty Is puttIng stoLm dLainage into that aLea. Ms. Sonsteby went on to say that for the assessment Loll of a previous stoLm drainage PLoJect, Anoka County agLeed to pal' $9,000 on County Road 116, which she felt should have been used to Leduce the assessment roll of that pLoJect. Counc i I discussion noted the paLkland in this aLea was accepted back when lowland was given to the City, which Is why this low aLea Is now park property. The paLk is not being used fOL pondlng; the water is continuing to go where It has always gone and the City cannot stop the water tLOm goIng Into the area. To reroute the natural dLalnage is not feasIble. They also felt the assessment roll for a pLevlous proJect Is not geLmane to thIs proJect. Ms. Sonstebv - stated mOLe wateL will now be going In theLe with the paved streets. Mayor Windschltl stated it is the same amount of water, though it mal' Lun in theLe faste.. Mayor Wlndschltl noted the petition befoLe the Council is 22 yes, 3 no, aSking if there aLe any changes. Mr. Cook didn't think the the paLkland was Included as one of the assessable units when deteLmlnlng the unit cost. The Counc i I diLected the paLk should be included as one of the assessable units. ML. SchLantz stated then the pLoposed unit cost would be loweLed somewhat. MOTION by Knight, Seconded by Ell ing, to close the public heaLing. Motion caLrled unanimously. MOTION by EllIng, Seconded by Knight, a Resolution oLderlng the Improvement ot street construction, PLoJect No. 88-18, In the Dehn's 1st an 2nd ALea and directing pLeparatlon of final plans and specIfications. (See Resolution R176-88) DISCUSSION: MayoL Windschltl explaIned if the bids come In 5 percent hlgheL than estimated, the Lesidents will be called back. OtheLwlse the pLoJect wIll pLoceed, with the next hearing being for the actual assessment of the pLoJect. Motion caLried unanImouslY. The heaLing ended at 8:10 p.m. PUBLIC HEARING/UPLANDER/IP88-14 Mayor Wlndschitl explained the Statute 429 procedure. He also noted the alteLnatives possible with this pLoJect: 1) to assess the presently unbulldable paLcels, which then makes them buildable; or 2) or assess only the buildable paLcels fOL all costs. M.. Cook then Levlewed the feasibIlity LepoLt, noting the pLoposed cuI de sac on the southerly end. The storm dLainage fOL the Load consists of thLee culverts, at 161st, in the middle of the pLoJect, and at the end of the cuI de sac. The cost of the pLoJect Is estimated to be $40,880. If it Is divided among all 24 units, the cost would be about $1,700 peL unIt. If divIded among only the 15 buildable units, it would be about $2,725 peL unIt. The hearing was then opened for publIc testImony. Dave Larson. 16010 UplandeL - asked the pULpose of spending $40,000 on a deadend street wheLe theLe aLe only 8 houses. MayoL WlndschltJ explaIned the CouncIl Is Leactlng to a petItIon Lecelved of 9 yes votes, and eltheL 3 OL 11 no's, depending on whetheL Chapman's lots aLe consldeLed buildable or not. The curLent petition Is 12 yes, 2 no. The Mayor explaIned what had taken place when the land was subdIvIded which resulted In the issue of the unbulldable lots. He didn't think the City would Lun utilities to that area without petItIons fLom the Lesldents unless it was a hea I th Issue. MayoL Wlndschltl also explained that If utilities aLe put In befoLe the 10-yeaL bonding peLiod, they could not be Leassessed fOL the stLeet. If It Is afteL the 10-yeaL peLlod, they could be reassessed. Dave LaLson. 15955 UplandeL - asked if they took the option to declaLe those lots buildable, would It LequiLe going thLough the MetropolItan SeweL Board. Mayor Wlndschltl stated no. If the lots aLe of Lecord and an assessment Is placed against them, the City would have little choice but to allow them to be built upon. Jeff Kessle.. 15964 Up]andeL - stated Lot 25 is a two-aCLe lot with the gas lIne going across It, askIng how they were ever able to build on It. He was neveL notified. He was going to buy Lot 25, and all of a sudden there aLe two houses next to each otheL. ML. Cook explained theLe weLe three lots that weLe split. MayoL Wlndschitl thought that came thLough seveLal yeaLs ago. The pLoblem wIth the notification mal' be that the notice goes to the owner of Lecord at the COULt house, which sometImes is the mOLtgage company. ML. LaLson. 15995 UplandeL - I I ved there fOL 14 years and Is "sick to death" of the sand. He'd like to see the Load go thLough Just to get rid of the sand, also pLefeLLlng to pal' the extra $1,000 by assessing 15 lots instead of 24 to prevent the seweL pLoblem fLom occurring. If It weLe a] lowed to build to the higher density and a sewer pLoblem OCCULS, then It Isn't In the resIdents' hands and It will be mOLe than $1,000. Counc i I discussion noted If some futuLe Council declared those lots buildable, they would not get a free Lide. What would typIcally happen Is a supplemental heaLing would be held amending the assessment Lolls by reducIng the assessment of those now payIng, and adding the assessment to the newly buildable lots. Counc I I recessed at this time to allow the residents time to decide which assessment they would pLefeL to take. 8:35; reconvened at 8:45 p.m. Counc II asked those Lesldents to stand who favoLed the I aLger assessment wIth no assessment agaInst the presently unbulldable lots. Everyone pLesent stood up. Special CIty Council Meeting Minutes - August 4, 1988 Page 6 (PublIc Hearing/Uplander/IP88-14, Continued) MOTION by Eiling, Seconded by Apel, to close the public hearing. Motion carried unanImously. MOTION by Elling, Seconded by Ape I , a Resolution ordering the improvement of street construction, ProJect No. 88-14 In the Uplander Street area from 158th Avenue to 161st Avenue and dIrecting the preparatIon of final plans and specIfIcations; and the assessment to be based on 15 buIldable lots for an estimated cost per lot of $2,725. (See Resolution R177-88) DISCUSSION: Mayor Wlndschltl noted the policy is to call the residents back in only If the bId Is 5 percent over the estimate. The estimated completion date is November 15. Mr. Cook also noted no easement acquisition is necessary, and the road will be placed in basically the same locatIon as the existIng roadway. The boulevard wIll be brought up and the present areas will be sodded. Motion carried unanimously. The hearing closed at 8:52 p.m. STORM DRAINAGE DISCUSSION/TULIP/VINTAGE/xENIA/161ST AREA Mr. Cook reviewed the drainage map of the area noting the concerns of Arlo Hanson about the drainage pond behind him. The present plan for the MSA proJect for the remainder of the street will be basicaily the water from the road, though ultimately it could take care of the larger basin when the land is developed totally. The present drainage comes through the HouJe property and dIscharges Into the backyards of the low area, whIch Is the natural low area. Mr. Hanson is concerned about floodIng, but he explained there will be some street runoff but It should not be a problem right now. Mr. Cook contInued that they looked at the area in terms of what would have to be done to take care of the entire watershed, noting the drainage route that wouJd be needed to the west. He estimated a cost for such a storm sewer project would be $90,000. They don't expect to see a problem under the present conditions, but he wanted the CouncIl to be aware of that potentIal. No Council actIon was taken. TONSON TIRE PERMIT Mayor Windschitl reported an apparent change of posItion on the part of Anoka County regarding the revocation of the Tonson license. He was told the County Board approved the lIcense subJect to two conditions. The Council took action on Tuesday (August 2), based on the understandIng the County intent was to pu11 the license for noncompliance. Now they are saying that is not what they are doing. He felt there is entire matter Is very confusing. CouncIlman EllIng stated he would talk wIth varIous County officIals tomo~row to determIne what Is takIng place. LETTER/RE: ROBERT KEENE/UNDERLIFF Mayor Windschitl noted the letter with 10 sIgnatures requestIng assistance In dealIng wIth a noIse problem In theI~ neighborhood, primarily loud music being placed at the resIdence of Robert and Marge Keene, 14269 UndferclIff Street. It was agreed to table the Item to the next meetIng, asking that the Deputy submit a report on the matter. UNIVERSITY AVENUE EASEMENT ACQUISITION Mr. Schrantz reported Ms. Baldridge has agreed to sIgn the easement needed for the ~oad Improvement on UnIversity Avenue. CROSSTOWN BOULEVARD PROJECT Mayor Wlndschitl explained the Attorney has suggested the CouncIl go through the 429 procedure to assess a portIon of the Crosstown Boulevard proJect so the bond for the proJect can be reJeased. Mr. Sch~antz saId the Attorney has recommended holdIng the hearIng on August 16. Council agreed, noting formaJ actIon wi I I be taken at the August 9 work sessIon. APPROVAL OF CLAIM MOTION by Knight, Seconded by Apel, to void Check 14850 for an amount of $2,400.53; and approve Check 15070 fo~ an amount of $4,268.82 to W. B. MIller, Inc. Motion carried unanimously. PARK BOARD/FOX MEADOWS Park Board Chairman Marc McMullen reported the Park Board decided not to do the Fox Meadows park thIs year because ot the many questIons involved with the exIt of CoRd 58 onto CoRd 7. The Park Board does not lIke the park access off of CoRd 58, and there is a lot of oppositIon from the resIdents to access off of Fox Street. Because so much hInges on what happens to the intersection of CoRds 58 and 7, they have agreed to table any further action. Special City Council Meeting MInutes - August 4, 1988 Page 8 (Park Board, Fox Meadows, Continued) The Counc 1 ] felt that the monel' was budgeted and that not much more will be known about that Intersection by next year; therefore, they should go ahead wIth the park development usIng the plan that wIll best serve the maJorIty of the people of the CIty. MOTION by Apel, Seconded by EllIng, that the Counc i I direct the Park Board to reconsIder the Fox Meadows sIte and, if necessary, go back to their orIginal plan and use their best Judgement and get something goIng there this year.
