CHARTER COMMISSION MEETING-MARCH 29, 1988
A Public Hearing of the Andover Charter Commission was called to order
by Chairman Jerry Windschitl at 7:35 P.M., Tuesday, March 29, 1988 at
the Andover City Hall, 1685 Crosstown Boulevard N.W., Andover, MN.
Commissioners Present: Veiman, Bradley, Sabel
Commissioners Absent: Bosell, Knight, Peach
Also Present: William Hawkins, City Attorney: others
Mr. Winds chit 1 explained that the purpose of this public hearing is for
citizen input on the merits of and suggestions for a charter form of
government. Prior meetings have focused on trying to understand the
differences between a statutory form and charter form of government. He
noted that there is one unresolved question, whether a statutory city can
elect councilmembers by wards.
Rosella Sonsteby, 4151 - 141st Avenue NW - felt that the city should
have a Charter so that the people are informed as to what is going on and
so that everyone is treated fairly. Ms. Sonsteby distributed information
to the Commissioners which gave more information regarding her reasons for
wanting a charter. She expressed frustration with the way the assessment
was handled for the storm sewer in the Dehn's area, stating that more
people should have been notified.
Mr. Bradley noted that he met with Ms. Sonsteby and he felt that in many
respects she has been treated unafirly. Her payment for the wetland has not
been on a par with the others around it. He asked Ms. Sonsteby to be more
specific as to how a charter could help with her problems.
Ms. Sonsteby thought something should be done with the special assessment
policy as Good Value isn't being charged anything for the pipe and their
water runs through it also. She noted that she is paying 40 percent of
the cost of that pipe.
Mr. Windschitl noted that the figures for that particular project would be
made available to the Commission.
Further discussion continued on Ms. Sonsteby's problem with the assessment
policy. Bill Hawkins noted that all cities, including those with charters,
notify residents in the same manner as Andover. He asked Ms. Sonsteby
what else we could do. Ms. Sonsteby felt that people within one-half mile
should be notified because they are all affected by the project.
Dick Schneider, 1343 Andover Boulevard said that he didn't know what the
difference is between a Charter form of government and a statutory city:
however, he is in favor or more fair assessments. He stated that Prairie
Road was built with state aid funds and no one was assessed: Hanson Boule-
vard was assessed and it is a County road.
Mr. Windschitl explained that we have the most liberal assessment policy
for state aid roads. Other cities assess ever thing while we only assess
the right-of-way acquisition costs. Those assessments are then deferred

for 15 years or until the property is developed. If the property is not
developed within those 15 years, the assessment is cancelled.
Mr. Veiman asked if the assessment that is levied is to replace the funds
that were used to buy the right-of-way. Mr. Windschitl stated yes. If
all of the property owners donate the right-of-way, then there is no
assessment. If only one person won't donate the right-of-way, then every-
one will be assessed.
Mr. Schneider asked how the City Council feels about having a charter.
Bill Hawkins noted that the Council has no input into this: they only are
responsible for putting it on a ballot for an election.
Chairman Windschitl closed the public hearing.
Leqislative Bulletin
The Commission discussed several bills that were in the latest issue of
the Legislative Bulletin.
Mr. Windschitl asked the attorney to check on whether we, as a statutory
city, can elect councilmembers on a ward system.
It was noted that the next meeting will be on April 28th, rather than on
April 20th.
MOTION by Bradley, seconded by Veiman to adjourn. Motion carried.
Meeting adjourned at 9:08 P.M.
