SPECIAL CITY COUNCIL MEETING - MARCH 31, 1987
MINUTES
A Special Meeting of the Andover City Council was called to order by
Mayor Jerry Windschitl on March 31, 1987, 9: 15 p.m., at the Andover
City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota.
Councilmen present: EllIng, Knight, Orttel
Councilman absent: Lachinski
Also present: City Attorney, William G. Hawkins; City
Administrator, James Schrantz; and others
OAK BLUFF UTILITIES
Mayor Windschitl reviewed the background regarding the development of
the Oak Bluff p]at, noting motions and discussions that the Intent has
always been to provide municIpal sewer and water In that development.
He also noted the February 4, 1987, motion of the intent of assessing
that development sewer and water area charges In 1987. Those
assessments would amount to approximately $1,700 per acre.
Larrie Nettum and Bruce Nedegaard, owners of the plat, thought the
pending assessments were for sanitary sewer area charges only, not for
water. Mayor Windschitl noted the Council motion clear]y includes
water as well. Mr. Schrantz stated the notices for the public hearing
were for sewer only. The staff has been tel ling people there is a
pending assessment for sewer area charges only on that property. If
the water area charge Is to be incJuded, he thought another public
hearing must be held.
Counc i 1 generally agreed a public hearing should be held to include
the water area charges as well.
Mr. Nedegaard explained they purchased the property after the plat was
developed after having been to]d by both the developer and City Staff
that sewer and water would not be avai Jable to them until at least
1990. They have 15 of the 25 lots sold, and there is a lot of concern
that the City will be putting in the laterals this year. Five of the
lots have just put in wel Is and septic systems, 7 houses are under
construction and another eight wil I start within the next few weeks.
They are asking that the laterals not be installed but to Jet the
residents In the development petition for them when they want the
utilities just as Is being done in the other developments.
There was a lengthy discussion with the owners and several residents
on the issue. The CounclJ was concerned that with the larger Jots in
this plat, i f the laterals are not put In now, they may never be.
They noted one of the points brought out when the plat was being
developed Into one-acre lots was the ability to split the lot when
utilities did come through.

Mr. Nettum stated they have advised everyone about the placement of
the house so the lot can be split in the future. Some have chosen not
to do that, as the reason they were moving to the area was because of
the larger lot sizes. He stated when they first looked at the develop-
ment the middle of 1986, the plans for sewer In the area were between
1990 and 2000. But since the first of this year, that has changed so
fast, that now they are looking at laterals this year. He stated they
are not opposed to the area charges for sewer and water, but the
Installation of laterals at this time causes many problems for them.
Counc I 1 again noted the Intent has always been to service this area.
In this plat, there is a greater concern over water because of the
close proximity to the landf I]] . Councilman Orttel felt as long as
the City's costs are covered for the trunk 1 ine, which is done through
the area charges, he would not be opposed to putting In the latera]s
only when petitioned for by the residents. The I ine would be
available should a health problem occur. Mayor Wlndschltl agreed.
Councilmen Elling and Knight had a prob]em with that, stating clearly
the Intent was to Install utilities In this plat as soon as they were
available. They fe]t I f the laterals are not put in now while on]y a
few lots are developed and the lots can sti IJ be sp I It, the lines wi 11
never go in.
Winslow Holasek stated he was at most of the meetings when the plat of
Oak Bluff was discussed. He stated the reason the plat was developed
as one-acre lots was because of sewer and water. He felt everyone
knew sewer and water was eminent.
Jerry Hank stated he purchased a Jot In Oak Bluff and built on it.
Two months ago he was told there is no way sewer and water would be
put in unless the people living there petitioned for it. And that it
would not even be available for as long as ten years.
John (?) , homeowner In Oak Bluff, stated his biggest concern was
before he purchased the lot, he talked to the City staff abou t
utilities and was told it would not be available until the end of the
century. He doesn't want the sewer. One of the reasons people are
bu I 1 di ng there Is because they want more land, and they are not
concerned about splitting their lots.
Mr. Nettum wanted the record to show that they have advised all
purchasers to call the City regarding utilities. But up until the
public hearings, he didn't think there was any information that there
was any possibility of sewer and water being avai ¡able. They are not
disputing the fact that the utilities wil 1 eventually be provided nor
of the area charges at this time. It is the time frame for the
laterals. If the City puts the laterals In now, it wi 11 create mass
confusion for them.

Discussion continued on whether or not the City should have the
laterals instal led in Oak Bluff at this time, the concerns of the
possible effects the I andfl 1 1 may have on this area, and the argument
of al lowing the residents to petition when they want the u tl lit i i es.
Mr. Schrantz estimated the actual service could not be before this
fall.
Mr. Holasek felt it makes no sense to bypass this area once the
service is available, to needlessly allow poi]ution of the ground
water wi th all the addi tlonal wells and septic systems when utilities
are availabJe. He stated he agrees with Councilman Knight that the
plat was allowed as density zoning because sewer and water was
eminent. Plus there is duplication of costs of both private and then
municipal systems.
Mr. Nettum stated there are four wells in the project already
averaging 215 feet deep.
An owner of a lot in Oak Bluff asked how much it would cost if
laterals were installed. Mr. Schrantz estimated $40 per front foot
plus area charges of $1,700 plus connection charges, which is
approximately $9,000 for a one-acre lot.
Mayor Windschitl then asked if any Councilmember wished to propose a
motion to install laterals in the Oak Bluff development.
No motion was offered; therefore, the laterals for sewer and water
wi thin the Oak B]uff project will be installed when the residents
petition for it as is the policy for other neighborhoods in the City.
Counc i I emphasized, however, that they clearly intended to assess the
sewer and water area charges in 1987, asking the Administrator to
place the item of setting a public hearing for water area charges in
Oak Bluff on the next agenda.

APPROVAL OF SONTERRE LAND PURCHASE
Attorney Hawkins stated he has reached an agreement with Mrs. Sonterre
to acquire approximately 30 acres on Bunker Lake Boulevard. The
property Is in the Tax Increment Financing District and the proposed
commercial redevelopment area. The one stipulation Mrs. Sonterre
asked for is that she be able to retain her house, garden and
outbuildings and live there until she dies. Once she dies, it would
become the City's property. Mr. Hawkins stated the Council may want
the ability to move her driveway stated in the purchase agreement.
Counc i I reviewed the conceptual development plan of the area as
prepared by TKDA and agreed that the area could be developed around
the buIldings.

Mr. Hawkins asked about the funding of the purchase, feeling the City
would not want to sell TIF bonds for It. He asked i f the Counc I ] is
interested in looking at acquiring the M. R. Olson property. The
appraiser is working on the appraisal of Anoka Auto Wrecking. He has
not contacted the property owner north of Anoka Auto Wrecking. Mayor
Wlndschi t I stated he would set up a meeting on tha t parce 1 .
Counc i I discussion was to ask TKDA to do a a site plan for the
Sonterre property, including total site cost development of the 30
acres; and a TIF bond would then be sold for the purchase of the
property, plus the installation of the streets, sewer and water.
Counc i ] also asked the attorney to pursue the acquisition of the M. R.
Olson property as wel I .
MOTION by Orttel, Seconded by Knight, Counc I 1 approval of the
purchase of the Sonterre property on Bunker Lake Boulevard as
presented by the City Attorney and authorize the Mayor and Clerk to
sign the purchase agreement; and authorize the funds for the earnest
money; and authorize a survey of the area Included in the life estate
portion of the purchase agreement and also to survey the boundary
I ines of the property. Motion carried unanimously.
MOTION by Orttel, Seconded by Knight, to authorize the City Attorney
to meet with City Staff and City Consu]tants to develop costs for the
Sonterre property. Motion carried unanlmaously.
Mayor Windschitl asked for a motion to have the City Staff, Ci ty
Engineers, and City Attorney make a recommendation as to who would
manage the Industria! park, either hiring someone on staff,
contracting with a consultant, forming a development authority, etc.
MOTION by Knight, Seconded by Orttel, to so move. Motion carried
unanimously.
MUSA BOUNDARY
Mayor Windschitl reported on the meetings with the Metropolitan
Counc i I regarding the extension of the sanitary sewer line, noting the
documentation on undeveloped lots In the City. At this point the Met
Counc i I would allow extending the line to service the proposed school
just south of City Hall plus a narrow corridor of development:
however, In return they would require the City to change its zoning In
the rural area to a density of 4 lots per 40 acres rather than the
existing 2 1/2 acre lots.
Counc i I discussion was on the frustrations over the inconsistencies of
the Met Counc I] population projections and their demographic controls.
The consensus was a total opposition to the 4 for 40 requirement.

Counc II then reviewed the map of the staging of the sewet" line
assessments and agreed to change some of the mot"e outlying areas which
are scheduled for more Imminent service to a later date. It was hoped
the Metropolltan Council would then find the proposal more favorable.
Counc i 1 also advised the Mayor to contact the City's Met Council
t"epresentatives for assistance in this matter.
Council then went Into closed session with the Attorney on the Hanson
Boulevard condemnation. 11:10 p.m.
MOTION by Knight, Seconded by El ling, to adjourn. Motion carried
unanimously.
