Adjournment CITY of ANDOVER PUBLIC HEARINGS - APRIL 30, 1987 MINUTES Pursuant to notices published thereof, Public Hearings for Improvement Projects 87-4, 87-7, and 87-8 were called to order by Acting Mayor Ken Orttel on Apri 1 30, 1987, 7:35 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. CouncIlmen present: Elling, Kn i gh t Councilmen absent: Lachinski Mayor WlndschltJ, as a property owner in the area, elected not to act In an official capacity for these hearings Also present: TKDA Engineers, John Davidson and John Rodeberg; City Engineering Technician, Todd Haas; CIty Administrator/Engineer, James Schrantz; and interested residents IMPROVEMENT PROJECT 87-4/WOODRIDGE ACRES Mr. Davidson explained the procedures for the improvement hearing and explained the routing of the sanitary sewer trunk and watermain laterals. Mr. Rodeberg then reviewed the proposed Project 87-4 as to its 10cation, the improvement for watermain, sanitary sewer and street construction, its initiation by petition for water and sewer, the right of way and permits needed and the project scheduJe. The estimated cost of the project is $235,000 for a per-lot cost of $11,399.19 (including the area assessment from Project 87-3) based on a unit assessment within the project. Mr. Rodeberg felt the estimated costs are in line with other projects and seem high because of the larger lots. Mr. Rodeberg also explained Lot B is currently unbuildabJe but is being assigned six units. The cost of those uni ts wi I] be picked up by the City or by the property when i t is developed. Lots A and Care outside the Woodridge Acres plat but are being served by this project and therefore are being assessed on the same basis as the rest of the lots. Acting Mayor OrtteJ noted an April 17 petition from Richard Erickson on property south of Coon Creek adjacent to Quinn Drive for water, sanitary sewer, storm sewer and streets, waiving the public hearing. Jerrv Wlndschitl - stated the Council can include this petition either In this project or In his Kensington Estates project. The street access for this parcel is on Osage. He noted there Is another petition from Don Erickson on 145th. He has an agreement with the Ericksons on the development of al I of those parcels, but he has no financial Interest in either of the parcels. Mr. Rodeberg stated they were concerned with a straIght away up Osage, suggestIng an access wIthin the street right of way be constructed. Also, it could be costly to construct that extra 200 feet of roadway. Mr. DavIdson stated an alternative may be to construct a hammerhead turnaround and change the confIguration. Counc II dIrected that since the Erickson property wouJd access off Osage as we I I, that that desIgn be looked at agaIn. Me. Rodeberg felt including the Erickson property off Osage into this project would help because It provides an extra assessable unIt wIth mInImal addItIonal costs Mr. Davidson also explaIned there Is an addItional connector sewer 11ne from Woodridge Acres through Lots 1 and 2 to Kensington Estates and eventually to serve Shady Knoll. What Is shown in the feasibility Is only that which benefits the Woodridge Acres subdIvisIon. Testimony was then opened to the publIc. Bruce Mann. 14420 Quinn DrIve - asked who Is goIng to pay for that 300 to 400 feet of connector lIne between Woodrldge Acres and Kensington Estates. Mr. DavIdson explaIned the length, size, and depth of anything beyond the needs of this subdivision would be paid for as an area charge assessable to the entire sewer system. The Kensington Estates costs inside the plat would be paid for by KensIngton Estates. Mr. Wlndschitl - stated that sewer line coming in the back sIde of his plat is not needed to serve Kensington Estates. That J ine Is beIng brought through because of a depth problem for three houses In Shady Knoll, understanding it is more cost effective to come through the plat than to put in the deeper line down South Coon Creek Drive. His entire plat can be served from South Coon Creek Drive, but he is willing to provIde the easements to bring this I ne t.hrough from Woodrldge Acres. Discussion was then on the proposed storm sewer In the project. Mr. Rodeberg explaIned the proposal Is to run the water to the low area off Osage through the unbulldable portIon. It is In the 100-year flood plain and quite close to the creek. He didn't foresee any major easement acquisition problems. Counc i 1 questioned whether streets were petitioned for because that word was crossed off the petition. Mr. Schrantz stated the petitIon came in with streets crossed off. A woman in the audience stated she signed the petitIon wIth streets crossed off. Duane Zahler. 14334 Quinn Drive - stated when the sewer is put in, manhole covers are put In the street. He asked what would be the sense of having sand sIft down around the manhole covers, plus they would be sticking up to be drIven over, etc. He didn't thInk that made any sense. Would the streets have gutters? Mr. Rodeberg stated the standard street sectIon of a 33-foot wIde street wIth concrete curb and gutter is beIng proposed. Mr. Zahler - asked why the gutter is needed. Mr. Rodeberg stated it is maInly to control the storm sewer. Mr. Windschitl - thought the older subdivisions had the optIon of not putting In concrete curb and gutter. ActIng Mayor Orttel thought that was only where they didn't have complete utIlities. Mr. Schrantz estimated curb and gutter to be $6 a foot or $600 per 100-foot lot. Sharon Wiesner. 14366 Quinn Drive - Is opposed to sewer and water; however, 1 t they are put in, she would want the streets done at the same time. She said there Is no point in getting another assessment for streets in five years. Rick Hedstrom. 14352 Crosstown Boulevard. Lot C - agreed with Ms. Wiesner. He also asked that he be added to the petition as a no vote. Carolvn Gautschi. 14419 QuInn Drive - didn't want any of the utilIties but agreed if they get sewer and water, the streets should be put in also. Terrv Lindquist. 14431 Quinn Drive - is in favor of sewer, water, and streets. Ms. Zahler - asked if this is a vote for sewer and water, against 1 t , or for sewer, water, and streets. Acting Mayor Orttel stated the Counc II has not yet voted on the matter. The petItIon was for sewer and water. The streets wIll need to be dealt with separately. Ms. Gautschi - understood the petition was not brought around to all the homes. She sIgned no. Counc i 1 noted at thIs poInt the petItion is 9 In favor, 5 opposed, an apparent majorIty for sewer and water. Mr. Rodeberg explaIned if the streets are not Improved, 1 t wi II sti II cost about $400 per lot for Class 5 and restoratIon. The per-lot assessment wIthout streets would be approximately $8,200. Pub] ic Hear-ings Apri I 30, 1987 - Minutes Page 4 (Improvement 87-4, Woodridge Acres, Continued) Mr. Lindquist - asked what they do with the manholes if the streets are not paved. Mr. Davidson stated they would cover the manholes and leave them down 6 inches or so. Another alternative is to patch the area around the manhole with blacktop. Several residents noted the inconvenience of driving and maintaining such a road. Someone asked again asked about the curb and gutter. Mr. Davidson explained the option is to only upgrade to Class 5 or pave with curb and gutter. Another option would be with bituminous curb; however, in the sand the ends tend to ravel. If the roads are improved, they would recommend concrete curb and gutter. Counc i I also explained the assessment procedure as to when and how the assessments are paid. It was estimated the assessments would be at appr-oximately 9 percent simple interest, depending on the bond over a period of 10, 15, or 20 years. The engineers also explained the additional costs that would be required to hook up to the utilities Including the SAC charge for sewer and hookup costs from the right of way to the house. It was estimated those costs could be up to $1,000. MOTION by Elling, Seconded by Knight, a Resolution ordering the improvement of sanitary sewer and water, Project No. 87-4 in the Woodridge Acres area and directing preparation of final plans and specifications. (See Resolution R055-87) Motion carried on a 3-Yes vote. Counc i I discussion noted because streets were not included in the peti tion, a 4/5 vote Is r-equired to approve streets. Because of the absence of one Councilman, it was agreed to continue the public hearing to May 5. It was also suggested the residents circulate a petition on streets so the Council is aware of what the major-ity wants. MOTION by Elling, Seconded by Knight, to continue this portion of the Public Hearing to our next meeting, May 5. Motion carried on a 3-Yes vote. (The matter of streets for Woodridge Acres was discussed again toward the end of the meeting when a majority petition for streets was presented by the residents.' IMPROVEMENT 87-7/SHADY KNOLL Mr-. Rodeberg reviewed the proposed project for instal ling sanitary sewer, watermaln, storm sewer, and streets whIch was inItIated by petition. The estimated cost of the project is $227,590, for a per unit cost of $12,890.17 along Uplander and Thrush and $9,051.09 along South Coon Creek Drive. Those along South Coon Creek Drive would not be assessed for streets because that is being done as an MSA street. PublIc Hearings April 30, 1987 - Minutes Page 5 (Improvement 87-7/Shady Knoll, Continued) Mr. Rodeberg continued the proposal is to complete the roads in 1987; however, if I t gets too late in the year, they would consider finishing the roads in the spring of 1988. Mr. Rodeberg stated the CIty park has been assigned four unIts. Also one lot was originallY assessed to front on Uplander but has sInce been changed because it actually fronts on South Coon Creek DrIve. Also, In doing a cost comparison, it was agreed to leave the preliminary plat of Kensington Estates as approved rather than changing the configuration to elimInate a portion of Thrush as was discussed at the Apr i I 21 meeting. Half of Thrush would be assessed to the lots in Kensington Estates. Testimony was then opened to the public. Dan Lizakowski. 2355 South Coon Creek Drive - stated he still does not want sewer and water because he'd rather not have to split his lot to pay for the assessments. If the Erickson's aren't serviced, he didn't feel he should be either. Acting Mayor Orttel noted a petition has been received from the Erlcksons asking for the utl1lties. Counc II and engineers also revIewed the polIcy for paying the assessments and additional hookup costs not Included in the figures provided. Carl Hoffman. 2340 Uplander Drive - thought the project should go ahead. Joe Kabacinski. 2350 Uplander Drive - agrees with Mr. Hof fman. Ms. Kabacinski - stated if this goes through, they need to tar the roads as soon as possible, noting the terrible dust problem they have. Nancv Kolander. 2311 South Coon Creek Drive - is in favor of streets, sewer and water. MOTION by Elling, Seconded by KnIght, a Resolution orderIng the improvement of sanitary sewer, water, bituminous streets with concrete curb and gutter, Project No. 87-7 in the Shady Kno II area and directing preparation of final plans and specIfications. (See Resolution R056-87) Motion carried on a 3-Yes vote. MOTION by Knight, Seconded by El ling, to close the Public Hearing. Motion carried on a 3-Yes vote. 8:50 p.m. Public Hearings April 30, 1987 - Minutes Page 6 IMPROVEMENT 87-4/WOODRIDGE ACRES/STREETS Mr. Schrantz presented a petition of more than 50 percent in favor of streets in the Woodridge Acres area. Those residents who signed the petition were still present for the hearing. Because a majority petition in favor of the street improvement was received, Counc i I noted only a 3/5 vote is needed to order the Improvement. Counc II agreed to act on this item tonight rather than on May 5 since the residents were still In attendance. MOTION by Elling, Seconded by Knight, to rescind the motion made to continue this to the next Council meeting. Motion carried on a 3-Yes vote. Acting Mayor noted the written petition includes 12 people in favor of the street improvement, plus Richard Erickson's petition, which is over 50 percent even If the six unassessable lots are not Included. MOTION by Knight, Seconded by Elling, a Resolution ordering the Improvement of streets with concrete curb and gutter and storm sewer, Project No. 87-4 In the Woodrldge Acres area and directing preparation of final p1ans and specifications. (See Resolution R55-87) Motion carried on a 3-Yes vote. MOTION by El ling, Seconded by Knight, to Include Richard Erickson, PIN 27 32 24 24 0001, in the Woodridge Acres Project 87-4. Motion carried on a 3-Yes vote. This hearing closed at 9:05 p.m. IMPROVEMENT 87-8/KENSINGTON ESTATES. PHASE I Jerrv Windschitl - explained he, Richard Erickson, and Don Erickson have a private agreement to address the north side of the road. The Counc i 1 has already moved to include Richard Erickson with the Woodridge Acres project. For the Don Erickson property on 145th, they are consolidating the costs of developing the lot. He has an agreement In writing to provide street, storm sewer, sewer and water; so for assessment purposes, those two parcels will be grouped together. In other words, there wi II be a combined cost for Thursh, Raven, and 145th Avenue which wil I provide service to the Erickson property. There are two more units on that property, and at some point i n t I me Me. Erickson will be coming forward requesting a I ot sp I I t. He has an agreement to sp 11 t the assessments. Windschltl addressed the section on streets and restoration, It ems 8-11, seeding, topsoi I borrow, seed, commercial fertilizer, and mulch material. He questioned what it does on a new plat because almost all wi I] be sodded. Mr. Rodeberg stated that is usually incJuded for erosion control if a lot isn't bui1t in the Immediate future. If the developer wishes to do that work himself, that is allowed. Mr. Windschitl stated he wou]d prefer to do it himself, noting they have a Jot of good topsoil available to them. He also explained in doing the cost comparisons for changing the alignment to eliminate a portion of Thrush as proposed at the Apri I 21 meeting, the difference was not as significant as once thought, especially because of how far along things have proceeded at this point. Mr. Windschitl also stated he is making every attempt to getting between four and five years out of the tree farm there. Also, at this time he is flJllng in the depression east of Crosstown and South Coon Creek Drive and filling It back over with topsoil. Mr. Rodeberg also explaIned they have proposed to assess to Kensington Estates the portion of the sanitary sewer pipe off 145th going Into Woodridge Acres that runs behind the lots to the 145th cuI de sac. But the last 200 feet is considered to be a trunk connection to serve the rest of the area. MOTION by Knight, Seconded by Elling, a Resolution ordering the improvement of watermaln, sanitary sewer, streets and storm drainage, Project No. 87-8 In the Kensington Estates Phase I area and directing preparation of final plans and specifications. (See Resolution R057-87) Motion carried on a 3-Yes vote. Councilman Elling asked the record to show the reason he voted yes was because Councilman Lachinski was absent and he did not want to postpone the project for Mr. Wlndschitl. MOTION by Elling, Seconded by Knight, to close the PubJic Hearings. Motion carried on a 3-Yes vote. 9: 16 p.m. EAW REPORT/HILLS OF BUNKER LAKE PLAT Mayor Wlndschi t I reviewed a problem that has occurred with the Environmental Assessment Worksheet of the Hil]s of Bunker Lake plat. Because the EAW stated there would be 507 houses In the plat, It triggered a mandatory requirement of the Environmental Quality Board. That Istodoafull EIS on anything over 400 houses developed within 3 years or less, and that takes between 9 and 12 months to complete. Public Hearings April 30, 1987 - Minutes Page 8 (EAW Report, Hills of Bunker Lake Plat, Continued) They have met with a member of the Envl~onmenta] Qual lty Board, and it was recommended the area east of the tracks be eliminated. Also, the developers would agree not to deve]op more than 99 lots In the first phase, which has already been final ized, unt II this Is satisfactory to the EQB. Mayor Wlndschi tl stated one othe~ thing the EQB is recommending is the City consider abandoning the term preliminary plan, suggesting It be called a concept plan instead. Otherwise, this could affect most of the plats In the City. The Mayor noted this item will be on the May 5 agenda for further discussion. MEETING WITH HAM LAKE/d'ARCY BOSELL d' Arcy Bose] I reported on the meeting she attended this evening in Ham Lake. They are asking if Andover Is interested In participating In a study group regarding several Issues of the Metropolitan CouncIl such as their 4 for 40 development requirement, their review powers on fringe communities, etc. At this point, Ham Lake officials are considering cities and townships within Anoka County only and they would lIke to know the City's feelings by June 1. No Counc i 1 action was taken at this time. MOTION by EJling, Seconded by Knight, to adjourn. Motion carried on a 3-Yes vote.
