HomeMy WebLinkAboutSP August 27, 1986 CITY of ANDOVER SPECIAL CITY COUNCIL MEETING-AUGUST 27, 1986-MINUTES A Special Meeting of the Andover City Council was called to order by Acting Mayor Orttel at 7:37 P.M., Wednesday, August 27, 1986 at the Andover City Hall, 1685 Crosstown Boulevard N.W., Andover, MN. Councilmen Present: Elling, Knight, Orttel, Lachsinki Councilmen Absent: Windschitl (Arrived at 8:35 P.M.) Also Present: James Schrantz, City Engineer; John Davidson, TKDA; others Shady Knoll Sewer and Water John Davidson, TKDA - stated that in 1982 there were some meetings regard- ing sewer for Shady Knoll. At the present time the sewer goes to 140th and Crosstown. There were differential assessments on the basis of what it would cost to extend the trunk sewer up Crosstown. That would be the terminus of the trunk sewer system. There are several alternatives on how to get the sewer to Shady Knoll. It could be served with a lateral. There is presently a 24" trunk that comes out to 140th with an existing manhole at that location. When we get up to South Coon Creek Drive, we would have enough gravity flow. It vlOuld be a 24" pipe. Then we would be able to serve a larger part north, possibly to City Hall. Mr. Davidson stated th Alternate D is to go all the way. If Woodridge Acres and The Oaks come in with petitions, the trunk will have to be extended. Going along the side of Slyzuk's property will be less expensive than going up Crosstown. Alternate A is the gravity system going up the center of Crosstown. In all cases, the original estimates going down Crosstown are more expensive than Alternate D. < Acting Mayor Orttel stated that when this was discussed in 1982, there were a couple of houses in the back of Shayd Knoll that we could not serve. He asked if that problem is solved now. Mr. Davidson stated that everything can now be served. He also noted that to get to Shady Knoll it would cost $279,600 and up to the creek it would be $296,300. This is just the construction cost. The lateral costs would be about $25.00 per foot. Mr. Orttel noted that it would cost $100,000 to get a creek crossing with a lift station. We will be $200,000 short if we serve the whole 132.5 acres. " Councilman Lachinski asked if we could go up Andover Boulevard with this trunk. Mr. Davidson noted that we could. ' i , Councilman Elling asked what the cost would be if we went with Alternate A. Mr. Davidson stated that they would have to do an estimate because it's a deeper depth. Mr. Davidson also noted that if we go along the edge we would be 22 feet deep. Discussion was on whether Ken Slyzuk's property is in agricultural preserve Special City Council Meeting August 27, 1986 - Minutes Page 2 and if it is, can we take an easement for the pipe on his land. Acting Mayor Orttel noted that people-wise, we have a majority but Jerry Windschitl owns two-thirds of the land. We are now going to be able to go anywhere unless Mr. Windschitl signs the petition. Mr. Schrantz was directed to talk to Ken Slyzuk regarding his feelings on bring the pipe through his property. Councilman Lachinski felt that the whole matter has to do with what we decide to do north of the creek. Are we going to have 2~ acre lots or smaller lot sizes? If we don't cross the creek, we don't need a 24" pipe. Then the cost would be less. Mr. Schrantz noted that the Council needs to address the petition. The project can either be ordered or the people can be told it's not feasible. Acting Mayor Orttel suggested that Council find out if we can go down Andover Boulevard with this system. Councilman Lachinski felt that we should find out if this area can be supported with a small pipe. (Mayor Windschitl arrived at this time - 8:35 P.M; however, he participated in the meeting as a resident). Mr. Orttel asked if we need to have a 24" trunk. Also, can ~le run a laterial down Andover Boulevard. Mr. Windschitl noted that the people who brought in the petition really have a problem. He stated that he would be willing to work with those people so that we can get sewer down there. He also stated that if he is assessed, he will have to develop his property. His only concern is what the total assessment would be. Mr. Schrantz stated that he would pay an area charge and a lateral benefit for the piece with the house. He asked what we are going to do with the >later. Mr. Windschitl noted that Uplander is only a half street and it would have a big assessment as it only serves one house. He then suggested that he put together a sketch plan for his property. Mr. Orttel noted that if this issue is resolved with Mr. Windschitl, we don't have the Oaks and some people in Woodridge Acres. Mr. Windschitl noted that the people in Woodridge Acres are very much opposed to sewer. Councilman Knight felt that we should be waiting for the report to come in. It all depends on whether we want to go with a 24" pipe or a 10" pipe. Councilman Lachinski stated that if we go with a 10" pipe, then we can solve Shady Knoll's problem. Then we can cut back the area. Mr. Davidson will complete his report and this will be discussed when tha; report is ready. (At this time, Mayor Windschitl joined the Council) Special City Council Meeting August 27, 1986 - Minutes Page 3 Dehn's Pond Discussion John Davidson stated that one of the handouts received by the Council gives the assessed valuation of the properties. The other is the report they used to assume that 100% of the costs would be assessed against the benefitting area. The Anoka buy-in cost is 2.25¢ per square foot. The storm sewer cost is l¢ per square foot. Rosella has about 13 acres. The estimated total assessment rate would l~¢ per square foot. Mayor Windschitl noted that we were looking at $700 per lot and now we're looking at $1,300 per lot. We had l~¢ per square foot without Northglen and Quickstroms. Mr. Davidson noted that the 100 acres are determined from the tax rolls. The figures presented tonight are actual figures. The properties are those over 870. Mayor Windschitl stated that Anoka said that they assessed their people 1.25¢ per square foot and felt everyone else should be paying the same thing. $100,000 to drain 100 acres is a different ballgame. Mr. Schrantz noted that when we assessed strom drain before, we didn't include anything in the flood hazard. Councilman Lachinski didn't feel that we could approve this project until we know what the DNR's thinking is. Mr. Schrantz noted that Anoka's assessment was based on gross acreage as was reflected in S.E.H.'s report. Councilman Orttel noted that if the land is wet and over 865, you should have 100 percent runoff. He suggested that Council find out what the County is going to contribute. Mr. Schrantz noted that if we get $60,000 from 80-3 and 83-3, $10,000 from Good Value and $7,000 from the County we will be $67,000 short. Mr. Davidson stated that they went through the taxable values and the undevel- oped properties are starred and the partial benefit areas are shown with an asterisk. Using this, the city would need 9 mills to cover the cost. However, if you're using a combination of deferred assessments until they develop you're talking about increased values. If you're going to establish a district, then you should take in the secondary area. Councilman Orttel noted that the County is buying the land that Rosella is suing us for. Councilman Knight stated that he is not worried about the lawsuit, but what it will cost us for the lawsuit. It was suggested that we have the county get an estimate from their con- tractor to put the pipe in and see if the county will pay for the pipe. A Special Closed Meeting with John Burke was scheduled for September 2, 1986 at 9:30 P.M. to discuss the lawsuit. Special City Council Meeting August 27, 1986 - Minutes Page 4 It was also suggested that we obtain a written opinion from our fiscal people on whether the bond issue can stand this. Buildinq Inspector's Salary Mr. Schrantz noted that Dave Almgren has requested that his assistant, Don Anderson, have a salary increase of $10.00 per hour or we may loose him. MOTION by Elling, seconded by Lachinski to authorize an additional $2.00 per hour to a maximum of $10.00 for the assistant building inspector, subject to the receipt of a certificate of Insurance and a waiver for workers compen- sation insurance. Motion carried unanimously. Mayor Windschitl stated that we need to schedule a meeting to talk about MUSA zoning. We're trying to make one change to the ordinance regarding density zoning. MOTION by Orttel, seconded by Elling to approve the minutes of the July 29, 1986 special meeting as written. Motion carried. MOTION by Elling, seconded by Lachinski to approve the minutes of August 5, 1986 as written. It should be noted that Rosella's changes were talker about and it was the opinion of the Council that the minutes were accurat, Motion carried unanimously. MOTION by Orttel, seconded by Elling to approve the minutes of July 15, 1986 as written. Motion carried. MOTION by Orttel, seconded by Lachinski to approve the minutes of July 17, 1986 as written. Motion carried. MOTION by Knight, seconded by Lachinski to approve the minutes of July 22, 1986 as written. Motion carried on a 4 yes, 1 present (Elling) vote.
