Adjournment .- -. -. -. ~ 01 ANDOVER SPECIAL CITY COUNCIL MEETING - OCTOBER 6, 1983 MINUTES A Special Meeting of the Andover City Council was called to order by Mayor Jerry Windschitl on October 6, 1983, 7:30 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW for the Assessment Hearings for bituminous streets in the areas known as Nordeen Addition, 175th Avenue, and Kadlec Addition, plus amending Resolution No. 86A-83 (Doubles/140th Lane). Councilmen present: Elling, Knight, Orttel Councilman absent: Lachi nsk i . Also present: Engineer from Bonestroo, Rosene & Anderlik, Glen Cook; City Engineer, James Schrantz; City Clerk/A. Administrator, P. K. Lindquist; and others PUBLIC HEARING - BITUMINOUS STREETS/l983-5 (NORDEEN ADDITION) Mr. Cook reported the project consists of residential streets with a gravel base, bituminous surface, birm curb, 28 feet wide, for a total cost of $113,650. It is proposed that 51 units be assessed for the improvement of which the City owns four lots. The cost per unit is $2,228. Chet Conger - stated at the original hearings, 52 units were proposed, of which five were C1ty lots. Why has that been changed? Mr. Schrantz stated the one lot on the corner, Lot 424, owned by the City is not a buildable lot and is being used for the drainage in this project. Councilman Orttel asked when they are going to begin paving and can curb cuts be made in the birm. Mr. Cook stated they should be paving in one and a half to two weeks. If anyone wants a cut for a driveway, they should let Mr. Schrantz know about it. Otherwise in the future it is quite easy to put in a driveway because the birm is not very rigid and can be depressed simply by driving over it. Mr. Conger - stated if it gets too late, he felt it would be best not to pave it this fall but wait until spring. And what is the possibility of adjusting these assessments up or down after this year? Mr. Schrantz stated they will not pave if the weather gets too bad or it gets too late. The Clerk explained if there is an overrun, the Council could hold a supplemental hearing to assess the overage. Discussion was also on the placement of the peat from the project, with the Council asking Mr. Cook to be sure it is being placed on the City lot, not on private property. MOTION by Knight, Seconded by Elling, introducing a Resolution adopting the assessment for the improvement of bituminous streets under IP No. 83-5 for the area known as the Nordeen Addition, as presented. (See Resolution R108-83) Motion carried unanimous ly. PUBLIC HEARING - BITUMINOUS STREETS/1983-6 (175TH LANE) Mr. Cook explained the project is for bituminous surfacing on 175th Lane from Round Lake Boulevard to Quay Street. The total project cost is $51,664. There are 22 units to be assessed at a per-unit cost of $2,348. Palmer Johnson, 3401 175th Lane - borders where the easement is going to go. He wondered what 1S happen1ng w1th it, having heard the other people bordering the easement, 3419 175th, do not want it. And what happens if he doesn't provide the easement? Mr. Cook stated they have not yet been able to get an agreement on the 7\- foot easement from the adjoining property owners, who are opposed to the project and don't agree the easement would benefit them. It is his feeling there is a right to discharge the water at this location with the old culvert being in place, as that is Special City Council Meeting October 6, 1983 - Minutes Page 2 (Public Hearing - Bituminous Streets/1983-6, Continued) the original drainage for the area. They are trying to work with the easements to clear up a question that may exist and to solve a problem. They would have to do a little construction through Mr. Johnson's property by cutting about one foot for about 50 feet along the easement. That would also confine the water to the area instead of going across the lots. They do not intend to disturb the birm that is across the back of the two lots at this time. Mr. Johnson - stated he did not want the water to run across his yard. The Engineers stated they do not expect it to. The water will run down the flume when it rains. Mayor Windschitl asked when the Engineers anticipate having the easement question resolved. The Engineers stated they feel they could go ahead with just the easement from Mr. Johnson and that there really is no problem. If the easements are provided, they will move the existing culvert over to the west somewhat. If the easements are not provided, they will simply use the existing culvert where it is and let the water go where it goes now. Mr. Johnson - stated 3419 is the lowest lot on the entire road. And he has been told that all the excess dirt on the road will be used to build up that lot. He stated the owner wants all the benefits but does not want to give the easement. He's willing to give the easement, but not the entire easement. Mr. Schrantz reported they have said they would contract to put the excess fill on that lot, but they will not fill it without the drainage easement from the owner. Mr. Johnson - stated the easement, as he understands it, will be left natural. Right now he doesn't have a water problem with the road because the sand absorbs it. He wanted it made clear that the excess water from the street will be taken care of and not become an eyesore. Nor does he want a deep ditch through his property. Mr. Cook stated it will not be a deep ditch, intending to leave the gentle swale as it is n~. One of the advantages of giving an easement is it is then the City's responsibility to take care of it. Ron Birkholz, 3416 175th - was concerned with the culvert and water in his driveway. He also noted 1t is a real problem on the corner of 175th and Quay. The Engineers explained when the culvert is located and where they would place it to coincide with the easements, noting they will be trying to keep the water out of his driveway. MOTION by Elling, Seconded by Orttel, introducing a Resolution adopting the assessments for 1mprovements of bituminous streets under Improvement Project No. 83-6 for the area known as 175th Lane. (See Resolution R109-83) Motion carriedunanimously. Mayor Windschitl stated if the Engineers have any doubt as to whether or not it is the City's right to run water across the existing drainage, they should discuss the matter with the City Attorney. When discussing the easement issue further, Mr. Johnson stated if the other property owner doesn't want to sign the easement, he would purchase the lot across the street and the dirt can be dumped there from the project, and he would then sign the entire 15-foot easement on his property. The Engineers were encouraged to solve the easement question as soon as possible but not to place the excess fill on 3419 unless an agreement is reached on the easement, noting there may now be other options on the placement of dirt and the easement that could be investigated. PUBLIC HEARING - BITUMINOUS STREETS/1983-8 (KADLEC ADDITION) No residents were present from the Kadlec Addition. MOTION by Orttel, Seconded by Elling, introducing a Resolution adopting the assessments for the improvement of bituminous streets under Improvement Project No. 83-8 for the area known as the Kadlec Addition. (See Resolution RllO-83) Motion carried unanimously. Special City Council Meeting October 6, 1983 - Minutes Page 3 AMEND RESOLUTION NO. 86A-83 (DOUBLES/140TH LANE) Stan Birkhoff, 8413 168th Lane - explained the request is to change the approved varlance to one foot on the one side and to three feet on the other side, similiar to what was approved on October 4 for the neighboring lot. He presented the Certificate of Survey for the lot. MOTION by Orttel, Seconded by Elling, that the Council amend Resolution for 86-83 and allow one less foot required side yard setback for the reconstruction of the double with attached garages at Lot 3, Block 3, Red Daks Manor, Fourth Addition, also known as 2118 140th Lane, and attach to it the Certificate of Survey presented 10-6-83. (See Resolution R86B-83) Motion carried unanimously. MOTION by Orttel, Seconded by Knight, to adjourn. Motion carried unanimously.
