PUBLIC HEARING - OCTOBER 27, 1982
MINUTES
Pursuant to notice published thereof, a Public Assessment Hearing on the 1982-7
Russell/Stack Street Improvement was called to order by 1fuyor Windschitl on October 27,
1982, 7:30 p.m., at the Andover City Hall, 1685 Crosstown Blvd. N.W., Anoka, Minnesota
Councilmen Present: Jacobson, Lachinski, Orttel and Peach
Councilmen Absent: None
Also Present: City Engineer, James Schrantz, Consulting Engineer, Glenn Cook,
City Clerk, P. K. Lindquist; and interested residents
!Æayor Windschitl explained the original estimate on this project was $3250 per unit based
on 78 lots. After the bid opening, this figure was reduced to $2490 per unit based on
78 lots. The Engineers later determined there were 80 assessable lots bringing the unit
price down to $2080 per unit. This price does not include Mr. Russell's lots which he
has agreed not to develop by signing a "non-development" contract. He further explained
Mr. Russell had signed such a contract but it was found to be unacceptable by the City
Attorney. Another contract has been drawn and the Attorney is in the process of getting
it signed by all persons involved. If, for any reason, this contract is not signed, a hearing
will be held next year assessing these parcels reducing the present unit cost of $2080 to
approximately $1790 per unit. Anyone anticipating challenging the assessments must file
a written document tonight specifying the objection to the assessment, according to State
Law.
Mayor Windschitl then turned the meeting over to the Engineers who explained the present
status of the project which is almost finished. They pointed out the trouble spots in
the cul-de-sac and on Zuni and Yakima at 166th La. where there is some cracking. The
contractor has an obligation to correct any problems for one full year.
Dean Lips - 16631 Zuni St. N.W. - asked about finished grading on the slopes feeling that, if
it was not done properly, there would be a lot of undermining. Glenn Cook explained black
dirt would be used to finish the grade in most areas. The steep slopes would be sodded.
Mr. Lips then asked how wide the sod would be - the answer was roughly two feet.
Glen Rogers, 16647 Maniteau Blvd. N.W. - mentioned the contractor damaged his culvert. He
wanted to know if the people with problems should bring them to the Councilor contact the
City Engineer. Mayor Windschitl stated problems of that sort should be directed to the
Engineer s . If there were any questions on the assessments, the Council would try and
answer them tonight.
Jim Sturgeon, 16655 Yakima St. N.W. - stated he knew the bid was lower than the figure he
was presented and requested a breakdown. James Schrantz said the contract price was
$141,298, engineering, legal, etc. was estimated to be $28,863, or a total of $170,161.
Mr. Sturgeon felt the $28,863 figure was rather high.
Mayor Windschitl commented, at this point in time, it is possible the assessment might
change a little bit on the downward side. If this happens, there will be a reduction in
the assessments. The reason the project is being assessed before it is finished is to
avoid capitalized interest. 1œ. Sturgeon then stated if this does carryover to next
year, you cannot come back and assess more. Mayor Windschitl replied, in theory, if it
comes in less, you can reduce it; if it comes in more, you can raise it.

Both Mr. Schrantz and 1œ. Cook stated they felt confident the figures are as close as
they could be estimated at this time. 1œ. Schrantz added the $170,161 figure included
the x number of dollars for individual driveways and approaches.
Chuck Burnham - 16714 Argon St. N.W. - stated Betty Lacey asked him to find out the last
day to payoff the assessment so it would not go on the taxes. The Clerk advised November
26th would be the last day to pay the assessment interest free. After that date, the first
year's payment would include interest for the balance of 1982 and all of 1983. Mayor
Windschitl stated the assessment can be paid off at any time and suggested those interested
to contact the City Clerk for details.
John Ottenstroer - 5230 - 163rd La. N.W. - asked if the project would be done this year or
carryover into next year. Mr. Cook stated the completion date was November 15th unless they
ran into problems. There will be some clean up work to do next spring.
Mr. Schrantz then commented the first year's payment he calculated at $382.94, each
succeeding year the figure would be $348.76 at 10.7% interest. The higher figure represents
interest for 1982.
Mayor Windschitl asked if there were any more questions - there were none.
MOTION by Jacobson, seconded by Orttel, to close the public input of the hearing. Motion
êarried unanimously.
MOTION by Orttel, seconded by Jacobson, to introduce a Resolution adopting the assessment
for the improvement of bituminous streets under Project No. 1982-7 for the Russell/Stack
Addition and 165th Ave. west of Co. Rd. 7, as prepared by the City Clerk and presented at
the meeting this evening....(See Res. No. R-95-82.) Motion carried unanimously.
Mr. Schrantz then advised there were some people shopping around for driveways at this time.
Mayor Windschitl then suggested a break be taken in order for the residents wishing to have
driveways installed by the contractor discuss it with the Engineers.
Break - 7:55 p.m., - Reconvene - 8:27 p.m.
During the break, Glen Rogers expressed the desire to have a driveway put in by the
contractor and assessed. Since a motion had already been made adopting the assessment,
Mayor Windschitl asked the Clerk to research the question; if IAr. Rogers has a driveway
assessed, the total assessment would be greater. The Clerk advised the resolution itself
does not contain any figures. Glen Rogers stated, if his request would create a problem,
to forget it.
MOTION by Lachinski, seconded by Orttel, for those property owners who desire to have their
driveway approaches to the back of their property line assessed along with the project, to
allow the Engineers to add the amount to the assessment roll providing those owners make
the request in writing tonight. Motion carried unanimously.
MOTION by Jacobson, seconded by Peach, to close the Public Hearing. Motion carrieg.

SPECIAL CITY COUNCIL MEETING - OCTOBER 27, 1982
MINUTES
A Special Meeting of the Andover City Council was called to order by Mayor Jerry
Windschitl on October 27, 1982 at 8:44 p.m. for the purpose of discussing the 1983
budget and setting the levy for 1983.
Councilmen Present: Jacobson, Lachinski, Orttel and Peach
Councilmen Absent: None
Also Present: City Engineer, James Schrantz; Fire Chief Frank Stone;
Glen Rogers and Merlyn Prochniak, Park Commission Members
1983 BUDGET DISCUSSION (IN NUMERICAL ORDER)
E-12 - Fire Dept. C.O. Improvements - Agreed to leave at $4,000. Chief Stone advised
if this was cut, they couldn't make the planned improvements. Councilman
Lachinski asked if the Fire Department stayed within their 15% increase. The
Clerk stated yes, the Fire Department went somewhat below 15%, but the Rescue
went a little above, evening things out.
E-16 - Engineering C.O. - Other Equipment - Agreed to leave at $8,000. Engineer
Schrantz stated of the $8,000 is $1,000 for a vehicle for himself and cited
several problems he has had in the past being without transportation.
E-25 - Rentals - Streets - Agreed to reduce to $4,000. Per the Engineer, the streets
could be swept once a year instead of twice.
E-26 - Salt & Cinders - Agreed to reduce to $3,500 feeling this winter can't be as
bad as the last one. Mayor Windschitl commented, if it is, the budget is not
cast in concrete.
E-33 - Park C.O. Improvements - Agreed to leave at $10,000. If more is needed for
the purchase of Kelsey Park, the monies would be taken from the park
dedication funds.
E-40 - Total expenditures showing total additional deletions of $27,500 will remain
the same as will unallocated transfers of $8,455, (or a total budget of
$859,763 ).

It was determined the levy would be about 12.6 mills, or an approximate 1 mill
increase over last year. Councilman Lachinski asked what the annual payment on the
equipment bonds for the new fire truck and public works vehicle would be. The
Clerk advised about $39,000. Councilman Jacobson remarked this would cover the
cost of replacement vehicles thereby providing better service to the public.
Engineer Schrantz stated he had no plans to sell the old vehicle as it could be used
for sanding and eventually parts. Councilman Peach agreed with Councilman Jacobson's
comment, adding the population has hardly increased over the last two years.
Councilman Orttel stated the budget would have no increase were it not for the
replacement vehicles and thought that this in itself was commendable.

MOTION by Orttel, seconded by Jacobson, to adopt the 1983 budget with revenues of
$859,753 and expenditures in the same amount including $$,455 in surplus; it is
understood that the debt service for the equipment bonds for the Fire Department
vehicle and Public Works street vehicle are funded in this general fund budget.
Discussion: Councilman Lachinski asked how much was included in the overlevy for
aerial mapping. The City Clerk replied absolutely nothing. Motion carried
unanimously.
MOTION by Orttel, seconded by Peach, to enter a Resolution to establish the 1983
ïevy in the amount of $476,943 for the general levy and $93,066 as an overlevy
for a total levy amount of $570,009...See Res. No. 96-82. Motion carried unanimously.
