SPECIAL CITY COUNCIL MEETING - DECEMBER 30, 1982
MINUTES
A Special Meeting of the Andover City Council was called to order by Mayor Jerry
Windschitl on December 30, 1982, 7:40 p.m., at the Andover City Hall, 1685
Crosstown Boulevard NW, Anoka, Minnesota.
Councilmen present: Jacobson, Lachinski, Orttel, Peach
Councilmen absent: None
Also present: City Clerk/A. Administrator, P. K. Lindquist
AGENDA APPROVAL
Item 4, Additional Minutes for approval of October 27, November 4, November 23,
December 2, and December 7.
MOTION by Jacobson, Seconded by Peach, the approval of the Agenda as printed with the
additlon of extra Meeting Minutes under Section 4. Motion carried unanimously.
LANDFILL POSITION PAPER
Council was in basic agreement with the official position paper drafted by the City
Clerk and spent some time in clarifying some of the wording. The following was
agreed to:

Re: Licensing by Minnesota Pollution Control Agency and County of Anoka
NOTICE IS HEREBY GIVEN that the City of Andover, in order to protect the health, safety,
and welfare of its citizens, is requesting that the license/permit for Waste Disposal
Engineering, Inc., to operate a landfill in such City, be revoked on the 10th Day of
January, 1983, if a written agreement is not received from the operator for compliance
with the following MPCA requirements:
1. Pump test proposal to be submitted to the MPCA no later than
15, January, 1983.
2. Well abandonment, cleanout, and installation to be done no later
than 15, January, 1983.
3. First quarter sampling no later than 15, January, 1983.
4. Submittal of results/discussion/conclusion of pump test by
1, February, 1983.
S. Submittal of lab data from January sampling to be received by MPCA
no later than 15, February, 1983.
6. Submittal of comprehensive remedial actions proposal for water
contamination from hazardous wastes of the site to be received by MPCA
no later than 7, March, 1983.
The comprehensive remedial actions shall be put into operation no later than 1, April, 1983,
and problem corrected no later than 1, July, 1983. Such action shall include removal
of the hazardous wastes from the now established pit on said property.
The City of Andover further requests that all contingencies required by Anoka County as
part of the 1982 Permit be met by the operator no later than 10, January, 1983; and
further, that if the approval of the 1983 Permit includes any contingencies, they be
met within thirty (30) days, or the site shall be required to close immediately.

It is the opinion of this City that the operator has failed to comply with many of the
requirements of the licensing agencies for the protection of the environment.
The City of Andover wishes to again put on notice the County of Anoka and the State of
Minnesota that should the installation of public water become necessary as a result of
contamination from the landfill site, that all such costs for same be borne by said
licensing agencies and the owner and operator of the landfill.
The City of Andover also considers the landfill and hazardous waste pit to be a serious
environmental threat and that the existing bonding required of the operator is totally
inadequate in relation to that threat and should be increased accordingly.
MOTION by Orttel, Seconded by Jacobson, that we adopt the Official Position Paper as
drafted and corrected here tonight regarding the Waste Disposal Engineering, Inc.,
landfill site. Motion carried unanimously. The Clerk was directed to send copies of
the statement to the Minneapolis papers, to the Anoka Union, and to the local television
stations.
APPROVAL OF MINUTES
February 2, March 2, September 21, October 27 Special, October 27 Public Hearinq,
November 4, November 16, and November 23, 1982: Correct as written.
MOTION by Ortte1, Seconded by Peach, that we approve Minutes of October 27 Regular
Meeting, October 27 Public Hearing, November 4, November 16, November 23 regular
Meetlngs, along with February 2, March 2, and September 21 as written. Motion carried
unanimously. (Mayor Windschitl voted Yes except for November 16 on those parts of the
Meeting that directly affect him.)
December 2, Public Hearing and Special Meeting, December 7, 1982: Correct as written.
MOTION by Jacobson, Seconded by Lachinski, approval of the Minutes for December 2,
PubllC Hearing, as written.
VOTE ON MOTION: YES-Jacobson, Lachinski, Orttel; PRESENT-Peach, Windschitl
Motion carried.
MOTION by Jacobson, Seconded by Lachinski, approval of Special City Council Meeting
Mlnutes of December 2 as presented.
VOTE ON MOTION: YES-Jacobson, Lachinski, Orttel, Windschitl; PRESENT-Peach
Motion carried.
MOTION by Jacobson, Seconded by Lachinski, approve December 7 Meeting Minutes as
presented.
VOTE DN MOTIDN: YES-Jacobson, Lachinski, Ortte1, Peach; PRESENT-Windschit1
Motion carried.
December 21, 1982:
Page 7, Motion directing the Engineer to prepare an amendment to the assessment
policy: Councilman Jacobson understood there was an agreement that no
interest should accumulate while the assessment is deferred, but that is
not specifically stated in the Motion. Council generally agreed with
Councilman Jacobson, feeling that intent is so stated in the Motion.
Page 8, last line, change to: in the Andover group insurance program.
MOTION by Jacobson, Seconded by Lachinski, to approve the December 21 Meeting Minutes
as presented with the exception of the correction on Page 8 to correct the name of the
Andover insurance group. Motion carried unanimously.

WRITE-OFF - OUTSTANDING CHECKS
MOTION by Orttel, Seconded by Jacobson, that the City cancel the oustanding checks
Numbered 570, 1110, 1430, and 3223 due to the time that has elapsed since their
issuance. Motion carried unanimously.
APPROVAL OF CLAIMS
MOTION by Jacobson, Seconded by Orttel, approval of Checks 6094 through 6141, noting
that 6097 is voided, for a total amount of $7,655.41, and eliminating Check 6llD for
$15. Motion carried unanimously.
MOTION by Jacobson, Seconded by Orttel, approval of Check 6110 for $15.
VOTE ON MOTION: YES-Jacobson, Lachinski, Orttel, Windschitl; PRESENT-Peach
Motion carried.
Mayor Windschitl thanked Councilmen Jacobson and Peach for their past four years of
service to the City, expressing a desire that they stay active in City services in
the future.
MOTION by Peach, Seconded by Orttel, to adjourn sine die. Motion carried unanimously.
Meeting adjourned at 8:46 p.m.
