HomeMy WebLinkAboutBOR May 27, 1982 ~ o¿ ANDOVER BOARD OF REVIEW - MAY 27, 1982 MINUTES The Regular Board of Review for the City of Andover was called to order by Mayor Jerry Windschitl on May 27, 1982, 7:30 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Anoka, Minnesota Councilmen present: Jacobson, Lachinski, Orttel, Peach Councilmen absent: None Also present: County Assessor, Bob Weisbrich; City Clerk, P. K. Lindquist; and residents Mayor Windschitl explained the purpose of tonight's hearing is to discuss valuations used for calculating next year's tax. Any problems with this year's tax statement must be handled at the County abatement hearing. The following residents presented their cases: Albert Smith, 254 l50th Lane NW, Smith's Rolling Oaks Mr. Smith stated his taxes are consistently higher than any of his neighbors, but he does not have the largest house nor does he have the most land in the area. He wanted to know what justification there is for him having the highest taxes every year. Mr. Weisbrich reviewed the dimensions of Mr. Smith's hou se. He also explained that it has been found there are some discrepancies in that area of the City, and he will be visiting and re- evaluating all the houses in that area this summer in an effort to correct any disparities there may be. Mr. Smith and Mr. Weisbrich compared valuations of several houses in the neighborhood, and Mr. Smith was allowed to review the records while the hearing continued. The matter was discussed again at the end of the meeting. Reino Kyrola, Plat 65918, Parcel 0150 Mr. Kyrola felt his valuation is getting out of line. Two years ago it was $70,000, last year it was $89,000, and now it is up to $96,000. It is only a two-bedroom home, and he didn't feel it is worth that much. He a 1 so felt it was worth less than a neighbor's home, which has more square feet but is actually valued for less than his. Mr. Kyrola also noted that the basement of the neighbor's house is being rented out as an apartment, which is against the ordinance. Mr. Weisbrich reviewed Mr. Kryola's dimensions, noted that Mr. Kryola built a garage this past year and that the house construction is graded 5, which is a better grade of construction than that of the neighbor's. Mr. Weisbrich felt that the house was worth $96,000 and compared it with the neighbor's house in question. No errors were discovered in the records. No action was taken by the Council; however, the Clerk was directed to investigate the allegation of an apartment being rented in the area contrary to City ordinance. Lois Ostrander, Plat 65912, Parcel 6500 Mrs. Ostrander felt the taxes were too high. They had a fire in the house several years ago, and she has not even been able to fix up the house since then. It was agreed that Mr. Weisbrich will view the parcel and make a recommendation. It is possible that this should also go through the County abatement procedure to correct previous years' taxes. Board of Review May 27, 1982 - Minutes Page 2 Linda Farnes, Plat 66792, Parcel 0600 Mrs. Farnes explained they have a rambler on Cedar Creek, and in 1982 their taxes went up 96 percent from $597 to $1,168. And their 1982 valuation went up $5,100 more. Comparing their home to one on Ward Lake Drive which has 50 square feet more, one more fire place and same lot size, theirs is valued at $93,800 and the other is valued $68,000. She argued that just because they are on Cedar Creek, which is practically just a swamp and full of mosquitoes, their lot and valuation should not be that much higher. They are trying to sell their house for $115,000, but to date no one has even looked at it. Mrs. Farnes felt the taxes should be equalized through the area, asking why some in the area with bigger homes should be paying less. Mr. Weisbrich reviewed the record, noting the valuation of the creek lot has increased substantially because people are paying that amount of money. He could not justify lowering the valuation of $93,800 when they are trying to sell their house for $115,000. The law states the valuation should be the actual market value. Council questioned the valuation placed on the creek lots, feeling there is a big discrepancy between 2~-acre lots on and off the creek. Mr. Weisbrich stated they are running at 95 percent in Andover, which is the same as last year even though they raised the values; but he did not know the County average. He also noted that this year's tax statement is the first time the residents along Cedar Creek have felt the increased valuation placed on the creek lots. It was agreed that Mr. Weisbrich will research the sale prices of vacant creek lots in the area to determine the accuracy of the valuation placed on those creek lots and make a recommendation. Rudy Buthreiler, 3271 l74th Lane NW, Plat 67513 Mr. Buthreiler stated he has talked with Mr. Weisbrich, and that Mr. Weisbrich has agreed to view the property and make a recommendation. He added a garage and combined two lots two years ago, but he didn't understand why the valuation didn't increase at the time that was done. It was agreed that Mr. Weisbrich will view the parcel and make a recommendation. Frank Padula, Plat 65907, Parcel 2500 Mr. Padula also talked with Mr. Weisbrich, as his tax increased 152 percent and valuation went from $70,000 to $100,100. Mr. Padula also noted he does not receive tax statements for other properties he owns in the County. Mr. Weisbrich stated he did not view the property; therefore an arbitrary assessment was given on this parcel. They now have a request for review, so the County will send out another appraisor; and if the value is out of line, they will lower this year's taxes plus the valuation. The request for review is on this year's taxes, not this year's valuation. And if the taxes are lower, the valuation will automatically be lowered as well. Mr. Weisbrich also noted that Mr. Padula may not be receiving tax statements if they are being sent to the address of the property and not to Mr. Padula's home address. That change can be made at the County. No action was taken by the City Council. Delmar Nies, Plat 67796~arc~ 0036 Mr. Nies stated his valuation increased $5,000 from last year, but now the neighbor has placed a four-strand barbed wire fence in the back and has cattle, which he felt is a nuisance. Mr. Weisbrich reviewed the dimensions of the house, etc., and found no error. He agreed to view the property and make a recommendation as to whether or not some economic obsolescence is created because of the farming situation. It was agreed that Mr. Weisbrich will view the parcel and make a recommendation. Al Smith, Smith's Rolling Oaks, Continued Mr. Smith stated in looking through the book, there are 23 houses in the area for $78,000 and under, most in the low $70,OOO's or high $60,OOO's. His house is figured wrong by 156 square feet. But he has found many houses that are around 1500 square feet that are still lower than what he is being valued. Mr. Smith pointed out that the valuations are not equal in the area. r'lr. Weisbrich again explained they are aware of the inequity in valuations through that area, but he will personally 90 throu9h the area again this summer to correct the disparity. The square footage error in the books will be corrected, and the last two years' taxes will be adjusted. It was agreed that Mr. Weisbrich will view the parcel and make a recommendation. Roger Hanson, Plat 65909, Parcel 0010 Mayor Windschitl noted the letter from Mr. Hanson to the Council relative to his increased valuation. Mr. Weisbrich stated he was unable to view the property and an arbitrary assessment was placed on the house. It was agreed that Mr. Weisbrich will view the parcel and make a recommendation. MOTION by Jacobson, Seconded by Peach, to carry the Board of Review business over to the Tuesday, June 1, meeting. Motion carried unanimously. Peach Recording Secretary ~ o¿ ANDOVER SPECIAL CITY COUNCIL MEETING - MAY 27, 1982 MINUTES A Special Meeting of the Andover City Council was called to order by Mayor Jerry Windschitl on May 27, 1982, 8:50 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Anoka, Minnesota. Councilmen present: Jacobson, Lachinski, Orttel, Peach Councilmen absent: None Also present: City Clerk, P. K. Lindquist APPROVAL OF CLAIM MOTION by Jacobson, Seconded by Orttel, that we approve Check Number 4959 to the League of Minnesota Cities for $480, which is registration fees for City personnel to attend the League of Minnesota Cities Convention. Motion carried unanimously. JUNKYARDS - PUBLIC HEARING DATE -- - MOTION by Jacobson, Seconded by Lachinski, that we hold a special public hearing meeting on Wednesday, July 14, to discuss the problem of the junkyards within the City of Andover and authorize the Clerk and Mayor and legal counsel to notify the individuals listed in the Special City Council Meeting Minutes of May 1 as to this action and advise them what is going on and advise them of the hearing. (See Resolution R35-82) Motion carried unanimously. It was suggested pictures be taken of the specific violations for the record and that the Council receive a listing of the violations of each junkyard.
