(612) 755-5100 SPECIAL CITY COUNCIL MEETING MARCH 20, 1980 MINUTES A Special Meeting of the City Council was called to order at 9:21 P.M. by Mayor Jerry Windschitl on Thursday, March 20, 1980 at the Andover City Hall, 1685 Cross- town Boulevard N.W., Anoka, Minnesota for the purpose of continuing agenda items from the Regular City Council meeting of March 18, 1980. Councilmen Present: Orttel, Lachinski, Jacobson Councilmen Absent: Peach Also Present: City Engineers, John Davidson and Dave Pillatzke; City Clerk, Pat Lindquist; interested residents. Agenda Approval MOTION by Jacobson, seconded by Lachinski to accept the agenda with the deletion of Item #3, Liquor/Municipal, Private, and the addition of Item #7, Rezoning of the Urban Service Area. Motion carried unanimously. Procedure for Interviewing Consultants MOTION by Orttel, seconded by Jacobson to schedule the interviews for prospective engineering consultants on Tuesday, March 25, 1980 from 6:00 to 8:00 p.m. and inter- view three applicants at that time and on March 27, 1980 from 6:00 until completed, interview the remaining four applicants and to allow 40 minutes per interview. Motion carried unanimously. CIP/MSAH Councilman Lachinski stated that this was discussed at a previous meeting; however, there should be some discussion on MSAH projects. The council is waiting for an updated report from the engineering firm on the feasibility of how much of the Hanson Boulevard project can be completed this year. T.K.D.A. will have their report ready for the second meeting in April at which time this will be continued. Employee Mileage MOTION by Lachinski, seconded by Jacobson, that we change the reimbursement of transportation to a rate of 19¢ per mile effective March 20, 1980. Motion carried unanimously. Rezoning/Urban Service Area Dave Pillatzke. T.K.D.A. - Stated that at the last meeting they were asked to COme up with a proposal or a type of report that would facilitate amending the existing zoning ordinance for the Urban Service Area. Wes Hendrickson of T.K.D.A. suggested that T.K.D.A. do a supplement to the Comprehensive Plan that would include land use, transportation, utility plans, parks and open space, etc. This plan would take 3 to 6 months to complete and cost between $10,000 and $15,000. This would help us in Special City Co il Mee.~·ng March 20, 1980 Page 2 the event we ever go to court on the rezoning. Mayor Windschitl explained to the engineers' that we don't have three to six months to wait. Engineer Davidson noted that from what he understands, Bill Hawkins is concerned about the legal implications of a rezoning without justification. Unless you go to a neighbor- hood plan specifically defining those land uses and then define by specific boundaries what the zoning should be, you are going to have a hard time providing legal .justification that would stand up in a court of law. Councilman Lachinski felt that we need something more than a Comprehensive plan and that we need to change our ordinances immediately. (Cóuncilman Peach arrived at 9:50 P.M.) Mayor Windschitl stated that our attorney is asking what our reasons are for doing what we are doing. Discussion centered on whether we could freeze development in a certain area, and on the Industrial Study Area by the Railroad tracks. Pat Lindquist stated that Bill Hawkins is looking at why this area is more desirable as industrial rather than residential. Councilman Lachinski state~·that we need some kind of an area in the city where jobs can be created. Councilman Peach stated it should be near good roads, it should be in the sewered area, and it should be near the tracks. r MOTION by Lachinski, seconded by ~tel, that the City Council set a Special Meeting on April 24, 1980 at 7:30 P.M. at the ity Hall to finalize the Urban Service Area and proposed rezoning within the new Metropolitan Urban Service Area. Motion carried unanimously. ~ MOTION by Orttel, seconded by Jacobson, to authorize $200.00 to do a feasibility study on the installation of streets and storm water drainage in the l38th Avenue N.W. and Xavis Street area. The cost is not to exceed $200.00. Motion carried unanimously. Approval of Minutes MOTION by Orttel, seconded by Jacobson to approve as written the minutes of February 11, 1980 Special, February 25, 1980 Special Meeting, and February 25, 1980 Special Meeting. Motion carried unanitnOusly. MOTION by Orttel, seconded by Jacobson to approve as written the minutes of March 4, 1980. Motion carried on a 4 yes, 1 present (Windschitl) vote. Approval of Claims MOTION by Jacobson, seconded by Orttel, to approve claims #3014 to 3039, excluding #3030 to Midwest Planning in the atnOunt of $107.50, for a total of $19,461.65; and Checks #352 - 355 out of the 1978-2 account for $1,445.14. Motion carried unanimously. MOTION by orttel, seconded by Lachinski to adjourn the meeting. Motion carried unanimously. (612) 755-5100 PUBLIC HEARING - STREET IMPROVEMENTS SECTION 33 MARCH 20, 1980 MINUTES Pursuant to notice published thereof, a Public Hearing on the proposed 1980 Street and Drainage Improvement Project No. 1 for l33rd Avenue N.W., Gladiola Street N.W., l34th Avenue N.W., Eidelweiss Street N.W., 135th Avenue N.W., and l35th Lane N.W., was called to order by Mayor Jerry Windschitl at 7:30 P.M. on Thursday, March 20, 1980 at the Andover City Hall, 1685 Crosstown Boulevard N.W., Anoka, Minnesota. Councilmen Present: Orttel, Lachinski, Jacobson Councilmen.Absent: Peach Also Present: City Engineers, John Davidson and Dave Pillatzke; City Clerk, Pat Lindquist; interested residents. Mayor Windschit1 opened the public hearing and explained that pursuant to a petition received by the city, a feasibility study was done on Gladiola Street, l33rd Avenue, l34th Avenue, Eidelweiss Street, l35th Avenue and l35th Lane. He then explained the public hearing procedure. John Davidson reviewed the feasibility report on 1980 Street and Drainage Improvement Project #1 and stated that 49% of the residents were in favor of the project. He noted that temporary slope and construction easements may be required and that per- manent drainage easements will be required depending on final design. Mr. Davidson commented that l33rd Avenue is half in Andover and half in Coon Rapids and that Coon Rapids will be proceeding with the improvement of their half of the street, which will have concrete curb and gutter. Mr. Davidson stated that there are 6,000 assessable front feet in the project and one small storm sewer, which would be at the intersection of l35th Lane and Gladiola Street, the cost of which will be spread OVer the entire cost of the project. The estimated cost of this project would be $15.46 per front foot without the storm sewer, or $18.04 per front foot with storm sewer. The per lot cost based on a 100 foot lot would be $1,546.00 without storm sewer and $1,804.00 with storm sewer. Assuming the interest rate is 8%, the annual payment over 10 years would amount to $230.40 without storm sewer or $268.85 with storm sewer. Over a 15 year period, the annual payment would be $210.76 with storm sewer and $180.62 without storm sewer. T.K.D.A. feels the project should be assessed over a 10 year period because without curb and gutter the streets stand a chance of breaking up earlier than streets with curb and gutter. Mayor Winds chit 1 noted that the end of l33rd Avenue that goes down to the lake was vacated approximately 4 years ago and should be deleted from the project. He also stated that on l35th Lane, Texas bridges may have some value for traffic control. There have been some problems in that area because of the school buses and the number of children. These dips ±n the road would reduce the speed in that area. Councilman Jacobson emphasized the fact that 135th Avenue is not centered where it should be and will be moved about 10 feet north. At the present time, the roads are 25 feet wide. When blacktopped, they will be 32 feet wide - 28 feet of blacktop and 2 feet of shoulder on each side. This means that it is going to be wider and go into front yards. Councilman Lachinski asked what the grade looks like on l35th Lane and how many feet ." Public Hearing-. .eet In )vements March 20, 1980 Page 2 from the north on Gladiola are draining down into that intersection. Is the water finding its way to the lake? Engineer Davidson stated that it is a flat grade and does drain to the south. Councilman Orttel commented that several people in the area felt that if the road is open to the lake, it will be utilized as a public access. It was felt that this could be barricaded Some way. Mayor Windschitl open the public hearing to the residents for their testimony. He noted that the petition received by the city showed there are 59 total lots, with 30 in favor, 5 opposed and 1 or 2 with question marks. Jeanne Gasser, 2829 - l34th Avenue N.W. - doesn't know yet if she is for or against the project. Asked when we expect to get the final bids and when this will become a pending assessment. Engineer Davidson reviewed the timetable for this project: the Council will either order or abandon the project this evening; if the project is ordered, T.K.D.A. will come in with final plans and specifications the first meeting in May, at which time a date will be set for opening of bids; if bond money is available, the Council could award the contract on June 17; construction should be started at the end of June and be completed the first of September. John Martinek, 13319 Eidelweiss Street N.W. - because his house is sold, he is opposed to the project. Asked at what point in time he would become liable for the assessment. Mayor Windschitl stated that this is a legal question and Mr. Martinek should contact his attorney as there are different interpretations as to when an assessment becomes pending. Mr. Martinek - asked if it would be necessary to get a final opinion as to what the 59 property owners want. He had asked earlier that his name be removed from the petition making it only 47% in favor. (The City Clerk' stated that his name had been removed from the petition.) Mayor Windschitl stated that the Council can only speculate what the people want if they don't show up at the public hearings. Dave Stenger, 13365 Gladiola Street N.W. - There is quite a grade on the dogleg by Kemp's Addition and if you come in on l35th, you can't see a third of a block that direction. It's not flat and it curves away from you. This should be checked into. (Mr. Davidson stated that they will design the street system for a 30 mph speed zone.) Mr. Sten~er - asked how much the storm sewer would be since the assessment including the sewer would be $268.00. (Mr. Davidson stated there will be 390 lineal feet of storm sewer with a total cost of almost $18,000.00.) Mr. Sten~er - is against the curb on l33rd. Gre~ Kolinski, 13339 Eidelweiss Street N.W. - Asked if the rectangular symbols on the map represent storm drains. (Engineer Davidson explained that they are in-place culverts which will either be retained or replaced.) Connie Johnson, 13326 Gladiola Street N.W. - has the lot where the drainage goes through to the lake. There is a culvert in the street. Asked if anything was going to be done with that as far as ditching or digging in the yard. -'., ,.. Public Hearing- :et Inr wements March 20, 1980 Page 3 Mr. Davidson explained that the street would be widened out to 28 feet. The culvert will be extended or replaced. There will not be any improvement to the ditch except to clean out the end of the culvert. No present natural drainage courses will be relocated. Carl Stromer, 13336 Gladiola Street N.W. - Stated there is a culvert from the west side over to the swampy area. Mayor Windschitl commented that anything that is there would have to be replaced. Essentially what you are going to end up with is the road will be realigned and will be wider. If you have trouble with water standing on the road now, you may have water stand- ing when the project is done. Carl Stromer - Asked what the potential is for having that area filled. Mayor Windschitl explained that if it's a natural water way, there is nothing the city or a contractor can do with it. You can't obstruct natural water flow. Jeanne Gasser - asked if it was the Council's discretion as to whether or not the storm sewer and curbs and gutters on l33rd would go in. (Mayor Wlndschitl said it was.) Councilman Orttel stated that in the summer we might have people driving along the lake looking for a place to launch their boats. It might be feasible to put a stop sign on 135th Avenue. He asked the engineer if the culvert on l34th and Eidelweiss is a functioning unit.. Mr. Davidson stated that because of the curve and the crown there is a problem with that area. He didn't know if the culvert was open and functioning, and if isn't working properly it will be replaced. Councilman Lachinski asked what T.K.D.A.'s cost would be for final plans and specifications. (Mr. Davidson stated it will be approximately $11,000 through the final plans. Out of this amount, $2,300 had been spent so far). Councilman Lachinski commented that the city cannot pay more than 7% for bonds. If the city cannot obtain the bond money, the project will not go. Jeanne Gasser - asked when they would know exactly how much their assessments would be. (Engineer Davidson stated that prior to the assessment hearing, notices would be mailed which will contain the figures.) MOTION by Jacobson, seconded by Lachinski, to close the public portion of the public hearing. Motion carried on a 3 yes (Jacobson, Lachinski, Windschitl), 1 abstain (Orttel) vote. John Davidson reviewed the total cost of the project based on a 10 year assessment vs. a 15 year assessment. Carl Stromer - asked if it will be either a 10 year or 15 year assessment and who decides which it will be. (Mayor Windschitl said it will be one or the other and the Council will make the decision. The engineers are recommending 10 years.) Mayor Windschitl felt we should delete the storm sewer on l35th Avenue and put in a birm on that stretch to the lake and try to make a pond on the end and put in concrete Texas bridges. Councilman Jacobson felt that we should put something there so people won't use it as a public access to the lake. Public Hearing- eet Itr 'JVements March 20, 1980 Page 4 MOTION by Lachinski, seconded by Jacobson to order the public improvement of streets in the area of l33rd Avenue N.W., G1adiola Street N.W., l34th Avenue N.W., Eidelweiss Street N.W., l35th Avenue N.W., and l35th Lane N.W., and to authorize the firm of T.K.D.A. to prepare the final plans and specifications and to request Springstead to prepare the resolutions necessary to determine if bonding is available. (See Resolution R24-80) Motion carried on a 3 yes, 1 present vote. (Councilman Orttel's vote was listed as present as he is directly involved with the project.)
