A Special Meeting of the Andover City Council was called to order by !-~yor Jerry
~indschitl on July 11, 1978, 8:17 p.m., at the Andover City Hall, 1685 Crosstown
Boulevard ]In'!, for the nurpose of hearing an updated report from Attorneys Burke
and Hawkins, adopting a Resolution for the Fire Department Bond Election, and
interviewin~ tvo individuals for the position of Building Official.
Councilpersons present: Lachinski, HcClure, Orttel, VanderLaan
Councilpersons absent: None
Also present: Attorneys John Burke and Bill Hawkins; Fire Chief, Vic
Evans; Assistant Fire Chief, Bob Peach; and City Clerk,
P. K. Lindquist

and Hawkins on their legal matters, the Adoption of Resolution for the Fire Departœnt

Attorneys Burke and Hawkins reviewed the following litigations and their present standing:
Kaswell: was tried to conclusion and is nOw under advisement by the JudGe.
Cecil Heidelberger: did not show up for court. The Judge signed the judgement today
which gives him until September 1 to comply with licensing requirements. If he
does not com!Jly, the jud~ement requires him to cease operation.
¡'¡yron Poseland: is now in Florida and his lavryer has not yet filed a brief, which is'
long overdue. Technically, this case is still under advisement.
Rosella Sonsteby: We received the judgement this week on this condemnation. The
City "will have to pay the difference froo the original award. She could still
appeal the caGe.
,\'Tinslow HolaGek condemnation: is still pending waiting for trial. tw. Eawkins stated
he did meet flith Hr. Holasek and his attorney in his office. !-w. Holasel, sta tad
he would settle for ~15,000. After doing so~e calculo.tions o~ trees, Hr. Hawkins
felt that $10,000 was more than a reasonable figure. }IT. Holasek refused. 1'-

Hawkins has had no contact with Hr. Halasek since that last meeting.
1977-1 Condemnation actions: ~~inent domain proceedings are pendinG aGainst Gilbert
l~enkveld, rT. Path, and Jim Conroy. The Commissioners have reviewed the properties
and will be meeting again shortly. Hr. !-Iawkins expected a decision wi thin the
next six Vleelæ.

my consent for the establishing of a Volunteer Fire Department for the City of Andove~
As I have failed to convince MY fellow Councilpersons to demand More þreciseness and
completeness of information before establishinß the Department, I nOIT Must allow the
question to enter the next arena of determination -_ that being the voting population
of the City.
I!ayor '"!indschi tl ouestioned if the brochure should be an official document of the
Council and Ylhether taxpayer Money should be involved in anything that is relating to
an election (cost of printinr, the brochure, mailin~ it, etc. )
Corrections on the Bond Election Eewsletter prepared by the Fire Department were:
m,~.'ho '.7i11 It Benefi t?tI , Change Paragraph 2 to: The Andover Fire Department is planning
to provide Rescue and EmerGency Nedichl Service within five years.
Date will be changed to August 17, 1978.
Election Question will be worded exactly as stated in the Resolution just passed.
Hr. Evans stated that Hr. Forness has checked the figures in the Hewsletter.

with a limited life expcctancy, they will be adequate for brush fires. Our only
new truck is a pickup which will also be converted for brush fire use. In
addition, we have obtained some basic equipment...
HOTIO'T by Orttel, Seconded by HcClure, that the Council adopt the I:ewsletter prepared
on the Bond Election as corrected the evening of July 11 and authorizo the Clerk to
proceed with the distribution of the Newsletter with the allocated funds cOhtingent
upon the approval of the bonding attorney for this type of expenditure. Dis cussion:
It was recommended that the na~es and phone numbers of fire fighters be in the Newsletter
for residents to call for further information, as they are the most l~owledgable con-
cerninp, fire departr.lent needs. 11s. Lindquist suggested getting a news article in the
Anaka Union and possibly getting slots through ¡~NO radio. It was agreed a notification
for an informational meeting at the City Hall could be added to the lTewsletter.
VOTE 0') HOTIm): YES-I!achinski, HcClure, Orttel, Windschitl; nO...VanderLaan: objected
to the burning hand r,raphic as she felt it was shocking and the Newsletter is a hard-
sell document. Hotion carried.
HOTIOIT by 1"lindschitl, Seconded by Lachinski, to reconsider the prior motion. Hotion
carried unanimously.
!'OTIm) by IkClure, Seconded by Orttel, that the Council approve the Special Bond Election
I!ewsletter as changed July 11 specifically deleting the picture of the burning hand,
and authorize the City Clerk to proceed with the distribution of the Newsletter utilizing
existing funds contingent upon the approval of the Bonding Attorney as to the appro-
priateness of this type of expenditure. HotioYl carried unanimously.

join the Volunteer Fire DepartMent, etc. ; their previous experience with buildinß
inapections and interpretïhg blueprints; their ability to uork uith contractors;
uhether or not they are involved in anything that would be in conflict of interest

range they are interested in.

* Has had 20 years construction b:J.ckground experience in dirtworl: and utilities.
~orked highuay heavy for five years and has done civil engineering ever since, 18
presently uor]dng for the City of ColuJ:1bia Heights Engineering DepartJ:1ent doing survey
and desißn work, etc. For the past three years, he has been attending inspection
courses at Porth }:ennepin Junior College. Received his Certification from the State
a year ago. In the fall he will be taking additional courses.
* His only conflict to attending Council J:1eetings would be his schooline,; hOì'¡eVer,
he felt a ttendine, Council meetings \'Iould talœ priority over his classes.
* Likes to locate a probler.1 before extensive correction becor.tes necessary. JIe
also likes towork \'lith the contractor instead of against hiJ:1 and would exhaust all means
before red-tagging a contractor for non-compliance with the Code.
* Did not find it difficult passing jud~ement and has done so over the years worlclng
with contractors.
* Has no experience \'J'Orkinr; graders but \'lould not object to driving a snow plow in
the winter if necessary. ~ould assist the Volunteer Fire Department i~ any way possible
and would be glad to volunteer if necessary. ITould also be \'Iilling and does have somo
knowledge in checking plats for draina~e, ~rading, etc.
* Would not have any problem making judr,emental calls when necessary.
* Has worked for three Months as housing inspector going throu~h existing apartment
units checking for safety and fire hazards. He didn't feel he would have any probleJ:1
inspecting single-faJ:1ily housings.
* I!as revievled housing prints, checked grades, helped determine house elevations,
etc. He has done all calculations necessary on prints in his courses, but hasnlt had a
chance to work with them since.
* Has done very little zoninG and ordinance enforceMent.
* ~~en worldnr, ~ith individuals doing construction, if he is not able to give them
the answer right a\'lay, he will definitely 100], it up for theJ:1 so it doesn't delay their
work.

* In his schoolinr" he studied the 1976 Code book ~hich included an over-all picture

buildinGs.
" Felt he ~ouldn't have any problem workinG with individual contractors and hclpin~
them if neod be. Hacn't had any ,robler:1G in his present jOb makinG decisions when
necessary and didn't feel that ~ould be a probleö as Building Official.

Inspection. Ee had not r,iven any thoußht to joining the Volunteor Fire Departnent. IIe

* Is rather involved in Church, but felt he would be able to attend City Cou~cil
meetinr,s if requested to.
* Felt he was tactful in dealinG with delicate matters and has had experience dcalin~
with t'l3tters ~here he is in the ~inority. If a builder refused to do what is required,
he would follow the State Codes throur,h ~hen dealinG with a violation of the Code.

benefits, he felt f,18,000 to ~20,OOO would be adequate, althouGh he realized he is just
beginninG in the building inspection field.

Council diccunsion was on qualifications of each applicant, on whether or not 3 decision
should be ~ade this eveninG, and on the Dtarting salary and startinG date. The Clerk
testified she had checked several of t~. AlMgren's references, all of vhich gave a very
favorable recoMMendation as to Iw. AlMGren's dependability and reliability.
l-~OTIOH by JÆtchinski, Seconded by 1-!cGlure, to hire }æ. David Alngren as the City of
Andover Building Official at a salary of $7.25 an hour vith a probationary period of
90 days, after satisfactory cOMpletion salary vill be at $7.50 per hour. r·.íotion
carried unaniMously.

Official at July 25 or" as soon as :possible. Motion carried unanimously.
