CITY of ANDOVER SPECIAL CITY COUNCIL/PLANNING AND ZONING COMMISSION MEETING APRIL 7, 1977 MINUTES A Special Meeting of the Andover City Council and the Andover Planning and Zoning Commission was called to order at 7:40 p,m, by Mayor Jerry Windschitl at the Andover Community Center, 1685 Crosstown Boulevard NW, Anoka, Minnesota, Councilpersons present: Lachinsk1, Orttel, VanderLaan Councilpersons absent: McClure Commissioners present: Bosell, Bruns, Elling, Chairman Jacobson, Retzlaff Commissioners absent: Johanson, Kishel Also present: City Clerk, P, K, Lindquist; Metropolitan Council representatives, Jim Barton, Sandy Dean, Lynn Holman; other interested residents, The representatives of the Metropolitan Council were present to answer questions the City had regarding the Systems Statement and the Plan Content Guide, Mr, Dean explained the procedure the Metropolitan Council is following in implementing the Metropolitan Land Use Planning Act, The first step of that process entails the Systems Statement which is a communication from the Metropolitan Council to the communities informing them of what adopted Metropolitan Plans affect that community, Because it includes only adopted poli~~œ,some of the information is out of date, The community will consider that statement in coming up with its own comprehensive plan, the content of which is clearly spelled ont in the law, The Metro Council will issue the Final Systems Statement, which is to be done before July 1, 1977; then the community has three years to adopt a comprehensive plan and submit it to the Metropolitan Council for review. Six months before submitting the comprehensive plan to the Metro Council, the plan must be submitted to the surrounding communities, school districts, and to Anoka County for their review, Should there be a disagreement between the community and the Metropolitan Council, within 60 days of receiving the Systems Statement. ·the community can petition for a hearing to tell their problem with the Systems Statement and their recommended solution to it, The Metropolitan Council has until January 1, 1978, to make changes on the Final Systems Statement, These changes must be included in the community's comprehensive plan also, The Metropolitan Council is charged with developing the system plan of the airport, and the Airports Commission is to carry out those plans, Preliminary Metropolitan System Statement Discussion I Population Projections - The figures in the Systems Statement are the adopted figures; however, this information is out of date, The current projected 1990 population for Andover is around 12,000, according to the Metropolitan Council, However, all the City projects estimate about 15,000 people in Andover by 1990--9,200 in the urban area, 5,800 in the rural area, There's about 4,000 people in the rural area now, Our urban boundary was based on the capacity provided for us on the Sewer lines, which has a saturation population of 31,000, So the urban area will remain essentially the same, approximately 1/4 of the City, However, if the area by Bunker Lake Road" and County Road 9 receive 'sanitary sewer and water, the population figures could increase significantly, Also, as soon as sewer and water is available, the city is under Supreme Court order to , issue a trailer park permit to the area just west of there. Metropolitan area growth is declining, The Metropolitan Council felt that the impact of the airport in Andover would not affect the population figures drastically; however, the figures are not based on the assumption that an airport would be here by 1990, - Special City Council/Planning and Zoning Commission Meeting ,.Minutes - Al'ril 7, 1977 Page 2 Housin~ _ The City was concerned over what was meant by "providing" low income housing. Ms, Holman explained that the paragraph on housing was just general information written for all communities, Andover is in a third priority area based on service levels, The Metro Council tries to work out the number of subsidized housing units for the area based on current population growth and employment and then the total metropolitan need, According to the current formula, Andover has a lO-year goal for four units, In the near future, Andover wouldn't be getting to this process; it's more of a long-term process, Metropolitan Council income limits defined for a family of four are $8,600 for low- income families, $13,800 for moderate-income families, and $18,150 for middle-income families, The area Andover needs to be concerned with now is not the implementation program but in terms of making policies to be able to develop low-income housing in the future, The City should write policies that make it easier to develop low- and moderate- income housing -- those policies relating to siting and environmental criteria, codes, ordinances, etc" affecting housing, Given construction and assessment costs on lots in the City, low-income housing have become prohibitive, The Metropolitan Council is referring to subsidized housing -- income coming from State or Federal programs, It is not their intent that the City provide this subsidy, just that the City have a plan that makes it possible to provide for subsidized housing, The Metro Council is looking at the amount of land zoned for the population growth and whether the land is_zoned for a variety of housing types and costs. Mobile homes are an option in terms of housing, but nO definite answer could be given the City as to whether it could be considered low or moderate housing. The Metropolitan Council looks at the cost Of the housing. Until Andover has both sewer and water available, we cannot be looking at subsidized housing. BasicallY, all that Andover needs to do is to do a little more housing analysis, and do some policiss that make it possible to develop low and modest housing, and look at the zoning ordinances. Subsidized housing in the rural area is totally out of the question. The City Council and the P & Z Commission felt the wording on the Systems Statement should be changed from "programs to provide subsidy housing" to "programs to facilitate subsidy housing". As far as housing rehabilitation is concerned, Andover should plan on a long term maintenance of existing housing. There are programs available for rehabilitation, mostly through grants and loans, and it should be made known in the community that these programs are available'l This plan is appropriate only on a very small level for Andover, The Metro Council is presently working on guidelines with ranges on house prices, house sizes, lot sizes, etc~ Subsidized housing is mainly for young people or for senior citizens, and these people need a certain number of services -- improvements, mass transit, etc, Subsidized housing is often multiple dwellings, not necessarily just single-family units, The Metro Housing Guide being drafted has a section which defines whether a plan is inadequate or inconsistent, One point they would consider is whether the subsidized housing policies are missing or are in conflict with the Metro policies, At the moment, the Metro Council staff can't answer at what levels policies become inconsistent; however, the committee is trying to come up with some ranges to judge this by, I The City of Andover must comply with the Systems Plan that Metro Council gives us for the airport area, which is 3/4 of the City, The airport search area is currently being revised, but the decision to move ahead with the airport facility will be made this year, The problem that Andover faces is that the Systems Statement comes out July 1, the City has 60 days to respond to the Statement; but the decision on the airport won't be made Special City Council/Planning and Zoning Commission Meeting Hinutes - April 7, 1977 Page 3 until after that time, How can the City comment on the Statement not knowing what is going to happen to 75 percent of the City? This item in the Systems Statement makes it difficult for the City to work with because we are opposed to the airport, The Metro Council is asking the City to approve something we can't agree with, The law doesn't provide for a time delay on this situation, but the Metro Council might be willing to take this problem into consideration, If the City doesn't appeal the Systems Statement, Mr, Dean explained it doesn't necessarily mean that we agree with it -- it just means that we know what the Statement is, When the Systems Statement comes out, the City could file an appeal at that time to let the Metro Council know our position, The law states that the time to amend is when the plan is adopted and amended, and the Systems Statement is only to inform communities what the plans are, The City Council and the Commission felt strongly that there is no recourse on the airport issue and would like to discuss this dilemma further with the Land Use Advisory Committee of the Metropolitan Council within the next month or so, Hr, Jacobson was asked to write a statement to them of how we feel, The plans are projected for 1990, and they are assuming that no airport will be put in before then; however, we don't want that hanging over our head for the next 14 years, The Metropolitan Council is in charge of selecting the airport site and the local plan must acknowledge the site and plan accordingly, If anything on the airport exists, the City should be made aware of it, Mr, Dean agreed to see what can be done åbout the airport situation, Recess at 9:15, Transportation - The total number of "person trips" projected for Andover is going to change as the,population changes; however, the figure is important to the traffic engineer to see if the roads are adequate to handle the traffic, The traffic behavior figures were estimated on 3,3 trips per day per resident, Roadways _ The map on page 13 was discussed as to its adequacy, Seventh Avenue will be improved this I summer, Round Lake Boulevard is the most heavily traveled road in the City, Prairie Road is being improved, and Hanson Boulevard is scheduled to be extended, This map is not a part of the Metropolitan Systems Statement, but is for the City's informa- tion only, Ir is the classification of thoroughfares used by the Transportation Advisory Committee for Federal and State funding purposes, If there is a change in the classification of some roads, the Transportation Advisory Board should be notified so they can update their records, The effect of the intersections which meet the principal and intermedi~te arterial roadways outside the City would be of concern in that they be kept in a high enough standard to carry the traffic, The City should communicate with the County to see that our ideas and classifications agree, The City would like to have a more accurate map in the Final Systems Statement, I Round Lake Seaport Operation - Round Lake is a native nesting ground for the State bird, the Loon, This is an issue that has to be addressed in the airport's policy plan revision, I Waste !~na~ement - Mr, Dean's letter to the Council answered the City's questions adequatelj Special City Council/Planning and Zoning Commission Meeting Minutes - April 7, 1977 Page 4 Industrial Growth - Commercial zoning is very limited in the City of Andover, and there are no immediate plans for any "wet industry" locating in Andover, The City ,., uld like to know the criteria used to determine whether or not it is a "wet industry" or a "dry industry." Rum River Regional Park - A small portion on the east side of Rum River will be acquired tor the park along the Cedar Creek area; however, most of the park will be in Ramsey. The Metro Council will be as specific as possible as to the area involved in the final plans for Andover, Plan Content Guidelines Lot sizes - The Metropolitan Council policy is 40 units per square mile maximum density in the general rural_use area, They are concerned about ~ncre~ numbers of peop1e in the rural areas demanding services and the problems this creates. Over density could create premature extension ot sewers, unplanned transportation facilities, etc. H the City wants to develop with greater density, the City must show thàt adequate services will be provided for these people, This policy seems in conflict with the State law which states that anything over 5 acres can be developed by metes and bounds, which could exceed this 40 units per square mile, There are ways the City can work out zoning ordinances to allocate the right to certain lots to landowners based on how much land he has to plot, Approval of a final plat does not mean the City must allow it;_ however once a substantial financial investment on the property is made, the City cannot stop the development on that plotted land, If the City can show the Metro Council how we intend to develop in the rural area in terms of providing services, then we should be able to get our comprehensive plan approved on a small lot size. Discussion on the questions asked in the City's letter to Mr, Dean about the Plan Content Guide: 1) Who bears the cost of the extensive studies that need to be done? There is a good possibility the City will be allocated $4,700 by the Metro Council that can be used for this, ' 2) Inventory of existing houses - Most of this information comes from data from the census and estimates. This is something that a planning consultant would know how to do, I 3) Land use plan category - This refers to after the comprehensive plan is done and is reviewed by the Metro Council, We may want to amend it occasionally, Major amendments shall be reviewed by the Metropolitan Council before they are put into affect, The Metro Council will have to further define and clarity what a major amendment will be that they Willi want to see. 4) Location, type and capacity of all existing treatment facilities - The City must identify wherelall private sewer facilities are located which require a permit issued by Pollution Control to any system that discharges on land or to a stream, I 5) Description and location map of existing sewage problems - Since 1972 the City has kept accurate records of septic systems put in, The Metropolitan Council requires the I - Special City Council/Planning and Zoning Commission Meeting Minutes - April 7, 1977 Page 5 City to survey every on-site system in the City and to begin monitoring all septic systems at the expense of the City, Andover has an Ordinance dealing with the maintenance of systems that is presently being enforced, Andover also requires a Pumping Permit be issued for all septic systems to be pumped within the City, This would help the City monitor all septic system failures; however, little has been done in this area until now, If the Ordinance is being enforced, this should give the City all the necessary information required by the Metro Council, Mr, Dean agreed to look at our Ordinance to see if this would be the case, MOTION by Orttel, Seconded by Lachinski, to adjourn, Motion carried unanimously, Meeting adjourned at 10:30 p,m, \1\=-~~ Marcella A, Peach .-
