Q.fl,'1'l1 ~ecord~n~ SecrctD.~v , " I I , 1 1 , , - --.< · , CITY of ANDOVER SPECIAL CITY COUNCIL MEETING - OCTOBER 4, 1977 MINUTES A Special Closed Meeting of the Andover City Council was called to order by Mayor .Jerry Windschitl on October 4, 1977, 6:40 P,M, at the Andover City Hall, 1685 Crosstown Boulevard Northwest for the purpose of discussing the pending lawsuit filed by Horace Mayo and Charles Bankey covering matters relating to Cedar Crest Fourth Addition (proposed). Councilpersons present: Windschitl, Orttel, VanderLaan Councilpersons absent: ' Lachinski, McClure (arrived 7:05 P,M,) Also present: City Attorney, William G, Hawkins, City Litigating Attorn~, John M. Burke, City Engineer, Rex Stockwell, P&Z C airman, Larry Retzlaff, City Clerk, Pat Lindquist. ,. Attorney Hawkins explained to the Council the reason that this meeting was being held "behind closed doors", i. e" the entire meeting is devoted to discussing litigation pending before District Court in Anoka County, He further noted that this type of meeting was being held pursuant to a Minnesota Supreme Court decision allowing closed meetings to discuss litigation, Attorney Hawkins further informed the Council that he and Attorney Burke felt the need to review the facts involved prior to proceeding for the following reasons: 1. It has been sometime since we focused on it, 2. There are three councilpersons that were not on the Town Board at the time the plat was presented, 3, A settlement proposal was just reached on October 2, and he felt that the Council had not had sufficient opportunity to review it, 4, The City should examine the concessions they would have to make as opposed to the potential exposure under a settlement stipulation. 5. The attorneys wished to seek direction from the City Council, Reference was made to the letter of September 27, 1977 from Attorneys Burke and Hawkins t'! the City Council outlining the facts in the case. The date of October 25, I ~72 on page 2 of the letter was corrected to 1973, All items discus sed in the following minutes refer directly/indirectly to the above referenced letter. I Mayor Windschitl questioned the reference to "Cedar Crest 5th Addition", noting , that he was not aware of such proposed subdivision, Attorney Burke presented a map as prepar~d by D. Olson showing a fifth Addition lying directly north of the Fourth Addition, It was further noted by Attorney Burke that originally the entire Third, Fourth and Fifth Additions were presented as the Third Addition; following the p~eliminary plat approval of the entire area, only Final approval was given to the area on the west side now known as the Third Addition (the remaining area was left in abeyance and ultimately labeled Fourth and Fifth Additions, Th~ Fourth Addition was presented for Final approval in May, 1974, Attorney Burke further noted that former Mayor Richard Schneider, then Chairman of Town Board, had informed him that final approval was given at this meeting; however, Marvin Christenson, Town Board Member and the minutes of such meeting indicate that it was not, - " Special City c.. ..ncil 1\ ,ting October 4, 1977 Page 2 Councilperson McClure arrived, Other items in the letter culminating with the filing of the lawsuit were reviewed by Attorney Burke. Caswell & Associates letter of December 11, 1973, referring to the 66' roadway was discus sed. It was noted that all documents on file show a 50' roadway. Attorney Stockwell commented that the referenced plans of DeWayne Olson refer to 66' street sections (standards). Mayor Windschitl noted that the wording in the above referenced letter refers to the Final Plat and not Mr. Olson's plans and specifications. Further review indicated that 50' minor streets are required by Ordinance No. 10 which was in effect at that time. Attorney Hawkins stated that in plats, the City does request 66' right-of_ way and the developers have complied throughout the years, however Ordinance No. 10 does not require it. City Clerk Lindquist questioned the Final Plat copy showing the surveyor's signature under a date of October 15, 1974, noting that the Final Plat was filed in May of that year. It was agreed that this did open some questions inasmuch as the Surveyor always has signed the Final Plat prior to presentation to the Council for approval; however due to the fact that the City does not have a copy of the Final Plat showing a date of May, 1974 filing, it would have to be assumed that in this case the Surveyor did sign the plat, contrary to procedure, after presentation for approval, 1 The next item discussed was the park property, It was noted that Lot 8, Block 1 had been dedicated for the now recorded Third Addition, Records indicate that the property is still in the ownership of "Mayban ",. ;11\lt;orney Hawkins advised that the Quit Claim Deed could not be filed inasmuch as there were back taxes due Dn the property. Attorney Hawkins referred to seeing an agreement showing an additional $400 paid to the City as park dedication for the Third Addition (Clerk's Note: the City has no record of receipt of such payment). It was noted that Ordinanc~ No. 10 now requires 100/0 of land dedicated for parks, and the proposed plat lonly includes 70/0. Attorney Hawkins pointed out that the court 1 would in all probability look to the Ordinance in effect at the time that the original plat ';"as approved in the preliminary stage, I Attorney Hawkins stated that the City exposure was the greatest in the lititgation as it address~d the park issue in regard to inverse condemnation, of which costs could exceed $15,000, including 1) cost of land, åi1d 2) costs of attorneys and appraisers fo~ both sides in the action, He also informed the Council that Attorney Burke and he had proposed settlement primarily,'because of the high exposure covering the Park area. I Discussed we~e the double frontage lots; it was noted by Engineer Stockwell that , if the roads were extended to eliminate this double frontage, the developer would , actually not lose any lots. Attorney Hawkins noted that he felt that Andover could muster a good defense as far as the continuation of the plat, however, this was not true of the charges covering the park area. Special City C ...ncil 1-. _ting October 4, 1977 Page 3 It was pointed out that two persons listed in the action as defendents, former Mayor Richard Schneider and possibly former Town Board/Council member, Winslow Holasek, would not be friendly witnesses for the City. Mayor Windschitl stated that he would like another meeting with the City Attorneys and all those persons involved at some point in time with Cedar Crest Fourth Addition, Those persons listed were Lyle Bradley, Marvin Christenson, Skip Rither, Richard Schneider, and Wimlow Holasek. The time factor relating to the up-coming moratorium was discussed, Attorney Hawkins noted that the matter was being litigated under the Ordinance in effect at the tiIne the lawsuit was commenced- for settlement purposes it was the Ordinances in effect today; if there would be another moratorium, there would not be a settlement and the cas e would be heard with the Judge s ruling controlling, regardless of the moritorium, Attorney Burke stated that he would have to give the Court an answer within two weeks which was almost up now. Councilperson Orttel stated that he felt that the exposure was very great on the part of the City inasmuch as the plat as proposed did meet the provisions of Ordinance No, 10 at the time preliIninary approval was granted. Mayor Windschitl stated that the residents in the adjoining area opposed the development into the one -acre lots. Councilperson VanderLaan noted that the residents did not have all the facts furnished to the Council and perhaps did not realize the. possible exposure to the City, Noting that this was a closed meeting, it was agreed that the motion setting another ses sion should be handled at the Regular City Council Meeting.
