SPECIAL CITY COUNCIL MEETING _ APRIL 28, 1976
MINUTES
A Special Meeting of the Andover City Council was called to order by
Mayor Richard J. Schneider. April 28. 1876, 7 :30 P. M. at the Andover City Hall,
1685 Crosstown Boulevard N. W., for the purpose of interviewing applicants for
the Parks and Recreation Commission, and approving minutes from several
previous meetings. Miscellaneous other items to be discus sed per the attached
agenda.
Councilpersons present: Holasek, Rither, VanderLaan, Windschitl
Councilpersons absent : None
Also present: City Clerk, Patricia K. Lindquist, and City Building
Official, James E. Thurston (arrived 8:45 p. m. ).
Agenda Approval
MOTION by VanderLaan, seconded by Rither, to approve the agenda as written
with the addition of Item 6a (Building Inspector _ Decline of Appointment, Selection
of Replacement). Motion carried unanimously.
Parks and Recreation Commis sion Interviews

The Clerk informed the Council that Ms. Larson had just called to advise that she

would not be present for her interview scheduled for 7:45 P. M.

Marvin Christenson, scheduled for a 7 :30 P. M. interview, was present and was
confronted withi the same questions as those asked all other applicants for the
,
positions (see Minutes of 3/9/76). The Council had previously been given rating
sheets on whicl they could record the accuracy of responses to the questions.
Selection of Park and Recreation Commission Members
The Clerk was ~eqUested to call Ms.' Larson to ascertain whether or not she
may be still interested in becoming a member of the Commission. She stated
that she was in~erested. but would have to come for the interview at some other
time. A discus1sion was had on 1) number of interview times to be scheduled
for an applicant, 2) necessity of completing the selection of members at once,
inasmuch as th~ year was five months over, and 3)the possibility of scheduling
another intervi w date for Ms. Larson for May 4, at which time appointments
would also be ntade. It was noted that the Park and Recreation Commis sion
Chairman had requested that appointments be made as soon as possible in order
to permit the ctmmission to act in full capacity.
MOTION by Rit er, seconded by VanderLaan, that the Council appoint the balance
of the Commiss1ion members at this meeting, and that the Clerk be directed to
indicate to Ms. Larson that there was a need for immediate action on the appointrnents;
and advise her that there will be two vacancies on December 31, 1976, and invite
her to reaffirm her interest and reapply at that time.

Selection of Park and Recreation Commis sion Members (continued)
Discussion on the need for such immediate action, and the possibility of delaying
for one week. Councilperson Windschitl felt that inasmuch as a number of
allowable interview dates had not yet been established, an::Jtner !;Ln~ <:'l'u\ 1
be granted for Ms. Larson. Counci1person Rither pointed out that the Commission
is meeting again on Monday, May 3, and if a selection is not made at this meeting,
another month will be lost. Vote: Yes - Rither, VanderLaan, Windschitl; No -
Schneider, Holasek. Motion carried.
MOTION by VanderLaan, that an amendment be added to the Planning and Zoning
Commission and Park and Recreation Commission Selection Criteria, that a
maximum of two interview times will be scheduled per applicant per appointment
period. Motion declared out of order by Mayor (Not an agenda item)
MOTION by Windschitl, seconded by VanderLaan, to appoint Walter Arntzen
to the Park and Recreation Commission £"r a term to expire December 31, 1977;
and Greg Drummond and Marvin Christenson to terms expiring December 31, 1976.
Vote: Yes - VanderLaan, Rither, Windschitl; No - Schneider (objected to all
three persons being included in one motion, Molasek (objected because all possible
candidates wer'e not interviewed). Motion carried.

Windschitl stated that he would not be able to cast a vote
for Bernard Steffans (suggested earlier) if he was a
candidate for the position, inasmuch as Mr. Steffans
represented a firm involved in work performed for him
on "The Oaks" plat.

Page 1 - Add to Engineer Kasma's statement--Mr. Kasma further
stated that in order to get a favorable A-95 Review, they
needed a motion from the Council stating that by a certain
date we would agree to amend the plan by changing 2 1/2
acres to 10 acres; and prohibit commercial and industrial
development, with the exception of agricultural orientated,
in the rural planning district.

Page 4, Councilperson Rither's statement, -last two sentences - Correct to read--
Many parts of the 1st Section of the Comprehensive
Development Plan are word for word from the
Metropolitan Council's Framework-Development
Guide, but that was because the Planning and Zoning
Commission and the Planner felt they applied to
Andover; the statements addressed Metro Systems
such as transportation and land use and we must
be aware of how we fit into that. The A-95 Review
does effect us- it does not effect the adjoining
communities as they do not have a sewer project
in progress.

MOTION by Windschiti" seconded by VanderLaan, to approve the Minutes of
March 9, 11, 16, 18, 30, April 6, 15, 1976 as corrected. Motion carried
unanimously.
Building Inspector - Resolution'
The proposed resolution was distributed for action on Tuesday, May 4, 1976.
Building Inspector - Decline of Employment, Selection of Replacement
The Council was given a letter, received that day, from Mr. Zepper declining
employment for personal reasons. Discussion on 1) ,te-advertising, 2) reconsidering
the original list of applicants, 3) reconsidering those persons interviewed for the
position, and 4) following the recommendation of the staff to hire Mr. Nelson or
Mr. Rambow to' £ill the vacancy.
MOTION by Vai:.derLaan, seconded by Rither, that Donald Nelson be hired as
Building Inspector/Deputy Assessor/Tree Inspector for the City of Andover,
at a salary of $5.25 per hour and be classified as a non-exempt employee,
with a six-month probationary period. Discussion on the amount of salary--
VanderLaan not~d that a motion at a previous meeting had mandated that the
salary be set a~ $11,000 to $14,000 per year. Vote: Yes - va nderLaan, Rither;
No - Schneider (objected to salary and lack of experience), Holasek (would like

to review his notes on all the applicants), Windschitl (objected to salary).
Motion defeatedl Council per son Rither stated for the record that in seconding
the motion, he .i..as supporting the staff and their recommendations as he had
always done.
MOTION by Windschitl, seconded by Rither, that Dennis Rambow be hired as
Building Inspector/Deputy Assessor/Tree Inspector for the City of Andover,
at a salary of $t 77 per hour and be classified a non-exempt employee,
with a six-mont probationary period. Vote: Yes - VanderLaan, Rither,
Schneider, Windschitl; No - Holasek (same objections as for previous motion -
wished to revieJ. notes on applicants.) Motion carried.
The Staff was di1rected to contact Mr. Rambow to see if he were still available.

Horsemen's Co cil

The Clerk was directed to set a meeting date to review the responsibilities and
the Horse Ordinance with the Horsemen's Council; and to advise the City Council
of said date.

Federal Revenue Sharing
The Clerk informed the Council that she had received correspondence from the
Federal Revenue Sharing Office to the effect that our allotment for the Seventh
Entitlement Period (July 1, 1976 through December 31, 1976) was estimated to
be $27,760. This was a $10,000 increase over the Sixth Entitlement Period
which covered from July 1, 1975 through June 30, 1976.

COU}ICILPERSON WINDSCHITL'S REASON FOR THE FOLLOWING MOTIONS:
Page 3, Motion 4 - Because the City is unable to economically provide
this service at the present time.
Page 4, M tion I - 1. Because the wording of the CDP WaS not consistent.
2. He wanted to make provisions for neighborhood
groceries in rural district.
Page 4, Motion 4 - Because he did not think it was proper for multiple
I dwelling units to be mixed into residential areas.
Page 4, Motion 5 - Because he does not think it is appropriate to
prohibit farmers from draining peat land or swamp
land.
CORRECTIONS TO MINUTES - APRIL 5, 1976
Councilperson VanderLaan's Copy
Councilperson VanderLaan asked Mayor Schneider how he could use a
TKDA report prepared February 3, 1976. analyzing the petitions from
the residents, in order to cast his vote on January 8. 1976 to
order the improvement projects. She reiterated,her statement made
on March 29, 1976 Was absolutely correct and requested that she and
the Mayor discuss this again as the last item before adjournment
because a more important issue WaS the subject of discussion now and
should be taken up immediately.

CORRECTIONS TO MINUTES - APRIL 5, 1976
In response to Councilperson VanderLaan',s remark made at the March 29th
Special Council Meeting, in regards to the Council approving projects against
the wishes of the majority, I presented these petition counts.

Note: The only area (on approved projects) where the majority signed negative
was Red Oaks Manor 3rd, and I remarked on this at that time. Mr. Kasma stated
that the Sanitary Sewer Project in Red Oaks Manor 4 could not be constructed
if Red Oaks Manor 3 was not included in the project.
