The Regular Bi-1.pnthly l1eeting of the Andover City COunCillvas called to order by
Mayor Richard J. ScJmeider on September 21,1976,7:30 p.m., at the Andover City
Hall, 1685 CroSStOI\'I1 Boulevard N.W., Anoka, Mitmesota.
Councilpersons present: Ri ther, VanderLaan, Winds chi tl. lIolasek
Councilpersons absent: None
Also present: City Attomey, William G. Hawkins; City Engineer, D. R.
Kasma; Planning & Zoning Chairman, Ken Orttel; City Clerk,
Patricia Lindquist; and interested residents.

IISAlI - Prairie Road Assessments/iCondemnation
Engineer Kasmaexplained that he has discovered that the State "ill not rny the cost
of acquiring de right-of-way, but they will issue a check to the land Olffier for the
amount agreed Upon for the right-of-1Vay. TI1erefore, this financing will have to
COme from other funds. Some counties are using General Fund money and some cities
are assessing this to the property owners. I f the property miner would contribute
the right-of-way to the City there would be no problem, bU~ fðies anticipate that
condemnation process will have to be used in some cases. - '''( ave developed-a
policy to charge the cost hack to the property millers. Ar.1ount listed is only a
ballpark figure and not the actual amount. Engineer Kasma recommended that we
amend our general assessment policy to include the rural roarnvays. For property
funding on rural state aid streets there shall be æ1 assessment for any cost not
funded according to the current rules and regulations under /.1innesota Statutes.
He is recommending furthcr that the Council authorize a public hearing and proceed
on this basis for the non-eligible costs and recommends that the hearing be October 19.
Engineer Kasma Ifeels the public hearing should be held to explain the whole situation
to the residentj of Prairie Road.

There l~ere some questions from the floor on how the decision was made to do one half
the road projecr at a time and how it Ivas determined which half should be done first.
Engineer Kasma xplained the process to the residents.

Public Works Funding
Engineer Kasma proesented a Concept Design, which l~as drawn up after the Building
Committee Meeting, for a Multi-Purpose Building. Discussion followed on whether or
not this building should be called a Fire Station. It was detcrmined that this
should not be presented as a Fire Station when the application for funding is submitte~
as the City of Andover may not be in a position to support a Fire Department for some
time yet but is in need of a ~laintenance and Hulti-Purpose City Building. Engineer
Kasma reviewed the application that must be completed and sent in for this Federal
funding. "
~OTION by Winds chit 1 , Second~bY VanderLaan, that we approve the concept of the
garage. community service buildin~as presented by TKDA and that we authorize the
expenditure of up to $1,000 for tht' preparation of the Site Plan, required documents,
and cost estimates by TKDA. Councllperson VanderLaan requested that the maker of
the motion use ,the title of Public Works/Community Service Building. This was satis-
factory with Councilperson Windschitl and he suggested that the $1,000 come from the
contingency fund. Carried unanimously.

Councilperson lIolasek proposed that the next Building Committee lfeeting should be
held septembert5, 1976 at 7:30 p.m. in Andover City Hall.
Acknowledgemen of Petition - 140th Lane Street Improvement
lOTION by Ri th~r, Seconded by Holasek, that we adopt a Resoltuion acknm,rledging the
Petition receiVed from residents of North\~oods Addition regarding proposed Street
and storm seweJ construction and that this petition be placed on file. Carried
unanimously.
l-IUD Floodway Plan
Engineer Kasma ~xnlained the lITID Flooch~ay Plan and how it would pertain to the City
of Andover. Fl odway line has to be established for the City. Cost will not exceed
$800. Public h~arings, etc. will be necessary to establish new zoning along the
river. This WTl establish possible need for flood insurance for residents in that
area.

Senior Citizens Assessment Deferral
Attorney llawkin explained the program, revimved the attached sheets of cost figures,
and told hmv th s has been handled in other cities. To determine what affect this
would have on t le City of Andover the nubmer of senior citizens involved will have to
be secured, pos ib1y from Ule County, and possibly utilizing services of the Fiscal
Agcnt.

~OTION by Irindschitl, Seconded by VanderLaan, that the Clerk obtain the information
trom the County offices as to the numbers of senior citizens in the urban area and
also inquire of our Fiscal Agent whether he Ivould be willing to provide us any
services as far as doing some projections or some of the calculations that Ivou1d be
required. Carried unanimously.
Attorney Hawkins informcd the City Council that a La1v was passed this past session
that gives the municipalities authority to defer on unplatted land also.
Green Acres - Petition
This petition is for concrete curb and gutter rather than the bituminous bfrm as
originally contracted for. Engineer Kasma explained that the contractor can still
complete this project this fall with Concrete Curb and Gutter if 1~e can let them
know immediately. Prices would go up again next spring if we wait. He reviewed
increased costs for the concrete curb and gutter. There is some question as to
l~hether this can be accomplished by Change Order. This IvÍll be checkcd by Engineer
Kasma and reported at thc Public Hearing.

~OTION by 1Vindschitl, Seconded by Schnedier, that we hold a Public Hearing for
concrete curb and gutter in thc Green Acres Addition, to be held October 5, 1976,
at 7:35 p.m. at Andovcr City Hall. Carried unanimously.
Unit sewer assJssment charges were reviewed again by Engineer Kasma.

Amendment - Ordinance 8A
lOTION by Vande~Laan, Seconded by lIolasek, for adoption of Ordinance 8B as recommendcd
by the Platmin~and Zoning Commission August 27, 1976, to revise Ordinance 8 - Zoning
Rcgulations, S scction 404, Lot Provisions A, Change the IvOrd "or" to "and" and
that also Ordin~cc A be changed, Subsection 302, Definition, Item c, Agricultural Use
Rural, Change tpe first line: "to an area of 5 or more continuous acres"; and to
Amend Item d, Definition: Agricultural Use Urban, Change the first line to read;
"an area of lest than 5 continuous acrcs. Carried unanimously.
City Parks/Alcololic Bcvcrages
City Council re~iewed the recommendation from the Park Recreation Commission. It
was felt after þome discussion that it would be very difficult to interpret excessive
use of alcohol .~ the parks and Attorney Ha1~kins feels that the Disorderly Conduct
Statute and oth r Ordinances could hc used if it was felt necessary. Councilperson
Rither feels th t it should bc shown in the record that after discussion on the part
of the City Council and conferring l~ith the City Attorney, it has beendbtermined that
outside of comp ete prohibition of consU1tion of liquor in our parks, we at the
present time ha e sufficient controls to govern the conduct which is being addressed
by the Park/Rcc eation Commission, within thc limitations of the State Law, unless
they would want to make a recommcndation at some future datc that we do not allmc
liquor at all.

Date/Budget Meeting:
~OTION by VanderLaan, Seconded by Irindschit1, that the City Council meet to discuss the
budget on Tuesday, October 12, 1976, at 7:30 p.m. at Andover City Hall. Carried unanimously
Public Works Vehicle
After discussion it was felt that the recomnendation for a station \v::t:,;on for a second
vc1Ücle would be the best type vehicle to buy.
¡IJTIO:~ by Ri ther, Seconded by VanderLaan, to direct the Staff to obtain quotes on
a stationway type vehicle, intermediate size, to be used for the City of Andover and
that they obtain the lowest possible price within the limitations set I>y State Law
and that they return to the City Council with a proposal for our action. Carried
unanimously. .
Payr.¡ent of Claims
~ raTION by Ri ther, Seconded by 1'Iindschi tl, to approve payment of claims from the
General Fund, Checks :10. 842 thru 878 and 879 thru 900 in the amount of $24,492.32;
from Improvement Fund 75-1, Checks No. 149 and 150 in the amount of $81),055.11; and
from Improvement Account No. 1976, Checks No. 118 thru 122, in the amount of
$34,333.88. Carried unanimously.
