Schneider on May 18, 1976, 7:30 p.m., at the Andover City Hall, 1685 Crosstown I Boulevard N.W., Anoka, Minnesota. Lynch Grace Lynch, C~ity Action Program, gave a brief description of the winterization program in Ano County. Families with an atmual income of poverty level and people leving on Social Security are eligible for this winterization program which will save money and will tlso save fuel. She asked for the cooperation of the City Council and tie City of Andove to Ilelp publicize the program, and help locate the people who may be eligible for tJe program. ~ JTION by Holasek, seconded by VanderLaan, that the City of Andover should cooperate in any way poss~ble to help publicize the program, including having it published in the next newsletter, and help locate residents who may be eligible for the program. Motion carried ~animOUS1Y. Regular City Council lreeting - ~åy 18, 1976 Minutes - Page 2 , Robert Pears - Special Use Permit I~. Pears Ivishes to add salvaging of cars to his present operation. His request for this permit ~~s been turned down by the P & Z Commission. It is the opinion of the City Attorney that there are not enough legal grounds to turn down the issuance of this special use permit. It would be very difficult to prove that another salvage yard Îl that area would decrease the property value. The fencing and planting of shrubs around the salvage areas was discussed and Hr. Pears has always complied with all requests made by the City. , I ~nTION by VanderLaan, seconded by Rither, that the Special Use Permit for Robert Pears be allowed in that the City Attorney indicates that the City Council should allow this Special Use Permit for Robert Pears in that the applicant does not substantially violate criteria of the Special Use Permit Provision. One, reference P & Z recommendation April 30, 1976, is invalid in that supply and demand are not criteria for issuancecf a special use permit; Two, ~~. Pears has complied with all prior demands of the City regarding the ~ontrols of his operation. Road ~åintenan¿e Contract - Kraabel Construction Present contra¿t expired April 30, 1976, and it is possible at this time to get bids on future road 'maintenance. ~Ir. Kraabel's increased prices were reviewed and in the following discussion it was decided that equipment that was always kept in good repair and availability were very important factors. ImION by HOlaJek, seconded by Schneider, that we accept the quote from I~. Kraabel and renew the contract for another year retroactive to April 30, 1976, running until April 30, 1977. I In the discussion that followed it was determined that the contract wording should be updated. I ~Iotion was withdrawn by Holasek. InTION by HOlas~k, seconded by Sclllleider, to direct the City Staff to make the necessary changes in the contract to update it and present it back to the City Council at that time. ~n the interim the current contract ~~uld be extended for two months until June 30, 976, with the understanding that any increases approved by the new contract ~uu1d be retroactive to April 3D, 1976. Orttel stated that there are many problems with the plat; soil condition, etc. and it will not be approved in that condition. ~OTION by Rither, seconded by Windschitl, to refer the further consideration of the E"arnes Rolling Oaks preliminary plat back to the Planning and Zoning Commission for further consideration. ~btion carried unanimously. i , Sanitary Sewer: Project i Engine Kasma reviewed the areas put up for bid and the estimates that were given previously. Bids came in lower than the projected estimates. ': Financial Consultant Forness reviewed the conventional financing that will be used as FHA does not have money available at this time and there is no guarantee that funds will be available after the beginning of their fiscal year, October 1, 1976. The interest rate is being estimated in the 6.65 range and the total bond issue will be $1,450,000, for 20 years. This is no enormous by todays standards and there should be no problem selling these bonds. ~ÐTION by Vand~rLaan, seconded by Rither, to direct the staff to pre~e-a-resolution awardIng tQe bids to Northern Contracting Company in the amounts of ~~~2.3b:ànd ~$327,560.15'for Sanitary Sewer Projects 1976-lA and 1976-lB respectively an~d1rect the City Fiscal Agent to begin proceedings for the bond sale. Motion carried) Financing of AJrial ~Iapping, Storm Sewer Study Benefits will ~e received from aerial mapping and storm sewer plan for all future storm sewer plans and projects, also street design, etc., and on that basis there should be no problem including it as part of the Storm Sewer Project. Assessment hearings can b1 held next fall so the assessments can be included on the 1977 tax roll. Five minute break - 9:20 Eldorado streetl and 166th Avenue N. He is proposing a turn around, culvert, ditching and gravel to bring the road up to standards. Engineer Kasma recommends that the City Council ask the staff to research thei past action by the Town Board and developer to provide them with the background information on which to base a decision on the responsibility for the needed construction. He also reviewed the four recommendations set out in his letter. She would object to this street becoming a City street and being widened and improved. ~VTION by VanderLaan, seconded by Rither, that they direct the City Staff to research past action by the TOWn Board and developer to provide the City Council with all background information on which to base a decision on responsibility for needed construction. i i , ~btion carrie~ unanimously. ~6AH Prairie Road Project , , Engineer Kasw~ gave a brief report on the Prairie Road project and summarized his letter dated Hay 18, ~976, which gives reasons for construction and time schedule. i Resident, Doug Steele, 140th and Andover: County has thoroughfare going straight North (Hanson Boulevard), within a mile of this proposed highway. Is very much against this typc of road through this area as he feels it would destroy trees, yards and gcncrally not be desirable for anyone living along the road. lie will make this project as costly as he can by taking the City to Court and whatever else he can do to delay it. i , Resident, Bob Nehring-, Prairie Rd: /lis yard will be decreased considerably by the construction of this highway. Engineer Kasma1pointed out that they will work with the people and they will put in Urban Section (no ditches, just curb and gutter) if this is preferred by the residents and a possibility from the drainage aspect, etc. Added cost of Urban Section would be assessed to the land rnvners. I ~VTION by Rither, secondcd by IVindschitl, that we direct the staff to prepare a resolution authorizing the firm of TKDA to prepare the preliminary plans and feasibility study for Prairie Road construction from County Road 116 to County State Aid Highway 18, said preliminary plans and feasibility study to be presented at a public hearing to be held July 6, 1976. Vote: Yes; scJneider. Vanderlaan, Windschit1, Rither - Present; Holasek, because he is effected byjthe project and for this same reason has not expressed an opinion one way or another only asked questions. ~lotion carried. State of mtmesota Bridge Replacement Program Engineer Kasma Ireviewed recommendations that were presented to the City council by letter dated ~~ 11, 1976. They feel it is the best interest of the City of Andover to proceed wit the bridge replacement program at this time. ~loney from the State will be given on a "¡first come, first serve" basis and is a 10 year program. Final plans and specifications for the bridges will cost $10,000 which Ivill come out of State Aid Funds. Enginee~ Kasma felt that if the bridge replacement program does not go, arrangements could be made for deferred billing, as the City of Andover does not have money available' for further Engineering costs. , i Councilperson VanderLaan suggested that this be placed on the agenda for the next meeting and in the mcantime Engineer Kasma can provide us with the materials and answers to the questions from the City Council. Heath, Jonquil, 133rd, 134th, Arrowhead, (;Iadiola, 135th Lane, and Horthwoods Streets Engineer Kasma briefly reviewed the street projects and stated that it would be possible to have public hearings and talk about them all the same night. ~OTION by VanderLaan, seconded by Windschitl, that the City Council accept the feasibility study for storm sewer and street construction on 134th Avenue N.W., 133rd Lane N.W., 134th Lane N.W. and Arrowhead Streets and that a public hearing be held on Tuesday, June 8, 1976, at 7:30 p.m. at the Andover City Hall. ~btion carried unanimously. ~OTION by Rither, seconded by Holasek, that we accept the feasibility report on storm sewer and street construction in the Meadowcreek Additions and that we authorize a public hearing, on said project on June 8, 1976, at 7:30 p.m. in Andover City Ila11. I ~btion carried'unanimously. , MJTION by Rith~r, seconded by Holasek, that we direct the staff to prepare a resolution to accept the feasibility study on storm sewer and street construction on Gladiola Street N.W., 135th Avenue N.W., and 135th Lane N.W. and authorize a public hearing to be held June 8, 1976, 7:30 p.m. at the Andover City Hall. ~btion carried unanimously. ~OTION by Rither, seconded by l~indschit1, that we direct the staff to prepare a resolution accepting the feasibility study for street construction in Northwoods Addition and that the pUblic hearing on said improvements be scheduled for June 8, 1976, at 7:30 p.m. in Andover City Hall. ~btion carried I unanimous ly. 76-1 Easements City A-torney I awkins stated that there are three individuals he contacted regarding easements for sanitary sewer - Willis Olson, Tom May and R. Przezdziecki. Final agreement was reached with two of them on settlements for gardens which would be disrupted fdr this year and trees which would have to be removed and tentative agreement was reached with the third resident.
