Minutes of 6-1-76 Carried unanimously Ward Lake DrivJ Maintenance i Larry Eros, 15535 Prairie Road - Works with fellmv who lives on Ward Lake Drive and was told that the proposed road development project was going to be changed from Prairie Road to Ward Lake Drive. (No change in the road work project, plan is ,to start from County Road 18.) At the meeting on Prairie Road the two objections came from one fellow who has his house up for sale and the other from a fellow who owns open land. Felt that only people against the propose~ road development had been asked for their opinion. (It was every intent to make it clear that anyone Ivho had something to say was invited to speak.) I i Engineer Stoclavell reviewed the letter dated June 14, 1976. HJTION by Winds hitl. seconded by VanderLaan, to approve the two items that have been suggested by th Engineer, to do tIle scraping anù grading including watering at $1,000 and to gravel, ith Class 5, the unstable areas at a cost not to exceed $800. Vote: Yes; Rit er, VanderLaan, Windschitl - No; Holasek, as he does not feel this will help the dust p oblem - Present; Schneider, as he feels it should be included in rt~~ development at his time. ~btion carried. EV Builders Var ance Wilfred Ì3earl1y -: Is fairly sure the house was built in 1971 and the survey was taken in 1972 at which time the mistake was discovered. Settlement has been reached with the neighbors to change the lot line. Regular City Council Heeting June 15, 1976- ~ünutes Page 2 Attorney Hawkins stated that this will not be one lot but l~ill be on one deed and will have Vvo legal descriptions. H)TION by VanderLaan, seconded by Ri ther, that the City Council approve the variance of EV Builders for the following reasons: In the opinion of the Attorney failure to grant the variance will create an unneccssary hardship with respect to a substantial property right of the =er, that the granting of the variance does not interfere with the purpose of Ordinance 10, does not interfere Ivith street patterns, will not create a buildable lot and if the variance is not granted, in the future the house may have to be removed. Carried unanimously. Robert Snyder Variance City Council has information pertaining to this variance from the Planning and Zoning Commission. Robert Snyder, I 167th Lane N. W. - Would like to purchase 8.3 acres to add to his existing parcel on which his house it located. This additional property is for more room, privacy and garden area. None of the property fronts on a public road and the person convcvin~ this propertv is .Jack E. Neuman. . I ,. . , Attorney Hawkips cited letter from Attorney Gencral questioning whether cities have the authority ~o limit size of parcels to 20 acres. He feels as long as this is simply moving a lot line and not creating a new parcel, it should bc granted. ~[)TION by HOlakek, seconded by Schneider, for reasons cited in the Planning and Zoning Recommendation 576 and that he is not creating a parcel, just moving a lot line. and that this will be combined under one description. (This should be put in the form of a resolution prepared by the staff.) Carried unanimbuSlY. Country Estate - Preliminary Plat Leonard ~lcLaug lin, 1022 Adams Street - Has to decide if they will go ahead Ivith the plat as proposed, depending upon Imat Ivill be required in the way of Streets ~'T' Discussion fol owed on this preliminary plat and how assessments would be handled. Norm Houim,' Houim & Associates - Described as fol101~s: Lot 1 has entrance onto J Street, Lct 2 is an existing house which at the present time is in the set back line; Lot 3, commercial with common drive beúveen Lots 3 and 4 coming off Bunker Lake Blvd. (cleared with County); and Lot 4 has entrance off Hanson Blvd. at this time. Lot 4 is 'large and separated by NSP easement, can build on either side of ease- ment. Ten acre tract for general business divided into four lots, with 70 foot set back for possible future service road. In the discussion it was determined that the service road easement should be secured at this time and it was suggested that this be sent back to the P & 2 Commission. ~VTION by Holasek, seconded by Rither, that the City Council refer this back to the P & Z Commission for I possibility of looking to requiring easement or construction of a service road. Carried unanimously. Forest Meadows - Final Plat Attorney Hawkins stated that everything is in order on this final plat. One thing has been added that has not been used before, as stated in Article 5, we have requested guarantee on stability of work performed but have not asked for Surety Bond. A Surety Bond would assUre money for repair of a road if it breaks un in the first year. Mr. Carlson Sii:ed and turned in the certificate of deposit. \VTION by Wind chitl, seconded by Holasek, for approval of final plat of Forest Headows, and gye the Mayor and City Clerk authorization to enter into a development contract. Lion's Club Beer License Thomas Pahl, An~over Lions Club - Requesting license for July 30, 31, and August 1, 1976. The fee shall be $10.00 and beer will be sold from the concession stand located at 1685 Crosstm~ Boulevard. Vote: Yes; Rither, VanderLaan, Windschitl, Schneider - No; Holasek /lotion carried. The State Building Code leaves a good part of is to the discretion of the individual city. Previously this has been left up to the piscretion of the City Building Inspector, so he can require a permit for work that wrl be performed if he feels it is necessary. There is an appeals provision in th Building Code if a resident feels the permit is unnecessary. Discussion followed on the difficulty10f waiting for adoption of this ordinance as it was to be put into effect because of the delay in the Comprehensive Plan. ! , ~DTION by Windschitl, seconded by Holasek, that we Table Item 5.b. until the July 6 meeting. Dog Ordinance No. 36 There \Vas discussion on the dog tags now used as they are very light weight and do not last very long: , 'DTION by Rither, seconded by Holasek, that this Ordinance regulating the licensing of dogs in the City of Andover be referred back to the Planning and Zoning Commission for reconsideration of the type and manner of tag to be affixed to the animal and that they also give I consideration to a revised schedule setting fees, which Ivould be based on the number of animals kept in each kennel. Position \OYION by Holasek, seconded by VanderLaan, that we direct the City Staff to provide the County with items necessary to assure the City of Andover one full time C.E.T.A. paid employee. i Carried unanimously. , I Clerk Treasurer Resolution/Expenditure Authorization i HJTION by Rither, seconded by Holasek to direct the staff to prepare a resolution regarding the 76-1 Project, to amend Section 7 to read: The Clerk Treasurer shall have the authority to make Purchase Orders for routine equipment costs not to excecd $500, with thc' exception of the Road \Iaintcnance Contract, which amount is not to exceed $1500.
