Schneider on July 6, 1976, at the Andover City Hall, 1685 Crosstown Boulevard N. W., Anoka, }·ütmesota. Councilpersons present: lIolasek, Ri ther, VanderLaan, Windschitl Councilpersons absent: None Also present: City Attorney, William lIawkins; City Engineer, DClvey Kasma; City Clerk, P. K. Lindquist; and residents Agenda Approval ** }ÐTION by Rither, seconded by VanderLaan, to adopt the agenda with the following changes: Add: 4e. Change Order on Sanitary Sel~er Project 75-1 Add: 5c. Interim Ordinance Amendment by VanderLaan, seconded by Rither, that under 5c, Interim Ordinance we agree to discuss whether or not l~e want to send a letter on the possibility of obtaining funds for planting greens ,and Attorney K~~kins suggested that also under the Interim Ordin31lce the Russell Addition be discussed. I Barnes Rolling Oaks - Preliminary Plat ** Brad Wicklund, !answered questions asked by the City Council on this preliminary plat. All portions north of Phase 1, as well as Phase I, were put into one parcel, which Ë approximately ~5 acres. TIle $3,699 is the correct figurc to be uscd. TIle road will be constructed from Ever$f)en' approximately 316 feet in 1eng~1. It is ~greeable to thcm to pay fo whatever SIgnS are necessary. When the queStlon of the Increased setback came up, Brad Wicklund produced two copies of another plat which shmved the future service road easement. A 36 inch culvert will be constucted in University Extension so the drainage will involve Hamm Lake and the Coon Creek Watershed. A pennit will haw to be obtained from Hamm Lake for the culvert. They will clean the ditch from 146~ Lane to the Eastern edge of the development. ~ÐTION by Winds chit 1 , seconded by Schneider, to approve the preliminary plat of Barnes Rolling Oaks anU incorporate the P & Z recommendations and in addition require the dedication of t e service road as Item 1; Item 2, posting of a bond for the construction of the culvert n University Extension; and Item 3, normal approval of lIamm Lake of the drainage pI . I Regular City Council Heeting July 6, 1976 - ~linutes Page 2 Councilperson VanderLaan feels this is very irregular as this is being treated differently in that at the last meeting we sent back to Planning & Zoning Commission a particular plat with the identical problem of the service road. Vote: Yes; Windschitl, VanderLaan, IIolasek, Schneider - No; Rither ~ otion carried Pankonin Addition - Preliminary Plat ** The same map was brought to this meeting as they brought in before but the service road would be dedicated on the plat except across Lot 2" which has a house on it now. The service road would he dedicated, but not huilt at this time. ~ÐTIO~ by VanderLaan, seconded by Schneider, recommending Pankonin Addition Preliminary Plat, per recommendation from the P & Z Commission, dated June 29, 1976. Carried unanimously Quinn Street/Nightingale Street Extension ** Engineer Kasma 'explained the results of his investigation of this possible extension. He first talked to Ralph Van Heyning and he Ivas opposed to any kind of street construction. He then talked ;to Mr. Henkveld and this type of construction would be satisfactory to him. Engineer Kasma ,is not recommending Blacktop or sewer at this time. Northwestern Bell is l~illing to buy their share of the right-of-way and this could be negotiated at the time of purchase. After discussion it was determined that the P & Z Commission should review this to ¡see how it l~uld fit into the future plan for extension of facilities into the area. ~ÐTION by VanderLaan, seconded by Rither, that the City of Andover accept the feasibility study dated June 25, 1976, for Quinn Street and Nightingale Street extensions in the Red Oaks area and that action on the issue be postponed indefinitely. Carried unanimolslY. 1976 Street prJgram - Final Plans ** Engineer Kasma ~eviewed this program starting with 134th Lane,134th Avenue, 133rd Lane and Arrowhead Streets and explained the minor changes that had been made in the plans for tis project. The next prOje~he reviewed was Green Acres, blacktopping, 32 foot streets with blacktop roll t e curb. Carrol Abbott, 917, l42nd Lane - Concerned about the curbing, having it ripped out by the snowplm and who would have to maintain it. (The snowplow Ivill not cut close enough to take ut the curb, and the City does have to maintain the street.) Regular City Council Meeting July 6, 1976 - ~linutes Page 3 The last area reviewed by Engineer Kasma was Northwoods, l~hich does not require any action by the City Council. ~UTION by Rither, seconded by Holasek, to direct the staff to prepare a Resolution accepting final plans and specifications, to direct the City Clerk to advertize for public bids on the 1976 street Program on 133rd Lane, 134th Lane, 134th Avenue and Arrowhead Street N. W. and in Green Acres. Carried unanimously. Keller Construction Company Extension ** Engineer Kasma explained that they have a request from Keller Construction Company for an 8 week extension and they are reconunending a 4 week extension. He does not feel they should be given an 8 week extension at this time, is recommending 4 weeks and will come back for more time if it is necessary for the cleanup work and yard restoration. ~UTION by VanderLaan, seconded by Rither, that VIe City Council approve the Change Order from Austin P. Keller Construction Company regarding 75-1 Sanitary Sewer construction project for an extension of time for a period of 4 weeks. i i Carried unanimously. I Hevision - Ordinance 8, Section 4.04 ** This revision Jill change wording in Section 4.04 in the lot requirements. ~UTIO~ by RithJr, seconded by VanderLaan, that the City refer to the P & Z Commission for Public "ear~ng and recommendation on amending Ordinance No.8, Section 4.04 to read "A lot or I arcel of land upon the effective date of this Ordinance which is a residential district and which does not meet the requirements of this Ordinance as to area, width, and other open space may be utilized for single family detached purposes provided the m~asurement of such area, width and yard space are within 60% of the requirements 01 this Ordinance." Ron Rahmatm, Coon Rapids - 11hat will insure that the resident will actually measure his system to df~terminc if it needs to be pumped. (Residcnts must certify that this has been done, fmd names and addresses of those pumping must be furnished, Also the person doing the pumping will have to secure a permit.) i Regular City Council Meeting July 6, 1976 Page 4 Doug Steele, 140th Lane N. Ir. - Feels it will cost some residents too much money to dig up their system and do this measuring because some are very deep. (In these cases, just make sure they are pumped at least every 4 years.) In the discussion that followed there seemed to be a great deal of controversy about the length of time a septic system would last without being pumped. Mary Kay Ráhmann, Coon Rapids - Does not feel forms should be sent to all residents, just require the pumping. Carol Abbott - Has a neighbor that has a tank that has been running on the ground for 2-1/2 years, made many calls and got no results. (City sewer will be going through there shortly.) mnON by VanderLaan, seconded by Rither, proposing adoption of the Private Sanitary Sewer Ordinance to become Ordinance No. 36 of the City of Andover. Engineer Kasma stated that the form to be sent out can be revised and he read from 7a. page 2, Property OI~er who has on site septic system shall on biannual basis file inspection report... This can be modified to read - Property owner has the option of mandatory pumping every 4 years and will not have to make measurement, report could still be filed. ~DTION by Windschitl, seconded by Schneider, to table this item until we have a chance to have Engineer Kasma rework Section 7 dealing with maintenance and Council and Attorney are furnished copies of the changes. i l~ally ATItZen,le 5 year guarantee on a septic system is with the stipulation that it be pumped eve year. Vote: Yes; Rither, VanderLaan, Sc]meider - No; Holasek - Present; Windschitl Councilperson Holasek voted no as he felt the council felt there was no need for an Ordinance at the last meeting so he came to the conclusion there was no need for one tonight. Councilperson Windschitl trys to stay away from voting on items that may impact him directly or indirectly, but in this case he changed his vote to a YES. ~Iotion carried. ~DTION by VanderLaan, seconded by Schneider to amend Section 4 - Scope of Control, Ordinance No. 35, to read, "Neither the Planning Commission of the City or the City Council shall grant any preliminary or final approval to a subdivision plat, site plan, or rezoning unless it has been filed with the Clerk's office prior to July 1, 1976." Carried unanimously. Attorney Hawkins explained his findings on the Russell Addition. He fee Is that all lots that are not lots of record, would fall under the Ordinances of the City of Andover 1 f'I'\',o- -; 0 fJ[;-V n! /.:"" Ron Rahmann, cJon Rapids - Purchased his property on a contract for deed and has a construction contract but cannot start until they have a decision from the City Council. I ~Ir. Russell stated that these lots have not heen recorded, had assurance from the City of Ramsey 'and had the variance. Has no Ivritten agreement to convey dated I before November: 12, 1974. The City councJl determined that this could be referred to the P & Z Commission for their reconunendation on the variance for Mr. Rahmann and a determination on the total situation. Th~ could be placed on the P & Z agenda for next week and the one lot could be acted n at that time.
