The Regular Bi-~bnthly ~æeting of the Andover City Council was called to order by
~byor Richard J. Schneider on ,July 20, 1976, 7:30 p.m., at the Andover City Hall,
1685 Crosstown Boulevard N. W., Anoka; Minnesota.
Councilpersons present: Holasek, Rither, Windschitl
Councilpersons absent: VanderLaan
Also Present: City Attorney, William Hawkins; City Engineer, D. R.
Kasma; P & Z Chairman, Ken Ortte1; City Clerk, P. K.
Lindquist; and others.

MSAH-Prairie Road (Informational)

No notices were sent out to residents regarding this informational hearing as no
costs will be assessed. Engineer Kasma would like to have this item put on the
agenda for the next City Council kæeting as he will have additional information at
that time. Engineer Kasma presented maps shrnvin? the proposed right-of-way with
consideration that has been taken for trees and other obs~les. One short area
is being propos'ed as urban section, which would probably requires some form of storm
sewer. Proiec~ costs were reviewed.

Doug Steel, l40th Lane - Questioned the possible storm sewer and where the drainage
would be going.] (Engineer Kasma - FÏnaf determination has not been made but the
obvious place would be the creek.) Would it be possible to move the hridge to the
East when it is~rePlaced. (The hridge will be moved to the East and will eliminate
some of the roa easement problems where houses are very close to the road. Asked
about speed li '. t through the proposed urban section of road. (Checked with the State
and the speed l'mit will be 50 mph.)
Engineer Kasma lans to meet with Ble people involved to show them what is proposed.

ANard Bids - Street Projects (75-lC, 76-4,5)
Engineer Kasma reviewed the bids received for the street project on 133rd Lane, l34th
Avenue, 134th Lane and Arrowhead, and the hreakdown of the actual costs of streets
and storm sewer. Price of asphalt has dropped so this project is costing less than
anticipated.
'ÐTION by Windschitl, Seconded by Rither, to award the contract for l33rd Lane, 134th
Avenue, 134th Lane and Arrowhcad Street to Northern Asphalt Construction Company in

Green Acres project Ivas also reviewed by Engineer Kasma. Three bids were received.
Northern Contracting will do the street excavation and this will be done by a Change
Order to them. llardrives will comc in and lav the blacktop. This bid is more than
anticipated because of the amount of dirt that has to be moved.

'~TION by Holasek, Seconded by l1indschitl, that in regard to 75-lC, Green Acres
street construction, Commission No. 6473 that the City award the contract to the low
bidder, Hradrives, Inc. in the amount of $43,135.70 and they also approve a Change
Order No.3 to iorthern Contracting in the amount of $14,640 for the extra excavation.
Carried unanimously.
Engineer Kasma þxplained that the Northwoods Addition project will be done on a
Change Order basis rather than going out for bids. Northern Contracting has been
contacted. I .

Northwoods Additon, 76,-5, allmving additional 22,60 for street construction.

KcsolUtion, by the City of Andover City Council that in accordance with Ordinance No. 10
Section 14.02, the requirements of said Ordinance are hereby waived and the variance
approved." (Copy of complete Resolution attached)
Councilpersoll Rither stated that the reason for the lengthy Resolution is that he feels
all of the matters of fact should be entered into the record so that there is no question
as to the chain of events that occurred prior to the Incornoration of the City of
Andover.
Carried unanimously.
Variance - Ronald Rydh
~lrs. Ronald Rydh - TIley wanted to sell 2-1/2 acres to one of their children and are
told they cannot due to City Ordinance.
Discussion followed regarding the Odinance Ivhich prohibits conveying 2-1/2 acres of
land.
. '-}[)TION by Rithcr, Seconded by Schneider, that based upon the reconunendation of the
City Attorney in a letter dated June 16, 1976, and the reconunendation of the Planning
and Zoning Commission dated July 12, 1976, that the application for the variance from
the requirements of Ordinance 10, of Ronald I. Rvdh dated Junc 3, 197(" be disapproved.
After some dislsion Attorney Hawkins suggested that some of the reasons for dis-
approval should be given.

Councilperson Rither amended his ~btion to include tlle rcason,that it has not been
shown that an unnecessary hardship will occur and that granting of this variance could
have an adversel effect upon the purpose and intent of the nlatting Ordinance and that
the nlatting Orµimmce is designed to allow the City to revielv all such subdivision
of land in order to insure the early development, extension of streets, roads, etc.

Mrs. Rydh thcn ked if it would be possible for them to sell their children 5 acres
of land. Attorpey Hawkins told her that this is possible and they will not need
City Council Action to do so.
Councilperson ¡Jindschitl requested that the City Attorney give the City Council an
interpretation ~f the Ordinances in question so this type of issue will not be so
confusing in th future.
Vote: Yes; Win~SChitl, Rither, - Present; Holasek (as he feels Ordinance is too
restrictive - SChneider abstained as he felt it was not fair to landowner, is too
restrictive. ~s would defeat the motion so Mayor Schneider and Councilperson
Ho1asek both ch ged their vote to YES.

Final Plat - Pankonin Addition
Attorney liawkins stated that this could be approved subject to authorization from him
that the title is clear.
~mION by Windschitl, Seconded by Holasek, to approve the Final Plat of the Pankonin
Addition, subject to the receipt of written opinion from the Attorney that the title
of the property is proper.
Carried unanimously.
Final Plat - Barnes Rolling Oaks - First Addition
No one was present at the meeting and the fees have not as yet been paid. This may
be due to the proposed culvert on University Extension, which 11r. Barnes was requested
to pay for.
Easement - Tom lIay
Attorney Hawkins reported that his proposed amount of $1475.00 for Torn /.lay for the
easement is going to have to be revised. Mr. May is asking more µ for some of

,VTION by Wind~chitl, Seconded by Rither, to approve the additional expenditure of
$350.00 for the purchase of the easement on ~1r. Thomas Hay's property.

the County Resolution 37-76 and request that the City of Andover be included in the
program to be aliministrated by the County.

Non-Intoxicatinl!! M:llt Liquor License - St. Patrick's Olurch
~VTION by Rithe~, Seconded by Irindschitl, that a temporary On Sale Non-Intoxicating
~hlt Liquor License be issued to St. Patrick's Olurch for August 21, 22, 1976, at a
fee of $10.00'1

of the City C1e k dated July 16, 1976, Rae Ellen Bakke be employed by the City of
Andover as a full time Clerk/Steno at an hourly rate of $3.75 with a starting date
of August 16, 1976.

Meeting Date - Building Inspector/Assessor
~PTION by Rither, Seconded by Windschitl, that we set a meeting date of July 28, 1976
at 7:30 p.m., Andover City Hall to consider the follO\ving three items:
1. Hiring of Building Inspector/Deputy Assessor
2. Amendment to Persotmel Benefit Resolution
3. Setting rate of pay for election judges.
Councilperson Rither than added - simply include any other items which in the
opinion of the City Clerk, should be acted upon by the City Council.
Carried unanimously.
Weed Cutting
City Clerk Lindquist reported that the City of Ramsey hires a retired farmer to cut
their weeds.
~OTION by Rither, Seconded by HOlasek, to direct the Staff to find someone to do this
job for the City of Andover, and come back, if it exceeds the limitation, with a
recommendation that the City Council could act on.
Carried unanimously.
Attorney Hmvkins will check on the maps and report back to the City Council.
Address Changes/Auditors Suhd. 82

City Clerk Lindquist explained that the numbering in Subd. 82 is a complete mess and
in order to straighten it out they should start over and completely renumber.

I.OTION by Rither, Seconded by Windschitl, that the City Council concur Ivith the
recommendation [; the City Clerk and that the Staff be directed to resolve the
inconsistencies in the address numbering system in Auditors Subd. 82.
Carried unanimo ly.
Councilperson Rlther suggested putting the phone number of the Post Office on the
letter that is tent to residents so they can request change of address cards.
