Adjourn ent l CITY 01 ANDOVER REGULAR CITY COUNCIL NEETING - APRIL 6, 1976 MINUTES The Regular Bi-Monthly Meeting of the Andover City Council Was called to order by Mayor Richard J. Schneider, April 6, 1976, 7:30 P.M. at the Andover City Hall, 1685 Crosstown Blvd. N.W., Anoka, Minnesota. Councilpersons Present: Holasek, Rither, VanderLaan, Windschitl Councilpersons Absent: None Also Present: City Engineer, D.R. Kasma; City Attorney, Ed Babcock; Acting Administrator, Patricia K. Lindquist and a full audience. PUBLIC HEARINGS HEATHER STREET SANITARY SEWER EXTENSION Mr. Kasma explained the proposed extension of Heather from l42nd Lane, north to South Coon Creek Drive, at a cost of $40,000. He then gave a breakdown of the cost: 1,500 feet of developable frontage at $16 a foot is $24,000; 15 stubs at $300 each is $4,500, totaling $28,500 in assessments with the balance coming from future connection charges. The bulk would be assessed to adjacent property owners. The utilitiea should be in prior to the MSAH. i Pam Quinlan - 2934 South Coon Creek Drive - stated that they are ~ family living on the east side of the road. The $20,000 would be assessed to them alone and whoever owns the property on the west side. TIle road will come next and;will force them to sell. They can build many homes on their 47 acres which will effect everyones lives. ~~y has Dahlia not been built yet? You are proposing another road and you haven't built the first one yet. I (Engineer Kasma - Because of the peat underlying the top soil. Extremely , expensive to dig it out.) I Pam Quinlan - Is there an option to build the sewer line somewhere other than our property? What about extending Heather the other way? I (Kasma - ¡That is what this hearing is for, to determine if there are alternatives or if an alternative is necessary. It seemed logical to provide another exit in that area. Extending Heather the other way is out because of existing homes, school property and unstable soil conditions.) The ~ayor stated that Mrs. Blanche Gallant, property owner of the west side of South ¡Coon Creek Drive, had phoned him and said she was very much against the extension of Heather. I Michael Quinlan, 2934 South Coon Creek Drive - If the assessments only go to two property owners, do I then assume that when the sewer comes down South Coon Creek Drive I will not be assessed for it againi (Kasma - The policy being considered by the City Council at this time is that you would not be assessed for the first corner lot.) John Nord. 14216 Heather Street - The sewer extension Was originally planned one block west of where it is right now, why Was it changed? (Kasma - Because they would be going through someones house. It was the logical place to go.) Rick Pas he. 2950 - l42nd Lane NW - Wouldn't it be cheaper to remove one home, one block west, than to run so much additional sewer linel (Ka~a - Hore expensive to remove a house.) Carol Abbott. 2917 - l42nd Lane NVI - This will only benefit developers who will develop the other side of South Coon Creek Drive. Let them pay for it when the tÍt:1e comes. HOTION by VanderLaan, second by Rither to close the Public Hearing on the Heather Street Sanitary Sewer Extension. Hotion carried unanimously. HUNICIPAL STATE AID HIGHWAYS I Hr. Kasma began by going over each point of the outline provided concerning HSAH in the urban area. (Attachment A) The Hayor then asked for citizen input. Robert HcClure, 2130 - 138th Avenue !\'1I - Hhy not drop south on Nightingale to Bunker? I I (Kasma - We have to connect County State Aid Highways. He don't intend to build any further but it must show on the plan for approval.) I Bob McClure - Leave l39th, drop down to Nightingale and provide an exit. I 14216 Heather Street - I'm the only house on Heather and this makes John Nord, no sense.1 You will be going past a playground, you will increase traffic and . I i Everything we've wanted we couldn't have and I'm sick of J..ncrease cr me. , living in, a sewer. He need sanitary sewer and this could delay it a year. The City is negligent and have many more pressing problems than routing commuters through residential areas. I John Hibbprd. 3015 - l42nd Lane ~11 - Hill a 44 foot easement allow for a 66 foot road? And what is the width of the road now? I (Kasma - Yes. Eighteento 24 feet.) I John Hibbard - First you said one criteria 1;2S having a road traffic will use and laterbyou stated it would not increase traffic in the erea. lIe bought our property ecause it's quiet and a MSAH will ruin it. I (Kesma - We're trying to get State Aid in the amount of $135,000 and we're looking for a feasible place to spend it.) John Hibbard - Sounds like a Dayton sale, you've got a person going down to buy something he doesn't need to save money he doesn't have. Regular COuncil MeetLng - 4/6/76 I Minutes - Page 3 Dan McIntyre, 2939 - 142nd Lane NW - My property adjoins Mr. Quinlan's property. We enjoy our property. With a Street and sewer and 30 new homes back there our reason for living there will be ruined. Who is the big land owner back there who wants the sewer in? (Kasma - No one we know of, that is what this hearing is for.) Carol Abbott - Checked mileage on these proposals and there is no mileage change either way. It would increase traffic. Jan Pashe, 2950 - l42nd Lane NW - Presented a petition from Green Acres and a portion of Northwoods facing Crocus. We love our area the way it is, please don't change it. Mike ~lin1an - Can't believe roads will be added when you can't maintain the roeds we have now. Arnold Sachs, 2924 - 141st Avenue NW - How ,~ide l~il1 the ditch be? (Kesma - No ditch.) Craig Rounds. 2242 - 139th Avenue ~rI - 1~at we need on 139th is another exit on to Bunker Lake Road. Consider another exit, we'll get by with the road we have. I Gary Lenzmeier, 2908 - 141st Avenue NW - Last year the price was $5.25 per foot, what will the price be this year? I (Kasma - Probably go up 107..) I We need a 32 foot road, nothing Gary Lenzmeier - Increase traffic and speed. More. I John Nord - Dahlia to relieve and divide traffic flow out of Green Acres. Put in Dahlia. I (Kasma - .soil conditions make it impractical, too expensive.) MOTION by llindschitl, to terminate any further discussion on the consideration of Ueather Street Sanitary Sewer Extension or the use of Municipal State Aid Highway monies in Red Oaks, Green Acres, or Northwoods. I It was decided to make two motions of the one. MOTION bJ l1indschitl, second by Holasek to terminate the.·project of a Heather Sanitary Sewer Extension. Motion carried unanimously. MOTION bJ Windschit1, second Schneider to terminate any further discussion on using Municipa1 State Aid lIigh,~ay monies in Red Oaks, Green Acres, and Northwoods. Hotion carried unanimously. MOTION bylwindschitl, second by lIo1asek to authorize the Engineer to prepare a feasibility report on the extension of Nightingale in Red Oaks. ~~p~ by Ho1asek, second by Windschitl to include the feasibility of Quinn as an outlet. Motion carried unanimously. CIC~\RETTE LICENSE - HOCKEY'S INN MOTION by Rither, second by Windschitl to approve the Cigarette License for Hockey's Inn. Vote: Yes - Schneider, Rither, VanderLaan, Windschitl¡ No - Holasek Motion carried. / SPECIAL USE PERMIT - SLyzag: There Was a lengthy discussion on ordinance iterpretation concerning mobile homes. I MOTION by Holasek, second by Windschitl to defer action until the Attorney can review the ordinances and render an opinion.' Vote: Yel - Windschitl. Schneider, Holasek¡ No - VanderLaan, Rither (Sufficient indicators now that what we are addressing is very much in conflict with what our , Ordinances read. But I feel that it is a sufficiently important and crucial question to have answered because of the repercussions that could be felt if we do the wrong thing. I feel we have enough information at this time.) I ROAD ACCEPTANCE - l40th LANE l~¡ MOTION by Rither. second by Holasek to adopt a Resolution accepting l40th Lane as a City Street. llotion carried unanimously. COMPREHENSIVE STORM DR!\INAGE PLAN I The Mayor cannot justify an expenditure effecting all citizens when development will be s~opped in the rural area. He proposes a plan for the urban area only. Hr.. Kasma stressed the need for this plan and the minimal cost of it in contrast to what it would cost him to do it. He said there are 1000 existing lots to be filled inlthe rural area already. Councilperson VanderLaan pointed out that the Engineer's Report stated that we have already lost $22,000 from ~~o sewer projects to credit monies to the Ariel Happing and Cowprehensive Storm Sewer Plan. l~. Kasrna stated that the Environmental Quality Council has called ~im with questions I about our drainage and that they have a reviewal right similar to the Metropolitan Council and they can require the City to conform to standards that in the end could be more expensive. The contract for the work should be ready , for the Attorney's reviewal by the next meeting. The Mayor is opposed to this City wide e}~enditure at this time. MOTION by Windschitl, second by rrither to approve the initial FHA Operating Budget of $2,500 from January 1, 1976 to December 31, 1976 for maintaining the portion of the project that will be built this year. Motion carried unanimously. Motion carried unanimously. HOTION by VanderLaan, second by Rither that the City of Andover approve the Summer Recreation Program as recommended by the Park/Recreation Commission at a cost of $3,865.· Hotion carried unanimously. SHADE TREE INSPECTOR SCHOOL HOTIO!/ by Holasek, to send Art JB1>Qrski to Shade Tree Inspector School at a cost of $15.· Motion died, nO second.. ~ere WaS some discussion concerning the Shade Tree Inspector and who it will be. Mr. Zepper will be the Shade Tree Inspector pending his acceptance of the positions offered him by the City. For this reason, the Council felt an expenditure of $15 to send Mr. Jaworski to the school would not be practical. MOTION by Holasek, second by Schneider to send Art Jaworski to Shade Tree Inspector School at a cost of $15. Councilperson VanderLaan asked if they shouldn't be authorizing Mr. Zep?ers attendance at this school.· ~ by Windschitl, second by ¡¡olasek to allow Mr. J~lorski to attend the school and if he serves the City as a Tree Inspector he will be reimbursed the $15. I Vote on Amendment: Yes - Windschitl; No - VanderLaan, Rither, Schneider, Holasek A.~endrnent defeated. Vote on Hotion: Yes - Schneider, Holasek; No - Rither, VanderLaan, Windschitl Hotion defeated. I SPECIAL HEETD'IG DATE MOTION by!vanderLaan, second by Rither that the City Council choose April 22, 1976 at 7:30 P.!I. as a Special Meeting Date, agenda left to the discretion of the Acting Administrator. Motion carried unanimously. I PAYMENT OF CLAIMS MOTION by!vanderLaan, second by Rither to approve checks #636 through #653 totaling $25,978.'34.' Hotion carried unanimously. I April 6,1976 PUBLIC HEARING PRESENTATION OUTLINE FOR MSAH SYSTEM IN URBAN AREA . 1. INTRODUCTION TO MSAH SYSTEM a) Since City incorporated and over 5,000 persons qualify for MSA b) SA allocation depends on miles of roads in City and condition of roads c) Current allocation 1 ) Construction $68,025 2) Maintenance I 2,390 Total $80,415 d) City should use funds within 20 months of allocation or penalty of $1,900 annually e) Currently have $135,000 for new construction f) City can sell bonds to do bigger projects but interest payments come out of annual maintenance funds g) Procedures for SA Project - similar to City but must conform to State Highway De partment Standards 2. ANOKA COUNTY THOROUGHFARE PLAN a) The Long-Range Plan for Anoka County (Visual Aid) b) Coordination between County and City Program 3. ESTABLISHMENT OF MSAH SYSTEM a) City began with 15.38 miles eligible for SA designation b) We proposed initial SA System based on City Staff and our judgement in 1974 to get initial allocation c) Currently conducting information hearings to determine needs and priorities for SA System 4. CRIT RIA FOR MSAH SYSTEM The JA routes must be approved by the Minnesota Highway Department based on th ir criteria. The current criteria is that the SA Street must: a) Carry relatively heavy traffic volumes b) Connect points of major traffic interest within the City c) Connect with rural roads or urban routes of Community interest and carry major traffic into ~ through a City d) Form a system of streets which will effectively serve traffic within the City e) We have traffic counts taken every two years.
