Adjournment L CITY 01 ANDOVER REGULAR CITY COUNCIL ~n:ETINr. - APRIL 20, 1976 HINlITES The Regular Bi-~Ionthly Heeting of the Andover City Council was called to order by ~Iayor Richard J. Schneider on April 20, 19 6, :30 p.m., at the Andover City Hall, 1685 Crosstown Boulevard N. W., Anoka, ~litmesota. Councilpersons present: Holasek, Ri ther, VanderLaan, Windschi tl Councilpersons absent: None Also present: City Engineer, D. R. Kasma; City Attorney, William G. Hawkins; City Clerk, P. K. Lindquist and approximately 12 residents, the majority of which represented the Green Acres, Northwoods and Red Oaks Hanor area streets. Special Discussion with William Hawkins on Petitions City Attorney William Hawkins notified the City Council ~lat ~le petitions received from residents can be acted on by the council as far as determining whether or not a feasibility 'study should be made, however, ~ley cannot rely on them for majority vote requirement as they are not clearly labeled as to specific streets they coyer. . I PUBLIC HEARING WAS CONVENED AT 7:45 p.m. - Informational, NorthlVoods Streets L1ty !:nglneer ¡Kasma stated that a letter was sent out to the property owners which pointed out the ~lree options available to them (copy attached). He feels that a standard street width of 32 feet should be established for the City of Andover. Engineer Kasma described the storm sewer project . The following Icitizens commented as shown: (Staff responses are indicated in parentheses) Dick Letming, 13930 Yukon - Why are we anticipating storm selVer, this has never been a problem, has it been voted on? (No) (Yukon would be one street t}~at would not have storm sewer). Are there any plans for city water in the near future? (No) Harold peterso~, 2644 140th Avenue - If 24 foot streets are left n~ will we be forced to put in 32 foot streets some time in the future? (No) Feels everyone along the street is happy with 24 foot and is in favor of leaving ~lem 24 feet. wide. I j Regular Council Meeting - 4-20-76 ~Iinutes - Page 2 Dean JoJmson, 2561 140th Avenue N. W. - Could city water be put in the boulevard without tearing up the streets again. (Yes it is possible) Feels they should go for the 32 foot streets with concrete curb and gutter. Bob Nelson, l40th Avenue - Questioned price of 32 foot streets that was quoted in letter. (Explanation regarding extra grading, etc.) In favor of replacing existing 24 foot surface. Special Use Permit - Steve Slyzuk Steve Slyzuk had requested a permit to park a mobile home on his property to house migrant workers. Report from Attorncy Hawkins states this permit cannot be issued and Slyzuk has at this time paid $100 trnvard sccuring this permit. Attorney Hawkins stated there are similar cases on the docket in Champlain and he will check on them, as an amendment could be made to the City ordinance. HJTION, VanderLaan, moved that the City has received a recol!D11endation from Attorney Hawkins that the issuance of a special use permit to all~ the mobile home on the property of Steve Slyzuk for use by migrant workcrs would be in violation of both Ordinances 6 and 8 and that there is no provision for ~le placement of tJle mobile home for ~le described use,therefore, the City Council will disapprove the snecial use consideration to S. Slyzuk. Seconded, Rither. Motion carried unanimously. ~mION, Winds chi tl, seconded Holasek, that the question of mobile home be referred to tlle Platming and Zoning COl!D11i ttee and be researched for a method of allmving this type of thing in an agricultural district. Vote: Yes; Schneider, Holasek, Windshitl: No; Ri thcr, VanderLaan Motion carried. ~mION, Schneider, seconded, !Iolasek, that the $100.00 paid by S. Slyzuk for the purpose of securing the permit for the mobile hom~,be refunded to him due to the fact that his request was denied. Vote: Yes; Holasek, Schneider, Windschitl, Ri~ler: No; VanderLaan Petition - Street Improvement/Jonquil, Heather Streets Engineer Kasma sewer project. I Ralph Anderson, Heather Street - Contacted Engineer's office and was told he could proceed with pctition and they Ivould go ahead without Jonquil âIld nmv it seems anothcr study Hill have to be made. He feels as long as petitions are signed by ~le majority they procecd as soon as possible. Engineer Kasmk gave background on feasibility study and stated they would try to incorporate all three projects if that is what they decide; east and west side of Crooked Lake, with Green Acres. I Regular Council Heeting - 4-20-76 Page 3 ~UTION, Holasek, seconded, Schneider, that due to the fact that we don't have a petItIon that we have to act on tonight and also due to the ite~s Engineer Kasma has mentioned, this be postponed until such time as the aerial study is done for that area and Engineer Kasma could then report back. TIle residents could express their opinions again at that time and the Council could take action. Notion amended to authorize Engineering to proceed and prepare feasibility study. Motion withdrawn and restated. ~UTION, Holasek, seconded Schneider, to authorize Engineering to proceed with teaslbility study on both East and West side of Crooked Lake for storm sewer and streets in that area, making use of the aerial photo for the study if possible. Motion carried unanimously. Snowfencillg Around Ballpark It was agreed that the snowfence they have at City lIall will be installed by the Lion's Club. There will be no expense involved and no need for a motion. 9: 30 p.m. - Break for 10 Minutes Letter from Art Jarowski - Deseased Trees The City Council reviewed the letter received from Art Jarowski on Harch 27, 1976, The trees are not located on City property, but the community could adopt a proposal to pay a portion of the cost of their removal. Ordinance, Subdivision 2 sets up a procedure which calls for sending the owner a notice asking Ilim to remove the trees and if he does not the City could have them removed and assess the cost to him. The owners are Mayo and Menke. A hearing would be held on this matter. It was determined that the City Clerk should notify the miners at this time to have the trees removed. TIle letter received from Art Jarowski will be considered the written report from the owners. Advisory Land Use Committee - Elected Officials Mayor SChneider received a letter from James Boland regarding the Land Use Advisory Committee, Low Cost Housing Committee and Solid Waste Advisory Committee. The City Council can make a resolution on the persons it suggests to serve on these committees. MJTION, vanderLaan, no second, that Councilperson Rither be assigned to serve on lJehalt of the JitY of Andover on the ~Ietropolitan Land Use Advisory Committee. ~mION, Windschitl, seconded, Holasek, that Major ScJmeider represent the Council on tl1e Land ust Committee. Vote: Yes: Windschitl, Holasek, Schneider, No; VanderLaan, Rither ~.mI01'i, Ritherl seconded, VanderLaan, that Councilperson Windschitl be nominated to serve on the Solid Waste Advisory Committee. Councilperson tndschitl stated that he could not attend at least a portion of the meetings as he 'felt they would be daytime meetings, so would ¡lave to decline at this time. " \ Vot~: Yes; Rither, VanderLaan, No; Schneider, Holasek, Windschitl MotIon defeated. ) Regular Council ~1eeting - 4-20-76 Page 4 Engineer - Final Plans and Specifications (76-1) Engineer Kasma needs a motion to accept the final plans and spccifications and authorize advertising for bids. For bidding purposes and for contracting purposes the Northwoods Area and Green Acres Area will be one project - (a), and Úle Red Oaks Manor will be one project - (b). Bids must be submittcd by ~1ay 14, 1976 at 2:00 p.m. and they are looking into the possibility of getting FHA financing. They should know by Ilay 18, but the fiscal year has been changed from July 1 to October 1 and funding changes almost daily. ~ÐTION, Schneider, seconded, 1101asek, that the Clerk Treasurer prepare a resolution to accept the final class specifications to seek bids on Project 76-1 (storm sewer included) . Motion carried unanimously. Proposed MunicÈJal State Aid Highway Lngineer Kasma referred to his letter of April 19, 1976, regarding the proposed Municipal State Aid Highway Construction Program Commission No. 6223-16 (copy attached). Discussion followed which detennined that there is not a standard road width in Úle form of a State Law for the State of ~Iitmesota and that a standard should be established for the City of Andover. The Bill which may be signed by the Governor of the State of ~ünnesota would make 6.5 million dollars available to cities such as Andover for the construction of bridges. Engineer Kasma stated that ~filnicipal State Aid for highways can be changed from one area to another if the City would determine that a change was necessary. ~,!OTION, Rither, seconded, Windschitl, that the staff be directed to prepare a resolution calling for an information Public Hearing for all property owners along Prairie Road (f.1SAH 101) from CSAH 18 (Crosstown Boulevard NW) to County Road 16 (Bunker Lake Boulevard) for May 8, 1976 at 8: 00 p.m. to discuss information contained in the ,proposed State Aid Highway construction program. ~btion corrected to state Hay 4, 1976 at 8:00 p.m. ~btion carried ¡unanimously. I Oaks Plat - Street Acceptance Engineer Kasma [reported that the blacktopping done last fall does not meet standards; thickness varies and the road has what they call"birdbaths". Trailer Rental James Thurston feels a trailer hitch should be put on a City truck so a trailer could be rented for hauling brush and also for hauling the large mower which is used in the parks, etc. The City Council determined that the Acting Administrator and the Building Officials have the authority to make this type of a decision. Eldorado Street Acceptance MOTION, Holasek, seconded Windschitl, that the Clerk Treasurer contact the people on that street and find out what their feelings are on having their street dedicated to the Citro Discussion followed on whether or not the street should be brought up to some standard before it is accepted. Councilperson Holasek" amended the motion to include criteria for the road; grading, ditching, and drainage, if necessary, before it can be dedicated. Hotion seconded by Windshitl and at this time he inquired if 166 should not be included in the motion. I ~ÐTION, Winds chit 1 , seconded Holasek, to amend above motion to include the people on 166. Hotion carried unanimously. Red Oaks Park Water Problem , Jerry Lapham, Park, Board, reviewed the water problem created after the pond was dredged and excess dirt was left around the edge of the pond because of freeze up. He has contacted the contractor and the contractor has agreed to do some ditching to try to correct the problem. Possible liability if the pond is not fenced was discussed with J\ttorney Hawkins. He will report at the next meeting on similar situations in ather cities. City funds can be used to help out with this water prob1~ and thl City Engineer will run a check of the area to determine possible solutIons. Recording Secretary Taking Tapes of City Council Heetings Home MJTION, Rither,1 seconded VanderLaan, that we give the recording secretary permission to take the tapes of the City Council meetings home for the purpose of transcription. Vote: Yes; sc~eider, Rither, VanderLaan, No; HOlasek, Windschitl Approval of Heeling Minutes MOTION, Rither,¡ seconded, Windschitl, to continue approval of meeting minutes to the May 4, 1976 meeting. ANOKA, MINNESOTA 55303 (512) 755-5100 April 20, 1976 Dear Resident: The City of Andover has scheduled an informational public hearing on the proposed construction on Prairie Road from Crosstown Boulevard NW (CSAH 18) to Bunker Lake Boulevard (County Road 16) as a part of the Municipal State Aid Highway System. The hearing will be held on May 4, 1976 at 8:00 PM at the Ando\'er Community Center at 1685 Crosstown Boulevard NW. The Council is currently preparing an immediate and long range plan for the City street system. The Council plans to adopt a Municipal State Aid Highway System that will be the basis for construction for the next five years. A t a recent p[¡blic information hearing, it was decided not to constrllct any MSAH , streets in the Green Acres, Northwoods and Red Oaks Manor Area. I 1976 PROGRAM We had rebommended possibly postponing any MSAH constrllction llntil 1977 based on con~trllcting some of the streets in the 1976-1 Sanitary Sewer Project Area. Since ~he COllncil has gone on record not to constrllct in this area, we recommend t e COllncil proceed with a 1976 State Aid Program on Prairie Road. The bitllminolls sllrfacing can be done in 1977 with Cllrrent State Aid funds. I Honorable Mayor and City Council Members April 19, 1976 Page Two To avoid any penalty for not proceeding in accordance with the Minnesota Highway Department time schedule, we must award construction contracts by September 1, 1976. PRAIRIE ROAD AND SOUTH COON CREEK BRIDGE The State Legislature passed a bill for bridge replacement in the State amounting to $50 million for fiscal year 1977(July 1, 1976 - July 1, 1977). The Governor has until April 21, 1976 to sign the bill. If the bill passes the following is a split of the funding: a) State 2.5 Million b) Counties 13. 5 Million c) Cities 6.5 Million d) Townships 5.0 Million The program provides for entire replacement cost. The City has two bridges eligible for replacement at this time. Both bridges are included in the MSAH system, and can be funded under that program. However, with th" current legislation the City could get the bridge construction cost from the Bridge Replacement Program and the engineering costs from the MSAH fund. The bridges are listed as follows in the State replacement program: Ranking in State of 15,000 1) Prairie Road Bridge No. 190 3015 2) I . 3738 Coon Creek Drive No. 5103 I On this rating system, ranking No.1 is worst and No. 15,000 is least bad. The cur- I rent plan of the Minnesota Highway Department is to fund on a first corne-first serve basis. 1 RECOMMEND nON We recomm1end the Council take the following action: 1) Pass a r,esolution callipg for an information Public Hearing for all property owners along Prairie Road (MSAH 101) from CSAH 18 (Crosstown Boulevard NW) to County Road 16 (Bunker Lake Boulevard) for May 4, 1976 at 8:00 PM to discts information contained in this report. Councilperson Windschitl "The motion is such that you have an attorney saying it is against the law to do ituall I am saying is that I would like the P &Z to re search it to see if it is something that could be allowed in an agricultural district. " Councilperson Holasek "I don't understand either, Jerry, do you mean under our present ordinances or are you suggesting that they review the ordinance and come up with a suggestion for an amendment to them?" Councilperson Windschitl "Yes, to propose an amendment if it is possible. ',' Councilperson Holasek "So if it is possible to amend it, then I will second the motion. " PKL
