SPECIAL MEETING & CONTINUED PUBLIC HEARINGS
JUNE 18, 1975
A Special Meeting of the Andover City Council was called to order by Mayor,
Richard J. Schn~ider, on June 18, 1975, 7:15 P.M., Andover Community Center,
1685 crosstow~Boulevard N. W., Anoka, Minnesota; for the purpose of dbscussing
the .' ,L£';ter of onditions" (Exhibit X) with a:' Farmers Home Administration
representative.
Mr. Ralph Maki of the F.H.A. presented the "Letter of Conditions" to the City
Council and adv1sed them that all conditions must be agreed upon by the City
before they will proceed any further with the loan application.
Mr. Maki noted Ithat although the F. H. A. will not be making daily inspections
as such, the reports covering same must be on file in the City Offices; and the
engineer will supply a full summary of expenses to-date, as the project moves along.

by Mayor, Rich~rd J. Schneider, at the Andover Community Center, 1685 Crosstown
Boulevard N. W., Anoka, Minnesota.
Councilpersons present: Holasek, Rither, VanderLaan, Windschitl
Councilpersons absent : None
Also present: City Engineer, D.'R. Kasma; City Attorney, William Hawkins;
City Clerk, Pat Lindquist; Reporter, Shirley Hatfield; and
approximately 60 residents.
Engineer Kasm covered briefly facts and information brought forth at the Public
Hearing on Jun 12; and read, and explained, a letter dated June 18 from T. K. D. A.
to the City Co eil, outlining cost estimates on the project for the area north of
143rd Avenue Auditor's Subdivision No. 82 (Exhibit A_2 attached). He noted that
the costs would be the same whether the storm sewer drained into Round Lake or
into the area w st of the Subdivision.
The Hearing wa then turned over to the residents for statements and questions.

ASke~ if the people at the end of the system nearest Round Lake would
have problem with the drainage should there be an extremely heavy rain;
and hi w the system would keep from filling with sand if the roads were
not u graded.

(Dewey Kasma - No, there would not be a problem with drainage for those at

the end of the system; and yes, there will be sand going into the catch basin,
however, the City maintenance crew must keep the system clean and in good
working cÓndition. )

Stated that it was easy to see that the system was never going to be
cheap~r, therefore, he was in favor of doing the whole project now.

Asked if the people would get assessed again if only part of the system
went in now, and the rest later; and stated that if the system is going to

have to go in later, would just as soon have it now.

Jim Olsonl_ 14289 Underclift Street N. W.
Asked why the people south of 143rd should pay for the trunk running
northlof 145rd; and stated that to justify a charge, the line on
undeiclift should be left in. Suggested running the storm water to
Roun Lake Blvd.
(Dewey Ktma - When doing just a small project like this, there is a
problem, I hereas, if the project is done only once, everyone pays equally. )
Bob Rudtke - 14417 Woodbine Street N. W.
Aske why he would be assessed if he did not receive any benefit.
( Dewey Ka ma- You would not be assessed if your water was not causing a
problem t you or someone else.)
John Berr, _ 3755 - 143rd Avenue
Inqui ed as to whereih> extra dirt would be going.
(Dewey K sma - It will be stated in the contract that it is to be left in the
area spec fied by the engineer. It would be divided equally within that area;
we are pr bably only talking about 100 yardR if the street improvement is not
ordered. )
Aske if the catch basin would be put in on the corner of 143rd and Xenia-
state that if the ditch remains, the culvert will take take of the water.

We would ave to look at your lot again as far as as sessment to you if the
project is approved. )
Rosella S nsteby - 4100 - 7th Avenue N. W.
State that it is the manner in which the roads are graded that is causing
the p oblem- except for the two houses on Woodbine, and that was caused
by th City. Noted that people signed petitions indicating that the vast
majo ity opposed both the storm sewer and street construction; and that
the C ty Council should respect the wishes of their constituents. Stated

that when parts of the project are left out, as in the case with the alternate
propdsal, the people left get assessed more. Expres sed concern that a
largel hole would be made where the storm Sewer drainage goes into

Round Lake.

(Dewey Kasma - Yes, there could be an additional assessment---lny estimate
is stating that this is the most it could cost. There should be no hole or pond
at the end bf the system from the drainage; and it will be maintained by the
City.
Askedl if she could get her piping back if the storm sewer were approved.
(Dewey Kasma - If you paid for it, you will get it back, however, you will
have to dig it up yourself. )
Steven I - 14348 Woodbine Street N. W.
Stated: that the water does not come off l44th, but that it does stand on
the co1rner and in the back of one lot.
JoAnne RJdtke - 14417 Woodbine Street N. W.
Asked why all the people had to pay for those that were having drainage

(Mayor Schneider - Possibly their water could be coming from your high lot. )
(Dewey Ka1sma - If one lot doesn't get it, the other one will-the water has to
go 'somewhere. )

LeRoy Nordstrom - 3737 - l43rd Avenue N. W.
Askedl that if the rest of the area needed storm sewer, would he be held
respohsible; and stated that the people having probljems should solve them

themselves.
(Dewey Kalsma - The smaller the project area, the more expensive it is; and
each lot wtuld be checked before the asses sment. )
Larry Sab - 14417 Vintage Street N. W.
Stated that he had no problems, however, was in favor of putting in the
entire storm sewer system now before the costs went any higher.
Councilpe son Holasek to Engineer Kasma _ If the area south of l43rd was
not includ d in the present project and was done later, what would the costs
be? Mr. asma - approximately lO¢ per square foot.
Councilpe son Windschitl to Engineer Kasma - If the storm sewer on Xenia St.
and the st eet improvement projects were not done n ow, would the ditch on
Xenia Street remain as is? Mr. Kasma - Yes, I would not have enough dirt

contr ctors guarantee their bid price even if the price of oil goes way up.

Stated that the catch basin on the corner of l43rd and Underclift which
was scratthed at the June 12 Meeting, should remain "out" as it was
not needed.
Ron Johnson -114416 Vintage Street N. W.
Asked if there would be a problem of sewage from those having septic system
failures r{¡nning into Round Lake.
(Dewey Kasmal - No, this is a sealed system. )

MOTION by VanderLaan, seconded by Holasek, that the City Council authorize the
City Engineer to prepare Final Plans and Specifications for the installation of Storm
Sewer, Project No. 75-2, in Auditor's Subdivision No. 82, with project to be
,
constructed as outlined in the letter from T. K. D. A. to the City Council, dated
June 12, 1975.
Councilperson Holasek gave the following reasons for seconding the motion:
1. Had seen the costs increase from $330.00 average per lot when the problems
first start~d in 1973, to $550.00 average per lot now.
2. It would b very discriminating for the people south of l43rd to be left out,
and end up paying 'considerably more when the project is done in 2 or 3 years.
Councilperson Ri her presented the following comments on the project:
"Based on doc mented evidence, the proposed storm sewer project is necessary.
The engineers presented us with alternate proposals, a) a project directing the
drainage in a esterly direction - this was not feasible, and b) based on a
scaled down ayea, while feasible, does not seem to address the entire drainage
area and prob em, and will eventually result in higher future costs for the area
proposed to b excluded. Similarly, to exclude that portion at this time would
result in a hig er as ses sment for the area receiving the improvement. While
it is recog,t\Ïz ble that the date for future sanitary sewer extension to this area
is unknown, I eel that it is reasonable to as sume that projections by the engineer
of five years r more, based on the capacity in the present trunk main and
development 0 curred to date and what we anticipate to occur, could be longer.
The original p oposal would include both storm sewer and blacktopped streets,
addresses the problem as an area wide problem; is a long term solution rather
than a "bandai type operation". It would appear that the original proposal as
presented on une 12 is the most feasible and economical solution to the problem
which exists. A storm sewer system without bituminous surfacing would result
in siltation an higher maintenance costs. If street surfacing were not included
now, we waul have to rely on cooperation from the residents to prevent the
entry of sand nto the system, and with the rapidly escalating costs of bituminous
material. "
MOTION AMEN ED by Rither, seconded by Vander Laan, to include the entire
project as presented on June 12, including bituminous streets in Auditor's Subdivision
No. 82.

Councilperson Windschitl noted that petitions presented by the residents, indicated
that only 12 in fav6r with 51 opposed to the bituminous street construction; and that
he could not justify putting the streets in now knowing the results of the petitions
and the fact that sanitary sewer was not in yet, which when it does come, would
result in the stre~ts being torr. up.
Mayor Schneider loted that he would not be in favor of bituminous if he lived in the
area inasmuch as ¡the tearing up of the streets for sanitary sewer constru~n could

Councilperson Hotasek stated that he did not see where there would be an extensive
maintenance probiem with the siltation; and cited the storm sewer on Crocus Street
having not requirJd any additional maintenance.
Vote (amendment)l: Yes,-Rithel',"VanderLaan; No - Schneider, Windschitl, Holasek.
Amendment defeated.
MOTION AMENDED by Windschitl, secnnded by Holasek, to delete the catch basin
On the corner lot, the m.anhole on Underclift, and the section of pipe and catch basin
on Underclift. M . Kasma noted that this would only affect one lot, and the owner
of that lot, Mr. ehle, has requested that it be removed. Vote: Yes _ Holasek,
Schneider, Vande Laan, Windschitl; No - Rither. Amendment carried.
Vote (motion): Y s - Holasek, Schneider, VanderLaan, Windschitl; No - Rither.
Motion carried.

Inquired as to ho would be responsible if the system did not work.
(Dewey Kasma - t would be the City, with no cost to the homeowners.)
Steven R keli - 3 20 143rd Avenue N. W.
Stated that he as very disappointed with the decision and the Council, inasmuch
as the Council ersons apparently had little regard for the wishes of their constituents.
(Councilperson H lasek - Our decision was based on concern, not disregard, with this
concern being for the health of the people. )
Mike Yehle - 364 143rd Avenue N. W.
Stated that he elt that the engineer tried to sell the project to collect a higher fee.

MOTION by Vand rLaan, seconded by Rither, that the Public Hearing for
Storm Sewer and treet Improvement in Auditor's Subdivision No. 82 be terminated.
Motion carried animously.

Gentlemen:
We are writing t report, as authorized by the City Council on June 12, 1975, to
provide an alte r ate storm sewer feasibility report to eliminate the current storm
drainage proble in Auditors Subdivision No. 82. The proposed area to be served
is shown in Figu e No. 1 (Revised).
PROJECT DESC IPTION
The proposed pr ject èonsists'of a storm sewer systern:'includirig 12to 1'8, inch pipe,
catch basins, an yard restoration.
PROJECT COST
The preliminary cost estimate for the storm sewer construction, including 10% con-
tingencies and 1 0/, engineering, legal and administrative cost is $32,700.00.
A detailed cost is attached to this report.
PROJECT FINA CING
We recommend ssessing the entire amount to be benefited property owners.

A Continued Pubhc Hearing for Street Construction Improvement in Russell Addition,
wasccalled to ord~r by Mayor, Richard J. Schneider, on June 18, 1975, 9:20 P.M.,
at the Andover Co'mmunity Center, 1685 Crosstown Boulevard N. W., Anoka, Minnesota.

Also 'present: City Engineer, D. R. Kasma; City Attorney, William Hawkins;
City Clerk, Pat Lindquist; Reporter, Shirley Hatfield; and
approximately 50 residents.
Mayor Schneider read and explained the letter sent to the residents on June 13, with
reference to a statement made at the June 12 Hearing by Walter Arntzep., Building Official,
covering postal dklivery in the Russell Addition (Exhibit X, attached). Mr. Arntzen's
,
response to the City Council in a letter dated June 16, was read to the audience by
Mayor Schneider '(Exhibit X-I, attached).
Three petitions f om the area were presented as follows: Kathy Ness (Exhibit A),
James & Bea La ock (Exhibit B), and Clyde Russell, containing 46 signatures
(Exhibit C).
The meeting was turned over to Engineer Kasma. Mr. Kasma read and completely
explained a lette to the City Council, dated June 18, 1975, (Exhibit X-2)¡ and noted
that he had discu sed the roads with Burton Kraabel, City Street Maintenance Contractor,
and it was agree that 4" of Class No..5 gravel should "do the job", and that some
driveway culvert were needed. Mr. Kraabel had advised that there were no areas
requiring an exc ssive amount of gravel to stabilize.

State that a stretch on Manniteau Street was very bad, and that he felt
that his portion should be included in the area to be fixed with the $3,000
contr 'bution from Mr. Russell. Noted that he has had to leave his car on
165t Avenue whenever it rains because of the impassable condition of
Man "teau Street.
MOTION by Van erLaan, seconded by Schneider, that Councilperson Rither's motion
made on June 12, be removed from the table for discussion. Discus sion ensued on this
unanimously.

Noted that the City Council appeared to be against using just the $3,000
to fi><! the bad spots. Asked Glen Rogers if he would assist in selecting
the ireas to be repaired, to which Mr. Rogers stated that he would not.

by Mrl. Russell; and if it were not the Council's decision to just use the $3,000

driveJray culverts were needed on Zuni Street N. W. Asked if before the
incorporation, was it an established policy to take money from 1±e General
Fund to put blacktopping in needed areas.

however, r. Kraabel told me that there were no sinkholes and very little
gravel wo ld be lost if it were put on this year and blacktop in two to three years.
The remo al of 165th Avenue from the project would certainly be taking the
bulk of th assessment from Mr. Russell.)

Aske if the Council was aware of the fact that some of the people wanted
black op rather than gravel if it had to be one or the other.
Councilperson Wi dschitl to Mr. Russell - Do you feel that the 2400 feet which could
be covered by the $3,000 would solve the problem? Mr. Russell - I thought so, and
Ramsey thought ~o, but according to Mr. Kasma, there are different standards now.

permitting citize input, be closed. Motion carried unanimously.

Rither, seconded by Councilperson VanderLaan on June 12, be removed from the table
for discussion. ~ot ion carried unanimously.
The City Council covered all the facts of the citizen input, cost figures, necessity for
a full improvement project, the fixing of only the bad areas, the possible repercus sions
from the residents if only specific areas were fixed and future problems arose, utilizing
City of Ramsey equipment, the need for correction, and forced development in the
rural area.

Ramsey apply thi in the area of most need, to be deBÏgnated by the City Engineer,
City Road Supervisor, and the City Road Maintenance Contractor; and continue this
Public Hearing tolNovember 4, 1975, to see if this solves the problem, and if not,

Postmaster for Anoka. Mr. Ralph Kotke, who identified himself
.0 me as I "Rock" is the Superintendent of Mails, and I had just assumed
him to be the Postmaster.
Mr. KotJe had called me in regard to the roads in the Russell Addition,
)Jor¿een IAddition and 159th Avenue ofl County Road 7. He stated that
thc're we~e numerous problems that he would'like corrected. I assured
¡Üm that 159th and Nordeen Addition would be corrected immediately,
however, I requested that he wait {'Or the results of the Public Hearir.g
insofar s the Russell Addition roads. Prior to my speaking with
Mr. Kot e, he telephone City Hall and spoke to the City Clerk, sta..ting
